NTRA Poll: After Final Preps, Top Three Are Essential Quality, Rock Your World, Hot Rod Charlie

Essential Quality, who is training at Churchill Downs in preparation for the Grade 1 Kentucky Derby presented by Woodford Reserve on May 1, remains at No. 1 in this week's National Thoroughbred Racing Association (NTRA) Top Three-Year-Old Thoroughbred Poll.

Trained by Brad Cox and bred and owned by Godolphin LLC, Essential Quality is undefeated in five starts, including his most recent victory in the Grade 2 Toyota Blue Grass Stakes at Keeneland on April 3. Essential Quality, the Eclipse Award-winning two-year-old male of 2020, received 34 first-place votes and 366 points in this week's poll. Rock Your World, who won the Grade 1 Runhappy Santa Anita Derby on April 3, has moved from fourth to second place this week. Owned by Hronis Racing and Talla Racing, and trained by John Sadler, Rock Your World has 266 points. Another California-based star, Roadrunner Racing, Boat Racing, LLC and William Strauss's Hot Rod Charlie, remains in third place. Trained by Doug O'Neill, Hot Rod Charlie, winner of the Grade 2 Twinspires.com Louisiana Derby on March 20, has one first-place vote and 261 points. St. Elias Stable's Known Agenda, winner of the Grade 1 Curlin Florida Derby on March 27 for trainer Todd Pletcher, takes the fourth spot with one first-place vote and 253 points. Klaravich Stables Inc.'s Highly Motivated, who gave Essential Quality all he could handle finishing second in the Blue Grass by just a neck, moves from seventh to fifth place with 158 points.

Following his third-place finish as the odds-on favorite in last Saturday's Grade 1 Arkansas Derby, Gary and Mary West's homebred Concert Tour drops from second to sixth place with 144 points. Keith Asmussen and Erv Woolsey's Arkansas Derby winner Super Stock, joins the top 10 for the first time at No. 7 with 138 points. Zedan Racing Stables Inc's Medina Spirit, who finished second to Rock Your World in the Santa Anita Derby, retains eighth place in the poll with 101 points. Life is Good, who is sidelined with an injury and will miss the Triple Crown, is in ninth place with 66 points. He is followed by Greatest Honour, who was taken out of Kentucky Derby consideration last week by trainer Claude R. “Shug” McGaughey III. Greatest Honour, beaten favorite in the Florida Derby, has 57 points in 10th place.

The first eight positions in NTRA Top Thoroughbred Poll, remain unchanged from last week. Mystic Guide, winner of the Group 1 Dubai World Cup, holds onto the No. 1 ranking with 24 first-place votes and 346 points. Charlatan, runner-up in the Group 1 Saudi Cup, is second in the voting with seven first-place votes and 317 points. Two-time Eclipse Award Champion Monomoy Girl (five first-place votes, 313 points) remains in third place, followed by Eclipse Award Champion filly Swiss Skydiver (one first-place vote, 296 points) in fourth place, and Knicks Go in fifth (239 points).

Grade 1 Pegasus World Cup winner Colonel Liam is in sixth place (213 points). Idol holds onto seventh place (179 points), and Gamine is in eighth place (97 points). The new shooter to the top 10 is C Z Rocket, who won last Saturday's Grade 3 Count Fleet Handicap at Oaklawn Park. C Z Rocket is in ninth place (89 points), followed by Maxfield in 10th (56 points).

Essential Quality Extends His Lead In NTRA Top 3-Year-Old Poll

Undefeated Essential Quality, fresh off a determined victory in the Grade 2 Toyota Blue Grass Stakes at Keeneland on April 3, maintained the top spot in this week's National Thoroughbred Racing Association (NTRA) Top 3-Year-Old Thoroughbred Poll.

Trained by Brad Cox and bred and owned by Godolphin LLC, Essential Quality ran his record to five for five in the Blue Grass. The Eclipse Award-winning two-year-old male of 2020, Essential Quality received 31 first-place votes and 371 points in this week's poll. He is expected to make his next start in the Kentucky Derby presented by Woodford Reserve on May 1. Concert Tour, winner of the Grade 2 Rebel Stakes, remained in second place for the second consecutive week with five first place votes and 319 points. Concert Tour, bred and owned by Gary and Mary West and trained by Bob Baffert, is expected to be favored in this Saturday's Grade 1 Arkansas Derby. Hot Rod Charlie, winner of the Grade 2 Twinspires.com Louisiana Derby on March 20, was third in the poll with one first place vote and 239 points.

Rock Your World, frontrunning winner of Saturday's Grade 1 Runhappy Santa Anita Derby in California at odds of 5-1, moved up to fourth in the NTRA poll with 238 points. Rock Your World, who was bred by Hall of Fame trainer Ron McAnally and his wife Deborah, was making his first start on the dirt following two victories on the turf. Rock Your World is owned by Hronis Racing of brothers Kosta and Pete Hronis and Michael Talla's Talla Racing. St. Elias Stable's Known Agenda, winner of the Curlin Florida Derby on March 27, rounded out the top five in this week's poll with 233 points.

