Equine Fatalities on the Decline in California

Last week, a Santa Anita press release had the misfortune of arriving amid the squall of a busy news cycle.

In a nutshell, the release shared this not insignificant titbit: The track had wrapped a 16-day race meet, and a one month and 20-day training period, with zero fatalities. Since the beginning of the winter/spring meet last December, there have been five racing fatalities–zero on the main dirt track–from 5,069 individual starts.

The resulting ratio for the year of an average of 0.98 fatalities per 1,000 starters made Santa Anita “currently the safest racetrack in the nation,” according to the release. The national fatality rate is 1.53 per 1000 starts.

This is quite the reversal from 18 months prior, when Santa Anita was dubbed a “death trap.” Last year at the facility, the fatality rate was 3.01 per 1000 starts.

As it was, the news disappeared somewhat into the ether–but not by those at the front line.

“It is great to see what we’re doing, and what’s being done, that there are positive results,” said racetrack veterinarian Jeff Blea, past president of the American Association of Equine Practitioners.

The news also followed on the heels of another successful Del Mar summer meet where the facility saw only one racing fatality for a ratio of 0.42 per 1000 starts, and two training fatalities.

Stepping back to look at the year thus far through Oct. 28, California as a whole is operating at a rate of 1.64 fatalities per 1000 starts (including Quarter Horse starts). Over the 2019-2020 fiscal year–the basis of the California Horse Racing Board’s (CHRB) annual reports–the state-wide fatality rate was 1.4 fatalities per 1000 starts (including QH starts). It should be noted that Quarter Horse deaths constitute a disproportionate percentage of overall fatalities in the state.

Zeroing in on Los Alamitos–the subject of an emergency CHRB meeting in July due to a spike in catastrophic injuries–the facility concluded its two-week day-time summer meet with zero Thoroughbred racing and training fatalities.

“It would be an understatement for me to say that Los Alamitos has doubled its efforts because it’s done more than that,” said Jack Liebau, vice president of the Los Alamitos Racing Association, of the safety reforms the track has instituted since July. Indeed, since that emergency meeting, there has been one Thoroughbred and five Quarter Horse racing fatalities, and zero training fatalities, according to the CHRB.

Of course, none of this is playing out in a vacuum, with trainers, breeders and owners in California operating under what California Horse Racing Board (CHRB) medical director Rick Arthur says is the most stringent regulatory environment in the country–in some regards, globally. Economic constraints are an obvious tradeoff.

Earlier in the year, the TDN reported how reduced horse inventory at Santa Anita had a knock-on effect over field size and handle, while some backstretch workers had even turned to Uber-driving to supplement their income–and all this before the pandemic hit.

“Everybody is glad that the heat is off us,” said Eoin Harty, president of the California Thoroughbred Trainers (CTT). “Whatever protocols have been implemented are obviously working.”

But the COVID crisis has only heightened economic pressures on trainers, he added.

“The biggest concern going forward is the purse funds, how we generate them, how we elevate them.” Harty said. “It’s hard enough to win a race in California as it is,” he added. “And when you can potentially go somewhere a little easier for a lot more money, it becomes very inviting.”

Nor should the industry rest on its laurels when it comes to the downward trend in fatalities, cautioned Blea.

“They’re racehorses and they’re athletes, and because they’re athletes, they’re always at risk of getting hurt,” he said, emphasizing the element of unpredictability that working with horses brings. “Anything can happen. It can happen out in the field, in a stall. It can happen out on the racetrack.”

“Fractures Just Don’t Happen Overnight”

   The arc of regulatory change in California these past 18 months has been broadly encompassing: tougher scrutiny during both training and race-day, more rigorous pre-race examinations, stricter medication policies, whip use reform, and greater public transparency of even low-level medication violations.

Consequently, many struggle to identify solitary reasons behind the decline in fatalities–a multifactorial issue as it is. Rather, they look at the gestalt of a wholesale cultural shift.

