Bolt d’Oro Colt Overcomes Wide Draw, Earns ‘TDN Rising Star’ Nod on Debut at Churchill

Arman (c, 2, Bolt d'Oro–Beautissimo, by Uncle Mo), a $600,000 OBS March purchase (:9 4/5) by Kaleem Shah, overcame a very wide draw in post 10 to earn 'TDN Rising Star' honors going five furlongs on debut at Churchill Downs Thursday evening.

The 8-5 favorite wasn't off to a great beginning breaking toward the rear and rushed up on the outside to chase in fourth heading into the far turn. Four wide and on the move approaching the quarter pole, he gained a narrow advantage in the stretch and leveled off nicely after a couple of left handers from Martin Garcia to win going away by 2 1/2 lengths. Longshot Eakly (Caleb's Posse) was second. Arman becomes the seventh winner and first 'Rising Star' for his red-hot freshman sire (by Medaglia d'Oro).

Arman is one of seven of the 49 Bolt d'Oro juveniles reported as sold to fetch $500,000 or more this year.

Shah, on hand at Churchill Downs, named the promising bay after his son Arman.

“My team collectively loved the horse, so I decided to name him after my son,” Shah said on the FS2 'America's Day at the Races' broadcast.

“So, there was a lot of pressure on the team,” he added with a laugh. “Arman was running, I had to show up for the race.”

The Florida-bred is out Beautissimo (Uncle Mo), an unraced half-sister to the stakes-winning and multiple graded-placed dirt router Two Thirty Five (Stay Thirsty). Beautissimo brought $50,000 from Trackside Farm at the 2018 Keeneland November Sale. She is also responsible for the unraced 3-year-old colt Tone Poem (Tonalist) and a filly by Vino Rosso of 2021. Beautissimo was bred to Goldencents for 2022.

This is the extended female family of champion Halfbridled (Unbridled).

Baffert Issued 365-Day Suspension at NYRA Tracks; Can Return in January

A three-member panel assigned with the task of deciding whether or not the New York Racing Association was justified in punishing Hall of Fame trainer Bob Baffert announced its decision late Thursday afternoon, issuing a one-year suspension from the NYRA tracks, effective immediately.

In April, a hearing officer recommended that Baffert be suspended for two years, so Thursday's decision was not a complete loss for the embattled trainer.

After a federal judge ordered that NYRA could not impose a ban on Baffert without affording the trainer due process, a hearing was held in January in which the racing association stated its case for suspending the trainer. The hearing officer was O. Peter Sherwood, a retired New York Supreme Court justice, who turned over his findings to the panel.

The process began in September, 2021 when NYRA delivered a statement of charges to Baffert alleging that he had engaged in conduct detrimental to the best interests of the sport of Thoroughbred racing, conduct that was potentially injurious to the health or safety of horses or riders. The statement of charges was an offshoot of Medina Spirit (Protonico) testing positive for betamethasone in the 2021 GI Kentucky Derby, along with other medication violations Baffert had been charged with within a relatively short time frame.

“This was an impartial and deliberative process that has resulted in a lengthy suspension of the sport's most prominent trainer,” Dave O'Rourke, NYRA President & CEO, said in a statement. “However, this is not simply about Bob Baffert or any one individual but about protecting the integrity of the sport here in New York. Today's decision advances that goal.”

Reacting to the decision, Baffert's attorney Clark Brewster lashed out at the panel and accused NYRA Board members of taking action against Baffert because they are jealous of his success.

“From reading the NYRA-selected panel's decision it is obvious they tried hard to mitigate and generalize the nonsensical and contradictory ramblings of the Peter Sherwood order, but still they capitulated to the will of a few NYRA Board members who are blindly driven by jealousy and self interest to destroy Bob,” Brewster said in a text message.

The panel called allegations that NYRA Board Members took action against Baffert for competitive reasons “reckless.”

The panel credited Baffert with 59 days he served while temporarily suspended before the court made its ruling regarding due process. He was also credited for the 90-day suspension issued by the Kentucky Horse Racing Commission and reciprocally honored by the New York State Gaming Commission. He will become eligible to compete again at the New York tracks on Jan. 25, 2023.

Baffert is also currently serving a suspension from Churchill Downs, which banned the trainer for two years.

Brewster had requested any penalty issued to Baffert be stayed pending an administrative and judicial review. The panel denied that request, stating that the decision of the hearing panel is “final” and takes effect “immediately.” Referring to Rule 16(f), the panel's report concluded that “there shall be no administrative appeal within NYRA of the Panel's final   decision.”

The panel did not blindly agree with all of Sherwood's charges. It noted that the retired judge had written that Baffert was guilty of multiple instances of doping. The panel found problem with the word doping, noting that Baffert wasn't necessarily charged with using performance-enhancing substances. It also took exception to Sherwood's charge that “Baffert has engaged in a pattern and practice of unlawful conduct that has no parallel in the modern history of Thoroughbred racing.”

“There is scant support in the record for such a statement,” the panelist's report read.

In an effort to explain why the suspension was reduced to one year, the panel asserted that Sherwood “appears to have relied principally on a decision by Churchill Downs Inc. to ban Baffert through the 2023 Kentucky Derby to arrive at his recommendation for a two-year ban by NYRA.” The panel noted that Churchill, a private company that does not necessarily have to hold a hearing for someone it attempts to suspend, never did hold a hearing regarding Baffert's two-year suspension. Had it done so, the panel was not convinced that a hearing officer would have issued such a lengthy suspension.

