Miceli Suspended 30 Days

Trainer Mike Miceli has been suspended 30 days and fined $2,500 by the New York Gaming Commission for failing to follow Commission rules pertaining to the horse Cover Photo after a win in a $10,000 claiming race Mar. 13 at Aqueduct. The horse raced within 14 days of receiving a joint injection, which violates Commission rules. Cover Photo was not disqualified from her victory. Miceli will begin his suspension May 8 and, according to the DRF, bloodstock agent Joe Brocklebank will take over in his absence, granted he passes his trainer's test.

NYRA Hearing Officer Recommends Two-Year Suspension for Baffert

Judge O. Peter Sherwood, the retired New York Supreme Court justice who served as the hearing officer in NYRA's dispute with Bob Baffert, issued his report Wednesday, recommending that Baffert receive a two-year suspension.

The report has been sent to a three-person panel that has been convened to consider whether or not Baffert should be penalized by NYRA. Each side will have seven days to respond to the report. After the seven days, the panel will have 10 days to make a final decision.

The panel consists of attorney John Carusone Jr., New York Thoroughbred Horsemen's Association Executive Director Will Alempijevic and Humberto Chavez, who heads the New York Racetrack Chaplaincy of America program.

On May 17, NYRA suspended Baffert, but had to drop the ban when a federal judge ruled that NYRA could not take such steps without first holding a hearing for Baffert or for anyone else the racing organization sought to suspend. Because of its affiliation with the state of New York, NYRA, unlike privately owned tracks like Churchill Downs, does not necessarily have the right to ban someone without due process. Churchill's two-year ban of Baffert is currently in place.

The hearing commenced in January with NYRA attorney Henry Greenberg stating that Baffert had taken a “wrecking ball” to the sport's integrity because of his record of repeated drug violations. NYRA charged that during a 14-month span, Baffert-trained horses tested positive for prohibited medications seven times. The most high-profile offense occurred in the 2021 GI Kentucky Derby in which Medina Spirit (Protonico) tested positive for betamethasone.

In asking the hearing officer to recommend a suspension for Baffert, NYRA said that his conduct was detrimental to the best interests of racing, the health and safety of the horses and NYRA business operations.

NYRA released Sherwood's 54-page report Tuesday.

Sir Mark Todd To Resume Training After Four-Month Suspension

Sir Mark Todd, who had been placed in an interim suspension by the British Horseracing Authority (BHA) on Feb. 16, received a four-month suspension, with two months deferred, following a BHA independent disciplinary panel hearing on Thursday.

Todd had been charged with conduct prejudicial to the reputation of racing in February, after a video emerged on social media of him striking a horse with a branch in August of 2020. The 65-year-old had been knighted in 2013 for his services to equestrian sport.

Although Todd issued an apology, his licence was suspended in February pending an initial hearing on Mar. 24, which was adjourned due to legal issues. His Honour Brian Barker, acting as panel chairman, heard the case privately on Apr. 14. Barker announced Todd's suspension, but as he has already served two months, he will be able to make entries immediately.

Barker said, “The appropriate sentence is one of four months suspension, with two months of that deferred for two months.

“That means that the eight weeks that he has already served is sufficient and that Sir Mark is able to operate under his licence immediately and that further, providing that there are no transgressions in the next two months until the June 14, then that deferment will disappear.”

Baffert Banned in NY Through ‘At Least’ Early July

Citing Section 910 of the New York Racing, Pari-Mutuel Wagering and Breeding Law, the New York State Gaming Commission (NYSGC) has announced that it will honor the 90-day suspension handed down to trainer Bob Baffert and that the conditioner is “prohibited from participating in any New York State horse racing activity through at least July 2, 2022.”

Section 910 reads: “§ 910. Reciprocity of licenses. All license denials, suspensions and revocations imposed by the pertinent racing and gambling authorities of other jurisdictions, including states, United States territories, and Canadian provinces shall be recognized and enforced by the commission …”

According to a release from the NYSGC, Baffert is suspended in New York and may not enter any horses to run at any New York track, including Aqueduct, Belmont Park and Saratoga–run by the New York Racing Association–as well as Finger Lakes Race Track.

New York is one of 38 racing states that honors out-of-state suspensions issued by regulators.
