NYRA’s O’Rourke Chairs All-Weather Surfaces Committee

The New York Racing Association has announced the formation of an All-Weather Surfaces Committee to study the impact of various racing surfaces on equine injury rates. According to a Wednesday NYRA press release, the committee, which first met last October, will evaluate safety metrics from tracks utilizing all-weather racing surfaces, as well as study the feasibility of broader adoption of all-weather surfaces nationally.

The committee, chaired by NYRA CEO and President David O'Rourke, was formed at the request of the Horseracing Integrity and Safety Authority, as part of HISA's strategic response to several clusters of equine fatalities in 2023.

In addition to O'Rourke, members of the committee also include Keeneland Vice President of Racing Gatewood Bell, Breeders' Cup President and CEO Drew Fleming, 1/ST Racing and Gaming Executive Vice Chairman Craig Fravel, and Del Mar Thoroughbred Club President  Josh Rubinstein.

“Embracing science and technology will ensure the continued success of Thoroughbred racing in the United States,” said O'Rourke. “All-weather racing surfaces can play an important role in our collective efforts to improve safety, and I thank Lisa Lazarus and HISA for the opportunity to advance this discussion among decision makers in the sport.”

The committee is expected to convene regularly in the coming months and will share its findings and recommendations with HISA's Racetrack Safety Committee and with other stakeholders across the sport when complete.

“HISA is grateful to NYRA and to David O'Rourke for leading this effort, and to all the members of the committee for their dedication to equine safety,” said HISA CEO Lisa Lazarus. “This committee's work will be essential in deepening our understanding of all-weather surfaces, and we look forward to reviewing the results when complete.”

NYRA is in the process of constructing a one-mile Tapeta track to serve as the fourth racing surface at the new Belmont Park. Previously, NYRA installed a Tapeta pony track at Belmont to provide an additional training option in inclement weather, while also providing NYRA with information on the performance of a synthetic surface in the Long Island climate.

ICHA Conference Highlighted by Equine Welfare

The 57th International Conference of Horseracing Authorities, focused this year on safeguarding equine welfare and exploring shifts in societal expectations and the sport's response around the world, took place on Oct. 2 at Saint-Cloud racetrack in Paris.

Organised by the International Federation of Horseracing Authorities (IFHA), the day-long conference emphasized horse racing in a changing society, safeguarding equine welfare and explore shifts in societal expectations and the racing industry's response around the world.

“Today we continued what has been a chief mission throughout the life of the Federation: equine welfare,” IFHA Chair Winfried Engelbrecht-Bresges, who delivered the Conference's opening and closing remarks, said. “This Conference provides an opportunity to focus and build upon the significant body of work which has been carried out domestically and internationally over many years by our members to protect our equine athletes.

Moderated by racing presenter Nick Luck, speakers on the day included Professor Natalie Waran, Chair of the Independent Commission for Equine Ethics and Wellbeing for the International Federation for Equestrian Sports (FEI); Lisa-Jane Graffard, General Secretary, Au-Delà des Pistes; Julie Harrington, Chief Executive, British Horseracing Authority (BHA); Najja Thompson, Executive Director, New York Thoroughbred Breeders' Inc. (NYTB); James Given, Director of Equine Regulation, Safety and Welfare, BHA; Josh Rubinstein, President, Del Mar Thoroughbred Club; Brian Stewart, Head of Veterinary Clinical Services, The Hong Kong Jockey Club (HKJC); Sonia Wittreck, Stud Book & Doping Control, Head of Department, France-Galop; and Hiroshi Ito, Counselor of the Japan Racing Association (JRA).

During her speech, Waran presented key strategies for equine sports to proactively consider amidst changing societal expectations. This included increasing continuing education for anyone working hands-on with equine athletes to better their welfare.

“Our changing social values in relation to animals have affected different industries in different ways,” said Waran. “It is important to recognise that society does not distinguish between different equestrian sports. There is enough data out there to show that the concerns around horse involvement in sport are rising. The racing world must positively engage with both perception and reality and show real commitment to change to ensure positive welfare.”

Following her keynote, a panel of senior racing administrators including Lisa-Jane Graffard, General Secretary, Au-Delà des Pistes; Julie Harrington, Chief Executive, British Horseracing Authority (BHA); and Najja Thompson, Executive Director, New York Thoroughbred Breeders' Inc. (NYTB), shared their approaches and strategies to shape the narratives surrounding equine welfare and racing.