The panel consisted of attorney John J. Carusone Jr., William Alempijevic and Rev. Humberto Chavez. Carusone is an attorney with the firm Carusone & Carusone in Saratoga Springs, New York. Alempijevic is the Executive Director of the New York Thoroughbred Horsemen's Association. Chavez heads the New York Race Track Chaplaincy of America (RTCNY).

Though Baffert is based in California, he normally makes a few starts a year in Saratoga and is always eligible to have a candidate in the GI Belmont S. He has won the Belmont three times.

‘Protecting The Integrity Of The Sport’: Bob Baffert Suspended From NYRA Tracks For One Year

Following the issuance of a hearing report by Judge O. Peter Sherwood in April, and in accordance with the New York Racing Association, Inc. (NYRA) hearing rules and procedures, a three-member hearing panel has today delivered a final determination in the matter of Robert A. Baffert.

After a two-month review of the 50-page hearing report, the panel has moved to suspend Mr. Baffert from racing or training activities at all NYRA tracks for 365 calendar days effective immediately.

The panel's decision credits Mr. Baffert with 59 days served under the prior NYRA temporary suspension as well as the 90-day suspension issued by the Kentucky Horse Racing Commission and reciprocally honored by the New York State Gaming Commission. Accordingly, Mr. Baffert is excluded from participating in racing or training activities at all NYRA tracks through January 25, 2023.

As addressed in the NYRA hearing rules and procedures, which can be found here, the decision of the hearing panel is “final” and takes effect “immediately.” Further, Rule 16(f) states that, “There shall be no administrative appeal within NYRA of the Panel's final decision.”

In September 2021, NYRA delivered a statement of charges to Mr. Baffert alleging that he had engaged in conduct detrimental to the best interests of the sport of thoroughbred racing or potentially injurious to the health or safety of horses or riders.

Further, as detailed in the statement of charges, NYRA charged that the conduct warrants revocation or suspension of Baffert's right to train horses, enter races, or engage in any racing-related activity at all NYRA properties including Aqueduct Racetrack, Belmont Park and Saratoga Race Course.

NYRA established Hearing Rules and Procedures to provide a formalized mechanism for a respondent to reply to charges and to participate in a hearing in accordance with due process rights.

The NYRA administrative hearing in the matter of Mr. Baffert commenced on Monday, January 24 and concluded on Friday, January 28. Judge Sherwood, a retired New York State Supreme Court Justice, served as hearing officer to ensure the proceedings were fairly and impartially conducted in accordance with NYRA's Hearing Rules and Procedures.

John J. Carusone, Jr., Esq.

An attorney with the firm Carusone & Carusone in Saratoga Springs, New York, John Carusone has practiced law in the greater Saratoga Springs community for more than 40 years. Mr. Carusone is an appointee of the City of Saratoga Springs to the Saratoga Race Course Local Advisory Board (SLAB). The advisory board was legislatively authorized in 2008 and serves as a mechanism to encourage productive and consistent dialogue between the New York Racing Association, Inc. (NYRA), Saratoga County and the City of Saratoga Springs.

Mr. Carusone sits on the board of directors at both Arrow Financial Corporation and Saratoga National Bank and Trust Company. He is a graduate of Hamilton College and Albany Law School.

William Alempijevic

Will Alempijevic is the Executive Director of the New York Thoroughbred Horsemen's Association (NYTHA), which represents the interests of thoroughbred owners and trainers NYRA tracks. NYTHA serves as New York State's recognized representative of owners and trainers and works to protect the economic interests of all horsemen and to gain public recognition of horse racing as a vital industry, deserving support, protection and preservation.

Mr. Alempijevic sits on the board of directors of the Backstretch Employee Service Team, the non-profit based at Belmont Park that works to support the healthcare needs of the NYRA backstretch community. He is a graduate of Canada's Wilfrid Laurier University in Ontario with a degree in economics with financial management.

Humberto Chavez

Rev. Humberto Chavez leads the New York Race Track Chaplaincy of America (RTCNY), the non-profit ministering to the spiritual needs of the NYRA backstretch community through enrichment programs and nondenominational religious services. Rev. Chavez was named Chaplain of the RTCNY in 2003 and has expanded its work and reach in the years since. The RTCNY recently broke ground on a new headquarters located on the grounds of Belmont Park.

In addition to his work with the RTCNY, Rev. Chavez is the lead pastor of the Bridge Church of Malverne, NY, where he and his wife Rev. Karen Chavez had previously started a now thriving Spanish speaking ministry. In 2020, The Thoroughbred Owners and Breeders Association (TOBA) presented him with its Industry Service Award, given to the individual person who has made exceptional contributions to the horse racing industry.

Rev. Chavez is the chairman of the board of the Elmont Police Athletic League. He and his wife Karen live in Franklin Square with their three children.

Jessie Harrington, who took this last year with the future G1 Moyglare Stud S. winner Discoveries (Ire) (Mastercraftsman {Ire}) as she inched out Tuesday (Ire) (Galileo {Ire}), saddles Yuesheng Zhang's newcomer Danvers Gold (Ire) (Galileo {Ire}), a daughter of the G3 Cornwallis S. scorer Mrs Danvers (GB) (Hellvelyn {GB}) who cost 320,000gns at the Tattersalls October Yearling Sale Book 2.
