Jason Servis To Change Plea; Hearing Set for Friday

Trainer Jason Servis  has been granted a change-of-plea hearing, which will be held Friday at 11 a.m. before Judge Mary Kay Vyskocil of United States District Court (Southern District of New York)., in which he is expected to plead guilty for his role in the highly publicized racehorse doping scandal.

Originally indicted in March of 2020, Servis represents the last domino to fall in the doping scandal that also involved trainer Jorge Navarro and more than two dozen others and sent shockwaves through the industry. Servis had appeared ready to fight the charges in court and had hired a high-profile attorney in Rita Glavin, who represented former New York Governor Andrew Cuomo when he faced allegations of sexual harassment. Servis's trial had been set to begin Jan. 9.

It was revealed last week that Servis and his attorney had begun the process of negotiating with prosecutors when a request was filed to the court asking for additional time to file motions prior to Servis's scheduled court date.

“The Government and counsel for defendant Jason Servis are currently in discussions regarding a potential pre-trial disposition, which may obviate the need for trial,” wrote United States Attorney Damian Williams in his letter to the court.

Servis was originally charged with three counts of felony drug misbranding. Some eight months after the original indictment was released, the charge of mail and wire fraud conspiracy was added in a superceding indictment. The maximum sentence under federal guidelines for that charge is 20 years.

It won't be known until Friday's hearing what charges Servis will plead guilty to. Like Servis, Navarro entered into a plea agreement with the government, pleading guilty to one count of conspiracy to commit drug adulteration or misbranding. He was sentenced to five years in prison. Unlike Servis, Navarro was never charged with conspiracy, which could mean that Servis will face more than five years.

In a related development, Alexander Chan, a veterinarian who had worked for Servis and was scheduled to be tried alongside the barred trainer in January, also changed his plea and plead guilty to one felony count of conspiracy to commit drug misbranding or adulteration. He will be sentenced April 13. Chan had also been facing three felony charges related to drug adulteration, misbranding, along with wire fraud conspiracies.

That Servis might be acquitted at trail always seemed like a longshot. The federal government had compiled numerous intercepted phone conversations between Servis and others in which he discussed his doping routines with Chan, Navarro and another vet, Kristian Rhein. When Rhein pled guilty in August of 2020 he implicated Servis. Rhein was sentenced to three years.

Servis's performance-enhancing drug of choice was allegedly SGF-1000, purported to be a performance-enhancing drug intended to promote tissue repair and increase a racehorse's stamina and endurance beyond its natural capability. The government charged that Servis administered SGF-1000 to “virtually all of the racehorses under his control.” The list includes Maximum Security (New Year's Day), who was first under the wire in the 2019 GI Kentucky Derby before being disqualified for interference.

The evidence included a conversation between Servis and Navarro in which Servis recommended SGF-1000 to his fellow trainer and said, “I've been using it on almost everything.”

In the original indictment it was charged that Servis and his co-conspirators “concealed the administration of PEDs from federal and state government agencies, racing officials, and the betting public by, among other things, concealing and covertly transporting PEDs between barns where Servis's racehorse were stabled, falsifying veterinary bills to conceal the administration of SGF-1000, and using fake prescriptions.”

Servis's sentencing may be the final chapter in a scandal that has hovered over the industry for nearly three years. With Chan having changed his plea and Servis about to do the same, the cases covering all the individuals originally indicted will have been adjudicated. Every person involved will have either pled guilty or been convicted in court.

Saratoga to Open at 100% Capacity

After racing with no fans in 2020, Saratoga will open with 100% capacity in 2021, the New York Racing Association announced today.

With 70% of adult New Yorkers now vaccinated against COVID-19, Gov. Andrew M. Cuomo announced Tuesday the immediate removal of COVID-19 protocols and restrictions for nearly all activities and industries, including outdoor sports and entertainment venues. Accordingly, NYRA will open all sections at Saratoga at 100%.

The lifting of all COVID-19 protocols, including the requirement for fans to provide vaccination status, applies to all hospitality areas and venues within the facility, including the popular Saratoga backyard, 1863 Club and The Stretch. Season admission passes, which provide access to the backyard, will be available for purchase and use without the prior requirement that fans provide proof of vaccination status.

“As New Yorkers collectively reach this major milestone in the fight against COVID-19, NYRA thanks Governor Cuomo for his leadership in achieving this goal and for the opportunity to welcome fans back to Saratoga this summer,” said NYRA President and CEO Dave O'Rourke. “This season will be a celebration like no other in Saratoga's long and storied history and we are thrilled to open the gates to the best fans in racing in just a few short weeks.”

