Australian Trainer Blames Caffeine Positive On Coffee Spill

Australian trainer Nick Smart has blamed a coffee spill for one of his horses testing positive for caffeine, reports racing.com.

Smart trainee Mr Coyne was found to have the prohibited substance in his system after running second in the Ecycle Solutions BM120 Steeplechase at Ballarat on Aug. 23 last year.

“It was a real mystery to us. When we looked into it, and it sounds silly, but our coffee set-up is right near the feed room,” Smart said. “It was right at the feed door with the coffee and everyone used to make their coffee every day. So I put it down to someone has spilt something in a bucket and it went like that.”

The Victoria Racing Tribunal has not yet set a date for Smart's case.

Colorado Horsemen’s Association To Appoint New Officers And Directors Tuesday

The Colorado Horsemen's Association's Board of Directors will appoint a new president, vice president, and up to four new directors at its regular monthly meeting set for Tuesday at 11 a.m. MT.

The new officers and directors will fill seats vacated by the previous president, vice president, and two additional directors, all of whom resigned last week. Per article 5.2 of CHA bylaws, “Should a director resign, he may be replaced until the next election by a majority vote of the Board of Directors.” The next regular election will occur later this year.

CHA voting members interested in serving on the Board are invited to submit a letter of interest to any current Board member in advance of Tuesday's meeting. A voting member is defined in the bylaws as a licensed trainer with at least one active racehorse currently in their care or any licensed owner. A voting member must be a resident of Colorado to be considered for Board or officer appointments. The current Board members are Victor Cervantes, Kerry Kemper, Kim Oliver, Miguel Pena, and Mark Schultz.

Tuesday's meeting will be held remotely via Zoom and is open to any interested party. A link and passcode will be posted Tuesday morning on the private Facebook group, “Horsemen of Arapahoe Park,” and is also available upon request by e-mailing ColoradoHorseRacing@gmail.com.

Judge Delays Ruling On Baffert’s Lawsuit Against NYRA

Judge Carol Bagley Amon declined to render a verdict during Monday's hearing in trainer Bob Baffert's civil case against the New York Racing Association, according to bloodhorse.com. Instead, the U.S. District Court Eastern District of New York judge plans to consider attorney statements from both sides before issuing her ruling at a later, unspecified date.

Baffert filed suit against NYRA on June 14, nearly a month after the racing association notified the Hall of Fame trainer that he was temporarily banned from racing or stabling at NYRA tracks while the Kentucky Horse Racing Commission conducts its investigation into the post-race drug positive for Baffert-trained Medina Spirit, who crossed the finish line first in the May 1 Kentucky Derby. Baffert is seeking a temporary and permanent injunction against the ban.

As defendant in the case, NYRA filed a memorandum of law on June 30 in opposition to Baffert's motion for preliminary injunction. The Jockey Club filed a brief on that same date as amicus curiae, or friend of the court, claiming that its role as keeper of the Stud Book gives it a “unique interest in ensuring that when Thoroughbreds enter the breeding shed (where they determine the future of the breed through progeny), they do so with records uninfluenced by the effects of medication.”

On July 7, attorneys for Baffert filed their own memorandum of law, which consisted of 434 pages and included an affidavit from the trainer. In the memo, Baffert's attorneys allege that NYRA has “vindictively” targeted the trainer utilizing “hypocrisy” and “backdoor” tactics. The filing also zeroes in on two legal arguments: that the ban violates the trainer's right to due process, and that NYRA has no authority to issue a ban.

Thoroughbred Horsemen’s Association To Host Compounded Medications Webinar Monday

The Thoroughbred Horsemen's Association will host an online Continuing Education webinar on “Compounded Medications: What Trainers Need to Know” today, Monday, July 12, from 2-3 p.m. ET. Trainers and assistant trainers who participate will earn one (1) hour of CE credit toward the annual CE requirement. In addition, the webinar will be recorded and posted on the new continuing education website for trainers and assistant trainers, www.HorsemenU.com.

The presentation will feature Dr. Dionne Benson, Chief Veterinary Officer at The Stronach Group Racing and Gaming. Compounded substances are an area of concern for trainers interested in ensuring horse health and avoiding potential regulatory issues. While the use of compounded substances has a place in proper horse care, often they are overused, which increases the risk to horses and trainers alike. This CE will teach trainers the differences between compounded, generic and label medications. Additionally, the potential risks of using compounded medication will be covered.

She practiced law as a commercial litigator for a number of years prior to enrolling in vet school, and was a Law School faculty member while attending veterinary school.
