Formidable Pair Could Put Baffert Back in La Brea Winner’s Circle

Trainer Bob Baffert boasts a record seven victories in Santa Anita's GI La Brea S., and a winless drought since 2012 could come to an end for the Hall of Famer Sunday. Baoma Corp's $750,0000 Fasig-Tipton Saratoga buy Private Mission (Into Mischief) cuts back after setting a supersonic pace in the GI Longines Breeders' Cup Distaff Nov. 6. Prior to that she was an easy winner of Del Mar's GIII Torrey Pines S. Aug. 21 and the local GII Zenyatta S. Oct. 3. Both those victories came around two turns, but the bay is a two-time winner at distances shorter than this seven-furlong trip. Kalypso (Brody's Cause) gives Baffert a strong one-two punch. Victorious in the GII Santa Ynez S. over track and trip just over a year ago, she was bested at short odds in two consecutive route tries before bleeding and being eased in the GII Eight Belles S. at Churchill Downs on GI Kentucky Oaks day Apr. 30.

Missy P. (Into Mischief), a full to Grade I winner at this distance Mia Mischief, aired by 9 1/4 lengths on debut here in March–making her a shoe-in for 'TDN Rising Star'-dom–but she could only manage second at odds-on in the Angel Flight S. over track and trip May 1 and has been off since finishing fifth in the turfy Desert Code S. against the boys June 6.

Speedster Livingmybestlife (The Big Beast) annexed Los Al's Lucky Spell S. over six furlongs Sept. 24 and the restricted Seashell S. going a two-turn mile at Del Mar Nov. 3. A win by that Hronis Racing colorbearer would be trainer John Sadler's first in the La Brea since he won three out of four renewals from 2007 to 2010.

Two Weeks From Crucial Hearing, NYRA Adds to Arguments Against Baffert

The New York Racing Association (NYRA) Wednesday added to an already daunting compilation of court documentation filed by both parties in an attempt to bolster its arguments in advance of a Jan. 6 “motion to dismiss” hearing in Bob Baffert's civil rights lawsuit against NYRA.

The purpose of the Dec. 22 reply memorandum was to give NYRA “the opportunity to briefly address new arguments raised by Plaintiff in his opposition brief” and to confirm NYRA's position in relation to Baffert's civil action claim.

“First, Plaintiff fails to articulate an actionable 'substantive due process' claim,” the filing in United States District Court (Eastern District of New York) stated. “Instead, Plaintiff's Response simply repeats his procedural due process allegations and fails to point to any facts showing that NYRA's actions in connection with the Administrative Proceeding are 'arbitrary, conscience-shocking, or oppressive in a constitutional sense…'

“Second, Plaintiff's argument that he is not required to exhaust administrative remedies is foreclosed by controlling precedent. The Second Circuit has held that, although most [Section] 1983 [civil rights] plaintiffs are not subject to an exhaustion requirement, that rule 'does not apply to procedural due process challenges if the plaintiff failed to avail himself of the very administrative procedures he attacks as inadequate'…

“Third, like other disciplinary proceedings brought against licensees, the Administrative Proceeding is clearly a civil enforcement proceeding requiring Younger abstention [a doctrine that mandates federal courts must not hear cases involving federal issues already being litigated at the state level]… Moreover, contrary to Plaintiff's argument, the Court has already recognized that the state interests implicated here are 'weighty' and 'important.'”

“Finally, Plaintiff's argument that his claim implicates 'pure questions of law' misses the mark. Plaintiff has raised these same legal issues in the Administrative Proceeding, and upon its completion, Plaintiff may seek judicial review in New York State court… Plaintiff's claim stretches beyond pure legal questions–Plaintiff has made the factual allegation that the Administrative Proceeding is a 'fait accompli.'”

NYRA had barred Baffert back on May 17, which was 16 days after the now-deceased Medina Spirit won the GI Kentucky Derby while testing positive for an overage of betamethasone. In the 12 months prior to that positive, four other Baffert trainees had also tested positive for medication overages, two of them in Grade I stakes.

