Weekly Stewards and Commissions Rulings, May 10-16

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

California

Explainer: Upon receipt of notification from Industrial Laboratories, the official testing laboratory for the Kentucky Horse Racing Commission and confirmed at Texas A & M Veterinary Medical Diagnostic Laboratory, sample number E454454 taken from Warrior's Charge, who finished second in the eleventh race at Churchill Downs on June 26, 2021 contained phenylbutazone at a level of 2.51 ug/ml in blood (Class C)/ After waiving his right to a formal hearing before the Board of Stewards Brad H. Cox is hereby suspended 10 days, May 23 2022 through June 1, 2022 (inclusive) and fined $500. Warrior's Charge us disqualified and all purse money forfeited.

Constitution’s We the People Takes Flight in Peter Pan

'TDN Rising Star' We the People (Constitution) put on a show for those that braved the rain at Belmont Saturday–and the fans watching at home–with a dominant and seemingly effortless victory in the GII Peter Pan S., the local prep for the GI Belmont S. June 11.

Dispatched as the 5-2 second choice behind 2-1 favorite Set Sail (Malibu Moon), We the People broke alertly and hustled up to take immediate control. Clicking off opening splits of :23.46 and :47.24 on a clear lead, the bay was still well within himself under a motionless Flavien Prat turning for home. Prat shook the reins at the colt at the top of the lane and We the People instantly responded, opening up on the field with ease to win for fun by 10 1/4 lengths. Golden Glider (Ghostzapper) was the runner-up with Electability (Quality Road) in third. Favored Set Sail never made any impact, finishing sixth.

“[In the Arkansas Derby] Everyone broke well and all sent [for the lead] so I found myself wide and had to take back, drop in, and he didn't understand what I wanted from him from that point on,” Prat said. “Today, he broke well and got me into the race. I wanted a clean trip and to be in the clear and see what he could do from there. He responded really well.”

“We know how good he is,” said winning trainer Rodolphe Brisset, who also saddled fourth-place Western River (Tapit). “He's just his own enemy sometimes because he's a little cocky. Today was good. He got a little warm in the paddock and we gave him a shower and you could see he kind of relaxed and was drying up. I thought the warmup was good compared to Arkansas. Of course, if we bring one all the way here it's because we thought he had a shot to do that. He can run on anything. He's one of those kind.”

As for running one or both of his pupils in the Belmont, Brisset said, “We [brought] both here to see if we could consider the Belmont. Obviously, We the People passed the test and I think I'll have to watch the replay and take my time and wait 10 days to decide on Western River. He only got beat [less than] a half-length for second. I don't think the race set up for him too because they went in :47 1/5 and it wasn't really fast enough to make that big kick. We know the two turns may be the key, too, for Western River.”

A $110,000 KEENOV weanling turned $220,000 KEESEP yearling, We the People summoned $230,000 from WinStar at the Fasig-Tipton Gulfstream Sale after breezing in :10 3/5 as part of the dispersal of the estate of the late Paul Pompa. He is the third former Pompa horse to win a graded stakes this year, following G1 Dubai World Cup winner Country Grammar (Tonalist) and GI Jenny Wiley S. victress Regal Glory (Animal Kingdom).

Graduating by 5 3/4 lengths going a mile on debut at Oaklawn Feb. 12, We the People earned the 'Rising Star' nod when repeating that effort in an Oaklawn optional claimer exactly one month later. Attempting to get on the GI Kentucky Derby trail, he ran in the Apr. 2 GI Arkansas Derby–his first start without Lasix–but failed to fire, finishing seventh.

Pedigree Notes:
We The People is the second son of Constitution to win the Peter Pan, following 2021 victor Promise Keeper. He is the 21st worldwide graded winner (13 NH & 8 SH) and 34th worldwide black-type scorer (22 NH & 12 SH) for the young WinStar phenom. The colt is also the 29th graded victor and 54th black-type winner out of a daughter of the pensioned Tiznow. We the People is bred on the same Constitution/Tiznow cross as the stallion's best son, Tiz the Law, whose quartet of Grade I wins includes the Belmont S., albeit that was the year it was run at 1 1/8 miles as the first leg of the Triple Crown in 2020.

