Weekly Stewards and Commissions Rulings, June 13-19

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

The TDN will also post a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from the same week. These will include decisions from around the country.

California

Track: Santa Anita

Date: 06/16/2023

Penalty: $1,000 fine

Violation: Medication violation

Explainer:  Trainer Ian Kruljac, who started the horse Closeau, that finished third in the seventh race on April 8, 2023, at Santa Anita Park is fined $1,000.00 and assessed one half (1/2) point in accordance with California Horse Racing Rule #1843.4 (Multiple Medication Violations (MMV) – Expires 6/16/24) pursuant to California Horse Racing Board Rule #1887(a) (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1843(a)(d) (Medication, Drugs and Other Substances and Rule #1843.1(b) (Prohibited Drug Substances -Methocarbamol [Class 4]). This is Ian Kruljac's second offense in 365 days. Mr. Kruljac has accumulated one (1) MMV point.

Track: Santa Anita

Date: 06/16/2023

Penalty: $1,000 fine

Violation: Medication violation

Explainer: Trainer Jeff Mullins, who worked the horse Numero Dix for removal from the Veterinarian's List on April 5, 2023, at Santa Anita Park, is fined $1,000 and assessed one half (1/2) point in accordance with California Horse Racing Board Rule #1843.4(a) (Multiple Medication Violations (MMV) – Expires June 16, 2024) pursuant to California Horse Racing Board Rule #1887 (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1866(h)(i) (Veterinarian's List), #1844(d)(5) (Authorized Medication), #1843(d) (Medication, Drugs and Other Substances) and Rule #1843.1(b) (Prohibited Drug Substances – Methocarbamol [Class 4]). This is Jeff Mullins second offense in 365 days. Mr. Mullins has accumulated two and a half (2 1/2) MMV points.

Penalty: Four-day suspension

Explainer: Apprentice Jockey Armando Aguilar, who rode Warrior's Moon in the fourth race at Santa Anita Park on June 17, 2023, is suspended for 4 racing days (June 25, July 1, 2, and 3, 2023) for failure to maintain a straight course in the stretch causing interference resulting in the disqualification of his mount from fourth to fifth; a violation of California Horse Racing Board rule #1699 (Riding Rules – careless riding), second offense in last sixty days.

The following rulings were reported on HISA's “rulings” portal and through the Horseracing Integrity & Welfare Unit's “pending” and “resolved” cases portals.

This does not include the voided claim rulings which were sent to the TDN directly. Some of these rulings are from prior weeks as they were not reported contemporaneously.

One important note: HISA's whip use limit is restricted to six strikes during a race.

Violation: Use of shockwave therapy too close to workout

Explainer:  Trainer Vladimir Cerin, who treated the horse Poppy's Halo with ESWT on 12/13/2022, at Santa Anita Park, which is within 30 days prior to a workout is suspended SEVEN (7) days and fined $2,500 for violation of HISA Rule 2272 (3) (Shockwave Therapy). The suspension shall be from June 23, 2023, through June 29, 2023. During the term of the suspension, all licenses and license privileges of Vladimir Cerin are suspended and pursuant to California Horse Racing Board Rule #1528 (Jurisdiction of Stewards to Suspend or Fine) and HISA Rule 8200 (b)(2) through (12) (Schedule of Sanctions For Violations) Vladimir Cerin is denied access to all premises in this jurisdiction.

CALIFORNIA

Explainer: Trainer Ian Kruljac, who started the horses GYPSY LYNN, who finished first in the first race on August 21, 2022, at Del Mar Race Track, and GLENDALE who finished second in the third race on August 21, 2022, at Del Mar Race Track is fined $500 and assessed one half (1/2) point in accordance with California Horse Racing Board Rule #1843.4 (Multiple Medication Violations) pursuant to California Horse Racing Board Rule #1887 (a) (Trainer or Owner to Insure Condition of Horse) for violation of California Horse Racing Board Rule #1843 (a & d) (Medication, Drugs and other Substances) and Rule #1843.1(b) (Prohibited Drug Substances – Methocarbamol [Class 4]).