Baffert responded to NYRA's ruling-off by filing a June 14 civil complaint alleging that the ban violated his constitutional right to due process. On July 14, the eve of the Saratoga season, the court granted Baffert a preliminary injunction that allowed him to race at New York's premier tracks until the lawsuit was adjudicated in full.

Beholder’s First Foal, Q B One, to Debut Sunday

The long wait is just about over. Q B One (Uncle Mo), the first foal out of four-time Eclipse Award winner Beholder (Henny Hughes), will make his debut in Sunday's fourth race at Santa Anita, six days shy of turning four years old.

Like Beholder, he was bred by and is owned by Spendthrift Farm and is trained by Richard Mandella. Kyle Frey has been named to ride.

For now, Mandella's expectations for Q B One are rather modest.

“I wish we'd see a little more from him to get excited about,” he said. “But his works have been pretty good. I don't think we've seen anything great yet. It's time to throw him in the deep water and see what happens. He shows he might be good enough, but I'm not sure.”
Mandella is hopeful that Q B One will benefit from his debut and improve.

“I leave him a little room to improve because when it comes to his mind he's not yet 100% serious about the game yet,” he said. “I think a race will probably do him a lot of good. I think his mind is such that a race might make a man out of him, and then we can see the real deal. That's what I am hoping.”

Q B One had a five-furlong work in January and Mandella said at the time that he was just a few weeks way from making his first start.

“He had some bone bruising and needed a little time off, ” he explained. “So we had to start over.”
Mandella also trains Beholder's second foal, the 2-year-old filly Karin With an I (Curlin). She has yet to have a published workout.

“She's been fighting a virus,” he said. “She's just starting to breeze. She's a nice-looking filly. She's not too far along yet, but she does everything pretty nice.”

Beholder also has a yearling filly by War Front and a weanling filly by Bolt d'Oro. She was bred back to Curlin for 2022.
Q B One won't be the only one garnering attention in Sunday's race, as it includes a pair of pricey first-time starters from the Bob Baffert barn. Hopkins (Quality Road) was a $900,000 purchase at the 2019 Keeneland September sale, while Shaaz (Uncle Mo) was a $1.1-million seller at the 2020 Fasig-Tipton Midlantic Two-Year-Olds in Training sale. Yet the one they might all have to beat is the $5,000 Keeneland January purchase Soy Tapatio (Not This Time). Trained by Doug O'Neill, he was third in his most recent start.

Beyond Brilliant, Du Jour Square Off In Santa Anita Mathis Mile

Trainer John Shirreffs' Beyond Brilliant and Bob Baffert's Du Jour head a field of nine sophomores going a mile on turf in Sunday's Grade 2, $200,000 Santa Anita Mathis Mile, one of six graded stakes on an 11-race Opening Day card at The Great Race Place.

In what was the best race of his career, Beyond Brilliant controlled the pace throughout en route to taking the G1 Hollywood Derby at a mile and one eighth on turf Nov. 27 at Del Mar. Off at 10-1 in a field of 14, Beyond Brilliant, who was a close third two starts back in the G2 Twilight Derby here on Oct. 31, has now won two out of his last three races—all with Kent Desormeaux, who rides back on Sunday.

A bay colt by Twirling Candy, Beyond Brilliant is owned by Lee and Susan Searing's C R K Stable LLC and is 9-3-2-2 with earnings of $381,280.

Originally trained by Baffert, Du Jour was sent to trainer Bill Mott to run in the G1 Belmont Derby July 10, a race in which he finished fourth. Subsequently third in the G1 Saratoga Derby Aug. 7, he was most recently a dull eighth as the 9-5 favorite in the ungraded Dueling Downs Derby going 1 5/16 miles on turf Sept. 5 at Kentucky Downs. Following that race, Du Jour was returned to Baffert at Santa Anita and the bay colt by Temple City has a series of six drills, all on Santa Anita's inner training track, for his return.

Twin Creeks Racing's homebred Law Professor comes off a sharp off the pace win in a first condition allowance going one mile on turf Nov. 27 at Del Mar and appears to have found a home on the grass. Trained by Michael McCarthy, this gelding by Constitution earned an 85 Beyer in his most recent start and should get a lively pace to run at on Sunday.
