CHRB Issues Complaint Against Richard Baltas

Between April 15 and May 8 this year, 23 horses trained by Richard Baltas were allegedly administered a substance on race-day in violation of the California Horse Racing Board's (CHRB) rules, according to a complaint dated Tuesday, June 21.

The complaint states that surveillance video caught Baltas's employees allegedly administering the substance on the days they were entered to race.

In California, trainers face tight restrictions about what medications and supplements can be given to a horse within 48 hours of a race.

Baltas has been ordered to appear at a hearing at Los Alamitos before the board of stewards on July 1.

“Between the dates of 4/15/2022 to 5/8/2022, 23 horses trained by RICHARD BALTAS were administered a substance on days they were entered into races. Surveillance video captured all administrations by employees of BALTAS's barn. The substance was analyzed by University of California, Davis, who reported the presence of Higenamine and Paenol,” the complaint states.

According to the United States Anti-Doping Agency (USADA), Higenamine is a chemical found in a variety of plants, and can act as an anti-asthmatic to open up airways.

According to USADA, higenamine is becoming more commonly found in dietary supplements for athletes. Paenol is also a plant extract.

Neither are specifically classified by the Association for Racetrack Commissioners International (ARCI) uniform classification guidelines.

TDN reached out to both the CHRB and to Baltas's attorney, Darrell Vienna. Both declined to comment on an open investigation.

A CHRB investigation had been ongoing since May 8, when the Baltas-trained Noble Perfection was a late scratch from the 10th race at Santa Anita.

At the same time, 1/ST Racing, which operates Santa Anita, banned the trainer from running and working horses at 1/ST-owned facilities. On May 7, the Baltas-trained Speedcuber suffered a sesamoid injury. Two days later, Speedcuber was euthanized.

“We are conducting an investigation into matters concerning trainer Richard Baltas,” 1/ST CEO, Aidan Butler, explained via text message at the time. “Pending completion of that investigation and any final decision based on the results, horses trained by Mr. Baltas are not permitted to enter races at 1/ST Racing venues nor engage in timed works.”

1/ST's prohibition currently remains in place.

According to the complaint, Baltas has similarly been charged with violating rule 1887 (a)—the absolute insurer rule—a total of 23 times.

“The trainer is the absolute insurer of and responsible for the condition of the horses entered in a race, regardless of the acts of third parties, except as otherwise provided in this article. If the chemical or other analysis of urine or blood test samples or other tests, prove positive showing the presence of any prohibited drug substance defined in Rule 1843.1 of this division, the trainer of the horse may be fined, his/her license suspended or revoked, or be ruled off,” the rule states.

“In addition, the owner of the horse, foreman in charge of the horse, groom, and any other person shown to have had the care or attendance of the horse, may be fined, his/her license suspended, revoked, or be ruled off.  The owner of a ship-in horse is the joint-absolute insurer of and is equally responsible for the condition of the horse entered in a race,” the rule adds.

Baltas likely faces a potential suspension or fine. In July of 2019, trainer Bill Morey received a 45-day suspension after two horses in his Santa Anita stable were illegally administered a supplement on race-day.

Ortiz Hit With 5-Day Careless Riding Ban at Royal Ascot

Jockey Irad Ortiz Jr. Was handed a five-day suspension Wednesday by the Royal Ascot stewards for his ride aboard Love Reigns (Ire) (US Navy Flag) in the GII Queen Mary S. earlier in the day. According to the Ascot Stewards' Report posted on the British Horseracing Authority's website, Ortiz allowed his mount “to drift left-handed without sufficient correction.” The incident occurred a sixteenth of a mile into the race when Ortiz allowed the Wesley Ward-trained filly to drift, impeding three others.  The stewards' report noted that Omniqueen (GB) (Tasleet) {GB}) got the worst of it and that her jockey Leigh Francis Roche was nearly unseated.

Ortiz is set to serve the days from June 29 to July 3. Barring a successful appeal, the suspension could keep him from riding Life Is Good in the July 3 GII John A. Nerud S. Love Reigns finished fourth. It's been a tough two days at Royal Ascot for Ortiz when Golden Pal (Uncle Mo) broke poorly in the G1 King's Stand S. before finishing last. Afterward, Ortiz revealed he was looking at the withdrawn Mondammej (GB) (Lope De Vega {Ire}) when the gates opened.

Cox Suspended 10 Days for Bute Overage in ’21 Foster S.

Trainer Brad Cox has been suspended 10 days and fined $500 by the Churchill Downs stewards for a phenylbutazone overage detected in the runner-up of the 2021 GII Stephen Foster S.

According to a ruling dated May 15 and posted to the Kentucky Horse Racing Commission (KHRC) website Tuesday, the Class C positive was present in the post-race testing of MGSW Warrior's Charge (Munnings) at a level of 2.51 micrograms per milliliter of blood when he ran second at 7-1 in last year's edition of the Foster.

Cox's suspension is to run May 23-June 1. Warrior's Charge has been disqualified and the purse money is to be redistributed.

TDN phoned Cox to get his side of the story and to ask whether he'd be appealing. He responded via text message.

“We were completely shocked with these lab results,” Cox wrote. “Due to the fact that this medication was administered within the strict guidelines that are set in place. Having said that, while we disagree with the results, I have to own it and accept responsibility. Moving forward, I am committed to industry leading protocols which hopefully prevent this from happening again.”

Asked what arrangements, if any, are in the works for transferring his horses during his suspension, Cox wrote, “No transfers at this time.”

Phenylbutazone, also called Bute, is a non-steroidal anti-inflammatory drug. Kentucky's racing rules permit it on race day in concentrations at or less than three-tenths (0.3) micrograms per milliliter.
According to the ruling, Cox waived his right to a formal stewards' hearing, as did the horse's owners, Marshall Gramm and Sol Kumin.

The KHRC classifies drugs on an A (most severe) to D (least severe) scale.

Both the owner and trainer penalties are in line with Kentucky's recommended sanctioning guidelines for a Class C first offense, which call for up to a 10-day suspension (absent mitigating circumstances) for trainers and the disqualification and purse forfeiture for the owners.

Vermeulen’s Appeal Denied, Ban Goes Into Effect

Trainer Fabrice Vermeulen's appeal was denied by a judge in the administrative court of Amiens and his six-month suspension began on Thursday, the Jour de Galop reported on Friday evening. The trainer was attempting to deny the decision of the France Galop appeals committee, who handed down a six-month ban for alleged ownership record falsifications. As a result, Vermeulen's six-month suspension, of which three months was suspended for five years, started on Thursday, Apr. 28 and will last through Thursday, July 28, 2022. Final declarations from Vermeulen's yard will be invalidated. Pretty Tiger (Ire) (Sea The Moon {Ger}), a multiple group winner, has been transferred to Pia and Joakim Brandt and is due to start in the G1 Prix Ganay on Sunday.