“You can have the greatest procedures and protocols, but if you don’t get stakeholder buy-in, it’s not worth a whole lot,” said Josh Rubinstein, president at Del Mar Thoroughbred Club, where the track’s high fatality rate during the summer of 2016 precipitated a comprehensive set of successful safety reforms.

“There’s been a change in culture, in a good way,” Rubinstein added. “For us, it’s been four years of continued improvement in safety.”

That said, some noted individual factors peculiar to the California experiment. Tom Robbins, Del Mar’s executive vice president of racing and industry relations, is quick to sing the praises of track superintendent Dennis Moore, whose expertise is shared among various Southern California tracks.

“Dennis came on board early 2017,” said Robbins, “and was given the green light to do anything that he felt was important to do.”

Santa Anita management emphasize a fairly new position: That of the “vet monitor” working alongside the “secondary vet” who scrutinizes the horses–typically from the finish line–on raceday.

The secondary veterinarian’s view of the horses on raceday is fairly limited, explained Amy Zimmerman, senior vice president and executive producer at Santa Anita. “As the horse goes around the backside, they lose sight of them. The only place they’re able to watch them is on the big screen monitor which is just showing one horse at a time.”

The new vet monitor, however, has access to feeds from the various cameras around the track, all of which are hooked up to a series of monitors in one room.

“What we did is mirror what they have in a TV truck,” Zimmerman said.

If the vet monitor spots a potential problem, they can request an isolated–and non-public–camera feed on a specific horse, and then if necessary, ask the on-track veterinarian to conduct an evaluation of that horse, Zimmerman added.

“Every person has only two sets of eyes, and they can only look at one thing at a time,” said Zimmerman, the brainchild of the additional monitor. “This allows more eyes on safety from people who are qualified to do that.”

Indeed, the vet monitor has a basis of comparison for many of the horses having also been involved in the pre-race examination program.

“It also is giving them the ability to watch the horses on the gallop out,” Zimmerman added. “If they don’t like the way a horse finishes, they can go back and look at [the horse] the next day or two days later and see how it really came back.”

According to G.D. Hieronymus, Keeneland’s director of broadcast services, the track will have a similar position in place “hopefully” by the spring. “This is something that all tracks need,” he said.

Many experts will say, however, that a problem has gone too far if a state vet scratches a horse the day of a race. Which is where Santa Anita’s two new imaging technologies–the Longmile Positron Emission Tomography (MILE-PET) Scan machine and standing magnetic resonance imaging (MRI) unit–appear to have played no small part.

“Disease is a process–fractures just don’t happen overnight,” said SoCal-based private veterinarian Ryan Carpenter, who earlier this year said that these modalities have “100% saved lives.”

“When you can understand bone remodeling and you can understand the disease taking place over time, then you have the ability to intervene before the fracture occurs. That’s where our ultimate goal is as veterinarians,” Carpenter said. “And that’s what the PET scan and MRI has helped us to do.”

Carpenter explained that prior to the arrival at Santa Anita of these two units, he and the other researchers expected to conduct only one or two scans a week.

“I know they’ve got four MRIs to do today and tomorrow,” he said, earlier last week. In all, they have conducted 164 PET and 89 MRI scans thus far.

“We’re doing more of them than we ever imagined,” he said.

Challenging Year

What isn’t imagined for many trainers and owners in California–especially those operating at the lower end of the economic ladder–is the weight of the additional constraints, financial and otherwise, that the past 18 months have introduced to operating a barn in California.

“This has been a very challenging year for everybody,” said Arthur, admitting that some of the measures–such as the medication restrictions during training–constitute a “paradigm” shift across the backstretch community.

“I don’t know any other state that’s currently regulating medications during training,” said Arthur. As such, “There is a transition period from the way they used to do things to the way they have to do things today,” he added.

During the 2019-2020 fiscal year, 0.2% of work bloods–required for removal from the vet’s list–resulted in a Class 1, 2 or 3 medication positive, and 2.6% resulted in a lesser Class 4 or 5 finding. During Out-of-Competition testing, 1.4% of the samples had a Class 4 or 5 positive.

