Prat Latest Southern California Jockey to Test Positive for Coronavirus

According to his agent, Derek Lawson, top California rider Flavien Prat has tested positive for the coronavirus.

Because he left California to ride Saturday at Keeneland, Prat was required to take a test Sunday before being allowed to ride at Del Mar. The test results were positive and Prat had to take off all his mounts.

“These athletes, they know their bodies,” Lawson said. “When I picked him up at the airport, he said, ‘I think I have it.'”

Lawson said that Prat is feeling fine and will return to his home in the Los Angeles area to wait out the quarantine period.

Along with Victor Espinoza, Martin Garcia and Luis Saez, Prat becomes the fourth jockey who rode on the July 4 card at Los Alamitos to test positive. For Saez, it cost him the mount on Maximum Security (New Year’s Day) in Saturday’s GII San Diego H. He will be replaced by Abel Cedillo, but trainer Bob Baffert told the Daily Racing Form that Saez will regain the mount once his quarantine period is over.

Prat, who was the leading rider at the 2019 summer meet at Del Mar, will also lose several important mounts and Lawson was quick to blame Los Alamitos for his predicament.

“All of this transpired at Los Alamitos,” Lawson said. “They were so careful at Santa Anita and then at Los Alamitos it was like the wild, wild west. They let everything get out of hand. We only went over there to ride Bellafina and for Baffert. They didn’t do anything. It was like, ‘Come on in, everyone is welcome.’ After how well everything went at Santa Anita, what a shame.”

Hall Of Famer Espinoza Tests Positive For Coronavirus

Hall of Fame jockey Victor Espinoza has tested positive for coronavirus and will be sidelined for at least 10-days, according to his agent, Brian Beach. Espinoza's positive test was first reported by Daily Racing Form.

Espinoza was named on mounts on Friday's opening day card at Del Mar near San Diego, Calif., but was taken off after he was unable to get results prior to the day's races from a coronavirus test he took earlier in the week in Orange County, north of Del Mar. A subsequent test he took in La Jolla, just south of Del Mar, came back positive Friday afternoon.

Espinoza took the tests after experiencing flu-like symptoms earlier in the week and learning that Martin Garcia, whom Espinoza came into contact with last weekend at Los Alamitos, had tested positive for coronavirus. Garcia, formerly Southern California based, rode at Los Alamitos Friday and Saturday and at Prairie Meadows in Iowa on Sunday. Garcia was tested on Tuesday at the direction of officials at Keeneland prior to that track's five-day meet that began on Wednesday, and the results came back positive.

“Victor is fine,” said Beach. “He was feeling flu-y early in the week and on Wednesday, when he found out Martin tested positive, he said, 'Uh-oh,' and got tested. He's not showing any symptoms now.”

Beach said Espinoza has been extremely careful since the coronavirus pandemic was declared in March. “He moved to his home in Del Mar during the Santa Anita shutdown,” Beach said. “He wanted to do everything he could to avoid exposure to this.”

Beach said his understanding is that Espinoza will be unable to ride in California for a minimum of 10 days from the day of the positive test.

Los Al Quarter Horse Racing License On Probation For Ten Days Due To Concerns About Equine Deaths

Los Alamitos escaped a shutdown but did see its racing license placed on probation for 10 days during an emergency meeting of the California Horse Racing Board (CHRB) on July 10. The CHRB notified commissioners and the public of an emergency meeting roughly 24 hours earlier in response to what executive director Scott Chaney described as a spike in equine fatalities.

Los Alamitos just concluded its daytime Thoroughbred meet this week but is scheduled to continue night cards for Quarter Horses until late December.

Discussion amongst commissioners and representatives of Los Alamitos seemed to suggest that an interpretation of whether or not fatality numbers are above average probably varies depending upon the timeframe examined. Chaney pointed out that between Jan. 1 and July 5 of this year there had been 14 racing deaths and five training deaths, compared with five racing deaths and four training deaths during the same period in 2019 — demonstrating nearly a three-fold increase in racing deaths.