 

KENTUCKY

Track: Churchill Downs

Date: 11/20/2022

Licensee: Shug McGaughey, trainer

Penalty: Thirty-day suspension (15 days stayed) and $500 fine

Violation: Medication violation

Explainer: Upon receipt of notification from the University of Kentucky Equine Analytical Chemistry Laboratory, the official testing laboratory for the Kentucky Horse Racing Commission and confirmed at Texas A&M Veterinary Medical Diagnostic Laboratory, sample number R020613 taken from Smokin T, who finished second in the eleventh race at Churchill Downs on June 4, 2022, contained 2-1-(hydroxyethyl) promazine sulfoxide (HEPS) at a level of 61.2 ng/ml in urine (Class B). After waiving his right to a formal hearing before the Board of Stewards Claude R. McGaughey III is hereby suspended 30 days and fined $500. Due to mitigating circumstances (number of violations in relation to overall record), 15 days are to be served from December 5, 2022, through December 19, 2022 (inclusive). The remaining 15 days are stayed on the condition that no Class A or Class B medication violations occur in any racing jurisdiction within 365 days from the date of this ruling.

Explainer: Having violated the Horseracing Integrity and Safety Authority Rule #2280 (Use of Riding Crop) and pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties–Class 3), Jockey JUAN HERNANDEZ, who rode TURN ON THE JETS in the ninth race at Santa Anita Park on October 8, 2022, is suspended for one (1) day (October 16, 2022), and fined $250.00 for one (1) strike over the limit. Furthermore, Jockey JUAN HERNANDEZ is assigned three (3) violation points that will be expunged on April 9, 2023, six (6) months from the date of final adjudication pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties. Jockey JUAN HERNANDEZ has accrued a total of nine (9) points. Pursuant to California Horse Racing Board rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

Explainer: In the matter of the claim submitted for the horse GYPSY LYNN; Having received first notice of a Prohibited Substance (methocarbamol) in the post-race test sample, pursuant to Horse Racing Integrity and Safety Rule 2262 (c)(5) (Void Claim), the claim submitted for the horse GYPSY LYNN, in the first race on August 21, 2022, at Del Mar Racetrack is hereby deemed void.

The horse, GYPSY LYNN trained by IAN KRULJAC, shall be returned to owner CLARKE M. COOPER (DBA: CLARKE M. COOPER FAMILY TRUST) and CLARKE M. COOPER (DBA: CLARKE M. Explainer: Pursuant to a formal hearing held on October 8, 2022, it is hereby ordered that BOLT'S BROAD, who finished first in the sixth race at Del Mar Race Track on September 9, 2022, be disqualified and deemed unplaced pursuant to HISA Rule 2282 (Riding Crop Violations and Penalties [Class 2 Violation]) for violation of HISA Rule 2280 (Use of Riding Crop).

It is further ordered that the purse money awarded to Owner WENDY RUIS (RUIS RACING LLC), $60,000 and Jockey DRAYDEN VAN DYKE, 4,800 be distributed in accordance with the revised order of finish by the Paymaster of Purses at Del Mar Race Track

Revised order of finish is as follows:

Explainer: Having received a report from the NYS Gaming Commission Equine Drug Testing Laboratory of the finding of Phenylbutazone in the post-race sample taken from Horse “Built to Last” (#4) which raced in the 3rd race and finished 1st on August 24th 2022. Trainer of record Mr. Thomas Morley having been notified of the post-race positive and having waived his right to appeal is hereby fined the sum of $1,000 and suspended ten Calendar days effective Thursday October 13th 2022, through Saturday October 22nd 2022, inclusive.

Furthermore, the Stewards order horse “Built to Last” disqualified from any part of the purse and the purse redistributed as follows:

Explainer: Carlos Villasana is hereby immediately suspended by the Board of Stewards for his failed drug test (reported on October 7, 2022 as positive for cocaine) and is ordered to undergo an evaluation by a professional in the field of addictive or substance abuse disorders approved by the KHRC. Consideration for reinstatement is contingent upon the adherence to the recommendation of the approved counsellor. Mr. Villasana must also provide a negative drug test prior to reinstatement. During his suspension Carlos Villasana is denied the privileges of all facilities under the jurisdiction of the KHRC.
