Multiple Graded Stakes Winner Tax Retired

Multiple graded stakes winner Tax (Arch) has been retired from racing. The 7-year-old gelding, who was claimed by trainer and co-owner Danny Gargan for $50,000 out of his debut race in 2018, won the 2019 GII Jim Dandy S. and GIII Withers S., as well as the 2020 GIII Harlan's Holiday S. He earned a trip to the 2019 GI Kentucky Derby with a runner-up effort in the GII Wood Memorial. Fourteenth in the Derby, he returned to finish fourth in the GI Belmont S.

On the board in 11 of 19 races, he won five times and earned $1,102,190.

“We've decided to retire him because it was the right thing to do by the horse,” said Gargan. “He's done enough. We just wanted him to win over the million-dollar mark, and he got well over that.”

In his final career start, Tax was runner-up in the GIII Challenger S. at Tampa Bay Downs in March.

Gargan said Tax has been sent to the farm of Dean Reeves, who co-owned Tax through 2021, and he will be retrained with an eye to a pony career.

“He went to Dean Reeves's farm and we're probably going to break him to be the farm pony next year,” said Gargan. “Maybe he'll come here to Saratoga next year and be our barn pony here.”

Tax retires as the all-time top earner for Gargan.

“He's my favorite horse of all-time,” said Gargan. “He's so pretty and so kind for such a big horse.”

Justify Colt Becomes Latest Rising Star at the Spa

Rosedown Racing Stables LLC's Champions Dream (Justify–Dancinginherdreams, by Tapit) entered this unveiling with sparking clocker reports and lots of buzz, and made his $425,000 OBS March price tag and 6-5 odds on the tote look like value as he earned 'TDN Rising Star' status Saturday at The Spa.

Just a $25,000 Keeneland September yearling purchase by G.W. and Karen Parrish's Parrish Farms–reportedly due to concerns about his feet–the grey blossomed into a $425,000 OBS March juvenile off a sharp :20 4/5 breeze.

Turned over to Danny Gargan, the son of 2015 GII Pocahontas S. romper and fellow 'Rising Star' Dacinginherdreams was looking to become just his trainer's second juvenile debut winner at Saratoga over at least the past five years–the other among 25 to try was subsequent three-time stakes winner Dakota Gold (Freud) almost exactly a year ago.

The 13-10 chalk took a narrow early advantage and set a pressured first quarter of :22.94 before sneaking away through a :45.81 half. Cagliostro (Upstart)–himself a $385,000 OBS grad–took a run at the leader into the stretch, but Champions Dream swatted that one away and kept on to maintain a 2 1/4-length edge on the line. Well-bred longshot Prairie Dunes (Curlin) closed well to spice up the exacta.

Champions Dream becomes the 12th winner for his fast-starting freshman sire (by Scat Daddy), and third to follow that Triple Crown winner in being named a 'Rising Star'. Justify has sired three graded stakes winners thus far, and has two daughters in Sunday's GI Spinaway S.

Champions Dream is the fourth foal and first winner out of his dam, who is half to stakes-winning juvenile Doubled (Exchange Rate) and the dam of GSW/GISP Texas Wedge (Colonel John) and a full to GSP Good Pick Nick. Dancinginherdreams has a yearling colt by Flameaway (Scat Daddy), a foal filly by the same John Oxley colorbearer and she revisited the Darby Dan resident once more for 2023.

Trainer Danny Gargan Sanctioned For Labor Law Violations

A federal court has ordered a prominent Long Island, New York, Thoroughbred racing stable and its owner to pay a total of $132,631 in back wages and liquidated damages to 52 grooms and hot walkers at several locations, including Belmont and Aqueduct racetracks. The stable owner failed to pay workers the overtime wages they earned.

The action by the U.S. District Court for the Eastern District of New York follows an investigation by the U.S. Department of Labor Wage and Hour Division. Investigators found that Danny Gargan and Gargan Stables Corp. paid certain employees at the racetracks, stables and other locations a fee per horse handled and not per hour as stated in their payroll records.

In addition to shortchanging workers' hours and unlawfully denying them overtime when they worked more than 40 hours in a workweek, the division determined the employer falsified payroll records to give the appearance that employees were paid by the hour when they were not. The court affirmed the department's assessment of $37,368 in civil money penalties for willful wage theft and for falsifying records in violation of the Fair Labor Standards Act.

Following the division's investigation and litigation by the department's Office of the Solicitor, the court entered a consent judgment ordering the defendants to pay $66,315 in back wages and an equal amount in liquidated damages to the affected workers.

The judgment also requires the defendants to:

–      Hire, at their own expense, a qualified compliance monitor to review their payroll and record keeping practices to ensure FLSA compliance, recommend changes to any non-compliant practices and consult with the defendants on any changes to their time or recordkeeping practices.

–      Implement and use an electronic timekeeping system to ensure accurate recording of employees' work hours.

–      Train employees, in languages they understand, on the proper use of the timekeeping system and pay them for that training time.

