Baffert Runners Arrive at Pimlico

The suspension of Tex Sutton charters meant that GI Kentucky Derby winner Medina Spirit (Protonico) and his once-beaten stablemate, 'TDN Rising Star' Concert Tour (Street Sense) (video), had to endure a lengthy van ride over from Churchill Downs, but GI Preakness S.-bound duo arrived safely at Pimlico Race Course shortly after 2 p.m. Monday afternoon. The horses were overseen by assistant trainer Jimmy Barnes, who said they departed Louisville about 4:45 a.m. Monday morning.

“It seemed simple,” he said. “Actually, we're here even earlier than we fly sometimes. If you are on the second flight they have to come here and go back. Other than having to drive 600 miles, it went very smooth.”

Also making the trip from Kentucky were Beautiful Gift (Medaglia d'Oro), drawn widest for Friday's GII Black-Eyed Susan S.; 'Rising Star' Following Sea (Runhappy), slated to run in Saturday's GIII Chick Lang S.; and Hozier (Pioneerof the Nile), runner-up to Concert Tour in the GII Rebel S. who is headed to Saturday's Sir Barton S.

Report: Why Regulators Test For Picograms Of Betamethasone

On Sunday morning, trainer Bob Baffert shocked the racing world with his announcement that Kentucky Derby winner Medina Spirit's post-race test had returned a positive result for 21 picograms of betamethasone. During his press conference, Baffert went on to say that Medina Spirit has never been administered betamethasone.

During the ensuing social media storm, questions have arisen about what exactly betamethasone is, the legitimacy of testing for substances in concentrations as low as a picogram (one trillionth of a gram), and how it got into the horse's system in the first place.

Dr. Mary Scollay, executive director of the Lexington, Ky.-based Racing Medication and Testing Consortium, answered some of those questions in a series with Horse Racing Nation.

Betamethasone is a corticosteriod used to reduce inflammation. It can be utilized in four ways: direct injection into a horse's joint, injection into the bloodstream, subcutaneous injection near soft tissues that may be inflamed, or via topical applications.

Betamethasone “is a medication that has legitimate applications in the care of race horses,” Scollay told HRN. “It's not a heinous substance. But it is a substance that we want to control in proximity to a race, largely to protect the safety and welfare, of course, because anti-inflammatories have the ability to mask inflammation, signs of inflammation, that can be warning signs either to the horse's connections or the horse itself that there is an injury present that could escalate into something far worse if pressured.”

The recommended withdrawal period in Kentucky for a betamethasone joint injection is 14 days, so no closer than two weeks before a race. The allowable threshold for betamethasone in a post-race test used to be 10 picograms, but that was changed last fall. Now, no trace amount is allowed.

When used as a joint injection, a typical dose of betamethasone would be nine milligrams, Scollay said.

“But then that drug leaves the joint, enters the bloodstream and is distributed throughout the body,” she told HRN. “And remember that a racehorse has upwards of 50,000 mls (milliliters) of blood. So you're not talking about 21 picograms in that entire horse's body. You're talking about 21 picograms in one ml of blood. And there's 49,999 other mls of blood, not to mention all the other tissues, the muscles, the organs, the brain, the skin, all the other tissues of the body. That drug distributes throughout the entire body. So 21 picograms, you know, you can be a little overly reductive and say that's nothing. But when you can contemplate the total sum of medication that may be in the body at that time point? It's a different story.”

If 21 picograms (remember, 21 trillionths of a gram) were found in a single milliliter of blood, that means upwards of 1,050,000 picograms of betamethasone was circulating through the horse's bloodstream at the time of the test. (That translates to 1.05 micrograms, or 0.00105 milligrams.)

Again, that doesn't include the amount of the medication remaining in the horse's tissues.

All of the above leads to the following question: if Medina Spirit was never administered this medication, how did it get into his system?

Scollay doubts that intentional sabotage is a factor in this case for two reasons. First, horses are under 24-hour security beginning on Tuesday of Kentucky Derby week. Second, the choice of a therapeutic medication to sabotage a horse just doesn't make sense.

Baffert Team Will Fight If Banned From Preakness

While awaiting word from the Maryland Jockey Club concerning the status of Bob Baffert and Medina Spirit (Protonico) for the GI Preakness S., Baffert's lawyer Craig Robertson said he will seek a temporary restraining order if Medina Spirit is not allowed to run.

His status became unclear Sunday when Baffert informed the media that he had been told by the Kentucky Racing Commission that Medina Spirit had tested positive for the corticosteroid betamethasone in tests conducted following the race. A few hours later, 1/ST, the owners of Pimlico, put out a press release stating they were still reviewing the situation. They bought themselves a bit of time when deciding to move the draw for the Preakness from Monday to Tuesday.

“Pimlico has not taken such action yet, Robertson said in a text message. “However, if they do, I will file such a TRO. There is something called due process of law and any rush to judgment or punishment at this point would be premature and unlawful. If anyone takes such action before the split comes back, we will act.”

Baffert told the TDN that he will not, no matter his personal status, be attending the Preakness.

The Kentucky Racing Commission has had little to say about the matter, which probably won't change until after a second lab has tested a split sample. Robertson has already set the ball in motion regarding the testing of the split sample.

“We will be given a list of labs by the Kentucky Horse Racing Commission from which we can chose to send the split,” he said via text. “That list has not been provided yet. No definitive time frame, but past experience tells me that from this moment until split results come back will be at least a couple of weeks.”

Baffert’s Attorney Prepared To File Temporary Restraining Order Allowing Medina Spirit To Enter Preakness

Craig Roberston, attorney for trainer Bob Baffert, told the Daily Racing Form on Monday that he is prepared to file a temporary restraining order if Pimlico Race Course attempts to deny Medina Spirit entry into Saturday's Preakness Stakes.

The Preakness Stakes draw was originally scheduled for Monday, but Pimlico management pushed entries back to Tuesday at 4 p.m. Eastern following Baffert's Sunday morning announcement that the Kentucky Derby winner had tested positive for 21 picograms of betamethasone.

Robertson said he planned to reach out to Pimlico on Monday regarding the legal issues involved with denying Medina Spirit entry to the Preakness. Only the first post-race sample has been tested at this point; this is not enough to disqualify Medina Spirit. That would be possible after the results are confirmed by a second test of the split sample, which has yet to be completed.

Until that point, banning Medina Spirit from the Preakness would be a violation of Baffert's due process rights, Robertson argued.

Churchill Downs made the announcement Sunday afternoon that it would ban Baffert-trained runners from entering, but Robertson said that legal battle has been put on the back-burner until the Preakness situation is resolved.

“We don't even have an official positive yet,” Robertson told DRF. “Any decision to ban him, by anyone, be it Churchill or Pimlico or anyone else, is unlawful.”
