Court Allows Ruis to Pursue Justify Matter

According to the attorneys representing Mick Ruis, a Los Angeles County Superior Court has ruled that the owner can continue his attempts to have the results of the 2018 GI Santa Anita Derby overturned. In January, the California Horse Racing Board (CHRB) voted to abide by the stewards' decision to let the result stand, with Justify (Scat Daddy) declared the official winner.

The decision by Judge Mitchell L. Beckloff was in response to the CHRB's attempts to have the case halted based on a legal term known as a demurrer, which is an argument that there's no factual or legal basis for a case to go forward. With the ruling, Ruis's suit against the CHRB will now proceed. A trial date has tentatively been scheduled for August.

Ruis is the co-owner and also trained Santa Anita Derby runner-up Bolt d'Oro (Medaglia d'Oro). After it was revealed in a report in the New York Times that the Bob Baffert-trained Justify tested positive for the substance scopolamine, Ruis began his quest to have the result of the race overturned with Bolt d'Oro declared the winner.

Ruis alleges that the CHRB failed to follow its own rules when it decided not to pursue penalties after Justify tested positive for scopolamine. The CHRB acted on recommendations from then executive director Rick Baedeker and equine medical director Dr. Rick Arthur. It was their call that Justify should not be disqualified because the positive test was the result of contamination linked to jimson weed.

At stake is the $600,000 winner's share of the purse. Second-place was worth $200,000.

“We just want simply for the Horse Racing Board to follow its own rules,” said Darrell Vienna, who, along with Carlo Fisco, is representing Ruis. “Their rules are unequivocal. They state that when a horse carries in its system a prohibited substance of the classification that scopolamine was classified at at the time of the race, they will be disqualified. There are no ifs, ands or buts about it.”

Vienna said he is holding out hope that the CHRB will reverse directions.

“Potentially, this decision might open the CHRB's eyes and have them do the right thing rather than being forced to do so,” he said.

Friday, Vienna and Fisco issued a joint statement, which read: “We have a long way to go but are pleased that the court confirmed our client's undeniable claim in pursuing this case. Today was a technical hurdle introduced by the CHRB in attempt to escape its responsibility for the Justify debacle. We remain confident that the trial on this matter will expose the legal improprieties of the former CHRB Board and its former Equine Medical Director as well as the utter refusal by the CHRB Board of Stewards to correct an obvious injustice.”

Rock Your World Retired To Spendthrift

Rock Your World (Candy Ride {Arg}–Charm the Maker, by Empire Maker), who defeated GI Kentucky Derby winner and GI Longines Breeders' Cup Classic runner-up Medina Spirit (Protonico) in the GI Runhappy Santa Anita Derby in his first start on the dirt, has been retired from racing and will enter stud in 2022 at Spendthrift Farm. The nursery had previous announced the acquisition in last April.

The handy winner of a six-furlong turf sprint on career debut at Santa Anita Jan. 1, the $650,000 Keeneland September yearling purchase took the one-mile Pasadena S. Feb. 27 by a widening 2 1/4-lengths and proved not for catching in the Santa Anita Derby, reporting home a 4 1/4-length winner. Compromised by a horrendous start in the Run for the Roses, Rock Your World was a battling runner-up in the Shared Belief S. at Del Mar Aug. 29, dropping a 1 1/4-length decision to Medina Spirit. Bred by Ron and Deborah McAnally and trained by John Sadler for Hronis Racing and Talla Racing, Rock Your World retires with a record of 7-3-1-0 and earnings of $612,100.

Rock Your World's dam was a stakes winner and twice placed at Grade I level going long as a 2-year-old and is also responsible for GSP She's Our Charm (Candy Ride {Arg}) and a yearling Curlin colt that fetched $825,000 from D. Hatman Thoroughbreds at this year's Keeneland September sale.

Rock Your World is a maternal grandson of GSW Charm The Giant (Ire) (Giant's Causeway), the dam of GSW Liam the Charmer (Smart Strike), while MGSW/GISP third dam Olympic Charmer (Olympio) also bred MGSP Charming Legacy (Ire) (Danehill), whose daughter Light of Darkness (Red Rocks {Ire}) won this year's G3 Istanbul Trophy in addition to the Turkish 1000 Guineas.

