Santa Anita's popular Runhappy Santa Anita Derby Day 5K Run & Walk returns following a two-year absence on Derby Day, Saturday, Apr. 9, with 5K post time at 8 a.m.

Deferred for the last two years due to COVID-19 restrictions, the Derby Day 5K has long been a springtime happening for participants ranging in ages from five years to 90-plus years of age.

“We are thrilled that the Runhappy Santa Anita Derby Day 5K Walk and Run is back, after two years due to the pandemic,” said Pete Siberell, Santa Anita's Director of Community Services and Special Projects. “For many thousands of people, this has been a Derby Day tradition since 1994.

“We are anticipating we'll have between 4,500 and 5,000 people either running or walking the 3.1 mile course, which ends with a lot of excitement on the inner training track. The race is a joint partnership between four iconic Arcadia entities, including not only Santa Anita Park, but the beautiful 127-acre LA County Arboretum and our two primary sponsors, Westfield Santa Anita and Methodist Hospital of Southern California.

“We also want to thank the City of Arcadia, which is providing police and fire staffing to help ensure the safety of everyone involved.”

Seven Supplemented To Triple Crown Series

Seven 3-year-olds, headed by recent G2 UAE Derby runner-up Summer Is Tomorrow (Summer Front), have been supplemented to the 2022 Triple Crown series for a fee of $6,000 prior to the late closing date this past Monday, Mar. 28.

Owned by Michael and Negar Burke, Summer Is Tomorrow is a two-time winner from seven starts in Dubai, having won a Feb. 25 allowance by 8 1/4 lengths going seven furlongs prior to his effort in the UAE Derby, in which he set the pace and was run down late by Japan's GI Kentucky Derby hopeful Crown Pride (Jpn) (Reach the Crown {Jpn}). The bay, trained by Bhupat Seemar, earned $200,000 and 40 Kentucky Derby points for the effort.

Azure Coast (Street Sense), who came from the clouds to win the G3 UAE 2000 Guineas at Meydan Feb. 11, has also been supplemented by owner Vladimir Kazakov and trainer Pavel Vashchenko. A distant ninth behind Summer Is Tomorrow in the UAE Derby, Azure Coast has yet to amass any Derby points.

The other late Triple Crown nominees include Bye Bye Bobby (Quality Road), second in Sunday's GIII Sunland Derby; O Captain (Carpe Diem), third in the GII Fasig-Tipton Fountain of Youth S.; Shake Em Loose (Shakin It Up), winner of Laurel's Private Terms S.; recent Gulfstream allowance winner Skippylongstocking (Exaggerator); and Win the Day (Midshipman), who graduated at third asking in his dirt debut going a mile at Santa Anita Mar. 6.

The seven supplements take the number of 2022 Triple Crown nominees to 321. Any horse that has yet to be nominated at the first two stages can become Triple Crown eligible through supplemental payments made at the time of entry for the GI Kentucky Derby ($200,000), GI Preakness S. ($150,000) and GI Belmont S. ($50,000).

CDI: Baffert’s Derby Lawsuit a ‘Manufactured Emergency’

The gaming corporation that owns Churchill Downs told a federal judge in a late-night Tuesday court filing that Bob Baffert's lawsuit to try and get his private-property banishment and exclusion from the GI Kentucky Derby lifted would not only harm the corporation's portfolio of tracks, but would hurt the owners and trainers of other horses who have rightfully earned Derby berths but would be precluded from entering if the court rules they had to be pushed off the qualifying list to make room for the barred trainer.

“This lawsuit is Bob Baffert's latest attempt to evade responsibility for his wrongdoing,” stated the Mar. 29 filing by Churchill Downs Incorporated (CDI), in United States District Court (Western District of Kentucky).

“Baffert could have filed this lawsuit ten months ago,” the filing continued. “Instead, his lawyers spent the time working the press and trying without success to persuade other courts and tribunals of Baffert's innocence. They only came to this Court after all their other gambits and legal maneuvers failed.

“They are now rushing into this Court with the 2022 Derby just over a month away, demanding an expedited preliminary injunction on the basis of a manufactured emergency in hopes of litigating Baffert's way into the race.”

