Weekly Stewards and Commissions Rulings, June 6-12

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

The TDN will also post a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from the same week. These will include decisions from around the country.

California

Track: Santa Anita

Date: 06/09/2023

Licensee: Kent Desormeaux, jockey

Penalty: Probation during remainder of license period, per terms and conditions

Violation: Disorderly conduct, failure to report

Explainer: Jockey Kent Desormeaux, having entered into a Settlement Agreement and Mutual Release with the California Horse Racing Board (CHRB) for violation of CHRB rules 1874 (Disorderly Conduct) and 1680 (Jockeys and Drivers to Report) on March 31, 2023, at Santa Anita Park, is placed on probation for the remainder of his license period, subject to the following terms and conditions of probation: He is placed on a testing agreement with the following conditions: (a) He will be tested by a CHRB investigator before entering the racetrack to exercise a horse or participate in a race. (b) On scheduled race days, he will report to the CHRB investigative office no later than 1.5 hours before the scheduled post time. (c) In the event CHRB investigators obtain a PAS reading detecting the presence of alcohol (Anything greater than 0.00) his license will be summarily suspended until a noticed hearing before a Board of Stewards is held and a ruling is issued. (d) Upon renewal of his Jockey license, a testing agreement will be part of his next license period.

Penalty: Fourteen-day suspension, $2,000 fine

Violation: Medication violation

Explainer: Mr. Todd Pletcher, as responsible trainer under 9 NYCRR 4043.4 (a),violated Commission rules in that Mr. Todd Pletcher trained horse ” Capensis “, that finished 6th in the 10th race at Saratoga racecourse on July 30th 2022, and having received a report from the New York Drug Testing and Research program that a race-day sample taken from the horse ” Capensis ” had the substance Phenylbutazone present at a concentration, including an assessment of the measurement uncertainty and imprecision of the quantitative threshold, in excess of 0.3 mcg/ml in plasma in violation of 9 NYCRR 4043.3 (a) (26).Trainer Mr. Todd Pletcher is hereby fined the sum of two thousand ($2,000) dollars and suspended fourteen Calandar days having appealed a stay has been granted.

Furthermore, ” Capensis ” is disqualified from any part of the purse and the Stewards order the purse redistributed as follows.

Pletcher Hit With Suspension for Bute Positive

The New York Gaming Commission has suspended Hall of Fame trainer Todd Pletcher 14 days and fined him $2,000 after a horse he trained tested positive for the non-steroidal anti-inflammatory phenylbutazone during a 2022 race at Saratoga.

Via text message, Pletcher said he is appealing the penalty. He declined to comment further.

The Paulick Report was first with the story.

The horse in question, Capensis (Tapit), was the even-money favorite in the 10th race at Saratoga on July 30, 2022 and finished sixth. He is owned by Eclipse Thoroughbred Partners, Robert LaPenta, Gainesway Stable, Winchell Thoroughbreds LLC and Stonestreet Stables LLC. He has not run since winning the Sept. 6, 2022 GIII Virginia Derby. A gray colt, he sold for $2 million at the 2020 Keeneland September sale.

The ruling, which was posted to the Gaming Commission's website on Sunday , states that phenylbutazone was present at a concentration in excess of 0.3 micrograms per milliliter in violation of 9 NYCRR 4043.3 (a) (26).

Pletcher is also dealing with another suspension handed down by New York regulators. He was fined $1,000 and suspended 10 days after tests revealed that his trainee Forte (Violence) tested positive for Meloxicam following his win in the GI Hopeful S. last summer at Saratoga. Pletcher has appealed that suspension, as well.

In addition, Pletcher is facing two possible violations in Florida, where, according to Florida Gaming Control Commission Division of Pari-Mutuel Wagering records posted online, he had a Class IV and Class V drug positive in December. According to reports, the Pletcher-trained Mind Control (Stay Thirsty) tested positive following the Sept. 24 Parx Dirt Mile, in which he was initially awarded the victory through disqualification. That case is also pending.

Asked why the New York case was just now coming to light, Brad Maione, the Director of Communications for the New York Gaming Commission said the following in an email to the TDN.

“By practice and procedure, when there is a possible rule infraction or violation, the Stewards set a time to meet, providing an affected party the informal opportunity address the matter. Following the meeting, the Stewards collectively evaluate potential rule infractions and, if appropriate, the State Steward will issue a ruling.

“Changes to the split-sample procedures have been instituted to reduce the ability of an affected party to game the system. Absent extraordinary circumstances, a trainer advised of a positive drug violation will now be afforded no more than two-weeks to identify and make arrangements for the split-sample to be tested…

Finally, you should be aware that the procedural processing of split-samples has remained constant since initiation. The Commission does not announce medication infractions until considered by the judges or stewards. As of Friday morning, there were three Thoroughbred and two Standardbred split-samples outstanding at a qualified, accredited independent laboratories. The Commission is awaiting return of their findings.”

Team Arcangelo Enjoying Belmont Victory

The team around Arcangelo (Arrogate) was still basking in the glory of his GI Belmont S. victory Sunday morning, even as trainer Jena Antonucci admitted no future plans had been mapped out for the gray colt who was taking a power nap nearby.

“There is zero idea,” Antonucci said of a potential next start for Arcangelo. “We know what the calendar is and what's where, so we'll let him come out of this and tell us. [The Aug. 26 GI Travers] is on our radar, but the stakes schedule is there and if it's seven weeks until we run or 11 weeks until we run, we'll just back into it.”

Antonucci, who won her first Grade I and became the first woman to train a winner of a Triple Crown event, said she is still processing the scale of the accomplishment 12 hours later.

“Everything is still a little bit numb on some levels and I'm just trying to sort everything out,” Antonucci said. “I'm just grateful and appreciative of what he did for us yesterday and it's pretty cool.”

Arcangelo was a little more subdued than his trainer Sunday morning.

“He's taking a nap and that's normal for him,” said Antonucci. “He's a hard sleeper.”

The Travers is the likely summer target for Belmont runner-up Forte (Violence), as well as stablemate Tapit Trice (Tapit), who was third on Saturday. Trainer Todd Pletcher said the July 22 GI Haskell S. or July 29 GII Jim Dandy S. would be considered as prep races for both sophomores.

“I think both races would be possible with both horses targeting the Travers, just deciding what we're going to do leading up to the Travers,” Pletcher said. “We'll just give it a couple weeks, see how they come out of it, how they're training and go from there.”