When the statistics are examined by the fiscal year however, which in California runs July 1 to June 30, the track seemed more consistent. The calendar year of 2019 had been a good one for Los Alamitos, according to track veterinarian Dr. Rebecca Fitzgerald, but a cluster in the calendar year 2020 brought the fiscal year's figures even with 2018-19.

Chaney also drew attention to what he considered a high number of non-racing/training deaths, which totaled 21 for this year. These “other” causes of death can include colic, respiratory illness, neurologic illness, and musculoskeletal injuries that happen in the barn area.

Drew Couto, Los Alamitos Quarter Horse Racing Association General Counsel, said that fiscal year over fiscal year, combined racing/training deaths have been going down for some time.

“We've seen a prolonged history at Los Alamitos, since 2008 of decreasing racing and training fatalities,” said Couto.

Couto was also asked by commissioners what the track had in mind to improve its numbers. Couto pointed to the fatality review program performed by officials but said Los Alamitos officials had not come up with a plan of action for how to reduce non-racing/training deaths, given the short notice of the meeting.

For most commissioners, that answer seemed to be inadequate. They turned to Fitzgerald and CHRB equine medical director Dr. Rick Arthur for more details on what could be causing the issue.

For his part, Arthur did not support Chaney's statement that action should be taken against the track's license status; in the course of studying racing and training fatalities, Arthur said it's not uncommon to see numbers “ebb and flow”; in some cases, the reasons for that are clear, while in others they aren't. CHRB officials surveyed by Arthur expressed confidence in the safety of the racing surface and in Fitzgerald's work, although she is the lone veterinarian responsible for performing pre-race examinations for the 50 to 60 horses entered each day.

Fitzgerald said she actually believes being the only one to see the runners based at Los Alamitos before each race is a good thing. Having a larger team might mean she would see a horse before one race, and not again for a few more starts, so she would be less likely to notice small changes that can be so crucial to catching underlying injury.

She also said she gets good support from the racing office, which flags horses for additional scrutiny based on changes in class, time off a lay-off and other factors.

Arthur said he didn't believe there was a clear pattern of any one risk factor in any of the fatalities, except that veterinarians and trainers at Los Alamitos seemed to be more likely to rely on greater numbers of intra-articular corticosteroid injections, particularly of cortisone. Arthur is hopeful that a “long overdue” rule to require continuing education for trainers could alleviate some of the “questionable training and horse management” decisions he has seen, though he pointed out those issues are not limited to Los Alamitos.

Commissioners agreed they wanted to see a report from track officials outlining areas of equine health and welfare concerns and planned actions for resolution. They discussed whether to stop racing at the track while such a report could be prepared or whether to simply put the track's license on probation. According to CHRB chairman Dr. Greg Ferraro, this would mean at the end of the ten-day period the commissioners could suspend racing if they aren't satisfied with the report.

Ultimately, most commissioners stated they were hesitant to halt racing without further information about the problem. The final vote was 5-1 for a 10-day probationary period and report (the lone 'no' vote coming from commissioner Wendy Mitchell. The CHRB will hold another emergency meeting July 20 to hear the track's report.

Hollendorfer Files Petition Against CHRB

Hall of Fame trainer Jerry Hollendorfer has filed a petition for writ of mandate and damages in San Diego County Superior Court against the California Horse Racing Board (CHRB) arguing the agency has failed to exercise its regulatory authority and intercede in disputes where several California racing associations have barred the trainer from their grounds.

The petition also raises bias and conflict of interest concerns within the CHRB, contending that these issues have compromised the board’s ability to exercise its oversight authority in an impartial manner.

In June of last year, The Stronach Group (TSG) banned Hollendorfer–one of California’s most prolific trainers–from Santa Anita after four of his horses were catastrophically injured between the end of 2018 and the first half of 2019, when the facility experienced a well-publicized spike in equine fatalities. The trainer remains barred from all TSG facilities in California, including Golden Gate Fields.

Last summer, Del Mar management similarly attempted to bar Hollendorfer from their facility—an action that Hollendorfer subsequently overturned in court. Del Mar president, Josh Rubinstein, said that Hollendorfer requested and was granted 25 stalls this summer at Del Mar.

