Drafted’s Owners Appeal $26,000 Forego Purse Disqualification Over HISA Riding Crop Infraction

The owners of Forego (G1) fifth-place finisher Drafted have filed an appeal of a Horseracing Integrity and Safety Authority decision that would see the gelding lose his $26,000 share of the $600,000 purse because his jockey incurred a riding crop infraction under HISA rules, Daily Racing Form reports.

Drafted's jockey in the Forego, won by Cody's Wish August 27 at Saratoga, was Luis Rodriguez Castro, who New York Racing Association steward Brook Hawkins determined struck the Field Commission gelding 10 times with his crop during the seven-furlong race. Under HISA rules, a jockey is limited to six strikes with the crop.

When a jockey uses the crop from 10 to 13 times, the penalty for the rider is a $500 fine or a jockey's share of the purse, whichever is greater, and a three-day suspension, which Castro received and did not appeal. His mount is disqualified, ordered unplaced in the order of finish, and the purse money is redistributed to those who finished behind that horse.

According to the Equibase chart for the Forego, Drafted finishing 1 3/4 lengths ahead of sixth-place finisher Three Two Zone. Kneedeepinsnow was seventh. Sixth place was worth $17,000 and seventh $14,000.

Co-owner Thomas E. O'Keefe filed the appeal with HISA on Friday on behalf of himself and fellow owners Truls Engebretsen of Dublin Fjord LLC, William Nichols of Racepoint Stables, and Kevin D. Hilbert, contending that they are being forced to forfeit Drafted's share of the purse without due process, according to Drew Mollica, attorney for the owners, who are seeking a stay of the purse redistribution.

“We challenge it on the constitutionality under the Fifth and 14th Amendments of the Constitution where they're taking our money without due process,” Mollica told the Form.

Eight-year-old Drafted, a graded stakes winner and earner of more than $1 million, is trained by David Duggan.

Protectionist’s Amazing Grace Slays T Von Zastrow Stutenpreis Rivals

Dr Christoph Berglar's homebred 4-year-old distaffer Amazing Grace (Ger) (Protectionist {Ger}–Amabelle {Ger}, by Danehill Dancer {Ire}), who finished 3/4-of-a-length behind G1 Deutsches Derby hero Sammarco (Ire) (Camelot {GB}) when second in July's G1 Grosser Dallmayr-Preis at Munich in her latest start, is set to dine at the top table again after annexing Saturday's G2 T Von Zastrow Stutenpreis at Baden-Baden. Connections immediately nominated both G1 Preis von Europa and GI E. P. Taylor S. as possible destinations after she defeated stablemate India (Ger) (Adlerflug {Ger}) in a hot renewal of the 12-furlong feature. Last term's G2 Diana Trial victrix, who also snagged June's Listed 170 Jahre Hamburger Renn-Club at Hamburg, was steadied to race off a moderate tempo in fifth passing the judge first time. Urged forward off the home turn, the 5-2 second favourite was ridden to go third passing the furlong marker and stayed on strongly to assert superiority by 1 1/2 lengths nearing the line.

“To finish first and second is a dream result,” trainer Waldemar Hickst to GaloppOnline. “I actually had more of a gut feeling for India because she had improved from race to race, but it was a great ride from Olivier Peslier and I'm extremely satisfied. I was concerned about the distance and the [good-to-] soft ground, but she had no problems with it. Amazing Grace could now head to Canada for the [GI] E. P. Taylor S., while India has an entry for a Group race in Paris on Arc Day.” The winning owner's racing manager Ronald Rauscher added, “We hoped Amazing Grace would be competitive, but the pace wasn't excessively high. She won very convincingly and we now have the E. P. Taylor S. in the back of our minds. Another possibility is the [G1] Preis von Europa in Cologne.”

Pedigree Notes

Amazing Grace is one of two black-type and two group winners for her G1 Melbourne Cup-winning sire. Out of a German listed winning-daughter of Danehill Dancer (Ire), Amazing Grace is one of two winners from three to race for her dam. Amabelle has the unraced juvenile full-brother to the winner in Astaire (Ire), a yearling filly by Gleneagles (Ire) and a foal of this year, once again by Protectionist.