As announced previously by Gov. Cuomo, all fans who show proof of vaccination via the New York State Excelsior Pass on opening day, July 15, will receive free grandstand general admission. Fans from outside New York State may redeem free admission by showing their Centers for Disease Control and Prevention (CDC) COVID-19 Vaccination Record Card.

NYRA is encouraging all fans who have been vaccinated in New York State to download the Excelsior Pass at https://covid19vaccine.health.ny.gov/excelsior-pass.

Non-vaccinated individuals will be required to wear a facial covering during their day at Saratoga Race Course, in accordance with CDC guidance.

The Whitney Viewing Stand at the Oklahoma Training Track will also re-open Saturday, June 26, when members of the public are welcome to view morning training from 7-10 a.m. Prior to the opening of the summer meet July 15, the Whitney Viewing Stand will be open Saturdays and Sundays from 7-10 a.m. with access available via Gate 21 on East Ave.

Licensed owners will no longer be required to show proof of vaccination when entering the Saratoga Race Course property. Beginning June 24, family members and guests will be permitted to accompany licensed owners to view morning training and visit the barn area.

At Belmont Park, the lifting of COVID-19 protocols will allow for the full re-opening of the facility to fans. Beginning Thursday, June 24, walk up general admission will be available for $5 and the backyard picnic tables will once again be available on a first-come first-served basis.

NYRA To Host Job Fair For 2021 Summer Meet At Saratoga

The New York Racing Association, Inc. (NYRA) will host a two-day job fair on Friday, June 11 and Saturday, June 12 to recruit workers for the 2021 summer meet at Saratoga Race Course, which begins on Thursday, July 15 and continues through Monday, September 6.

As announced by NYRA and New York Gov. Andrew Cuomo on May 27, the 2021 summer meet will re-open to fans at near full capacity following a season without spectators due to the COVID-19 pandemic.

The job fair will take place at Saratoga Race Course within the open-air Events Pavilion. Interviews will be conducted from 10 a.m. to 6 p.m. on Friday, June 11 and from 9 a.m. to 2 p.m. on Saturday, June 12.

Prospective summer employees should enter through the main gate at Union and East Avenues and park in the main lot. Unvaccinated individuals are required to complete a temperature check prior to entry, wear facial coverings while at Saratoga Race Course and adhere to social distancing guidelines to mitigate the risk of COVID-19.

The summer meet at Saratoga Race Course generates nearly $240 million in annual economic impact throughout the Capital Region and supports the employment of approximately 2,350 full-time, part-time, and seasonal workers.

Opportunities at this year's job fair will include: hospitality ambassadors; guest services; cashiers; admissions attendants; parking attendants; Bets Squad representatives; white caps/ushers; box office; betting clerks; general labor; security; porters; cooks; waitstaff; bussers; concessions supervisors and cashiers; cleaners; TV production; and technology support.

Positions are available with NYRA, Integrated Staffing, Levy Restaurants, AllPro and Union Square Events.

Applicants must be at least 15 years of age with New York State Certified Working Papers; prospective security guards, cashiers and betting clerks must be at least 18 years of age to apply. The 40-day summer meet at historic Saratoga Race Course, which will feature 76 stakes worth $21.5 million in total purses, will open on Thursday, July 15 and conclude on Monday, September 6.

NYRA Continuing Efforts to Bring Back Spectators

The New York Racing Association issued a statement Wednesday regarding it ongoing efforts to welcome fans back for the upcoming Belmont Park and Saratoga Racecourse meets. Horse and auto racing were omitted from New York Governor Andrew Cuomo's guidance last week relating to reopening sporting events to the public in the wake of the covid-19 pandemic.

“Governor Cuomo's decision to expand capacity limits for sports fans beginning this April is incredibly positive news as we look toward the spring and summer,” said NYRA's Pat McKEnna. “NYRA will work closely with the New York State Department of Health and the New York State Gaming Commission to secure the requisite approvals to welcome fans back to Belmont Park this spring and to Saratoga Race Course this summer. As COVID-19 cases continue to decline and vaccines become more widely available, we are optimistic that capacity limits will increase in the coming months.

“NYRA has conducted live racing for the past eight months without the energy and excitement that the fans bring, and we have missed them dearly during this time. We look forward to turning the page, and opening the doors to these historic venues in the very near future.
