CALIFORNIA

Violation: Reciprocity of out-of-state medication violation penalty
Explainer: Pursuant to California Horse Racing Board rule #1484 (Evidence of Unfitness for License) the following ruling is issued in reciprocity after receiving notice of suspension from the Kentucky Horse Racing Commission, ruling (21-0009) dated February 21, 2022, issuing Trainer/Owner Robert Baffert ninety suspension days. Robert Baffert is suspended for 90 days (April 4, 2022, through and including July 2, 2022).

Explainer: Jockey Mario Gutierrez, who rode ARDIS in the fourth race at Santa Anita Park on April 1, 2022, is suspended for 3 racing days (April 9, 10 and 15, 2022) for failure to make the proper effort to maintain a straight course in the stretch, causing interference which resulted in the disqualification of his mount from second to third place. This constitutes a violation of California Horse Racing Board rule #1699 (Riding Rules – Careless Riding). Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

Explainer: For having waived his right to appeal Jockey Kendrick Carmouche is hereby suspended three NYRA racing days April 14th 2022, April 15th 2022, April 16th 2022 inclusive. This for careless riding during the running of the eight race at Aqueduct racetrack on March 31st 2022. Suspended: 04/14/2022 to 04/16/2022 (3 days).

Violation: Discovery of non-FDA approved drug on trainer grounds
Explainer: Trainer Mr. Wayne Potts for having waived his right to appeal is hereby suspended 45 calendar days April 10th 2022, through May 6th 2022 inclusive, and again June 6th through June 23rd 2022 inclusive, due to a previous ruling (suspension) handed down by the New Jersey Racing Commission. This for the finding of a drug in your tackroom that has not been approved by the FDA for use in Thoroughbred horses. Ordered that during your period of suspension, you shall not directly nor indirectly participate in New York State pari-mutuel horse racing. You are denied the privileges and use of the grounds for all racetracks in New York State. You are forbidden to participate in any share of purses or other payments. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State, that is (a) owned or trained by you, or by individuals who serves as your agent or employee during your suspension; or (b) for which you during your suspension are directly or indirectly with training, including any arrangements to care for, train, enter, race, invoice, collect fees or other payments, manage funds, employ or insure workers, provide advice or other information or otherwise assist with any aspect of the training of such horses. Suspended: 04/10/2022 to 06/23/2022 (45 days).

Explainer: Jockey Kent Desormeaux, having failed to respond to written notice to appear before the Board of Stewards at Santa Anita Park on or before March 3, 2022, is suspended for violation of California Horse Racing Board rule #1547 (Failure to Appear) pending an appearance at a hearing before a Board of Stewards to answer to charges alleging violation of CHRB rule #1874 (Disorderly Conduct- Causing a disturbance) and #1485(d)(License Subject to Conditions and Agreement – Failure to abide by an agreement with the Winners Foundation). During the term of this suspension, all licenses and license privileges of Kent Desormeaux are suspended and pursuant to California Horse Racing Board rule #1528 (Jurisdiction of Stewards), subject is denied access to all premises in this jurisdiction.

KENTUCKY

Track: Turfway Park (for a violation at Churchill Downs)

Penalty: Thirty-day suspension (15 days stayed) and $500 fine
Violation: Medication violation
Explainer: Upon receipt of notification from Industrial Laboratories, the official testing laboratory fol. the Kentucky Horse Racing Commission and confirmed at Texas A & M Veterinary Medical Diagnostic Laboratory, sample number E490742 taken from Fed Money, who finished flrst in the tenth race at Churchill Downs on November 4, 2021 contained Metformin in blood (class 8). After a formal hearing before the Board of Stewards James E. Baker is hereby suspended THIRTY (30) days and fined $500. Due to mitigating circumstances (number of violations in relation to overall record), 15 days are to be served from March 1, 2022 through March 15, 2022 (inclusive). The remaining 15 days are stayed on the condition that no Class A or Class 8 medication violation occurs in any racing jurisdiction within 365 days from the date of this ruling. Fed Money is disqualified and all purse money forfeited. Pari-mutuel wagering is not affected by this ruling. During his suspension Mr. Baker is denied the privileges of all facilities under the jurisdiction of the Kentucky Horse Racing Commission. Entry of all horses owned or trained by Mr. Baker is denied pending transfer to persons acceptable to the stewards. Upon receipt of this ruling. it is required within thirty (30) days to pay any and all fines imposed to the Kentucky Horse Racing Commission.

NEW YORK

Track: Aqueduct
Date: 03/06/2022

Penalty: $500
Violation: Failure of business conduct, necessitating scratch
Explainer: Fined the sum of five hundred $500 for failing to tend to business in a proper manner necessitating a scratch in the 6th race at Aqueduct Racetrack Mar. 5th 2022.

Flatter Colt Up Late For Guineas Score

Mouheeb (Flatter) was a $400,000 selection at last June's OBS Spring Sale of Two-Year-Olds In Training, and started out with plenty of expectation riding on his shoulders being a full-brother to the GII Swale S. scorer and GI Champagne S. and GI Malibu S.-placed Favorable Outcome (Flatter), and a half-brother to the listed-winning and multiple graded placed Bellamentary (Bellamy Road). Mouheeb got off the mark on debut on Dec. 18 in a Jebel Ali maiden before finishing a head second to Godolphin's dual winner Rebel's Romance (Ire) (Dubawi {Ire}) in the UAE 2000 Guineas Trial on Jan. 14, and went one better in his stakes debut in Thursday's G3 UAE 2000 Guineas. Breaking on the rail under Ryan Curatolo, Mouheeb was content to let Meshakel (Ire) (Shamardal) set the tempo, with Godolphin's top-rated Naval Crown (GB) (Dubawi {Ire} splitting them. About three lengths separated the trio as they ran into the bend, with Mouheeb poised three wide upon straightening. Mouheeb came with a sustained rally under a drive down the middle of the course, and though he may have given his backers a few anxious moments, he reeled in a game Meshakel in the dying strides to win by a neck. Naval Crown stuck on for third, 6 3/4 lengths clear of the remainder of the field.

Curatolo, who was riding his first winner at Meydan, said, “This win means everything to me, I want to thank god, and the connections. The horse proved that he was the best today. He is a very talented horse, and last time we almost got there. He is a bit inexperienced, but he is getting better with time. The trainer did a very good job with him and his rider in the morning did a good job as well, because he can be quite difficult. Today he was more relaxed before the race, and that was good. This is a super special moment for me tonight, I am very pleased for the people who gave me the opportunity, and hopefully I can maintain that. I think this horse can go a bit longer, and his trainer will see what is best for him.”