Greatest Honour, beaten favorite in the Florida Derby, was sixth in this week's poll with 160 points. Klaravich Stables Inc.'s Highly Motivated, a game second behind Essential Quality in the Blue Grass, was seventh in this week's poll with 151 points. Medina Spirit, beaten favorite in the Santa Anita Derby, was eighth in the poll with 96 points. Life is Good, who is sidelined with an injury and will miss the Triple Crown, was ninth with 69 points, followed by Midnight Bourbon with 35 points.

A Godolphin homebred, Mystic Guide, also retained the top spot in this week's NTRA Top Thoroughbred Poll, which saw no change to the top seven placings. Mystic Guide, winner of the Dubai World Cup, remained in the top spot with 24 first place votes and 346 points. Charlatan was second in the voting with seven first-place votes and 320 points. Two-time Eclipse Award winner Monomoy Girl (six first-place votes, 306 points) remained in third place, followed by Eclipse Champion filly Swiss Skydiver (1 first-place vote, 248 points) and Knicks Go (225 points).

Grade 1 winner Colonel Liam remained in sixth place with 188 points and Idol remained in seventh place with 113 points. The lone change in the top 10 saw Eclipse Champion Gamine jump from 10th to eighth place with 93 points. Maxfield (57 points) and Shedaresthedevil (37 points) rounded out the top 10.

Dubai World Cup Winner Mystic Guide Takes Over NTRA Top Thoroughbred Poll

Godolphin homebred Mystic Guide earned his first top-level victory in spectacular fashion this past weekend when he surged to a 3 ¾-length triumph in the $12 million Dubai World Cup at Meydan Racecourse. In addition to padding his career bankroll, that win allowed the son of Ghostzapper to continue to elevate his reputation in the handicap ranks as he takes over the No. 1 spot in this week's National Thoroughbred Racing Association (NTRA) Top Thoroughbred Poll.

Trained by Michael Stidham, Mystic Guide came into the Group 1 Dubai World Cup off a six-length victory in the Grade 3 Razorback Handicap on February 27. The 4-year-old colt, who won the Grade 2 Jim Dandy Stakes during his sophomore campaign, earned 21 first-place votes and 333 points this week to move past fellow Grade 1 winner Charlatan into the lead position on the poll.

“Today he proved he is a champion and I know he is going to get better and better,” jockey Luis Saez told the Dubai World Cup notes team after piloting Mystic Guide to victory. “What a nice horse, he has all the ability. It's an honor for me. It's a dream come true.”

Charlatan, who most recently finished as the runner-up in the $20 million Saudi Cup, drops one spot to second with 10 first-place votes and 328 points. Champion distaffer Monomoy Girl sits third with 6 first-place votes and 309 points followed by fellow champion Swiss Skydiver (1 first-place vote, 249 points) and stablemate Knicks Go (231 points).

Grade 1 winner Colonel Liam ranks sixth with 193 points while Santa Anita Handicap hero Idol (122 points) is seventh. Godolphin's Maxfield ranks eighth with 68 points while Shedaresthedevil (52 points), and champion female sprinter Gamine (45) round out the top 10.

The Godolphin team reigns over both NTRA polls this week as their unbeaten juvenile champion Essential Quality maintains his lead position in the Top Three-Year-Old Thoroughbred Poll with 31 first-place votes and 373 points ahead of his expected run in the Grade 2 Blue Grass Stakes at Keeneland on April 3.

Concert Tour, winner of the Grade 2 Rebel Stakes, remains second with 6 first-place votes and 330 points with Louisiana Derby victor Hot Rod Charlie moving up to third with 258 points. Known Agenda joins the top 10 for the first time, landing in the fourth spot this week with 240 points following his triumph in the Grade 1 Florida Derby.

Medina Spirit sits fifth with 185 points while Greatest Honour (178 points) drops to sixth after finishing third as the favorite in the Florida Derby. Risk Taking (89 points) is seventh followed by Life Is Good (1 first-place vote, 88 points), Midnight Bourbon (70), and Helium (51).

NTRA: ‘Contrary To HBPA’s Hyperbole, HISA Is Neither Unprecedented Nor Unconstitutional’

Following Monday's announcement that the National Horsemen's Benevolent and Protective Association (NHBPA) is filing a lawsuit against the Horseracing Integrity and Safety Act (HISA), the National Thoroughbred Racing Association (NTRA) issued the following response:

Contrary to HBPA's hyperbole, HISA is neither unprecedented nor unconstitutional. HISA emulates the long-established FINRA/SEC model, with even greater protections for all stakeholders. It is disappointing that the HBPA—an entity whose mission is supposedly the welfare of horses and horsemen—would seek to undo much needed reforms to protect the industry's participants.

“HISA, a well-crafted and comprehensive piece of legislation, creates the national framework that addresses our industry's critical need for consistent, forceful anti-doping control and equine safety standards,” said Alex Waldrop, President and CEO of the NTRA. “The NTRA Board of Directors, which consists of representatives from tens of thousands of breeders, owners and trainers from more than 40 states, as well as thousands of horseplayers and virtually every major racetrack in the United States, voted to support HISA. We plan to work tirelessly on behalf of our members and a broad array of interested parties and stakeholders to support HISA's successful launch in July 2022.”

