Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.
Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

CALIFORNIA

Track: Santa Anita
Date: 03/11/2022
Licensee: Donald Palmer, owner
Penalty: Suspended license
Violation: Failure to appear at hearing
Explainer: Owner Donald Palmer (DBA: Live Your Dream Racing), having failed to respond to written notice to appear before the Board of Stewards at Santa Anita Park on March 10, 2022, is suspended for violation of California Horse Racing Board rule #1547 (Failure to Appear) pending an appearance at a hearing before the Board of Stewards to answer to charges alleging violation of CHRB rule #1876 (Financial Responsibility- $2,000.93 to DVM John Araujo). Suspension to commence on March 18, 2022. During the term of this suspension, all licenses and license privileges of Donald Palmer are suspended and pursuit to California Horse Racing Board rule #1528 (Jurisdiction of Stewards), subject is denied access to all premises in this jurisdiction.

Track: Santa Anita
Date: 03/12/2022
Licensee: Kyle Frey, jockey
Penalty: Four-day suspension
Explainer: Jockey Kyle Frey who rode MAGNIFICENT RIDE in the second race at Santa Anita Park on March 11, 2022, is suspended for FOUR (4) racing days (March 19, 20, 25 and 26, 2022) for failure to maintain a straight course in the backstretch and causing interference, which resulted in the disqualification of his mount from second to fifth place. This constitutes a violation of California Horse Racing Board rule #1699 (Riding Rules-Careless Riding). Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

KENTUCKY

Track: Turfway Park (for a medication violation that occurred at Churchill Downs)
Date: 03/12/2022
Licensee: Grant Forster, trainer
Penalty: 30-day suspension (15-days stayed) and $500 fine
Violation: Medication violation
Explainer: Upon receipt of notification from Industrial Laboratories, the official testing laboratory for the Kentucky Horse Racing Commission, and confirmed at Analytical Forensic Testing Laboratory, sample number E491165 taken from Epicurean, who finished sixth in the seventh race at Churchill Downs on November 26, 2021 contained Gabapentin in blood (Class 8). After waiving his right to a formal hearing before the Board of Stewards, Grant T. Forster is hereby suspended 30 days and fined $500. Due to mitigating circumstances (number of violations in relation to overall record), 15 days are to be served from March 28, 2022 through April 11, 2022 (inclusive). The remaining 15 days are stayed on the condition that no Class A or class 8 medication violation occurs in any racing jurisdiction within 365 days from the date of this ruling. EPICUREAN is disqualified and all purse money forfeited. Pari-mutuel wagering is not affected by this ruling. During his suspension, Mr. Forster is denied the privileges of all facilities under the jurisdiction of the Kentucky Horse Racing Commission. Entry of all horses owned or trained by Mr. Forster is denied pending transfer to persons acceptable to the stewards. Upon receipt of this ruling, it is required within thirty (30) days to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to summary suspension of license pursuant to 810 KAR 3:020 Section 15 (cc).

Weekly Stewards and Commissions Rulings: Jan. 18-24, 2022

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

California
Track: Santa Anita

Penalty: Three-day suspension

Violation: Excessive use of riding crop

Explainer: Apprentice Jockey Ricardo Ramirez is suspended for 3 racing days (JANUARY 28, 29 and 30, 2022) for violation of California Horse Racing Board rule #1688(b)(8) (Use of Riding Crop–more than six times–fourth offense in the last sixty (60) days) during the sixth race at Santa Anita Park January 17, 2022. Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

 

Track: Santa Anita

Date: 01/22/2022

Licensee: Kyle Frey, jockey

Penalty: Three-day suspension

Violation: Reinstatement of careless riding infraction

Explainer: Having received notice from the California Horse Racing Board that the appeal of LATS Ruling #01 (December 26, 2021) has been withdrawn, the original ruling is reinstated. Jockey Kyle Frey is suspended for 3 racing days (February 25, 26 & 27, 2022). Pursuant to California Horse Racing Board Rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

 

Track: Santa Anita

Date: 01/22/2022

Licensee: John Velazquez, jockey

Penalty: Three-day suspension

Violation: Reinstatement of careless riding infraction

Explainer: Having received notice from the California Horse Racing Board that the appeal of LATS Ruling #21 (January 15, 2022) has been withdrawn, the original ruling is reinstated. Jockey John Velazquez is suspended for 3 racing days (February 12, 13 & 18, 2022). Pursuant to California Horse Racing Board Rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

 

Track: Santa Anita

Date: 01/23/2022

Licensee: Ryan Curatolo, jockey

Penalty: $500 fine

Violation: Excessive use of riding crop

Explainer: Jockey Ryan Curatolo is fined $500.00 for violation of California Horse Racing Board rule #1688(b)(8) (Use of Riding Crop–more than six times–first offense within the past sixty days) during the ninth race at Santa Anita Park on January 22, 2022.