Rock Your World Among Nominees To Pacific Classic

The nomination deadline passed at midnight on Thursday for the five major stakes a week from Saturday at Del Mar. And when the racing office had finished sorting them out this morning, there were 15 horses on the list for the summer season's signature Grade 1, $1 million TVG Pacific Classic.

Most were expected. But one not-exactly-expected name figures to generate interest and speculation leading up to next Tuesday's close of entries and post position draw. That would be Santa Anita Derby winner Rock Your World, trained by John Sadler for Hronis Racing, the connections who notched back-to-back TVG Pacific Classic wins with Accelerate in 2018 and Higher Power in 2019.

Sadler has indicated since the start of the meeting that Rock Your World, a 3-year-old son of Candy Ride, was being targeted for the Grade 2, $250,000 Del Mar Derby Presented by Caesars Sporsbook on Sept. 4, in what would be a return to turf after three starts on dirt – a victory in the Santa Anita Derby followed by Triple Crown event disappointments in the Kentucky Derby (17th) and Belmont Stakes (6th).

The Pacific Classic has been won by 3-year-olds over older horses five times. Best Pal's victory in the inaugural running in 1991 was followed by General Challenge (1999), Came Home (2002), Dullahan (2012) and Shared Belief (2014). Under race conditions, 3-year-olds carry 118 pounds while older horses tote 124.

Sadler did not immediately respond to a text inquiry regarding Rock Your World but had, earlier in the morning, confirmed another TVG Pacific Class entrant from the stable.

San Diego Handicap runner-up Tripoli went six furlongs in 1:12.80 this morning under exercise rider Cerapio Figueroa to Sadler's satisfaction in a final tune-up for the event.

Sadler said he had the son of Kitten's Joy, a $450,000 purchase at the Keeneland September sale in 2018 for Hronis Racing, galloping out to seven furlongs in 1:24.80.

“I was pleased with it, he's set for the Classic,” Sadler said. Tiago Pereira, aboard for the 4-year-old colt's last three starts since May, retains the mount.

Tripoli has three wins in 13 career starts and earnings of $211,960. The second-place result in the Grade II, $250,000 San Diego Handicap on July 17, beaten a half-length by Express Train, came in his stakes debut.

Other Pacific Classic nominees, with trainer's name in parentheses are: Chess Chief (Dallas Stewart); Cupid's Claws (Craig Dollase); Dr Post (Todd Pletcher); Express Train (John Shirreffs); Ginobili (Richard Baltas); Independence Hall (Michael McCarthy); Magic On Tap (Bob Baffert); Midcourt (John Shirreffs); Mo Mosa (Mike Maker); Royal Ship (Richard Mandella); Sherriff Brown (Todd Fincher); The Great One (Doug O'Neill), and Tizamagician ( Mandella).

Trainer Pletcher, from his Saratoga headquarters, indicated he's considering the coast-to-coast ship for Dr Post seriously.

“We're going to breeze him Saturday and if we're pleased with that, he's a go,” Pletcher said.

The 31st running of the TVG Pacific Classic is for 3-year-olds and up at the classic distance of a mile and one quarter. It is designated as a “Win and You're In” Challenge Race giving its winner a guaranteed all-fees-paid admission to the $6-million Breeders' Cup Classic, which will be run at Del Mar on Saturday, November 6.

Sadler: Santa Anita Derby Winner Rock Your World Will Return To Turf

Trainer John Sadler told the Daily Racing Form Sunday that Santa Anita Derby winner Rock Your World will return to turf for his next start.

The 3-year-old son of Candy Ride won his first two starts on the grass, then dominated by over five lengths when switched to the dirt for the Santa Anita Derby. A tough trip saw the colt finish 17th in the Kentucky Derby, and Rock Your World did not threaten when sixth in the Belmont Stakes five weeks later.

Now, Sadler said the long-range target is the Grade 2 Del Mar Derby (nine furlongs on the turf) on Sept. 4. If Rock Your World is ready and requires a prep race, the G3 La Jolla (1 1/16 miles on the grass) on Aug. 8 is a possibility.