“A large number of our findings would not be a violation in other states,” Arthur explained. “And those finds are not a reflection of drug or medication abuse, but really how tightly California regulates drugs and medications.”

Have some of the reforms gone too far?

“I think it is potentially unfair,” he said, of a statutory change to come into effect Jan. 1 whereby drug positives confirmed through split sampling–or even earlier if the licensee declines to request split-sample testing–will be posted on the CHRB website before complaints are issued. “Horseracing is a very competitive business for trainers and owners. I think a lot of people jump to conclusions.”

While the reforms had already loosened the soils around the state industry’s economic roots, the pandemic has taken a hacksaw to the trunks, with a marked shift towards ADW platforms that, when compared to wagering at brick and mortar facilities, funnels fewer funds into the state’s purse account.

As the TDN reported earlier in October, compared to a comparable eight-month period in 2018, the number of races this year has declined 30%, and while the overall handle has declined 18.8%, purse revenues have dropped more than 26%.

“The cost of doing business is going up and the purses available to make sense of the economic model are not commensurate with the rate of inflation of horse ownership,” said Eclipse Thoroughbred Partnerships president Aron Wellman.

And while Wellman said that he “applauds the powers that be for putting out the fires,” given the harsh economics of running a solvent operation in California at the moment, some of the measures, he added, are a “little too extreme.”

Between the reforms and the cost of doing business, “It’s a balancing act,” said Wellman.

For a number of other stakeholders interviewed for this story, the fix is simple: Uniform standards across all states so that trainers and their owners are operating on a level playing field.

In that regard, “what you’re seeing with federal legislation, and other states such as New York and Kentucky–they’re going to be implementing the same things as we have here,” said Rubinstein, pointing towards the Horseracing Integrity and Safety Act, and the proposed whip reforms in New York.

“As challenging as it has been in California,” Rubinstein added, “we feel like, as a group we’re doing the heavy lifting early on here, and we’re ecstatic that others are attempting to catch up.”

Anatomy of California Response to Pandemic

When Victor Espinoza rolled through the gates of Los Alamitos racecourse on the afternoon of Saturday, July 4, he did so anticipating a quick in-and-out with few disruptions. The Triple Crown-winning jockey had two mounts, in the eighth and ninth races, neither of them hot fancies.

Approaching the jocks’ room, however, Espinoza paused.

“There wasn’t enough room for all of us,” said Espinoza of the room’s quarters, which had been split between Quarter Horse and Thoroughbred riders. “We were stacked in there like sardines.”

Events from that afternoon have played out like a serialized medical drama, with one jockey after another testing positive for COVID-19, first Martin Garcia, then Luis Saez–both of them riders from out of state.

Espinoza’s two rides yielded no wins that day and he returned home as usual. Two days later, “it hit me pretty bad,” he said of symptoms including headaches and body pain.

Aware of Garcia’s positive diagnosis, Espinoza sought his own test–positive–after which he alerted Del Mar management.

A weekend of live racing later, Del Mar tested all of the track’s jockeys and jock’s room personnel, with 15 riders proving positive for COVID-19, all reportedly asymptomatic.

Many in the industry have been quick to point the finger of blame at Los Alamitos–something Dr. Ed Allred, who owns and operates Los Alamitos, takes umbrage with.

“Our track doctor [Michael Morris] assures me he was careful,” said Allred, who added that, while hindsight would suggest prior jockey testing and better social distancing in the jock’s room might have been wise, the vagaries of the virus–which includes an incubation period of between 2-14 days–mean that it’s hard to pinpoint exactly when and where the infections occurred.

“The idea that this has started at Los Alamitos is poppycock,” he said.

Los Alamitos had suffered only one positive test–a backstretch worker in early May–prior to the track’s short two-week Thoroughbred meet, said Allred. Last week, Los Alamitos conducted tests on 49 riders and various track employees–mandatory for the former, voluntary for the latter–which yielded nine positives, all of them jockeys, he added.