The next panel of the Conference featured leaders from racing administration and veterinary science who explored protecting the sport's equine athletes. Speakers included James Given, Director of Equine Regulation, Safety and Welfare, BHA; Josh Rubinstein, President, Del Mar Thoroughbred Club; Brian Stewart, Head of Veterinary Clinical Services, The Hong Kong Jockey Club (HKJC); and Sonia Wittreck, Stud Book & Doping Control, Head of Department, France-Galop.

“Getting the balance right is part of training, but it is also something technology can help us with,” said Stewart. “If we do have a problem, we have to be able to achieve an accurate diagnosis, and that will guide our future management of that horse. Things are now coming together, and I am quite hopeful we might be able to make a significant difference.”

Also, Charles Scheeler, Chair of the Horseracing Integrity and Safety Authority (HISA) in the United States, gave an update on the organisation, including a review of the implementation of the Anti-Doping and Medication Control (ADMC) program and future developments.

“HISA is working under the supervision of the Federal Trade Commission and in partnership with the members of the sport to transform horse racing,” Scheeler said. “The essence of this effort is the creation of an ecosystem of care surrounding horses. We remain excited about horse racing's future in the United States, and we recognise that we have a rich legacy to protect.”

The final session of the Conference looked in-depth at enhancing stakeholder engagement, specifically regarding public engagement and response in relation to equine welfare. Nevin Truesdale, the Chief Executive Officer of The Jockey Club (UK), began the session with a discussion of his organisation's experiences with effective resolution and communication management.

“We need to operate together on this,” said Truesdale. “Having a clear set of messages as an industry, everyone singing off the same sheet, became really important for us in the lead up and the aftermath of Epsom. We have to be relentless in continuing to make the sport safer and in telling that story. There is a persuadable audience, statistics show us that, but that will only work for us if we are clear on the changes we are making. Standing still on this is not optional.”

The first International Conference of Horseracing Authorities was organized and hosted by the Société d'Encouragement in Paris, France, on Oct. 9, 1967. Since 1994, the annual conference has been organized by the IFHA and The JRA became the official partner of the Conference beginning in 2021. This year's Conference convened delegates from about 40 different countries, with a number of other racing executives and media members in attendance.

Hollendorfer, Del Mar Reach Settlement in Lawsuit

Hall of Famer Jerry Hollendorfer and the Del Mar Thoroughbred Club (DMTC) have reached an agreement in a lawsuit stemming from events during the summer of 2019 when the track temporarily barred the trainer from its grounds, according to a notice of settlement recently filed in the San Diego Superior Court.

The notice included no specifics.

“The terms of the settlement are to remain confidential,” explained Hollendorfer's attorney, Drew Couto.

DMTC president, Josh Rubinstein, confirmed the settlement in an emailed statement.

“The resolution of this litigation does not reflect the merit of or any acceptance of liability by any party,” Rubinstein wrote.

The 22nd District Agricultural Association, which manages and operates the Del Mar Fairgrounds, is also a defendant in the suit.     This resolution is the latest domino to fall in a sprawling series of cases filed by Hollendorfer after The Stronach Group (TSG) barred the trainer from its facilities in June of 2019. The company took the action after four of the trainer's horses were irreparably injured during Santa Anita's ill-fated 2018-2019 winter/spring meet.

This was a time when the track experienced a well-publicized spike in equine fatalities during an unusually wet spell. Hollendorfer has faced no formal regulatory sanctions for events that occurred during the meet.

Del Mar followed TSG's lead in barring Hollendorfer from its grounds, but the trainer successfully overturned the track's ban in court in July of that year.

Events from the summer of 2019 spawned a handful of different lawsuits, most of which are now resolved.

Last June, Hollendorfer and TSG-controlled subsidiary owners of Santa Anita Park and Golden Gate Fields reached a settlement, the details of which were similarly undisclosed. Hollendorfer has not started a runner at any TSG-owned facility since that original 2019 ban.

Last month, the Blood Horse reported that a San Diego Superior Court judge had dismissed Hollendorfer's case against the California Horse Racing Board (CHRB).

According to Couto, Hollendorfer intends to appeal that ruling.