–      Post and provide employees with information and documents in English and Spanish about the FLSA's requirements and their FLSA rights.

The order also permanently enjoins the defendants from inaccurately editing or altering employees' work hours, having employees work “off the books,” retaliating or discriminating against employees who engage in FLSA protected activity and requiring or asking employees to kick back wages.

“The defendants took advantage of their employees by underpaying them and then tried to hide this illegal behavior by falsifying their payroll records,” said Wage and Hour Division District Director David An in Westbury, N.Y. “Gargan Stables Corp. and Danny Gargan have learned that disregard for federal labor laws and their employees' rights have costly consequences. We suggest other employers review their own pay practices to prevent violations. The Wage and Hour Division has many tools to assist employers and workers in understanding the law.”

“To put it plainly, underpaying employees is wage theft. The U.S. Department of Labor has, and will continue to pursue all necessary legal avenues to obtain proper compensation for employees and deter future violations by employers. This settlement – the latest of several with racing industry employers – compensates these underpaid workers and includes enhanced training and timekeeping requirements to change this employer's behavior and prevent future violations,” said Regional Solicitor of Labor Jeffrey Rogoff in New York.

The division's Long Island District Office conducted the original investigation. Senior Trial Attorney David J. Rutenberg of the regional Office of the Solicitor in New York litigated the case for the department.

Dakota Gold Dazzles In Nownownow At Monmouth

Trainer Danny Gargan probably won't need to do any more convincing with owner Dean Reeves about sending Dakota Gold to the Breeders' Cup Juvenile Turf Nov. 5 at Del Mar Thoroughbred Club in Del Mar, Calif.

The horse stated his case emphatically on Sunday at Monmouth Park in Oceanport, N.J.

Dakota Gold, a New York-bred son of Freud, turned in an eye-catching performance on closing day at Monmouth Park, capturing the $500,000 Nownownow Stakes for 2-year-olds by 2½ lengths.

Ridden by Isaac Castillo, Dakota Gold stormed from off the pace in the one-mile grass feature, flashing under the wire in 1:36.31 over a turf course labeled “good” to improve to 2-for-2 lifetime.

After winning his debut at 5½ furlongs in an off-the-turf Maiden Special Weight race at Saratoga Race Course in Saratoga Springs, N.Y., by 4½ lengths on Sept. 2, Dakota Gold showed why Gargan was so eager to get him on the grass.

“I just couldn't wait to get him on the grass,” said Gargan. “We knew he had this kind of turn of foot on the grass. There was some pace in the race and he just flew by. When the jockey asked him he just galloped by. It was pretty impressive. You get lucky and get a horse like this once in a while. I think this horse has as much talent as any younger horse I've ever had.”

Dakota Gold, owned by Reeves Thoroughbred Racing, will likely get a chance to show off that talent next in the Breeders' Cup Juvenile Turf on Nov. 5 at Del Mar, said Gargan.

“There was a New York-bred race today at Belmont at seventh-eighths on the dirt,” said Gargan. “Dean and I discussed it and I really wanted to run here. I'm just glad I got the opportunity to do it and Dean gave me a chance.

“I told him if we win this we can go to the Breeders' Cup, so I think Dean is going to let me going to the Breeders' Cup.”

For the 23-year-old Castillo, this was the signature victory of his young career.

“This is the biggest win of my career, the biggest purse I have ever won,” he said. “It's incredible. It feels great. This is a fantastic horse, a championship-type horse.”

Sent off at 5-1 in the field of nine, Dakota Gold was back in the pack as There Are No Words and Grooms All Bizness set early fractions of :21.41 and :45.56 to the half, at which point Dakota Gold was sixth. Castillo swung Dakota Gold wide coming out of the turn and he simply breezed past the field, with Royal Spirit rallying for second. It was another six lengths back to 4-5 favorite Coinage in third.

In the $100,000 Smoke Glacken Stakes that served as the supporting feature, New Jersey-bred Speaking dazzled a field of open company 2-year-olds with a 3¼-length victory.

Trained by Eddie Owens, Jr. and ridden by Gerardo Corrales, Speaking turned in a sharp winning time of 1:10.12 for the six furlongs. Forty Stripes was second, 2¼ lengths ahead of Practical Coach in third.

“He doesn't know he's a Jersey-bred – and we're not going to tell him, either,” said Owens. “He showed us a lot of potential in the mornings so we have had high expectations for him. His first race he did everything professionally (winning by 6¼ lengths) so we knew he was going to be a very nice horse.

“Today, he was eye-popping. Very nice. I don't know what we have in store for him yet. We made no long-term plans. We'd like to get him to try two turns. But we're taking it race by race right now. We'll see what we find for him next. Wherever we go next I love the way he ran today. He showed us a lot. He did it with ease.”

Speaking, a Holly Crest Farm homebred, returned $3.60 to win as the favorite in the field of eight. The recently-gelded son of Mr Speaker is now 2-for-2 lifetime.
