California

Explainer: Trainer Ed Moger, who worked the horse Squalotoro for removal from the Veterinarian's List on March 10, 2022, at Santa Anita Park, is fined $500.00 pursuant to California Horse Racing Board Rules #1887(a) (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1866(h) (Veterinarian's List), #1843(a)(b)(d) (Medication, Drugs and Other Substances) and Rule #1843.1(a) (Prohibited Drug Substances – Phenylbutazone – Class 4).

Track: Santa Anita
Date: 04/20/2022
Licensee: Bob Hess, trainer
Penalty: $500 fine
Violation: Out of competition medication violation
Explainer: Trainer Robert Hess, who worked the horse Rantanen for removal from the Veterinarian's List on February 14, 2022, at Santa Anita Park, is fined $500.00 pursuant to California Horse Racing Board Rules #1887 (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1866(h) (Veterinarian's List), #1843(a)(b)(d) (Medication, Drugs and Other Substances), Rule 1844(d)(1) (Authorized Medication) and Rule #1843.1 (Prohibited Drug Substances – 5-Hydroxy Dantrolene [Class 4]).

Licensee: Diego Herrera, jockey
Penalty: $1,000 fine
Violation: Excessive use of the whip
Explainer: Apprentice Jockey Diego Herrera is fined $1,000.00 for violation of California Horse Racing Board rule #1688(b)(8)(d) (Use of Riding Crop – more than six times – third offense in the past sixty days) during the eighth race at Santa Anita Park on April 17, 2022.

Kentucky
The following ruling was not posted in time for inclusion last week.

Track: Keeneland
Date: 04/10/2022
Licensee: Brian Hernandez, Jr., jockey
Penalty: $500 fine
Violation: Excessive use of the whip
Explainer: After waiving his right to a hearing before the Board of Stewards, Brian J. Hernandez, Jr., who rode Cilla in the seventh race at Keeneland on April 9, 2022, was found to have violated the crop regulation. This being his first offense, Mr. Hernandez was given the option and chose to pay a fine. Brian Hernandez, Jr. is hereby fined $500.00 for his improper use of the riding crop by exceeding the allowable use in the overhand manner. Upon receipt of this ruling, it is required within 30 days to pay any and all fines imposed to the Kentucky horse Racing Commission. Failure to do so will subject the licensee to summary suspension of license pursuant to 810 KAR 3:020 Section 15 (cc).

Penalty: Four-day suspension
Violation: Careless riding
Explainer: Jockey Ryan Curatolo, who rode Silent Beauty in the ninth race at Santa Anita Park on April 10, 2022, is suspended for 4 racing days (April 30, May 1, 6 and 7, 2022) for failure to make the proper effort to maintain a straight course in the stretch, causing interference which resulted in the disqualification of his mount from third to fourth place. This constitutes a violation of California Horse Racing Board rule #1699 (Riding Rules – Careless Riding). Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

Penalty: $750 fine
Violation: Excessive use of the whip

Explainer: Jockey Edgar Payeras is fined $500.00 for violation of California Horse Racing Board rule #1688(b)(8)(d) (Use of Riding Crop–more than six times) during the third race at Santa Anita Park on April 16, 2022.

Kentucky

Track: Keeneland
Date: 04/13/2022
Licensee: Bob Hess, owner-trainer
Penalty: $1,000
Violation: Falsifying owner's signature to claim a horse
Explainer: After waiving his right to a formal hearing before the Board of Stewards, Robert B. Hess Jr is hereby fined $1,000 for violating the rules governing claiming by falsifying the owner's signature while attempting to claim “Malibu Marie” from the 4th race at Keeneland on April 8, 2022. Upon receipt of this ruling, the licensee is required within 30 days to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to a summary suspension of licensee pursuant to 810 KAR 3:020 Section 15 (cc).

Licensee: Jack Gilligan, jockey
Penalty: Three-day suspension
Violation: Excessive use of the whip
Explainer: After a hearing before the Board of Stewards, Jack Gilligan, who rode Baytown Lovely in the first race at Keeneland on April 10, 2022 was found to have violated the crop regulation. This being his first offense, Mr. Gilligan was given the option and chose to serve a suspension. Jack Gilligan is hereby suspended 3 racing days, April 14 through April 16, 2022 (inclusive) for his improper use of the crop by exceeding the allowable use in the overhand manner.