Florida

The following were presented on the Association for Racing Commissioners International's “recent rulings” website, and therefore not reported in as timely a manner as in other jurisdictions.

Track: Gulfstream Park

Violation: Medication overage

Weekly Stewards and Commissions Rulings: Dec. 20-27

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public and where.

There are two important notes. One is that Florida is expected to begin a new system, whereby a panel of stewards–one from the state and two association stewards–will hear medication and riding offenses (more on this in the primer).

There is currently no information on when that panel will begin hearing cases. We will be following developments and updating these weekly reports accordingly.

The other is that, due to the holidays, any rulings from this period that weren't publicly posted in time will be included in subsequent ruling roundups.

California

Track: Santa Anita

Date: 12/26/2021

Licensee: Kyle Frey, jockey

Penalty: Three day suspension

Violation: Careless riding

Explainer: Jockey KYLE FREY who rode JAMMING EDDY in the fourth race at Los Alamitos Race Course Dec. 12, 2021 is suspended for THREE (3) racing days (Jan. 2, 7, 8, 2022) for altering course without sufficient clearance in the turn and causing interference, which resulted in the disqualification of his mount from first to fifth place. This constitutes a violation of California Horse Racing Board rule #1699 (Riding Rules-Careless Riding). Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

Track: Santa Anita

Date: 12/27/2021

Licensee: Roimes Chirinos, jockey

Penalty: $500 fine

Violation: Riding crop offense

Explainer: Jockey ROIMES CHIRINOS is fined FIVE HUNDRED DOLLARS ($500.00) for violation of California Horse Racing Board rule #1688(b)(7) (Use of Riding Crop–more than two times in succession–first offense within the past sixty days) during the eighth race at Santa Anita Park Dec. 26, 2021.

Date: 12/27/2021

Licensee: Jose Ortiz, jockey

Penalty: $200 fine

Violation: Failure to fulfill jockey agreement

Explainer: Jockey JOSE ORTIZ who was scheduled to ride #11 CROSBY BEACH in the first race Dec. 26, 2021 at Santa Anita Park is fined TWO HUNDRED DOLLARS ($200.00) for violation of California Horse Racing Board rule #1872 (Failure to Fulfill Jockey Agreement).

Track: Santa Anita

Date: 12/27/2021

Licensee: Eduard Rojas Fernandez, jockey

Penalty: $500 fine

Violation: Riding crop offense

Explainer: Jockey EDUARD ROJAS FERNANDEZ is fined FIVE HUNDRED DOLLARS ($500.00) for violation of California Horse Racing Board rule #1688(b)(8) (Use of Riding Crop–more than six times during the running of the race–first offense within the past 60 days) during the ninth race at Los Alamitos Race Course  Dec. 12, 2021.

Miyadi Gives Frey A Leg Up To 1,000th Win

Career victory No. 1,000 for jockey Kyle Frey, achieved in Friday's third race aboard Tizlightning, came after getting a leg up from trainer Steve Miyadi, which was entirely fitting given their long, mutually beneficial relationship.

“They told me (about the chance for No. 1,000) in the paddock, I had no idea. If I'd have known that, he's a jinx, I'd have put someone else on the horse,” Miyadi said, joking. Miyadi followed it up with:

“No, he's a good kid. He started working for me when he was a boy. His dad worked for me and didn't want him to be a jockey, and I respected that. But here we are 1,000 wins later. I know the whole family – mom, dad, sisters, brothers – it's a family affair.”

Even so, don't even think about putting Miyadi in the sentimentalist category.

“I've never given him a compliment after he wins a race for me, and that rule still stands,” Miyadi said.

Frey got his 999th win on November 12 but had zero wins last weekend and a runner-up finish in Friday's first race before cracking the milestone by taking Tizlightning, a 2-year-old Lori Gallegos California homebred, wire to wire and narrowly holding off the late charge of Bright Leaf and apprentice Emily Ellingwood at Del Mar Thoroughbred Club in Del Mar, Calif.

“It means a lot,” Frye said. “It was a long road, but hopefully the next thousand will come a little quicker. It means a lot to win it for Steve. I talked to my dad a week or so ago and he (remarked) about how great it would be to get it for Steve. It's pretty cool.”
