Weekly Rulings: April 4-April 10

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

With the Horseracing Integrity and Safety Act (HISA) having gone into effect on July 1, 2022, the TDN will also post a roundup of the relevant HISA-related rulings from the same week.

California

Track: Santa Anita

Date: 04/09/2023

Licensee: Abel Cedillo, jockey

Penalty: Three-day suspension

Violation: Careless riding

Explainer: Having received notice from the California Horse Racing Board that the appeal of LATS Ruling #32 (March 3, 2023) has been withdrawn, the original ruling is reinstated.  Jockey Abel Cedillo is suspended for 3 racing days (April 28, 29 & 30, 2023). Pursuant to California Horse Racing Board Rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

The following rulings were reported on HISA's “rulings” portal, except for the voided claim rulings which were sent to the TDN directly.

One important note: HISA's whip use limit is restricted to six strikes during a race.

Angel A Rodriguez–violation date March 31; $250 fine and one-day suspension, 8 strikes

Isaac Manuel Jimenez–violation date April 1; $250 fine and one-day suspension, 7 strikes

Shaun Bridgmohan–violation date April 2; $250 fine and one-day suspension, 9 strikes

Will Rogers Downs

Gustavo Armando Herrera–violation date April 10; $250 fine and one-day suspension, 8 strikes

Travis G Cunningham–violation date April 10; $250 fine and one-day suspension, 7 strikes

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Date: 03/21/2023

Licensee: Stephen Fox, owner

Penalty: $2,000 fine

Violation: Violation of claimed horse transfer process

Explainer: Mr. Stephen Fox is hereby fined the sum of $2,000 for violating rule # 4038.4 Sale, Transfer restricted. This for transferring a claimed horse to another trainer prior to the 30 days from the date of the claim.

 

Track: Aqueduct

Date: 03/21/2023

Licensee: Gregory DiPrima, trainer

Penalty: $2,000 fine

Violation: Violation of claimed horse transfer process

Explainer: Trainer Mr. Gregory DiPrima is hereby fined the sum of $2,000 for violating rule #4038.4, Sale, Transfer restricted. This for transferring a claimed horse to another trainer prior to the 30 days from the date of the claim.

Licensee: Kendrick Carmouche

Penalty: Three-day suspension

Violation: Careless riding

Explainer: Having waived his right to an appeal Jockey Mr. Kendrick Carmouche is hereby suspended 3 NYRA racing days March 26th 2023, March 30th 2023, and March 31st 2023 inclusive. This for careless riding during the running of the 7th race at Aqueduct racetrack on March 18th 2023.

NEW YORK

Track: Aqueduct

Date: 02/16/2023

Licensee: Linda Rice, trainer

Penalty: $1,000 fine, 10-day suspension

Violation: Medication violation

Explainer: Having received a report from the NYS Gaming Commission Drug Equine Testing Laboratory of the finding of Phenylbutazone in the post-race sample taken from horse ” Winter Pool ” #(4) which raced at Aqueduct Racetrack in the

1st race and finished 1st on January 7th 2023. Trainer of record Linda Rice having been notified of the post-race findings and having waived her right to an appeal is hereby fined the sum of one thousand ($1,000) dollars and suspended 10 Calandar days effective February 20th 2023, through March 1st 2023 inclusive.

Furthermore, the Stewards order horse ” Winter Pool ” disqualified from any part of the purse and the purse redistributed as follows:

  5. (#7) Supply Chain

Ordered that during your period of suspension, you shall not directly nor indirectly participate in New York State Pari-mutuel horse racing. You are denied the privilages and use of the grounds of all racetracks, you are forbidden to participate in any share of purses or other payment. Every horse is denied the privilages of the grounds and shall not participate in pari-mutuel racing in New York State, that (a) is owned or trained by you, or by individuals who serves as your agent or employee during your suspension: or (b) for which you during your suspension are directly or indirectly with training, including any arrangements to care for, train, enter, race, invoice, collect fees or other payments, manage funds, employ or insure workers, provide advise or other information or otherwise assist with any aspect of the training of such horses.

Penalty: $500 fine

Violation: Medication violation

Explainer: Trainer Lorenzo Ruiz, who started the horse Manitowish, who finished third in the second race on Sept. 10, 2022, at Del Mar Race Track is fined $500.00 and assessed one half (1/2) point in accordance with California Horse Racing Rule #1843.4(a) (Multiple Medication Violations – Expires 02/10/24) pursuant to California Horse Racing Board Rule #1887(a) (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1843(a)(b)(d) (Medication, Drugs and Other Substances and Rule #1843.1(b) (Prohibited Drug Substances – Phenylbutazone [Class 4]).

 

Track: Santa Anita

Date: 02/11/2023

Licensee: Diego Herrera, jockey

Penalty: Three-day suspension

Violation: Careless riding

Explainer: Jockey Diego Herrera, who rode Lasmuigh in the third race at Santa Anita Park on Feb. 10, 2023, is suspended for 3 racing days (Feb. 18, 19 and 20, 2023) for failure to make the proper effort to maintain a straight course in the stretch, causing interference. This constitutes a violation of California Horse Racing Board rule #1699 (Riding Rules – careless riding).
