Presque Isle Files Suit Against Pennsylvania HBPA To Block Arbitration Over ADW Revenue Dispute

An ongoing legal dispute between Presque Isle Downs and the Pennsylvania Horsemen's Benevolent and Protective Association saw a new development last week when PID filed a lawsuit seeking to prevent the PAHBPA's “unsupported allegations” from going to arbitration, reports the Thoroughbred Daily News.

The dispute centers around revenue-sharing of advanced deposit wagering dollars, which is laid out in a Live Racing Agreement between the PAHBPA and PID. PAHBPA has two complaints: first, that PID's parent company Churchill Downs, Inc. is breaching the Live Racing Agreement by promoting its own ADW to on-track patrons, then not treating those wagers with the same return to the purse account as on-track wagers; and second, that the source market fee (from ADW bets made by in-state residents) agreed to by PID with CDI is too low compared to industry standards.

“PAHBPA's asserted allegations of breach are nothing more than a money grab without legal merit,” the PID's latest complaint contends. “Rather than raising questions as to PID's compliance with the terms of the Live Racing Agreement, PAHBPA's asserted allegations are an attempt to renegotiate through arbitration a long standing contractual provision, that with the benefit of hindsight and changed circumstances, they now disfavor. In essence, PAHBPA alleges that the source market fee received by PID from the collateral agreement is too low.”

Letruska, Maxfield Move Up In NTRA Top Thoroughbred Poll

Godolphin's 4-year-old Mystic Guide remained in first place in the latest NTRA National Thoroughbred Poll, but St. George Stable's 5-year-old mare Letruska and Godolphin's 4-year-old Maxfield, moved up to second and third place, respectively, following dominating victories at Churchill Downs on Saturday.

Mystic Guide, trained by Mike Stidham, received 21 first-place votes and 313 points. On Saturday, Mystic Guide breezed 4 furlongs in 48.2 at Fair Hill in Maryland in preparation for the Grade 2 Suburban Stakes at Belmont Park on July 3. A chestnut son of 2004 Horse of the Year Ghostzapper, Mystic Guide will be making his first start since winning the Group 1 Dubai World Cup on March 27.

Letruska, trained by Fausto Gutierrez, won Saturday's Grade 2 Fleur de Lis by 5 ¾ lengths for her fourth win in five starts in 2021. A bay daughter of 2010 Grade 1 Kentucky Derby winner Super Saver, Letruska has two first-place votes and 268 points, moving from third to second place this week.

Equally impressive on Saturday was Maxfield, who swept to a powerful 3 ¼-length victory in the Grade 2 Stephen Foster Stakes. A dark bay son of 2007 Grade 1 Kentucky Derby winner Street Sense, Maxfield jumped from seventh to third place in the poll. Trained by Brandan Walsh, Maxfield increased his first-place votes from one to five this week, and has a total of 253 points.

Winchell Thoroughbreds and Willis Horton Racing's 4-year-old Silver State dropped from second to fourth place, registering one first-place vote and 229 points. Trained by Steve Asmussen, Silver State is unbeaten in four starts this year, including the Grade 1 Hill 'N' Dale Metropolitan Handicap at Belmont.

Klaravich Stables' 4-year-old gelding Domestic Spending, the only turf horse in the top 10, is in fifth place with six first-place votes and 219 points. Trained by Chad Brown, Domestic spending won the Grade 1 Resorts World Casino Manhattan Stakes at Belmont on June 5.

Godolphin's 3-year-old Essential Quality, winner of the Grade 1 Belmont Stakes presented by NYRA Bets, is in sixth place. Trained by Brad Cox, Essential Quality has one first-place vote and 185 points.

Spendthrift Farm LLC and Madaket Stables' 6-year-old Monomoy Girl, the 2020 older dirt female Eclipse Award winner, rose from ninth to seventh place, and has 87 points.

The 4-year-old Gamine (109 points), last year's champion female sprinter, trained by Bob Baffert, stayed in eighth place.

Korea Racing Stable's Knicks Go (37 points), winner of the Grade 1 Pegasus World Cup Invitational, moved up one spot to ninth place.