“The court is aware that Mr. Hollendorfer will be appealing the decision in that case,” he said.

Hollendorfer has been an annual face at Del Mar since the summer of 2019, but at a significantly diminished presence compared to the halcyon years of his numerical dominance which led him to multiple leading trainer titles. Last summer at the track, he trained one winner from just 15 starts.

Filings with the San Diego Superior Court show that Hollendorfer has claimed several causes of action against the DMTC, mainly focused on the impacts from DMTC's actions on his business.

Among them, Hollendorfer argued that the DMTC's actions deliberately interfered with existing “contractual obligations” with several of his clients, and that it was done in part to protect the track's own bottom line.

Hollendorfer also claimed in court filings that the DMTC “conspired” with five other key California-focused industry organizations, including TSG and the Thoroughbred Owners of California (TOC), “to enact a group boycott that prevented Plaintiff from racing and stabling” horses in his care.

“The conspiring parties did so in order to prosper economically by avoiding responsibility and shift blame to Plaintiff for dangerous and inherent conditions at their racetracks. Primary objectives of the group boycott included the manipulation of public perception and deflection or misdirection public attention, scrutiny, and inquiries,” filings show.

Court documents show the DMTC pushing back against Hollendorfer's claims the track intentionally harmed his business, in part to protect its own economic interests. For example, the DMTC argues the trainer failed to prove the track had adequate prior knowledge of the trainer's “contractual relations” with his owners prior to banning him, including specific contractual details.

Court documents also show the DTSC countering Hollenderfer's claims the alleged group “boycott” was done to benefit the groups' members.

“There are no facts showing how DMTC or the District benefitted from the alleged group boycott,” filings state.

Hollendorfer sought to recover damages from DMTC for economic and reputational harm, filings show.

Hollendorfer's training operations have seen marked declines since TSG's ban was enacted in 2019. In 2018, he won 176 races and accrued over $7 million in earnings, according to Equibase. So far this year, he has won 14 races and won just under $670,000.

Over the weekend, a Monmouth Park press release detailed how the trainer had transferred 29 of his horses stabled at the track to long-time assistant Dan Ward, with a view to scaling back his operations to California only.

“I just want to concentrate on what I'm doing here in California,” Hollendorfer is quoted in the press release. “Dan and I have discussed for a while that he wanted a chance to go out on his own. Now seems like a pretty good time to do that.”

With No Main Track Racing Fatalities in ’22, Santa Anita Continues to Make Strides on Safety

It's been some four years since Santa Anita suffered through some of the worst times in its long and otherwise glorious history, a prolonged period where horses were breaking down and dying at an alarming rate. Aidan Butler, the chief executive officer at The Stronach Group 1/ST Racing and Gaming, the corporation that owns Santa Anita, is still haunted by that period, so much so that he says he has nightmares about horses breaking down.

“It was horrific,” Butler said. “Can you imagine having bloody helicopters from the news stations flying over the track every time a horse was injured.”

Butler was relatively new to the job at the time, and a fresh perspective was helpful. While some were quick to tell him that the breakdowns were “part of the game,” he represented a management team that refused to accept what was happening and knew that Santa Anita may not survive unless they fixed the problem. So they went to work.

So when the field safely crossed the wire in the Dec. 31 Las Flores S., the last race of the year run on the main track, Butler could have been excused had he popped open a bottle of champagne. The year was over and not a single horse had suffered a fatal injury during a 2022 dirt race at Santa Anita.

“That's one of those things you hope for but it seems almost impossible,” said Dr. Dionne Benson, the chief veterinary officer for the Stronach Group. “I could not be more thrilled with the work done by everyone involved. And that is what has made all the difference.”

There was also plenty of good news last year at Del Mar. Not a single fatality occurred in a race during either of the 2022 Del Mar meets. There were two fatalities during fall racing, both were non-musculoskeletal and were classified as sudden death.  In 2019, the track experienced two deaths during races.

“Since we implemented a series of reforms four years ago, including enhanced training protocols and increased veterinary and track surface monitoring, Del Mar has been one of the safest tracks in the country for horse and rider,” said Del Mar President and COO Josh Rubinstein. “It is great to see similar progress throughout the state, though we know safety and welfare are ongoing and we need to stay vigilant.”