In 2020, the U.S. Congress overwhelmingly passed, and the President signed into law, the Horseracing Integrity and Safety Act (HISA). Through this landmark legislation, HISA recognizes and empowers the Horseracing Integrity and Safety Authority (Authority) to protect the safety and welfare of Thoroughbred horseracing's most important participants—its horses—by delivering commonsense medication reforms and track safety standards.

The NHBPA, along with several of its state affiliates, seeks to upend this historic and bipartisan effort to protect Thoroughbred horses and ensure the integrity of horseracing. The HBPA has recently filed a baseless lawsuit in federal court in Texas, seeking to declare HISA unconstitutional on its face. Setting aside its fatal threshold deficiencies—including the lack of any concrete or imminent harm—the HBPA's lawsuit is meritless. HISA is constitutionally and legally sound. On behalf of a broad spectrum of organizations underlying the sport of Thoroughbred horseracing, we offer the following responses to the various claims by HBPA.

1. HBPA Claim: HISA violates the constitutional “non-delegation doctrine.”

Reality: HISA does not violate the non-delegation doctrine because the United States Supreme Court has long recognized that Congress may rely on private entities so long as the government retains ultimate decision-making authority as to rules and enforcement. HISA recognizes and empowers the Authority to propose and enforce uniform national anti-doping and equine safety standards, but only upon review, approval and adoption by the Federal Trade Commission (FTC). Though this is a first for the Thoroughbred horseracing industry, HISA's structure is not new. HISA follows the FINRA/SEC model of regulation in the securities industry, and, like that model, is constitutional because any action the Authority undertakes is subject to the FTC's approval and oversight.

2. HBPA Claim: The HISA runs afoul of the Appointments Clause.

Reality: The Authority is a private entity, independently established under state law, and recognized by HISA. As such, it is simply not subject to constitutional restraints on appointments (or removal) of its Board members. Indeed, any such claim is at war with HBPA's non-delegation theory premised on the fact that the Authority is a private entity. On the one hand, the HBPA claims that the Authority cannot take action because it is private entity, but then argues, on the other hand, that the Authority cannot appoint its own Board members because it is effectively a public entity. These two HBPA arguments are in conflict, but have one important thing in common: they are both wrong.

3. HBPA Claim: HISA violates due process protections.

Reality: The HBPA's due process theory also falls flat. Though the HBPA complains of equine industry participants regulating their competitors, a strong bipartisan majority of the House and the Senate made clear in HISA that a majority of the Authority's Board members must be from outside the equine industry. To be sure, a minority of the Authority's Board members will have industry experience and engagement. But it is difficult to understand how that statutory recognition of the value of informed voices constitutes a deprivation of due process. What's more, with respect to the minority industry Board members, HISA expressly provides for equal representation among each of the six equine constituencies (trainers, owners and breeders, tracks, veterinarians, state racing commissions, and jockeys). Furthermore, the committee tasked with nominating eligible candidates for Board and standing-committee positions is made up of entirely non-industry members. HISA further imposes broad conflicts-of-interest requirements to ensure that all of its Board members (industry and non-industry alike) as well as non-industry standing committee members (not to mention their employees and family members) are required to remain free of all equine economic conflicts of interest.

Beyond these robust safeguards, established precedent confirms what common sense indicates: even when a private entity is engaged in the regulatory process, agency authority and surveillance protect against promotion of self-interest. Under HISA, for example, the FTC has the authority to decline the Authority's proposed rules and overrule any sanctions—ensuring that neither the Authority nor the individuals making up its Board can use their position for their own advantage in violation of constitutional restraints.

HISA has broad support from the Thoroughbred industry, including: organizations such as the Breeders' Cup, National Thoroughbred Racing Association, The Jockey Club, The Jockeys' Guild, American Association of Equine Practitioners and the Thoroughbred Owners and Breeders' Association; the nation's leading racetracks, including Churchill Downs, Del Mar Thoroughbred Club, Gulfstream Park, Keeneland, The Maryland Jockey Club, Monmouth Park, The New York Racing Association and Santa Anita; leading horsemen's organizations such as the Thoroughbred Horsemen's Association and the Thoroughbred Owners of California; prominent Thoroughbred owners Barbara Banke, Anthony Beck, Arthur and Staci Hancock, Fred Hertrich, Barry Irwin, Stuart S. Janney III, Rosendo Parra and Vinnie Viola; leading Thoroughbred trainers Christophe Clement, Neil Drysdale, Janet Elliot, Claude “Shug” McGaughey, Bill Mott, Todd Pletcher and Nick Zito; grassroots organization Water Hay Oats Alliance, with more than 2,000 individual members; international organizations the International Federation of Horseracing Authorities and The Jockey Club of Canada; and prominent animal welfare organizations American Society for the Prevention of Cruelty to Animals, Animal Wellness Action and the Humane Society of the United States.