SF Racing, Starlight Racing, Madaket Stables, Stonestreet Stables, Frederick Hertrich III, John Fielding and Golconda Stables' 4-year-old Charlatan (135 points), who finished second in the Group 1 Saudi Cup for Bob Baffert, is in 10th place and received 32 votes. Charlatan has subsequently been retired.

The NTRA Top Thoroughbred polls are the sport's most comprehensive surveys of experts. Every week eligible journalists and broadcasters cast votes for their top 10 horses, with points awarded on a 10-9-8-7-6-5-4-3-2-1 basis. All horses that have raced in the U.S., are in training in the U.S., or are known to be pointing to a major event in the U.S. are eligible for the NTRA Top Thoroughbred Poll. Voting in the Top Thoroughbred Poll is scheduled to be conducted through Nov. 6.

Crazy Beautiful Headlines Saturday’s Delaware Oaks

Phoenix Thoroughbred III's Crazy Beautiful tops a field of nine in the $300,000 Grade 3 Delaware Oaks at Delaware Park this Saturday. The Oaks has been carded as the eighth race with an approximate post time of 4:45 p.m.

In her most recent effort, the Kentucky-bred trained by Kenneth McPeek posted a 1 3/4-length score in the mile and a sixteenth Grade 2 Summertime Oaks at Santa Anita May 30.

“She is doing great,” said trainer Ken McPeek. “We could not be happier with this filly. She handled the race in California pretty handily, so hopefully we will be able to pull off the coast-to-coast bookend and pull off the Santa Anita to Delaware Park double. The Delaware Oaks is a real good spot for her. The money, the grade and the timing are all what we are looking for. We are excited that Mike Smith is coming back to ride her and I suspect she will be tough.”

Previously, the daughter of Liam's Map was unplaced in mile and an eighth Grade 1 Kentucky Oaks at Churchill Downs on April 30. In her two other outings this year, she won the mile and a sixteenth Grade 2 Gulfstream Park Oaks by 2 ¼-lengths on March 27 and finished second in the one mile Grade 2 Davona Dale at Gulfstream Park on February 27.

Last year, she posted a record of two wins and two seconds from five starts which included a second in the Grade 1 Alcibiades at Keeneland and a second in the Grade 3 Pocahantas Stakes at Churchill Downs. She closed her 2020 campaign by finishing sixth in the Breeders' Cup Juvenile Filly at Keeneland.

Her connections are intending to use the Delaware Oaks as springboard for further engagements this summer in upstate New York.

“Absolutely, there is no question and after the Delaware Oaks, she will ship to Saratoga,” McPeek said. “If she runs well, she might comeback in the Coaching Club or we may skip the Coaching Club and run in the Alabama. We have not decided that yet, but she will be definetly be headed to Saratoga.”

She has a career record of four wins and three seconds from nine starts with earnings of $520,865.

Wootton Asset Seeking First U.S. Victory In Saturday’s Kent Stakes

Madaket Stables' Wootton Asset will be seeking his first victory in North America in the $150,000 Grade 3 Kent Stakes at Delaware Park this Saturday. The French-bred son of Wootton Bassett will be making his 2021 debut in the mile-and-an-eighth grass affair for 3-year-olds. The Kent has been carded as the seventh race with an approximate post time of 4:15 p.m.

Last year, Wootton Asset posted a record of two wins and a second from seven starts with earnings of $73,745. He made his first four career starts in France where he won his career debut and followed with a victory. In his next two outings, he finished fourth and fifth in a pair of stakes. In his stateside debut, the H. Graham Motion trainee ran second beaten a neck in Laurel Futurity at Pimlico. He followed with a pair of off-the-board efforts in the Awad at Belmont Park and Cecil B. DeMille at Del Mar to close his 2020 campaign.

“I thought he ran well last year,” said trainer H. Graham Motion. “When we ran him in the Laurel Futurity, he basically ran off the plane. Since he had been running in France before he shipped to the United States, we really were not sure how many more races he had him and maybe the California race may have been one too many. He really came to the United States to run on firmer ground and the first time we ran him, in the Laurel Futurity, it was extremely soft, but he ran well extremely well. He had the winter off and I think he has grown up a lot. Victor (Carassco) gave him a good work going seven-eighths on the Tapeta at Fair Hill on Saturday, so we are hoping for a nice effort from him in the Kent.”