Baffert had sued CDI Feb. 28 in an attempt to get an injunction enjoining CDI from suspending him from its tracks and races, and prohibiting Baffert and/or any horse trained directly or indirectly by him from earning points, qualifying and entering the Derby in 2022 and 2023.

Baffert has since transferred four Derby aspirants to other trainers, and he is simultaneously fighting an under-appeal Kentucky Horse Racing Commission suspension of 90 days that is set to start Apr. 4 because of a betamethasone positive in Medina Spirit, his now-deceased 2021 Derby winner.

“There is no legal precedent, in more than a century of Kentucky and federal law, for what would amount to a judicial takeover of the Derby—an eleventh-hour edict forcing CDI to accept a trainer whose conduct threatens the safety and integrity of the race,” CDI's filing stated, explaining how Baffert has failed to meet any of the three requirements for relief.

“First, Baffert has not shown he will suffer irreparable harm absent an injunction,” the filing stated. “His tactical, ten-month delay negates any claim of irreparable harm. His primary alleged harm—the loss of purse money—is speculative and would be fully compensable by money damages in any event.

“Nor will he lose his client base or suffer a loss of goodwill absent relief. Since his CDI suspension began, he has run horses in hundreds of races around the world at virtually the same frequency he did prior to the suspension. Although he claims some horses have been transferred from his care, he provides no evidence that these transfers resulted from CDI's suspension, rather than from the suspension imposed by the KHRC or another state racing authority…

“Second, Baffert has failed to establish a likelihood of success on the merits. His due process claim fails because CDI is a private corporation, the individual defendants are not government officials, and no one violated Baffert's rights in any event,” the filing continued.

“Baffert's claim for “wrongful exclusion” fails because CDI has a well-settled common law and contractual right to exclude from its property and its races repeat offenders like Baffert who endanger the safety of horses and jockeys, and threaten the integrity of the sport and CDI's signature events. And his antitrust claim fails because he does not allege, let alone establish, basic elements of Sherman Act liability.

“Third, the equities cut strongly in CDI's favor. An injunction would cause substantial harm to CDI, including to its business interests, brand, and customer goodwill, and would injure the owners and trainers who would lose their fairly-earned berths in the Derby to make room for Baffert,” the filing stated.

“An injunction would also undermine the strong public interest in ensuring that all who attend, watch, or bet on horse races have confidence in the safety and integrity of the sport. For all these reasons, this Court should deny Baffert's motion for a preliminary injunction. Defendants will soon file a motion to dismiss this lawsuit in its entirety.”

Faucheux, Graham, Brittlyn Lock Up Fair Grounds Titles

Ron Faucheux, James Graham and Evelyn Benoit's Brittlyn Stable locked up titles for leading trainer, jockey and owner, respectively, at the Fair Grounds, where the 2021-2022 meeting concluded Sunday, Mar. 27.

A native of Louisiana, Faucheux won his second consecutive training championship at the New Orleans oval, sending out 43 winners, a total 10 greater than Eclipse Award winner Brad Cox. Faucheux won three stakes at the meet.

James Graham won 72 races during the meeting to reign as champion jockey for the third straight season and fourth overall. Among the highlights of the season were the 27-1 upset of Call Me Midnight (Midnight Lute) in the GIII Lecomte S. in January. Mitchell Murrill, who rode his 1,000th career winner in February, brought up a total of 62 winners to fill second spot.

Benoit's Brittlyn Stables was represented by no fewer than 22 winners at the meet at a win rate of 33%, all–remarkably–sired by Star Guitar. It was the first leading owner title for Brittlyn. Chester Thomas's Allied Racing Stable was second with 14 victories.

The destruction caused by Hurricane Ida (late August/early September) offered plenty of challenges for racing officials, but , as the effects of the COVID-19 pandemic, business was solid due to the tremendous support from both horseman and bettors alike.

“The damage to the barn area, parts of the facility and the loss of the infield tote board due to Hurricane Ida leading into our meet caused some challenges, but we are New Orleans, and we are resilient,” Fair Grounds Senior Director of Racing Jason Boulet said.

“We are extremely proud of everyone who came together to put out a great product on a day-in, day-out basis and as always, we are extremely grateful to the horseman for their continued support throughout the meet. The return of the fans after a difficult, prolonged stretch with the COVID-19 pandemic brought renewed energy to the racetrack, and we look forward to what should be a very special 2022-23 season.”
