Kygo, One Republic To Headline ’23 Pegasus World Cup

Belinda Stronach, Chairwoman, CEO and President, 1/ST, and David Grutman's Groot Hospitality announced a multi-year partnership, beginning with the upcoming 2023 Pegasus World Cup Presented by Baccarat Saturday, Jan. 28 at Gulfstream Park.

Highlighting this year's event are post-race performances by Kygo and OneRepublic.

Offering a trackside takeover of Gulfstream's Carousel Club, LIV with Palm Tree Crew will curate top-tier entertainment, celebrities, VIP hospitality and programming. Texas Federal Judge Won’t Grant Briefing Stay to HISA

Facing a United States Court of Appeals decision from the Fifth Circuit that the Horseracing Integrity and Safety Act (HISA) is unconstitutional and battling three similar lawsuits in various stages within the federal court system, the HISA Authority and the Federal Trade Commission (FTC) were informed Monday that a U.S. District Court judge in Texas won't grant those defendants a requested stay that would halt the briefing schedule in that case pending a final resolution of the Fifth Circuit order.

“No Good Cause Exists to Stay This Action,” wrote U.S. District Judge Matthew Kacsmaryk (Northern District of Texas, Amarillo Division) in his Dec. 12 order. “This is not one of the 'rare' circumstances in which Plaintiffs should be compelled to stand aside while Defendants litigate another case. Defendants make no showing of 'hardship or inequity' in complying with the briefing schedule they previously agreed to. Defendants were already aware of the then-pending appeal in [the Fifth Circuit] when they agreed to the schedule.

“The Court recognizes that the Fifth Circuit's decision [declaring HISA unconstitutional] could moot this challenge or clarify some of the issues,” the judge continued. “But Plaintiffs advance seven distinct constitutional challenges to HISA-including the nondelegation doctrine. Plaintiffs argue HISA violates the doctrine on three alternate bases. [The Fifth Circuit decision] considered only one of those bases. Thus, the Court does not anticipate that the final resolution of [the Fifth Circuit decision] will necessarily clarify the issues in this case by much.

“Additionally, Defendants are considering whether they will petition for a writ of certiorari before the Supreme Court. Hence, it could be months or even years before [the Fifth Circuit decision] reaches finality. Until then, a stay could unfairly harm Plaintiffs because [that order] only binds the parties in that case,” the judge wrote.

The judge did, however, give the HISA Authority 60 days of extra time by mandating a revised briefing schedule that now calls for the HISA and FTC defendants to file their combined responses to the plaintiffs' motion for summary judgment on or before Mar. 6, 2023, which in effect grants the defendants' motion in part.

The plaintiffs in the case are Global Gaming LSP, a limited liability company that owns Lone Star Park; Gulf Coast Racing LLC, the owner of a greyhound track in Nueces County, and both LRP Group Ltd. and Valle De Los Tesoros, which are two limited partnerships separately looking to operate new horse tracks in south Texas. They collectively filed their suit July 29, seeking declaratory and injunctive relief and a preliminary injunction against HISA.

The Fifth Circuit suit was initiated by the National Horsemen's Benevolent and Protective Association (NHPBA) back in 2021. That case was dismissed by a federal judge Mar. 31, 2022, but the Fifth Circuit reversed that decision Nov. 18.

That NHBPA lawsuit is separate from a similar 2021 anti-HISA complaint, again over alleged constitutional issues, headed by racing commissions and attorneys general in Oklahoma and West Virginia. That case, too, was dismissed by a federal judge on June 3, 2022, but the plaintiffs appealed the decision to the Sixth Circuit, which heard arguments on reversing that decision Dec. 7.

A fourth lawsuit, in which both HISA and the FTC are defendants in a complaint initiated by the states of Louisiana and West Virginia, plus the Jockeys' Guild, alleges unconstitutionality and federal rulemaking procedure violations regarding HISA's initial framework of regulations that went into effect July 1. According to the electronic court docket, there has been no filing activity in that case since Sept. 7.

