Rice Plans Court Appeal to Keep Training

The previously levied three-year license revocation and $50,000 fine against trainer Linda Rice went into effect  Monday, the New York State Gaming Commission (NYSGC) announced. According to published reports, Rice will request a temporary restraining order to try and get the revocation stayed pending a court review of the NYSGC's ruling.

On May 17, Rice had her training license revoked for a period of “no less than three years” and got fined $50,000 when NYSGC members voted 5-0 to agree with a hearing officer that Rice's  years-long pattern of seeking and obtaining confidential pre-entry information from New York Racing Association (NYRA) racing office workers was “intentional, serious and extensive, and that her actions constituted improper and corrupt conduct…inconsistent with and detrimental to the best interests of horse racing.”

Rice had testified during eight days of NYSGC hearings late in 2020 that she had handed over cash gifts amounting to thousands of dollars at a time to NYRA racing office employees between 2011 and 2015.

But the veteran conditioner, who has been training since 1987 and owns seven NYRA training titles, also testified that she did not expect any special favors in return for that money, and that any entry-related information she did receive from NYRA employees was a type of disclosure that was routinely divulged to other trainers.

Rice's lone trainee entered to race June 7 was scratched at Finger Lakes.

Ironically–considering the circumstances of Rice's case–that entrant was named Inside Info (Mission Impazible).

Rice's attorney, Andrew Turro, did not respond to TDN queries prior to deadline for this story. But he told The Blood-Horse that a stay will likely be filed in Schenectady Supreme Court and that she will fight the case until all of her legal avenues of appeal have been exhausted.

“We are very troubled by the commission's determination with respect to the racing office information issue because it is incorrect in a number of material respects,” Turro told The Blood-Horse. “We will seek judicial review of the order as soon as humanly possible and we expect to be heard in court this week on a stay application.”

Rice has six horses total entered to race at both Belmont Park and Finger Lakes later this week.

Drug Distributor Izhaki Avoids Prison Time

Sarah Izhaki, one of 27 individuals indicted in March 2020 for their role in a horse doping scheme, was sentenced Monday to time served plus three years of supervised release. U.S. District Judge Mary Kay Vyskocil could have sentenced Izhaki to a prison term of 12 to 18 months, but opted for the more lenient punishment due to extenuating circumstances that include Izhaki's poor health and what Vyskocil called a “troubled upbringing.” Two months after the indictments were announced, Izhaki attempted suicide.

During the first 12 months of her sentence, Izhaki will be confined to her home and subject to electronic monitoring.

Scott Robinson, who, like Izhaki, pled guilty to conspiring to unlawfully distribute adulterated and misbranded drugs for the purpose of doping racehorses, received a sentence of 18 months in federal prison in March.

“I want you to know how sorry and remorseful I am for the bad decisions I made,” Izhaki said through an interpreter.  Vyskocil noted that Izhaki spoke fluent English, so it was not clear why she chose to use an interpreter.

“I am very sorry for the bad decisions I made against the poor animals,” she continued. “If I could do it again, I would have made different decisions. I know that my being remorseful and being sorry is not enough. The only thing I can do now is to make the right decisions moving forward.”

In the initial indictments released last year, the government charged that Izhaki , along with her daughter, Ashley Lebowitz, was selling misbranded versions of Epogen, a drug that is used to boost a horse's red blood cell count in order to improve endurance during a race. They had allegedly obtained the drug from a Mexico-based drug manufacturing company. Lebowitz has yet to enter a plea.

While acknowledging that Izhaki had committed a serious offense, Vyskocil repeatedly referred to Izhaki's mental and physical problems.

“In light of all of these conditions the court has serious reservations about Ms. Izhaki's ability, frankly, to cope with imprisonment,” Vyskocil said.

According to the pre-sentence report submitted by her lawyers, Izhaki, who grew up in a strict orthodox Jewish household, has dealt with a number of physical and psychological problems throughout much of her life. She was born in 1974 in Mexico and was forced to enter into a pre-arranged marriage when she was 14 and she bore a child when she was 16. Izhaki has problems with her eyesight and became legally blind at the age of 14 and has had eight cornea transplant surgeries. During a 19-month period beginning May 23, 2019, she was involved in two major car accidents, which have required additional surgeries.

