CHRB: No Complaints Will Be Filed After Investigation Into Modern Games’ Scratch At Breeders’ Cup

The California Horse Racing Board has completed the investigation into the events involving the Breeders' Cup Juvenile Turf race on Nov. 5 at Del Mar, in which the horse Modern Games (IRE) was inadvertently scratched (removed) from the race but then allowed to compete for purse money only as a non-wagering interest.

No complaints will be filed as a result of the investigation.

While the CHRB does not typically release an investigation report, especially when it does not result in a complaint, given the widespread public interest, a summary of the investigation is provided.  

The Board's investigation was conducted by Supervising Investigator Michael Barker, and included 12 percipient witnesses. Those witnesses included personnel from the starting gate (veterinarians, starter, and assistant starters), the stewards, placing judges, personnel in the pari-mutuel office and personnel in the totalizator room.

At the conclusion of the investigation, Supervising Investigator Barker made the following findings: 

Albahr was in the number two stall. Albahr reared up over the starting gate, then  fell back on to his side, with his legs caught under the number three stall. During this time, the  horse in the number one stall, Modern Games, went through the front gate after the gate was opened by starting gate personnel and was uninjured. The veterinarians on scene initially believed that Modern Games had forced his way through the starting gate, and they made the decision to scratch him. When informed by gate personnel that Modern Games did not force the gate doors open, the veterinarians inspected him and advised the stewards that  Modern Games was fit to run. 

Concurrently, the stewards were advised of the scratch of both Albahr and Modern Games by the veterinarians. The stewards called the scratch into the tote room and both Modern Games and Albahr were removed from wagering.

The stewards were then informed  that Modern Games was not injured and was fit to race. The stewards called the tote room  to inform them what was occurring and requested that the tote room hold off on the scratch of Modern Games, who has already been removed from the wagering pools. Modern Games was then placed back into the pari-mutuel pool.

Subsequently, the stewards determined that pursuant to CHRB Rule 1974, Modern Games would be required to run for purse money only. The tote room was then informed of the decision and Modern Games was again removed from the pari-mutuel pool. According to the witnesses, the time that  elapsed from the initial scratch of Modern Games until the running of the race was roughly 12 minutes.

During the investigation it was clear that inconsistent radio communication affected the events that transpired. Various witnesses indicated that they made calls over the radio that were not heard or received by the intended recipients. At some points witnesses resorted to cell phone communication to ensure their messages were relayed. The investigation noted that the regulatory veterinarians' hurried recommendation to scratch Modern Games could  potentially have been avoided if a protocol requiring one person on the veterinary staff and one person in the pari-mutuel department be in charge of scratches had been in place. 

The CHRB considered the merit of applying CHRB Rule 1697 to the recommended scratch by the regulatory veterinarians.

However, Executive Director Scott Chaney declined to file complaints for two reasons:

  1. The difficulty of proving a violation given that a condition precedent to a violation of this rule is that a horse actually broke through the gate; and
  2. More importantly, animal welfare is of paramount importance in the CHRB's application of rules and creation of protocols. The CHRB will not disincentivize regulatory veterinarians from recommending scratching horses when they have any iota of concern regarding their fitness to race. Just the opposite, the CHRB fully supports regulatory veterinarians erring on the side of animal welfare when there is even a possibility that a horse may not be fit to race.

Despite the fact there will not be any complaints filed in this matter, the CHRB nevertheless endeavors to prevent similar occurrences in the future. To that end, several recommendations have been identified.  

Recommendations:  

  1. There is one designated Racing Veterinarian and he or she is the only person who can recommend a scratch to the Stewards and the only person who can communicate a scratch to the Stewards.
  2. The tote company and the pari-mutuel department must each designate one person who can effectuate a scratch or purse money only designation by the Stewards. Both must agree before either action can take place.
  3. A horse cannot be placed back into the mutuel pools after it has been scratched without approval of all three Stewards.
  4. A Pari-mutuel Committee meeting should be held to consider changes to pari-mutuel  regulations. Issues that may be considered include but are not limited to: (a) advisability  of a purse-money-only designation and (b) requiring ADW companies to follow the example of brick-and-mortar wagering facilities in California by providing bettors with the opportunity to name alternate selections for scratched horses in Pick “n” wagers involving four or more races.
  5. Associations, particularly on days when there are large crowds and competing bandwidth,  must provide an adequate communication system for racing officials.

NBC Sports presents new “1/ST Saturday” Triple Crown prep race coverage, an unrivaled day of bicoastal racing featuring seven horse races live from 1/ST RACING's Gulfstream in Hallandale Beach, Fla., and Santa Anita in Arcadia, Calif., this Saturday, March 5 at 4 p.m. ET on CNBC.

Saturday's show will feature a live race every 15 minutes.

Santa Anita Moving Friday’s Program To Monday, March 7, Over Likelihood Of Rain

With Friday's weather forecast calling for a 90 percent chance of rain in Arcadia, Calif., Santa Anita Park, in consultation with the Thoroughbred Owners of California and the California Horse Racing Board, has announced it will shift Friday's eight-race program to Monday, March 7, with first post time at 12:30 p.m. PT.