Class of 2017: Grading the Rising Stars

Each year, the team at the TDN designates horses early in their career who display enough promise to become an eventual graded-stakes winner. In 2017, a total of 80 horses racing on North American soil received the honor, but how many actually went on to achieve success?

The class is led by the achievements of its lone Eclipse Award winner, 2020 champion turf female Rushing Fall (More Than Ready). A 2-year-old in 2017, the half-sister to SW & MGSP Milam (Street Sense) earned her tag with a half-length defeat of fellow 2017 'Rising Star' classmate Daddy Is A Legend (Scat Daddy) at Belmont Park. Two starts later she would take the GI Breeders' Cup Juvenile Fillies Turf and take the second-most votes behind Caledonia Road (Quality Road) to be champion 2-year-old filly. Rushing Fall raced only four time as a 3-year-old but earned 3 wins and a second, capping her season off with a score in the GI Queen Elizabeth II Challenge Cup S. She added two more wins at the highest level as a 4-year-old in 2019 before retiring as a 5-year-old with an impressive final record of 15-11-3-0, six of those being grade ones in four consecutive years, and earnings of $2,893,000. Rushing Fall was purchased by M.V Magnier's Coolmore connections for $5.5 million out of the 2020 Fasig-Tipton Night of the Stars sale.

The most successful colt of the 2017 'Rising Star' class, Mckinzie (Street Sense) didn't debut until late in his 2-year-old year, taking a maiden special weight event at Santa Anita in late October before immediately making an impact with a win via disqualification over future MGISP Solomini (Curlin) in the GI Los Alamitos Cash Call Futurity. Though he missed the Triple Crown series as a 3-year-old, McKinzie returned in the fall of 2018 to take the GI Pennsylvania Derby and would finish the year with a win in the GI Malibu S. He would put up one more grade-one win in the 2019 Whitney S. before finishing his career in the fall of 2020 with a record of 18-8-6-0 and earnings of $3,473,360. McKinzie now stands at Gainesway and had his first weanling sell at this year's Keeneland November Sale.

Four more members of the class won multiple times at the grade-one level: Paradise Woods (Union Rags), current WinStar Farm stallion Yoshida (Jpn) (Heart's Cry {Jpn}), Separationofpowers (Candy Ride {Arg}), and Moonshine Memories (Malibu Moon). Six other 'Rising Stars' of 2017 would go on to win once against grade-one company: Battle of Midway (Smart Strike), current Hill 'n' Dale Farms stallion Army Mule (Friesan Fire), Pavel (Creative Cause), Lady Ivanka (Tiz Wondeful), Mia Mischief (Into Mischief), and Sporting Chance (Tiznow).

Several notable horses, while not grade-one winners, would place at the level multiple times. Perhaps most notably is 2018 Canadian Horse of the Year and 2017 Canadian champion 2-year-old Wonder Gadot (Medaglia d'Oro) who took both the Queen's Plate S. and the Prince of Wales S. as part of the Canadian Triple Crown following a second-place finish to dual Eclipse Award winner Monomoy Girl (Tapizar) in the GI Longines Kentucky Oaks. She would be purchased for $2,000,000 by Japan's KI Farm at the 2020 Fasig-Tipton Night of the Stars Sale.

The aforementioned Daddy Is A Legend would hit the board twice in grade-one company behind both Rushing Fall and 2019 champion turf female Uni (GB) (More Than Ready).

There were 16 'Rising Stars' in 2017 who would go on to achieve success in grade two or three events–led by millionaire and current Spendthrift Farm stallion Coal Front (Stay Thirsty).

In total, 28/80 horses who received the 'Rising Star' honor in 2017 would win a graded-stakes race, or 35%. By including those horses that placed in graded events, that number jumps to 49/80, of 61%. An additional nine horses would win at the stakes level and five would be stakes placed. Of the 80, only 17 failed to earn black type in their careers.

