Weekly Stewards and Commissions Rulings, Apr. 11-17

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

New York

Track: Aqueduct
Date: 04/13/2023
Licensee: Dylan Davis, jockey
Penalty: Three-day suspension
Violation: Careless riding
Explainer: Jockey Mr. Dylan Davis is hereby suspended three (3) NYRA racing days. This for careless riding during the running of the 1st race at Aqueduct racetrack on April 6th 2023 having appealed a stay has been granted.

Track: Aqueduct
Date: 04/14/2023
Licensee: Jaime Torres, apprentice jockey
Penalty: Fourteen-day suspension
Violation: Careless riding
Explainer: For having waived your right to an appeal Jockey Mr. Jaime Torres is hereby suspended 14 NYRA racing days, April 20th, 21st ,22nd , 23rd , 27th, 28th ,29th ,30th 2023 through May 4th, 5th, 6th , 7th , 11th 12th 2023 inclusive. This for careless riding during the running of the second race at Aqueduct Racetrack on April 8th 2023.

Kentucky

Track: Keeneland
Date: 04/08/2023
Licensee: Aveory Faircloth, owner-trainer
Penalty: Sixty-day suspension, 30-days stayed due to good prior record
Violation: Possession of contraband
Explainer: After waiving his right to a formal hearing before the Board of Stewards Aveory Faircloth is hereby suspended 60 days for possession of contraband (needles, syringes and injectable medications) “by a person other than a veterinarian licensed to practice veterinary medicine” and discovered on the association grounds of Three Diamonds Training Center, a location under the jurisdiction of the Kentucky Horse Racing Commission. Due to mitigating circumstances (lack of violations in relation to length of license history), 30 days are to be served from April 11, 2023, through May 10, 2023 (inclusive). The remaining 30 days are stayed on the condition that no similar violation or Class A or Class B medication violation occurs in any racing jurisdiction within 365 days from the date of this ruling. During his suspension Mr. Faircloth is denied the privileges of all facilities under the jurisdiction of the Kentucky Horse Racing Commission. Entry of all horses owned or trained by Aveory Faircloth is denied pending transfer to persons acceptable to the stewards.

Track: Keeneland
Date: 04/12/2023
Licensee: Barbara Riley, owner-trainer
Penalty: $500 fine, horse disqualified, purse forfeited
Violation: Medication violation (for horse that ran at Turfway Park)
Explainer: Upon receipt of notification from The University of Kentucky Equine Analytical Chemistry Laboratory, the official testing laboratory for the Kentucky Horse Racing Commission, sample number R008025 taken from Future Victory, who finished second in the first race at Turfway Park on April 1, 2023 contained methocarbamol at a level of 7.98 ng/ml in blood (Class C drug). After waiving her right to a formal hearing before the Board of Stewards, Barbara J. Riley is hereby fined $500. Future Victory is disqualified and all purse money forfeited. Pari-mutuel wagering is not affected by this ruling. Upon receipt of this ruling, the licensee is required within thirty (30) days to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to a summary suspension of license pursuant to 810 KAR 3:020 Section 15 (cc).

California

Track: Santa Anita

Date: 02/03/2023

Licensee: Eoin Harty

Penalty: $3,000 fine

Violation: Out-of-competition joint injection violation

Explainer: Trainer Eoin Harty, who trains the horse El Joy, is fined $3,000.00 for violation of California Horse Racing Board rule #1866.3(c)(e) (Intra-articular Injections Restricted – treatment within 10 days of workout).

Harty told the TDN he will be appealing the ruling for various reasons, including for a career training record absent any prior medication violations (this is confirmed in the Thoroughbred Rulings website).

New York

Track: Aqueduct

Date: 02/02/2023

Licensee: Suzanne Zelman, racing official/official veterinarian

Penalty: $1,000 fine

Violation: Lasix administration violation

Explainer: You are hereby fined the sum of one thousand ($1,000) dollars for failing to tend to business in a proper manner necessitating the scratch of horse “Bustinupishardtodo” (# 8) from the eighth race at Aqueduct Racetrack on January 27th 2023.

According to New York Racing Association (NYRA) spokesperson Pat McKenna, the fine was for a failure to administer Lasix to the horse in question resulting in a mandatory scratch.

Kentucky

Track: Turfway Park

Date: 02/01/2023

Licensee: Eric Reed, trainer

Penalty: Five-day suspension, $1,000 fine

Violation: Medication violation

Explainer: Upon receipt of notification from The University of Kentucky Equine Analytical Chemistry Laboratory, the official testing laboratory for the Kentucky Horse Racing Commission, sample number R005087 taken from Golden Text, who finished first in the fourth race at Turfway Park on January 19, 2023 contained phenylbutazone at a level of 0.62 mcg/ml in blood (Class C) (2nd offense in 365 days). After waiving his right to a formal hearing before the Board of Stewards, Eric Reed is hereby suspended 5 days, February 10, 2023 through February 14, 2023 (inclusive) and fined $1,000.

Explainer: Owner Randy Rennon (dba Summer Knights Stables, Inc), having failed to comply with a Financial Agreement dated November 26, 2020, at Del Mar Race Track, is suspended for violation of California Horse Racing Board rule #1876 (Financial Responsibility – Farrier Kyle Baze $820.00). Suspension to commence on January 29, 2023.During the term of this suspension, all licenses and license privileges of Randy Rennon (dba Summer Knights Stables, Inc) are suspended and pursuant to California Horse Racing Board rule #1528 (Jurisdiction of Stewards), subject is denied access to all premises in this jurisdiction.

Date: 01/27/2023
Licensee: Rolando Quinonez, trainer
Penalty: $1,000 fine
Violation: Excessive use of whip during training hours
Explainer: Trainer Rolando Quinonez is fined $1,000.00 for violation of California Horse Racing Board rules #1874 (Disorderly Conduct – excessive use of riding crop during training) and #1530 (Cases Not Covered by Rules and Regulations) at San Luis Rey Training Center on September 14, 2022. Furthermore, Rolando Quinonez must be evaluated by the Winners Foundation for anger management and comply with any recommendations made by Winners Foundation.

Explainer: For having waived his right to an appeal Jockey Mr. Manuel Franco is hereby suspended for 3 NYRA racing days January 20th 2023, January 21st 2023, January 22nd 2023 inclusive. This for interference during the running of the seventh race at Aqueduct Racetrack on January 12th 2023 causing his horse ” Spiked” to be disqualified from first and placed third.

Explainer: Having received a report from the NYS Gaming Commission Drug Testing Laboratory of the finding of Phenylbutazone in the post-race sample taken from horse ” Eight and Sand ” (#10) which raced at Aqueduct racetrack in the 9th race and finished 1st on December 11th 2022. Trainer of record Ms. Michelle Giangiulio having been notified of the post-race findings and having waived her right to an appeal, is hereby fined the sum of one thousand ($1,000) dollars and suspended 10 Calendar days effective January 20th 2023, through January 29th 2023, inclusive. Furthermore, the Stewards order horse “Eight and Sand” disqualified from any part of the purse and the purse redistributed as follows:
