Weekly Rulings, Dec. 12-18

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

With the Horseracing Integrity and Safety Act (HISA) having gone into effect on July 1, the TDN will also post a roundup of the relevant HISA-related rulings from the same week, while we wait to see what the new year will bring regarding the legislation.

California
Track: Los Alamitos
Date: 12/16/2022
Licensee: Jose De La Torre, jockey
Penalty: Three-day suspension, $500 fine
Violation: Excessive use of the whip
Explainer: Having violated the Horseracing Integrity and Safety Authority Rule #2280 (Use of Riding Crop) and pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties – Class 2), Jockey Jose De La Torre who rode Papa Primitivo in the sixth race at Los Alamitos Race Course on December 11, 2022, is suspended for three (3) days (December 26, 30 and 31, 2022), and fined $500.00 for six (6) strikes over the limit. (Class 2 violation). Furthermore, Jockey Jose De La Torre is assigned five (5) violation points that will be expunged on September 16, 2023, nine (9) months from the date of final adjudication pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties). Jockey Jose De La Torre now has five (5) points pursuant to HISA Rule #2283 (Multiple Violations)

Track: Los Alamitos
Date: 12/16/2022
Licensee: Steve Knapp, trainer
Penalty: $500 fine
Violation: Medication violation
Explainer: Trainer Steve Knapp, who started the horse Square Deal, finishing fourth in the second race at Del Mar Racetrack on September 10, 2022, is fined $500.00 and assessed one half (1/2) point in accordance with California Horse Racing Board rule #1843.4 (Multiple Medication Violations – Expires 12/16/23) pursuant to rule #1887 (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rules #1840 (Veterinary Practices and Treatment Restricted), #1843(a)(b)(d) (Medication, Drugs and Other Substances), Rule #1844(d)(5) (Authorized Medication) and Rule #1843.1 (Prohibited Drug Substances – Methocarbamol [Class 4]).

Track: Los Alamitos
Date: 12/17/2022
Licensee: Armand Aguilar, jockey
Penalty: One-day suspension, $250 fine
Violation: Excessive use of the whip
Explainer: Having violated the Horseracing Integrity and Safety Authority Rule #2280 (Use of Riding Crop) and pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties – Class 3), Apprentice Jockey Armand Aguilar, who rode Big Frank Da Tank in the fourth race at Los Alamitos Race Course on December 16, 2022, is suspended for one (1) day (December 26, 2022), and fined $250.00 for two (2) strikes over the limit. Furthermore, Apprentice Jockey Armand Aguilar is assigned three (3) violation points that will be expunged on June 17, 2023, six (6) months from the date of final adjudication pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties – second offense since November 6, 2022. Apprentice Jockey Armand Aguilar has accrued a total of six (6) points.

NEW HISA STEWARDS RULINGS

The following rulings were reported on HISA's “rulings” portal, except for the voided claim rulings which were sent to the TDN directly. Some of these rulings are from prior weeks as they were not reported contemporaneously.

One important note: HISA's whip use limit is restricted to six strikes during a race.

California

Licensee: Francisco Orduna-Rojas, jockey

Penalty: One-day suspension, $250 fine

Violation: Excessive use of the whip

Explainer: Having violated the Horseracing Integrity and Safety Authority Rule #2280 (Use of Riding Crop) and pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties – Class 3), Jockey Francisco Orduna-Rojas, who rode Mr. Clutch in the first race at Los Alamitos Race Course on December 9, 2022, is suspended for one (1) day (December 17, 2022), and fined $250.00 for two (2) strikes over the limit. Furthermore, Jockey Francisco Orduna-Rojas is assigned three (3) violation points that will be expunged on June 22, 2023, six (6) months from the date of final adjudication pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties – third offense since July 3, 2022. Jockey Francisco Orduna-Rojas has accrued a total of nine (9) points. Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

Track: Los Alamitos

Date: 12/11/2022

Licensee: Steve Knapp, trainer

Penalty: Return of claim amount, $20,000

Violation: Medication violation, voided claim

Explainer: In the matter of the claim submitted for the horse Butkus; Having received first notice of a Prohibited Substance (Phenylbutazone) in the post-race test sample, pursuant to Horse Racing Integrity and Safety Rule 2262 (c)(5) (Void Claim), the claim submitted for the horse Butku, in the second race on October 28, 2022, at Santa Anita Park is hereby deemed void. The horse, Butkus trained by Steve Knapp shall be returned to previous owner Reed Saldana and Reed Saldana shall return the amount of the claim of $20,000 to owner Leslie Blake by December 26, 2022. Furthermore, Trainer Reed Saldana and Trainer Steve Knapp have reached an agreement for the care and training of the horse during the time the horse was in the claimant's barn.