Twelve Days a Racing: Jared Shoemaker Pipes Up

Jared Shoemaker, co-managing partner of Pocket Aces Racing, grew up in Lexington and fondly remembers going to Keeneland with his extended family from the time he could walk. It was one of his favorite things to do as a child.

By the time he was in high school, he admits to spending a lot of afternoons at the track while supposedly in class. Not one to miss a good day of racing–no matter the reason–he scheduled all of his lectures at the University of Kentucky to be done by noon so he could get to Keeneland by first post.

Shoemaker has spent the last 27 years in northeastern Kentucky, where his wife is from. He invested about 10 years working in college athletics and has been in the pharmaceutical industry full-time since 2008.

Pocket Aces Racing was born over a card game among friends in 2005, hence the double ace silks. They all pitched in and bought a Victory Gallop yearling filly to eventually race at Charles Town. Aptly named 'Victory Morning', the filly won her debut by about 10 lengths in her first start in September of her 2-year-old year. People that had never been owners, and had never even imagined owning a race horse (Shoemaker included), had so much fun with it that they decided to formalize, and turn it into a business.

Almost 17 years later from that four-time winning first filly, the syndicate has grown to over 300 partners and 30 active runners, give or take a few.

Shoemaker joined TDN for a Q&A and some reminiscing. Here are his answers to breeding and racing's most poignant questions for 2022 and into the new year!

TDN: What is your racing or bloodstock highlight for this year?

JS: Temple City Terror winning the G3 Dowager at Keeneland.

TDN: Who is your value sire for 2023?

JS: Temple City

TDN: Who do you predict will be the leading freshman sire next year?

JS: Flameaway

TDN: If you could nominate one candidate (person or horse) to the Hall of Fame, who would get your nomination? Why?

JS: Perry Ouzts – 7,336 says it all. I don't care what level it is; you can't argue with that number of wins.

TDN: What is one positive change you'd like to see in racing next year?

JS: Serious, real, and swift consequences for individuals that tarnish our great sport by cheating. Enough is enough.

TDN: Who is your favorite horse of all time?

JS: Ferdinand. His win in the Derby with Bill Shoemaker aboard is what really elevated my love for racing to the next level.

TDN: What was the most exciting race you saw this year?

JS: It's personal for me – it was Temple City Terror in the Dowager. To win a graded stake at Keeneland [having grown up at the track] is everything for me.

TDN: If you could go back in time and see one race in person, what would it be?

JS: The 1978 Triple Crown Races, but if I have to pick one, the 1978 Belmont.

TDN: If you could only go to one track for the rest of your life, which one would you pick?

JS: Keeneland

TDN: If you could compete in any race in the world outside the US, which one would you want an entry in?

JS: Dubai World Cup

TDN: What was the biggest “surprise” of 2022–be it sales price, track performance, or a stallion?

JS: I don't really think I'd call it a surprise, but I'm happy to see Good Magic at the top of the First-Crop Sire list. It's great to see a son of Curlin off to such a great start as a sire.

TDN: Who would you tab as your favorite 'TDN Rising Star'?

JS: We bought a Siyouni gelding out of the HORA sale at Keeneland last month so I'll go with Intinso who won an allowance at New Castle in late October.

TDN: What is a hill you will die on when it comes to horse racing or breeding?

JS: We have to clean up the sport, but we can't fool ourselves into thinking that getting rid of the cheaters and restoring confidence in the game is the panacea for all our woes.

TDN: Do you have thoughts on what more needs doing?

JS: We have to do a better job attracting new fans and making our sport more accessible. I realize everyone has their fiefdoms they want to protect, but the industry HAS to come together and cooperate to grow our sport.

TDN: Secretariat or Flightline? Care to stir the pot?

JS: Secretariat. Always Secretariat

TDN: The burning question on everyone's mind–do you decorate your house for the winter holidays before or after Thanksgiving?

JS: Always after.
