MSW Kudos Passes Away at Old Friends

Kudos, a MSW gelding, died on Wednesday, Jan. 4, 2023, at Old Friends Thoroughbred retirement farm in Georgetown, Ky., announced president and founder Michael Blowen.

The 26-year-old bay Thoroughbred (Kris S.–Souq, by Damascus) was found dead in his paddock during late-afternoon feeding. A reason for his death is unknown at this time. Necropsy results are pending to get an accurate cause of death. Bred and owned by longtime Old Friends supporters, Jerry and Ann Moss, Kudos was foaled in Kentucky on Apr. 17, 1997.

Trained by Richard Mandella his entire career, Kudos began racing in 1999, but did not win his first race until his eighth career start as a 4-year-old in a maiden special weight race at Santa Anita on Mar. 17, 2001. He then won his next three consecutive races, two allowance races and the Jim Murray Memorial H. at Hollywood Park for his first stakes victory.

In 2002, he won two more stakes races–the San Marino H. at Santa Anita, and the GI Oaklawn H., which was his first-graded stakes win and the biggest win of his career. In that race, he came back from 15 lengths to win by 4 3/4 lengths.

As a 6-year-old in 2003, he won the GII Californian S., while finishing second in the GII San Pasqual H., and third in the GI Santa Anita H., the GI Oaklawn H., the race he won the previous year, and the GI Hollywood Gold Cup, his final race.

Kudos retired with seven wins, five seconds, four thirds, and $1,238,935 in earnings in 24 career starts. In 2006, the Mosses donated Kudos to Old Friends for his retirement. He was the second horse they retired to Old Friends; the first was Ruhlmann.

“Kudos was one of our first stars and enchanted us for nearly 17 years,” said Blowen. “He was a great symbol of our growth. I can't thank Jerry and Ann and (racing manager) Dottie Ingordo-Shirreffs enough for allowing us to spend all this time with their treasure.”

Godolphin Tops Breeders Again

According to The Jockey Club Information Systems on Friday, once again, Godolphin led the individual breeders list in North America for 2022 with $18,621,521 in earnings. Topping the list in 2021, this time around they bred 189 starters with 150 wins, 125 seconds and 117 thirds out of 873 starts. Calumet Farm was second for the second consecutive year with earnings of $17,892,055 with 505 wins out of 3,666 starts.

Godolphin also commanded the breeders list that includes partners with $22,135,787 in earnings and 229 wins from 1,603 starts, with Calumet Farm in second with $18,150,644 in earnings and 517 wins out of 3,754 starts.

Rounding out the top 10 individual breeders were Stonestreet Thoroughbred Holdings LLC, $13,093,482 (151 wins / 845 starts); Brereton C. Jones, $9,451,302 (224/1,467); WinStar Farm, LLC, $9,375,196 (194/1,228); Kenneth L. Ramsey & Sarah K. Ramsey, $9,217,588 (197/1,559); Gary & Mary West Stables Inc., $8,237,678 (130/921); Spendthrift Farm LLC, $6,520,078 (130/825); Summer Wind Equine LLC, $5,421,032 (23/139); and Juddmonte Farms Inc., $5,104,858 (91/486).

Completing the list of the top 10 breeders including partnerships were Stonestreet Thoroughbred Holdings LLC, $13,845,485 (166 wins / 912 starts); WinStar Farm, LLC, $11,731,029 (269/1,718); Brereton C. Jones, $9,677,593 (232/1,535); Kenneth L. Ramsey, $9,530,194 (201/1,608); Sarah K. Fifth Circuit Rules No `Emergency’ Status in States Vs. HISA Case

The United States Fifth Circuit Court of Appeals ruled Thursday that it won't treat a request made by the Horseracing Integrity and Safety Act (HISA) Authority to vacate a recent panel opinion and reinstate a stay pending appeal as an “emergency” that requires an expedited decision.

The decision involves a lawsuit under appeal brought by the states of Louisiana and West Virginia, plus other “covered persons” under HISA, alleging unconstitutionality and federal rulemaking procedure violations.

(Note: An earlier version of this story misidentified the plaintiff in the case. The National Horsemen's Benevolent and Protective Association and its affiliates are not party to this decision; they are plaintiffs in a separate lawsuit. TDN regrets the error.)

Instead, the court ruled that the case would proceed under the court's standard timetable, which gives the NHBPA and its 12 affiliates 10 days to file a response to HISA's motion.

“The district court's order preliminarily enjoining enforcement in Louisiana and West Virginia of all then-existing rules promulgated under HISA directly undermines Congress's goal of providing for uniform regulations to protect horseracing participants (equine and human) and restore integrity to the sport nationwide,” the HISA filing from Jan. 3 stated.

“This Court appropriately stayed that order, finding that each of 'the stay elements are met' with respect to the district court's (manifestly flawed) conclusion that the Administrative Procedure Act forecloses the fourteen-day notice period the FTC formally provided…

“The stay pending appeal was necessary to 'allow [the Court] to bring 'considered judgment' to the matter before [it] and 'responsibly fulfill [its] role in the judicial process.' Yet the panel's subsequent decision to remand the case and lift the stay short-circuits that process, not based on the merits of the district court's order-which have never been adjudicated-but on the sole ground that a panel in a 'separate cases held that 'HISA is facially unconstitutional.'”

The HISA filing summed up: “This Court should vacate its panel opinion and judgment, and reinstate the Court's stay pending further adjudication of this appeal…. The Court should grant [a] panel rehearing and reverse the district court's grant of a preliminary injunction.”

MGSW Leinster Represented By First Foal

Leinster (Majestic Warrior), a multiple graded-stakes winning half-brother to MGISW Stormy Liberal (Stormy Atlantic) and third in the 2020 GI Breeders' Cup Turf Sprint, was represented by his first foal, a filly, Thurs. Jan. 5 at Pleasant Acres Stallions.

“Leinster was a great addition to the stallion barn at Pleasant Acres Stallions,” said breeder Helen Barbazon. “It's very exciting to see him produce such an exceptional filly in his first crop. We look forward to following this beautiful foal's career.”

Leinster will stand the 2023 season for $5,000.