Violation: Medication violation

Explainer: Trainer Richard Baltas, is suspended for 365 days from Dec. 9, 2022 to Dec. 8, 2023, and fined the sum of Ten Thousand Dollars ($10,000.00)*; pursuant to California Horse Racing Board rule #1887 (Trainer to Insure Condition of Horse) for violations of California Horse Racing Board rules #1902 (Conduct Detrimental to Horse Racing) and #1843.5 (Medication, Drug, and Other Substances Permitted After Entry in a Race)–Oral administrations of “X-Treme Air Boost” and other substances on race day that occurred between Apr. 15, 2022, through May 8, 2022, at Santa Anita Park. (21 counts).

Licensee: John Brocklebank, trainer

Penalty: Reinstatement of license

Violation: N/A

Explainer: Trainer John Brocklebank having appeared before the Board of Stewards, is reinstated, and the Stewards Ruling DMTD #027 dated 08/01/2021 is set aside. Having provided proof that John Brocklebank is under Chapter 13 Bankruptcy protection, the ruling DFTD #33 dated Nov. 25, 2017 is set aside while under this protection. Should John Brocklebank no longer be under the Bankruptcy protection, he shall notify the California Horse Racing Board.

KENTUCKY

Track: Churchill Downs

Date: 12/01/2022

Licensee: Lee Rossi, trainer

Penalty: Forty-five day suspension, $500 fine

Violation: Medication violation

Explainer: Pursuant to the Settlement Agreement and Stipulation in the case of Lee. J. Rossi vs. KHRC. Owner, trainer Lee J. Rossi is hereby fined five hundred dollars and suspended 45 days, 20 days to be served Dec. 11, 2022 through Dec. 30, 2022 (inclusive). The remaining 25 days are stayed on condition no Class A or B medication violation occurs in any racing jurisdiction within 365 days from the date of this agreement. Our Bernadette (Churchill Downs, Nov. 15, 2017) is disqualified and all purse money forfeited.

Explainer: Trainer Ian Kruljac, who started the horses GYPSY LYNN, who finished first in the first race on August 21, 2022, at Del Mar Race Track, and GLENDALE who finished second in the third race on August 21, 2022, at Del Mar Race Track is fined $500 and assessed one half (1/2) point in accordance with California Horse Racing Board Rule #1843.4 (Multiple Medication Violations) pursuant to California Horse Racing Board Rule #1887 (a) (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1843 (a & d) (Medication, Drugs and other Substances) and Rule #1843.1(b) (Prohibited Drug Substances – Methocarbamol [Class 4]).

 

KENTUCKY

Track: Churchill Downs

Date: 11/20/2022

Licensee: Shug McGaughey, trainer

Penalty: Thirty-day suspension (15 days stayed) and $500 fine

Violation: Medication violation

Explainer: Upon receipt of notification from the University of Kentucky Equine Analytical Chemistry Laboratory, the official testing laboratory for the Kentucky Horse Racing Commission and confirmed at Texas A&M Veterinary Medical Diagnostic Laboratory, sample number R020613 taken from Smokin T, who finished second in the eleventh race at Churchill Downs on June 4, 2022, contained 2-1-(hydroxyethyl) promazine sulfoxide (HEPS) at a level of 61.2 ng/ml in urine (Class B). After waiving his right to a formal hearing before the Board of Stewards Claude R. McGaughey III is hereby suspended 30 days and fined $500. Due to mitigating circumstances (number of violations in relation to overall record), 15 days are to be served from December 5, 2022, through December 19, 2022 (inclusive). The remaining 15 days are stayed on the condition that no Class A or Class B medication violations occur in any racing jurisdiction within 365 days from the date of this ruling.