But now that racing in California has entered into a second temporary suspension of live racing, coupled with the recent patchwork of subsequent positives, tough questions are being asked over the industry’s response so far, and its plan of action into the future.

Certainly, there have made missteps–lost tests, misguided protocols, slow lines of communication.

At the same time, industry figures are quick to highlight the unprecedented nature of this public health crisis, including the slippery complications of shifting guidelines from a variety of local, state and federal agencies, along with limited and sometimes inaccurate testing availability and equipment.

Still, lessons can be learned, experts say. As the pandemic in the U.S. shows no sign of abating, and as medical resources continue to run thin, these lessons will need to be adopted quickly, especially as the industry in California remains under a public microscope unlike any other jurisdiction in the country.

“Racing is not an essential service,” warned Dr. Ghazala Sharieff, corporate vice president and chief medical officer at San Diego’s Scripps Health, who has provided Del Mar with medical guidance. Individual responsibility, she added, is paramount.

“If people can’t follow the guidelines, and we have all these outbreaks, the better part might be to unfortunately say, ‘No more racing.'”

“It’s frustrating”

When the pandemic closed Santa Anita’s doors at the end of March, the impetus was to resume live racing as quickly and safely as possible, said Aidan Butler, acting executive director of California racing for The Stronach Group (TSG).

“We made a statement when we were shut down, and it was a true statement,” said Butler, pointing to the industry’s fragile economic ecosystem. “‘You’ve got to get us going or we’re going to have a humanitarian and animal welfare issue.'”

By and large, the protocols that Santa Anita built into the race-day furniture, including the mandatory testing of jockeys before each weekend of live racing and the efforts to separate the front side community from the backstretch, were warmly received. Terry Meyocks, CEO of the Jockey’s Guild, held them up as a possible gold standard other tracks should seek to emulate where possible.

The porous nature of the backstretch, however–with veterinarians, trainers, exercise riders and farriers coming and going daily–is an Achilles heel of every track. According to the Los Angeles County Department of Public Health, there were 38 confirmed infections at Santa Anita, with 10 symptomatic cases awaiting confirmation. Testing problems suggest this could be an undercount.

According to trainer Ben Cecil, when his foreman tested positive for COVID-19 near the end of May, he sent his team of eight employees to be tested by Santa Anita’s own medical personnel.

However, when Cecil checked on the results some 10 days later, he was told the samples had been lost, he said.

“By the time I found that out, there wasn’t much point in testing everybody again,” he said.

None of the untested employees became sick, he added.

“I think personally, our guys on the ground might have been slightly overwhelmed with the level of pressure and stress they were under,” admitted Butler, about the lost samples. “But I think as we moved forward, we became far better at it.”

Arguably the greatest obstacle to backstretch testing appears to be limited testing capacity within LA County as a whole–a problem since the start of the pandemic.

When one of trainer Jim Cassidy’s exercise riders returned from a weekend trip to Las Vegas carrying the virus, Cassidy sent his other employees to the nearby Methodist Hospital in Arcadia, opposite the racetrack–what had hitherto been a popular testing destination for the backstretch community–only for the workers to be turned away.

“They were told that there were too many race-trackers coming over to get tested,” said Cassidy. “They never did get tested.”

TDN reached out to Methodist Hospital for comment, but did not receive a response before deadline.

According to Cliff Goodrich, executive director of the California Thoroughbred Horsemen’s Foundation (CTHF), which is responsible for backstretch healthcare, Methodist Hospital adopted a policy of testing only those who are symptomatic.

“It’s frustrating when you’re doing what the health department calls for to test anybody who came in close contact with an individual who tested positive, and then have a hospital say, ‘We’re only testing those showing symptoms,'” said Goodrich.

“There’s always room for improvement”

Besides the daily traffic in and out of the backstretch, live racing has maintained open channels between tracks, none more so than between Santa Anita and Los Alamitos, which maintained live racing throughout the pandemic. Los Alamitos carded additional Thoroughbred races during the evenings–races that proved popular with several Santa Anita-based trainers.