Vyskocil made it clear that anyone yet to be sentenced in the case should not look at Izhaki's sentence as a benchmark.

“I recognize that there are more cases pending and people may well be looking at what the court does today, paying attention to this case and viewing it as a benchmark, a bellwether for other horse doping cases and for the abuses in the industry in general,” she said. “I want to say on the record, if you are doing that, you are making a mistake. And I say that because in the court's view the circumstances in this case are somewhat unique, a one off, and unlike some of the other cases that are pending. The sentencing guidelines do not adequately account for certain factors that are unique to Ms. Izhaki and her circumstances, including her mental and emotional condition, her serious physical health condition, her difficult upbringing, her prompt, and I will say, complete acceptance of responsibility and remorse for her conduct.”

Woodbine To Open June 12

With news that the province of Ontario has entered Step One of the 'Roadmap to Reopen' plan earlier than anticipated, officials at the Woodbine Entertainment Group have announced that Thoroughbred racing will return to the track this Saturday, June 12, with first post set for 1:20 p.m. ET.

“While it has been a very frustrating period, I would like to thank the Government of Ontario for the recent attention it has given the horse racing industry,” said Jim Lawson, CEO, Woodbine Entertainment. “In particular, I would like to thank Premier Doug Ford for his understanding and interest in the plight of the horse racing industry that has been so greatly impacted by the global pandemic and ensuing government restrictions.”

Racing will continue Sunday, June 13, followed by racing Friday through Sunday, June 18-20 before picking up with a four-day week (Thursday-Sunday). Woodbine plans to card additional races over the first two weekends to make up for some of the lost race days.

There will be no fans in attendance per governmental restrictions.

“Although our industry has been substantially impacted, I do very much remain confident in the future of horse racing in Ontario and look forward to getting back on track later this week,” Lawson added. “On behalf of Woodbine Entertainment, thank you to our horse people for their patience, professionalism, and resiliency they continue to demonstrate, especially in face of adversity.”

Fasig-Tipton July Catalog Now Online

Fasig-Tipton has cataloged a total of 348 yearlings for The July Sale, to be held at the auction house's Newtown Paddocks in Lexington, Kentucky, in a single session Tuesday, July 13. The catalog is available for viewing online.

The front cover for the 2021 edition, which is back in its normal position on the calendar after being pushed back to September last year, is adorned with Grade I graduates of The July Sale, including Derby City Distaff heroine Bell's The One (Majesticperfection), recent GI Madison S. winner Kimari (Munnings) and Speech (Mr Speaker), victorious in the 2020 GI Ashland S. Five graded stakes winners from this season appara on the back cover, including Chess's Dream (Jess's Dream), Leinster (Majestic Warrior) and Mighty Mischief (Into Mischief). Just this past weekend, $55,000 July grad Lone Rock (Majestic Warrior) led home a Fasig-Tipton sourced trifecta in the GII Brooklyn S. on the GI Belmont S. undercard.

“Fasig-Tipton selected yearling sales return to their traditional spots on the calendar in 2021, starting with a strong renewal of The July Sale,” said Fasig-Tipton President Boyd Browning. “The sale will begin with the Freshman Sire Showcase–a long-time element of the July Sale that we are reintroducing this year–which will offer the first yearlings by 2021's exciting group of freshman sires. The sale will then transition into the more proven, sire-heavy part of the catalogue. Overall, our 'proven' sire-power has increased again this year.”

Fasig-Tipton is also accepting nominations for the July Selected Horses of Racing Age Sale, which takes place Monday, July 12. Nominations will remain open right up until sale time, but entries are recommended prior to June 18.

“The market for racehorses is very strong right now, and the sale's placement ahead of the lucrative summer race meets make this auction immensely popular with buyers,” Browning noted.

The catalog will also be available via the Equineline catalog app. Print copies will be available beginning June 14.
