NYRA Suspends Baffert

There was more bad news for Bob Baffert Monday, as the New York Racing Association announced that it has temporarily suspended the trainer, which means he will not be allowed to enter any horses at NYRA tracks or occupy stall space.

“In order to maintain a successful thoroughbred racing industry in New York, NYRA must protect the integrity of the sport for our fans, the betting public and racing participants,” NYRA President and CEO Dave O'Rourke said in a statement. “That responsibility demands the action taken today in the best interests of thoroughbred racing.”

While Baffert was not planning on running any of his horses in the GI Belmont S., he was aiming Charlatan (Speightstown) for the GI Hill 'n' Dale Metropolitan H., run the same day as the Belmont. In most years, Baffert has also had starters during the Saratoga meet. It was not immediately known whether or not Charlatan or any other horses now trained by Baffert can run at the NYRA tracks for other trainers.

NYRA has joined Churchill Downs as tracks that are no longer accepting entries from Baffert. After agreeing to a number of conditions, including pre-race drug tests, Baffert was allowed to compete in the GI Preakness S. and other weekend stakes at Pimlico, by the track's owner, The Stronach Group. Medina Spirit (Protonico) ran third in the Preakness and stablemate Concert Tour (Street Sense) finished a well-beaten ninth.

In a response to TDN via email, Baffert's attorney, W. Craig Robertson, said: “I am just now reviewing the NYRA decision and then I will discuss it with Bob, along with all of his legal options.  No formal statement or decision until both of those take place.”

Baffert's troubles began when he announced that he had been informed by the Kentucky Racing Commission that Medina Spirit had tested positive for the banned medication betamethasone, which is a corticosteroid. The betamethasone positive cannot be officially confirmed until after a split sample has been tested. Baffert has admitted that Medina Spirit was treated with an anti-fungal ointment which contains betamethasone.

NYRA acknowledged that, when making the decision, it took under consideration that Baffert has had numerous positives over the last several months.

“In addition to the ongoing investigation into Medina Spirit's victory in the Kentucky Derby, NYRA has taken into account the fact that other horses trained by Mr. Baffert have failed drug tests in the recent past, resulting in the assessment of penalties against him by thoroughbred racing regulators in Kentucky, California, and Arkansas,” read NYRA's statement.

NYRA called the suspension “temporary” and said it will make a final determination based on information revealed during the course of the ongoing investigation in Kentucky, such as the post-Kentucky Derby test results of Medina Spirit.

Pneumatic Breezes Bullet for Preakness

TDN Rising Star‘ Pneumatic (Uncle Mo), last-out winner of the Aug. 15 Pegasus S. at Monmouth Park, breezed five furlongs in company in a bullet 1:00.85 over the Oklahoma training track at Saratoga Monday morning as he continues towards a start in the GI Preakness S. at Pimlico Oct. 3.

With exercise rider Angel Garcia up, Pneumatic went in fractions of :12, :23.80, :36 and galloped out three-quarters of a mile in 1:15.

“On this track, that’s about as good as horses work,” said Scott Blasi, assistant to trainer Steve Asmussen. “It was a solid five-eighths. They were out well. He’s trained really good since the Pegasus at Monmouth. Off that work we expect a big effort in the Preakness.”

Third to Maxfield (Street Sense) in the GIII Matt Winn S. May 23, Pneumatic was a well-beaten fourth behind Tiz The Law (Constitution) in the GI Belmont S. June 20. He came from just off the pace in the Pegasus to defeat Jesus’ Team (Tapiture) by 2 1/4 lengths.

Birdstone Pensioned to Old Friends

Birdstone (Grindstone–Dear Birdie, by Storm Bird), who sired the winners of two-thirds of the 2009 Triple Crown with runners from his first crop to race, has been retired from stud duties at Gainesway. He will live out his days at Old Friends Retirement Center in Georgetown, KY.

Bred by the late Marylou Whitney and trained by Nick Zito, the year-older half-brother to GI Kentucky Oaks winner Bird Town (Cape Town) won two of his three starts as a juvenile, including a 2 1/2-length success in the GI Champagne S. Eighth in a sloppy renewal of the GI Kentucky Derby in 2004, the bay was roundly dismissed at 36-1 in the GI Belmont S., with Smarty Jones (Elusive Quality) heavily favored to become the first Triple Crown winner in a quarter-century. Birdstone commenced a rally on the turn and employed his superior stamina to cause the upset, with Whitney openly apologetic to the racing public. He made his next start in the GI Travers S. nearly three months later, drawing clear by 2 1/2 lengths as a massive rainstorm was about to hit Saratoga. He retired to stud with a record of 9-5-0-0 and earnings of $1,575,600.

Birdstone sired nearly a third of his 22 stakes winners from his first crop, including Kentucky Derby upsetter Mine That Bird and Summer Bird, who would add the Belmont, Travers and Jockey Club Gold Cup en route to Eclipse Award honors. Birdstone was the sire of 10 graded/group winners in total, including GI Stephen Foster H. hero Noble Bird and Peruvian G1SW Birdie Gold.

“We are so grateful to John Hendrickson for allowing Old Friends to care for Birdstone in his post-breeding career,” said Blowen. “He’s a living tribute to the late Marylou Whitney, and we plan to carry on her great contributions to the aftercare of both humans and horses. We’re extremely grateful to John for trusting us to care for his tremendous stakes winner. Birdstone had a great life at Gainesway and we plan to continue that tradition at Old Friends.”

Tiz the Law Breezes Towards, Max Player Aiming For Runhappy Travers

Tiz the Law (Constitution) continued his preparations for the $1-million GI Runhappy Travers S. Wednesday morning, working five furlongs in a solid 1:01.10 over a Belmont main track labeled as fast. It was the New York-bred’s second breeze since winning the GI Belmont S. June 20. He went a maintenance half-mile in :50.06 July 1.

“He looked perfect,” trainer Barclay Tagg said. “He’s got a lot of energy. He wouldn’t blow out a candle.”

Tiz the Law is perfect in three starts this season, having won the GIII Holy Bull S. Feb. 1 ahead of a smooth success in the GI Curlin Florida Derby Mar. 28. He defeated Dr Post (Quality Road) by 3 3/4 lengths in the first leg of this year’s reconstituted Triple Crown last month.

“It’s just a matter of keeping him happy and healthy for seven weeks between now and the Travers,” said Jack Knowlton, operations manager for owner Sackatoga Stable. “[Assistant trainer] Robin [Smullen] says nothing phases him. If you watch him around the stable, on the track, and during his races it all seems to be true. Fortunately, [jockey] Manny [Franco] has gotten to know what he has under him and has done a great job. Hopefully we can continue the roll that we’re on.”

Trainer Linda Rice confirmed that GIII Withers S. hero and Belmont third placegetter Max Player (Honor Code) is also being prepared for the 10-furlong ‘Midsummer Derby’ at Saratoga, having also considered other options over the coming weeks.

“We’re leaning towards running in the Travers,” Rice said. “We looked at some other options with the [Grade I] Haskell [at Monmouth] or the [Grade III] Peter Pan [July 16 at Saratoga], but we are going to point right to the Travers.”