As the latest Santa Anita meet drew to a close, Santa Anita convened a “Working Group” consisting of key representatives from Del Mar, Los Alamitos, California Thoroughbred Trainers and the CTHF to share information.

According to Josh Rubinstein, Del Mar Thoroughbred Club president, Santa Anita provided overall testing numbers and individual results in a timely way.

“Santa Anita management was also great about sharing what they felt were best practices from their experience,” he wrote in an email.

Since the Del Mar stable area opened its doors June 26, five backstretch employees have tested positive, confirmed Rubinstein.

Some industry figures, however, argue that vital information could and should have been shared much sooner among all necessary stakeholders. The first working group call occurred on June 20, with closing day at Santa Anita just one day later.

According to Jack Liebau, vice president of the Los Alamitos Racing Association, he was unaware of the “extent” of the infection within Santa Anita’s backstretch until “Yahoo News” alerted him to an LA Times report July 12.

When asked whether Los Alamitos had similarly shared with other associations information concerning the backstretch employee who had tested positive, Liebau responded that the individual “was not known” to go to either Santa Anita or Del Mar. “Los Al backside is pretty much a self contained one,” he wrote in an email.

Privacy restrictions through the Health Insurance Privacy and Portability Act (HIPPA) pose barriers to the free flow of information, explained various officials, despite these laws having been relaxed in response to the pandemic.

“The original intent was to build something of a database that specific associations would have access to,” said Butler. “Unfortunately, the lawyers put the fear of God into everybody, including ourselves.”

Still, “there’s always room for improvement,” said Goodrich, about the way information has been shared among necessary stakeholders, adding that patient permission would also help to open those lines of communication further. “It would become easier to share information among a key group.”

“Why do we need to move from place to place?”

As the fallout from the July 4 weekend unfolded, several of Del Mar’s jockey COVID protocols proved a lightning-rod for criticism, none more so than the decision not to conduct mandatory testing of jockeys before opening day.

“If I was a reckless person, then I could have just gone and ridden opening day,” said Espinoza, adding how by that time, his symptoms had disappeared. “Nobody would have known I was infected, even myself.”

According to Sharieff, the reasons behind the decision not to mandate uniform jockey testing were largely two-fold. One concerns the possible deceptive nature of negative test results.

“Just because you get a negative test one day, does not mean even the same day or the next day you can’t start having symptoms,” Sharieff said. “There’s that period in-between testing where you can infect a ton of people and think you’re safe.”

The other surrounds restricted testing capability in San Diego County.

“As we get even tighter on tests now–we just got notified about a shortage, we’re down to less than a month of supplies–we’re going to tell you, ‘If you have symptoms, you need to stay home and self-quarantine,'” she said. “Even the governor now says not to do asymptomatic testing.”

Santa Anita contracted out the weekly testing of jockeys to a private company. When asked how limited capacity in the county might impact Del Mar’s intended weekly jockey testing, Rubinstein wrote that, “We are confident that we’ll be able to source testing resources as needed.”

“I get it, people are social”

As the track gears up towards a resumption of live racing next weekend, what specific lessons can be gleaned from the industry’s response thus far?

The TDN asked the California Horse Racing Board (CHRB) about what guidance the agency has provided during the pandemic.

CHRB spokesperson Mike Marten responded, “We issued an advisory Mar. 26 stating that local health authorities have jurisdiction in these matters, but that we would assist them on request. We have had communications with local health authorities and assisted when requested to do so, but the principal contact is between the track and health authority. The CHRB has taken direct action at racetracks to protect CHRB employees, including the closure of licensing offices when warranted.”

The CHRB failed to respond to multiple follow-up questions, including further agency guidance.

According to Liebau, effective action boils down to “more and more testing, and more transparency in the results of that testing.”

Liebau also posited an idea to limit the movement of people: isolate live racing to one facility.

“If we don’t have spectators, why do we need to move from place to place?” he said.