Antonym (Bahri), the second dam of Amazing Grace, also struck at listed level in Germany, while she, in turn, is out of the dual French Group 2 winner Annaba (Ire) (In The Wings {GB}). This is the extended family of G3 Park Hill S. heroine Anna Of Saxony (GB) (Ela-Mana-Mou {Ire}), as well as of Accessories (GB) (Singspiel {Ire}), the dam of a quartet of group winners led by Group 1 winners and sires Epaulette (Aus) (Commands {Aus}) and Helmet (Aus) (Exceed And Excel {Aus}).

Sponsored by Alex Nichols Agency

1st-DMR, $80K, Msw, 2yo, f, 5 1/2f, post time: 4:00 p.m. ET
Michael Petersen and Willow Grace Farm, who campaign last year's GI Del Mar Debutante winner Grace Adler (Curlin) in partnership, team up for the Sunday opener at Del Mar with $950K Keeneland September acquisition CARLA (Medaglia d'Oro). The February foal is the first produce from Naples Princess (Distorted Humor), a full-sister to SW Banker's Buy and a half to SW City Dweller (Carson City) and SW Glacken's Gal (Smoke Glacken), the dam of GII Davona Dale S. victress Live Lively (Medaglia d'Oro). The hugely productive cross of Medaglia d'Oro over Distorted Humor mares has yielded the likes of two-time Hong Kong Horse of the Year Golden Sixty (Aus) and additional Grade I winners Elate and New Money Honey, while extending to Forty Niner-line dams brings in the likes of multiple champion Songbird and Horse of the Year Rachel Alexandra. 2nd-KD, $150K, Msw, 2yo, 1mT, post time: 1:58 p.m. ET
The debuting Carnaby Street got American Pharoah on the board in the opening race of the meet Thursday afternoon and ON THE TEAR looks to continue the momentum here. A $350K KEESEP purchase, the Springhouse Farm-bred is a half-brother to this year's Star Shoot S. heroine Beautiful Empire (Classic Empire) and his dam, purchased by Springhouse for $260K in foal to Shanghai Bobby at Fasig-Tipton November in 2016, is a half-sister to successful young sire Practical Joke (Into Mischief). Life At Sea (West Coast) is the third foal to race out of Irish Jasper (First Defence), three times a graded winner sprinting on the main track. TJCIS PPs

6th-SAR, $105K, Msw, 2yo, f, 7f, post time: 3:20 p.m. ET
It's been an outstanding meet for Curlin and Stonestreet homebred PURE PAULINE will attempt to open her account at first asking Sunday. Inheriting the chestnut coloring of both her sire and of her GII Black-Eyed Susan S.-winning dam Keen Pauline (Pulpit), the Apr. 24 is bred on a variant of the cross over A.P. Indy-line mares that has tossed up Malathaat, Nest and Cody's Wish, each a Grade I winner during the current meet at Saratoga. Curlin is also represented by the rail-drawn third-time starter Take Charge Briana, whose dam Take Charge Tressa is a full-sister to MGISW and Spendthrift sire Omaha Beach (War Front). TJCIS PPs

7th-SAR, $105K, Msw, 2yo, f, 1 1/16mT, post time: 3:53 p.m. ET
PROUVER (Justify), a $310K graduate of last year's Keeneland September sale, is a daughter of Ready to Act (More Than Ready), who won her maiden at first asking sprinting over the local turf course and was well on her way to victory in the 2013 GII Natalma S. when she abruptly ducked in and unseated jockey Rajiv Maragh. The gray filly would go on to win the 2014 Sweetest Chant S. over the Gulfstream turf course and the GII Beaumont S. at Keeneland when the race was contested on the Polytrack. This is the extended female family of GI Hollywood Gold Cup hero and GI Pacific Classic third Mast Track (Mizzen Mast). Writteninthestars (Malibu Moon), a $110K KEESEP yearling turned $500K Fasig-Tipton Midlantic juvenile (:10 2/5, see below), is out of a half-sister to GSW Sparky Ville (Candy Ride {Arg}) and hails from the family of GISWs Harmony Lodge and Pinehurst and MGSW Graeme Hall.