At Santa Anita, the numbers in 2019 were ugly. During the meet that began on Dec. 26, 2018 and ran through June 23, 2019, 30 horses died. And that was with Santa Anita shutting down for three weeks to try to get the problem under control. The media was relentless and every breakdown became a major story. Animal rights groups like PETA were putting immense pressure on Santa Anita and some were calling for racing to be shut down in the state.

“At the time it was a very angry place and everybody was pointing fingers at everyone else,” Butler said. “A lot of it was completely unnecessary. Nobody wants to see animals get injured. Its not good for anyone's business.  But 2019 gave us the ability to look at things differently because things had really gotten bad. Everybody understood that something had to change. Something had to give.  Horsemen, owners, trainers, everyone, understood that business as unusual will not fly anymore. The emphasis on safety had to be the core of the sport because without it the sport could be in jeopardy.”

The question became, what can be done? There will probably always be fatalities in racing, but can steps be taken to reduce the numbers significantly to the point where Santa Anita is no longer the most dangerous track in the country but one of the safest?

“Everything we do must have an emphasis on safety,” Butler said. “That's bandied around a lot and everybody likes to talk about safety and how they want the races to be safe. We had an opportunity in 2019, albeit after an awful situation, to really reset the clock and look at every aspect of how we operate at Santa Anita.”

So what they did was look at virtually every aspect of the sport and try to figure out how they could make things safer. While many factors were in play, the one that seems to have produced the most results was management's decree that horses had to constantly be under the microscope and constantly subjected to veterinary exams. In 2022, 5381 veterinary exams were conducted on 4,673 unique horses.

“If I could pick one thing that had made a difference is the vet-trainer inspection prior to a workout or a race,” said trainer Eoin Harty, the president of California Thoroughbred Trainers. “You're forced to stand there and watch your horse jog up and down the road with your vet. If there is any doubt whatsoever your vet isn't going to sign off on it because it's going to be on his head if something happens. They have to sign a book that says the horse is good and that information is turned into the racing office. All the checks and balances have to be in place.”

Benson said that trainers have learned not to attempt to race or work horses if they are having any problems that could lead to an injury.

“It's been an effort by the veterinarians that we have who work for Santa Anita as well as the private veterinarians,” Benson said. “We look very critically at horses to make sure they are ready to race. And the trainers are doing an excellent job of horsemanship and making good decisions for their horses.”

Harty said that while trainers don't like all aspects of the extra scrutiny they have come to understand that it is necessary.

“Initially, there was some push back,” he said. “But trainers in California realized at the time that we were in a dire situation and unless everybody got on board and started pulling with the same oar potentially we were going to be out of business. There is always resentment when there is a change like that but in general horsemen have come to embrace this. People can adapt very quickly when they have to.”

Management has also been extra cautious when it comes to the racing surface and hired Dennis Moore to be the track superintendent. Concerned that when there is too much moisture in the track problems could arise, Santa Anita will cancel when the weather gets to be a problem. That was the case over the last few days when racing was cancelled on both Saturday and Monday due to heavy rains in the area.

Butler said another factor has been a crackdown on the use of medications used to block or numb pain.

“We're making sure any horse out there isn't on any pain blocking medications,” he said. “With any athlete, if you have anything wrong, medications that block the pain is where larger problems can start.”

The numbers weren't perfect at Santa Anita in 2022. When turf racing, training on the main track, training on the training track and sudden deaths are included, there were 12 deaths at the track in 2022. While that's 12 too many, it represents a major decline from recent years. During the fiscal year that ran from July 1, 2018 to June 30, 2019, there were 49 total deaths at Santa Anita.

Maybe there will come a time when 12 deaths seems like a lot, and the Santa Anita team has vowed to keep working to reduce the number to as a close to zero as a racetrack can come. In the meantime and after the situation had hit a rock-bottom level, it's not lost on anyone at Santa Anita how much better things have gotten.

“What happened in 2019 is that it opened up our eyes as to how we must make this sport safer,” Butler said. “Because if we didn't the sport was going to be in jeopardy and be in jeopardy quickly. Luckily for us, Belinda Stronach is not the sort of person to shy away from a battle. We engaged in what we thought was the only way to try to fix things and the numbers we see now speak for themselves. By fixing things the way we did I think we potentially saved the sport in California.”