Butler said that regulations at Santa Anita will continue to be tweaked. He highlighted an intended additional precaution at Golden Gate Fields, whereby those who don’t live on the backstretch will be required to wear face shields along with their masks.

At the end of the day, said Sharieff, the more we practice individual responsibility–wearing masks, rigorous hand hygiene and social distancing–the greater the likelihood of stemming further spread of the virus.

“I get it, people are social,” said Sharieff. “It’s across the board, people feeling like, ‘The county’s opening up, we’re safe.’ But that’s actually the wrong message, and now we’re closing back down again for the same reason–people aren’t being careful. And if [individuals] wants to keep racing, they’re going to have to do better.”

Los Alamitos Summer Thoroughbred Festival Wraps Up

An impressive stakes debut for Uncle Chuck, a successful return to California for Sneaking Out  and a two-turn tally for Cezanne highlighted the Summer Thoroughbred Festival at Los Alamitos in Cypress, Calif.

The brief seven-day season concluded Sunday.

A son of Uncle Mo and the Unbridled's Song mare Forest Music, Uncle Chuck toyed with three rivals in the Grade 3, $150,000 Los Alamitos Derby July 4 in his first start since a seven-length debut score June 6.

Trained by Hall of Famer Bob Baffert for owners Mike Pegram, Karl Watson and Paul Weitman, Uncle Chuck, who was purchased for $250,000 at the 2019 Keeneland September sale, could make his next start in either the $100,000 Shared Belief Stakes Aug. 1 at Del Mar or the Grade 1, $1 million Travers a week later at Saratoga.

The Los Alamitos Derby win – which was worth 20 points for Uncle Chuck towards a berth in the Sept. 5 Kentucky Derby – was the fourth in a row for Baffert and his fifth in the seven years the race – formerly the Swaps Stakes when offered at Hollywood Park (1974-2013) – has been run at Los Alamitos. Besides Uncle Chuck, he's also won with Game Winner (2019), Once On Whiskey (2018), West Coast (2017) and Gimme Da Lute (2015).

A 4-year-old daughter of Indian Evening owned by breeders KMN Racing LLC and trained by Hall of Famer Jerry Hollendorfer, Sneaking Out scored a 7-1 upset over heavily-favored Bellafina in the $201,000, Grade 2 Great Lady M. Stakes July 4.

The win was the fifth in 11 starts for the California bred and pushed her earnings to $431,441. It was the second win in the Great Lady M. for Hollendofer, who captured the inaugural running in 2014 with another Cal bred – Doinghardtimeagain for owner-breeder Tommy Town Thoroughbreds.

A 3-year-old son of Curlin purchased for $3.65 million in March, 2019, Cezanne is 2-for-2 for Baffert and owners Michael Tabor, Michael B. Smith, Mrs. John Magnier and co-breeder St. Elias Stable after his win going a mile July 2. A stakes race could be next for the Kentucky Derby prospect.

Baffert topped the trainer standings with four wins, the 11th time he has either led or shared the title at Los Alamitos since thoroughbred racing returned in July, 2014.

Juan Hernandez, the leading jockey at the recently-concluded Golden Gate Fields meet who decided to move to Southern California at the end of last month, and Edwin Maldonado shared the riding title. Both won six races.

The wealth was spread during the two weeks of racing as 43 different trainers and 52 different owner/partnerships won the 57 races offered.

“I've always said some owners and trainers enjoy more success at Los Alamitos than either Santa Anita or Del Mar,'' said F. Jack Liebau, vice president of the Los Alamitos Racing Association. “I think this is important for the overall financial health of Southern California racing. Although some might disagree, I see it as a positive so many different connections were able to win races during these seven days.

“We also ran a pair of graded stakes during the two weeks and saw a couple of serious Kentucky Derby contenders in Uncle Chuck and Cezanne.''

According to Liebau, all sources handle for the meet, which was spectator-less due to the Covid-19 pandemic, was up approximately 25% over comparable dates in 2019.