Fine shall be paid to the Paymaster within seven calendar days from the date of this ruling, or the license of the person upon whom the fine has been imposed shall be suspended.

Explainer: Official Ruling of the Board of Stewards Santa Anita Park Winter/ Spring Meet (Association) April 10, 2022 (Date) LATS Ruling #89 Apprentice Jockey Emily Ellingwood, who rode Dutch Bus in the eighth race at Santa Anita Park on April 9, 2022, is suspended for 3 racing days (April 17, 30 and May 1, 2022) for failure to make the proper effort to maintain a straight course in the stretch, causing interference which resulted in the disqualification of her mount from first to second place. This constitutes a violation of California Horse Racing Board rule #1699 (Riding Rules – Careless Riding). Florida

Track: Gulfstream Park

Penalty: $1,000 fine and purse money redistribution
Violation: Medication violation
Explainer: Stipulation and Consent Order # 2022-007341 – F.S. 550.2415 Violation = Methocarbamol. Respondent fined $1000, made payable to the board of relief fund established at Gulfstream Park Thoroughbred After Racing Program, Inc. In addition, the Owners agree that they shall return all money that was distributed from the purse to Gulfstream Park Racing Association, Inc.

New York

Track: Aqueduct
Date: 04/07/2022
Licensee: Heman Harkie, jockey
Penalty: Three-day penalty
Violation: Careless riding
Explainer: For having waived his right to appeal Jockey Mr. Heman Harkie is hereby suspended 3 NYRA racing days April 8th 2022, April 9th 2022, April 10th 2022 inclusive. This for careless riding during the running of the 1st race at Aqueduct Racetrack on April 3rd 2022.

Explainer: Owner Liparit Gharibyan, having complied with the provisions of California Horse Racing Board rule #1876 (Financial Responsibility–$146.13 to So. Cal. Equine Foundation) is restored to good standing. LATS #21 ruling issued at Santa Anita Park on January 15, 2021, is set aside.

Penalty: Four-day suspension
Violation: Failed appeal to overturn prior careless riding ruling
Explainer: Official Ruling of the Board of Stewards Santa Anita Park Winter/ Spring Meet (Association) March 24, 2022 (Date) LATS Ruling #76 Having received notice of a Proposed Decision adopted by the California Horse Racing Board that the appeal of DMTD Ruling #45 (August 12, 2021) has been overruled, the original ruling is reinstated. Jockey Umberto Rispoli, is suspended for 4 racing days (April 1, 2, 3 and 8, 2022).

Track: Santa Anita
Date: 03/24/2022
Licensee: Ron McAnally, trainer
Penalty: Thirty-day suspension (all 30 days stayed)
Violation: Substance violation
Explainer: Having received notice of a Proposed Decision adopted by the California Horse Racing Board Trainer Ronald McAnally, who started Roses and Candy in the third race on November 22, 2020, at Del Mar Thoroughbred Club, is suspended for thirty (30) days pursuant to California Horse Racing Board Rule #1887(Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board rules #1843(a)(b)(d) (Medication, Drugs and Other Substances) and #1843.1(a)(Prohibited Drug Substances – 7- Carboxy – Cannabidiol). In accordance with the Proposed Decision, all thirty (30) suspension days are stayed and Ronald McAnally is placed on probation for one year from the date of this ruling and may not have any violation of Class I, II or III drug positives. If Ronald McAnally violates the terms of his probation, the 30 days of stayed suspension shall be imposed following a noticed  hearing. New York

Explainer: Having received a report from the NYS Gaming Commission Equine Drug Testing Laboratory of the finding of Phenylbutazone in the post-race blood sample taken from Horse “Pendolino”( #8 ) which finished first (1st) in the 4th race on February 4, 2022, and having waived his right to appeal, Owner/Trainer Mr. Eduardo Jones is suspended for seven calandar days effective March 27, 2022 through April 2, 2022 inclusive, and fined the sum of five hundred ($500.00) dollars. Furthermore, the Stewards order horse “Pendolino” disqualified from any part of the purse and the purse redistributed as follows:

Every horse is denied the privilages of the grounds and shall not participate in pari-mutuel racing in New York State, that (a) is owned or trained by you, or by any individuals who serves as your agent or employee during your suspension; or (b) for which you during your suspension are directly or indirectly with training, including any arrangements to care for, train, enter, race, invoice, collect fees or other payments, manage funds, employ or insure workers, provide advise or other information or otherwise assist with any aspect of the training of such horses.
