Charges Dropped Against Maria Borell

More than seven years after Maria Borell, trainer of 2015 champion sprinter Runhappy, was accused of animal cruelty to animals in the second degree, charges against her were officially dismissed Thursday in district court in Mercer County, Kentucky.

Daily Racing Form reported Wednesday that Borell's attorney Russell Baldani had indicated that a proposed dismissal order had been filed earlier in the week that would lift the ban that forbade Borell from caring for horses. The Blood-Horse confirmed Thursday that the case had come to a conclusion.

Borell, who was fired as the trainer of Runhappy one day after his victory in the 2015 GI Breeders' Cup Sprint, was allegedly in Florida at the time that dozens of horses were located on a farm in Mercer Country in a substandard state of health. Her father Charles was questioned by authorities and detained and was released from custody two days later after posting bail. He would subsequently plead guilty to nine counts of animal cruelty.

A jury trial was set to begin July 12, but was delayed after Baldani and local prosecutor Ted Dean began discussing an out-of-court arrangement, Baldani told DRF, adding that he argued that the charges against Borell would be 'difficult to prove' at trial given that the affected horses were not under her immediate care at the time. Baldani told the Form that Charles Borell was prepared to testify to the same. Charles Borell was sentenced to nine concurrent days of 179 days, of which 176 were conditionally discharged and three were credited for time served.

Under the deal reached, Borell will pay her $7,500 bail bond to Thoroughbred Charities of America, which laid out as much as $13,000 towards caring for the horses, according to the Blood-Horse story. The publication says an additional $2,500 being held in escrow by Baldani would also go to the TCA.

In a Facebook post following the dismissal of the charges, Borell wrote, in part, “To all my past clients, my friends, my attorney Russ Baldani, everyone that has stood behind me in this battle, I love you and appreciate you more than you can ever imagine. Thank you for keeping me strong enough to never give up and to keep fighting. For the first time in years, my heart is full.

“Those who know me know I would never knowingly harm any animal. No animal in my personal care has ever been mistreated in any way. I am happily forfeiting my bail money to Thoroughbred Charities of America in thanks for helping all Thoroughbreds then, now and in the future.”

Mattress Mack Honored as Jockeys and Jeans Person of the Year

Jockeys and Jeans this year will hold its annual fundraiser at Caesars Palace in Las Vegas on Saturday, Jun. 24, and will honor Jim “Mattress Mack” McIngvale as its Person of the Year.

McIngvale is the owner of three Gallery Furniture stores in Houston and is internationally known for his business acumen, philanthropy, community involvement and success as a Thoroughbred owner and breeder as well a major bettor. The event will reunite McIngvale with Hall of Fame jockey Edgar Prado–one of 16 Hall of Fame members set to attend the event–who was was aboard Runhappy (Super Saver) for his win in the 2015 GI Breeders' Cup Sprint.

“Jockeys risk their lives every day they race,” McIngvale said. “And I think they need to be appreciated for the skills they bring to the sport. They make split-second decisions and are judged for those decisions. I think they deserve better medical care and should have a pension to help them after they retire like NFL players. I think they are racing's superstars.”

To date, the all-volunteer Jockeys and Jeans has raised more than $2.6 million for the Permanently Disabled Jockeys Fund (PDJF), which pays a monthly stipend of $1,000 to 60 jockeys who suffered career-ending injuries. After the fundraiser this year, the group expects to raise more than $3 million.

“Mattress Mack is truly one-of-a-kind, and I believe his acceptance speech will be something the entire racing world will be eager to hear,” Jockeys and Jeans President Barry Pearl said.” He is one of few persons who has been a successful Thoroughbred owner and breeder as well as a major bettor. He sees racing from a most unusual perspective.”

Runhappy’s Smile Happy Upsets Alysheba

LOUISVILLE, Ky. – 'TDN Rising Star' Smile Happy (Runhappy), eighth in last year's GI Kentucky Derby behind the re-opposing Rich Strike (Keen Ice), appears to have a very big season ahead of him after delivering a decisive 7-1 upset over a talented group of older horses assembled in Friday's GII Alysheba S. at Churchill Downs.

Smile Happy shadowed heavily favored last-out GII New Orleans Classic S. winner West Will Power (Bernardini) from an outside second through early fractions of :24.30 and :47.80. The Lucky Seven Stable colorbearer struck the front beneath Brian Hernandez, Jr. off the turn for home and kept on finding down the stretch to keep GI Pegasus World Cup winner Art Collector (Bernardini) safe by two lengths. West Will Power stayed on for third.

Winner of the GII Kentucky Jockey Club S. beneath the Twin Spires as a 2-year-old, last term's GII Risen Star S. and GI Toyota Blue Grass S. runner-up made two previous starts this season at Oaklawn Park. Smile Happy kicked off his 4-year-old campaign with a smart victory in an optional claimer in the slop Mar. 16, and was most recently third as the favorite in the GIII Oaklawn Mile Apr. 1.

“I'm really not surprised,” winning trainer Kenny McPeek said. “He's tricky to deal with sometimes and the last couple of races, we've finally figured his number. We ran him back quickly at Oaklawn because he was difficult to train at Oaklawn. We got him back here and he's done everything right. But, we learned a value lesson in his last race at Oaklawn. He's a true alpha. He wants everything his own way. But, he can run like the wind. I'm really proud of him.”

It was another disappointing run from last year's monumental Derby upsetter Rich Strike, who was making his first start of the season in the Alysheba. He passed one rival home to finish fifth after trailing for most of the way.

“I'm unusually disappointed in the effort,” trainer Eric Reed said. “I'm not sure what's going on. I expected him to finish better. He was where he was supposed to be but he didn't fire at all.”

Smile Happy, a $175,000 KEENOV weanling and a $185,000 FTKSEL sale graduate, is one of three graded winners for Runhappy and one of 24 graded winners for broodmare sire Pleasant Tap.