Accordingly, there will be no re-draw, with Monday's program now scheduled as an exact replica of what had been planned for Friday.

Although rain is predicted throughout the afternoon on Friday, Monday's Arcadia forecast is for sunny skies with a high temperature of 68 degrees.

With a mandatory payout in Golden Gate Fields' 20 cent Single Ticket Rainbow Pick 6 Jackpot on tap Monday, first post time at the Northern California track is scheduled for 12:15 p.m and will thus run concurrently with Santa Anita.

This Saturday, March 5, is the inaugural 1/ST Saturday, featuring an unrivaled day of racing pairing Santa Anita with Gulfstream Park.  With 15 stakes scheduled between both tracks, including three Grade 1 events at Santa Anita, Saturday is poised to be one of the biggest days of the year.

Saturday’s Cross Country Pick 5 Features Action From Aqueduct, Oaklawn, Tampa

The New York Racing Association Inc. (NYRA) will host a Cross Country Pick 5 on Saturday featuring racing from Aqueduct Racetrack, Tampa Bay Downs and Oaklawn Park.

Saturday's sequence kicks off in Race 8 [3:47 p.m. Eastern] from Tampa Bay Downs as maidens 4-years-old and up travel a two-turn mile over the turf. The field of 10, plus one also eligible, is highlighted by the first-time starter Supply Chain, trained by four-time Eclipse Award-winning trainer Chad Brown for owner Klaravich Stables.

A 4-year-old son of Speightster, Supply Chain has made steady progress towards his debut at Palm Meadows Training Center, most recently breezing four furlongs in 49.50 seconds on February 26. Highgate Road is also making his career debut for trainer Catherine Day Phillips after drilling a half-mile over the Payson Park turf in 48.40 on February 26.

The action moves to Hot Springs, Arkansas for the second leg of the sequence in Race 6 [4:33 p.m.] at Oaklawn Park, the six-furlong Downthedustyroad Breeders' for Arkansas-bred fillies and mares 3-year-old and up.

The Randy Morse-trained Connie K enters on a two-race win streak, most recently romping to a 7 3/4-length optional claiming victory at Oaklawn on January 8 over a wet fast track. The 4-year-old Ordained filly Richness will also look to extend her win streak to three-in-a-row after taking an allowance optional claiming race on January 30. Hillary G, an Even the Score filly, earned a stakes win last year for trainer Thomas Vance when she won Oaklawn's Rainbow Miss in April by 2 3/4-lengths with returning rival Kaboom Baby finishing third.

The sequence heads north to Aqueduct Racetrack for the middle and penultimate legs, featuring a pair of prep races for the Kentucky Oaks and Kentucky Derby with the $250,000 Busher Invitational in Race 9 [4:57 p.m.] and the Grade 3, $300,000 Gotham in Race 10 [5:27]. Each race awards 50-20-10-5 points towards their respective qualifying race to the top-four finishers.

The Busher will see six sophomore fillies battle for a spot on the Kentucky Oaks leaderboard as they travel a one-turn mile over Aqueduct's main track. NY Final Furlong Racing Stable and Parkland Thoroughbreds' Venti Valentine and JW Singer's Magic Circle will face off again after finishing second and third, respectively, in the Grade 2 Demoiselle on December 4 at the Big A behind next-out Suncoast winner Nest. The two graded stakes-placed fillies will face steep opposition from stakes winners Shotgun Hottie and Sterling Silver, who both exit stakes wins at sprint distances at the Big A in their last outings.

The Grade 3 Gotham features the return of Grade 3 Nashua winner Rockefeller for Hall of Fame trainer Bob Baffert in his first start since a second to stablemate Newgrange in the Grade 3 Sham at Santa Anita on New Year's Day.

The son of Medaglia d'Oro will be facing a pair of formidable foes conditioned by Hall of Famer Todd Pletcher. Golden Code, a runaway winner of a state-bred maiden special weight last time out on February 5, and the undefeated Dean's List will give Pletcher two chances to win his third Gotham. The field of 10 also includes Jimmy Winkfield winner Morello and stakes-placed Life Is Great and Bold Journey.

The sequence concludes at Oaklawn in Race 9 [6:10 p.m.], the Nodouble Breeders' for Arkansas-bred colts and geldings 3-years-old and up. The John Ortiz-trained Gar Hole boasts a 3-for-4 career record, looking to secure his fourth win in a row for owner and breeder Shortleaf Stable. Carson McCord's K J's Nobility will seek his second win in the Nodouble Breeders' while 5-year-old Tempt Fate will look to defend his Nodouble Breeders' title for trainer Carl Deville after winning two stakes at Oaklawn last year.

The minimum bet for the multi-track, multi-race wager is 50 cents. Wagering on the Cross Country Pick 5 is also available on ADW platforms and at simulcast facilities across the country. Every week will feature a mandatory payout of the net pool. The Cross Country Pick 5, which features a low 15 percent takeout, will continue each Saturday throughout the year.