In an email, Drew Couto, Hollendorfer’s attorney, wrote that the CHRB has failed to exercise its statutory and legal obligations towards Hollendorfer in a “timely or impartial fashion,” and as such, “Jerry’s career has been damaged beyond comprehension, despite his being a licensee in good standing at all times. The CHRB has left Jerry languishing in uncertainty in California for over a year. That’s simply inexcusable.”

Couto added that it appears the CHRB “implicitly condoned” actions taken by the racetracks whereby they intentionally “shifted the narrative” from safety issues “inherent to dirt racing surfaces and poor track management” onto Hollendorfer.

The CHRB’s actions “deprived Hollendorfer of his occupational rights as a licensee, without any of the protections and processes afforded licensees under the law” Couto added, describing the CHRB’s legal obligations as “some of the most important duties and responsibilities of a state regulatory body and licensing agency.”

When asked for a response to the petition, CHRB spokesperson Mike Marten wrote that the board does not comment on pending litigation.

The petition argues that those California tracks that have barred Hollendorfer from training and racing on their premises have used him as a “scapegoat” in response to much broader horse welfare problems, and took these actions in breach of the race meet agreements signed between the trainers and the racing associations.

Because the CHRB is charged with “implementing and enforcing the law equally within its statutory authority and jurisdiction,” it has failed to afford Hollendorfer his rights as a licensed trainer, the petition contends.

“Petitioner seeks judicial relief because, despite his possession of a valid license and subsequent denial of occupational rights and privileges, and substantial economic interests, the CHRB has wrongfully refused to act in conformity with the law, and has thus further deprived Petitioner of his vested fundamental rights–the ability to pursue his licensed occupation and livelihood–without due process and/or equal protection under the law,” the petition states.

Perhaps most damningly, the petition lays out an argument that the CHRB has “abused its discretion and abrogated its duties,” including suppressing evidence and information, covering-up its own involvement in “exclusionary actions,” and denying the existence of possible conflicts of interests among board members.

The petition states that at the end of August last year, Hollendorfer’s legal representative told the CHRB’s chief investigator of concerns that the board was unable to adjudicate on Hollendorfer’s complaints, related to his exclusion, as a result of a “pattern of concealed acts and conduct, the appearance of impropriety, and actual and potential conflicts of interest on the part of several CHRB board members.”

One of the examples given in the petition includes the much-publicized co-ownership of the Richard Mandella-trained Fravel between former board members Chuck Winner and Madeline Auerbach, Tim Ritvo, former TSG CEO, and Stacie Clark, wife of Mike Rogers, president of the TSG’s racing division.

As a result of that discussion, the petition claims, “Petitioner’s counsel understood Respondent’s Chief Investigator to have confirmed that the CHRB was suspending its investigation into Hollendorfer’s complaints.”

Also detailed is an email that Rubinstein sent to Winner, Auerbach, former CHRB executive director Rick Baedeker, and the board’s legal counsel in light of the San Diego Superior Court’s tentative ruling last year allowing Hollendorfer to train and race at the facility during the summer meet.

In the email, Rubinstein argues that the track’s attorney “may be able to sway the judge in person tomorrow,” but also lays out alternate contingency plans in the event Hollendorfer is successful, including rough ideas as to an official track statement.

The petition contends that the email “reflects a preliminary, additional and continuing level of coordination between Respondent and the Racing Associations, and confirms both Respondent’s willingness to abrogate its licensing duties and responsibilities to those private entities, and to act with bias toward Petitioner.”

Rubinstein failed to respond to a request for comment before deadline.

The petition–which calls for the CHRB to conduct a hearing on Hollendorfer’s track bans before “impartial neutral hearing officers”–is the latest in a long series of legal actions that Hollendorfer has taken over the past year as he seeks a professional return to the California racing circuit as a whole, along with redress for the economic toll that events of the past 12 months have had on his career.

At the end of April, Hollendorfer filed a first amended complaint against the Santa Anita-based Los Angeles Turf Club (LATC) in the Los Angeles County Superior Court.

The trainer currently has a string at Monmouth Park, and throughout the past year, has never been barred from the Long Beach-located Los Alamitos racetrack, in Southern California.