We the People's unraced dam Letchworth is a daughter of GI Ballerina H. winner Harmony Lodge (Hennessy), who also produced SW & MGSP Armistice Day (Declaration of War) and GSW Stratford Hill (A.P. Indy). Harmony Lodge's dam is GSW Win Crafty Lady (Crafty Prospector), who is responsible for MGSW & GISP millionaire and sire Graeme Hall (Dehere) and GSW Win McCool (Giant's Causeway). This is also the family of Grade I winners Magnum Moon (Malibu Moon) and Pinehurst (Twirling Candy).

The Barbe family's Henley Farms acquired Letchworth for $40,000 at the 2019 Keeneland January sale with We the People in utero. She has since produced a juvenile colt by Always Dreaming, who brought $220,000 at the recent OBS April Sale, and a yearling colt by Audible. She was bred back to More Than Ready.

Smith, MacAdam To Be Honored At Alibi

Photographer Patrick Smith and writer Mike MacAdam will be among the honorees at the Alibi Breakfast May 19 at Pimlico Race Course. The Alibi Breakfast features a gathering of media, owners, trainers, jockeys, horsemen and fans to celebrate the Preakness. Smith will receive the Jerry Frutkoff Award for the best Preakness picture of 2021, while MacAdam will receive the David F. Woods Award for best Preakness story. Smith is a staff photographer based in Baltimore for Getty Images. This is his second consecutive win, and third overall in the Frutkoff.

“During the 2021 Preakness, I was camped on the head-on position,” said Smith. “As I watched Flavien Prat guide Rombauer through the field and gain momentum, I know he'd rejoice with an iconic moment if he crossed the finish first – and he did.”

MacAdam, a turf writer and sports columnist for the Daily Gazette in Schenectady, N.Y., has provided daily live coverage of the Saratoga meet. MacAdam's story was entitled: “Preakness Winner Rombauer Runs Out of the Baffert Shadow.” He recently was named Sportswriter of the Year by the New York Press Association for the second time in the last three years.

“It's a gross understatement to say what an honor it is to be recognized by the Maryland Jockey Club with the David F. Woods Award,” MacAdam said.

Classic Hopefuls Turn It Up a Notch

With two weeks remaining until the first weekend of May, several chief protagonists for the GI Kentucky Derby and GI Longines Kentucky Oaks turned in some key breezes in Kentucky and California.

Jeff Drown's Zandon (Upstart), who cemented his spot in the Derby field with an eye-catching victory in the GI Toyota Blue Grass S. at Keeneland Apr. 9, has remained in Lexington to train up to the big race and went a half-mile in :48.60 (see below). The $170,000 Keeneland September graduate covered his opening furlong in :12.80, then gradually picked up speed through subsequent splits of :25.20 and :37 flat, with trainer Chad Brown and big-race rider Flavien Prat observing from the grandstand. Zandon galloped out five furlongs in 1:00.80, three-quarters of a mile in 1:13.80 and was up seven panels in 1:27.80.

“He was moving super; just what we wanted to see,” Brown said. “We just wanted to maintain where he is. He does not have to get any fitter. I was impressed with how he galloped out.”

Zandon is scheduled to ship to Churchill Sunday morning and will have his final Derby drill next Saturday.

Among those working beneath the Twin Spires Saturday was Blue Grass runner-up and 'TDN Rising Star' Smile Happy (Runhappy), who worked five furlongs in the company of his GIII Jeff Ruby Steaks-winning stable companion Tiz the Bomb (Hit It a Bomb). Smile Happy, whose docket includes a second-out victory in Churchill's GII Kentucky Jockey Club S., began the work about one length ahead of Brian Hernandez, Jr. and Tiz the Bomb (1:00.20), who moved to the outside of Smile Happy (1:00.40) and finished on even terms.

“We were just looking for an easy move today and we got that,” trainer Kenny McPeek said. “We'll probably do the same thing again next week.”

A day after stablemate and 'TDN Rising Star' Zozos (Munnings) sizzled six furlongs in 1:12.40, Gold Square's GI Arkansas Derby hero Cyberknife (Gun Runner) followed suit Saturday morning. Working at 5:15 a.m. with Florent Geroux at the controls, the Gold Square colorbearer went the same distance a tick quicker, then galloped out an extra furlong in :12.40, according to noted Churchill clocker John Nichols. Geroux also breezed Zozos on Friday, but retains the call on Cyberknife for the Derby.

“It was a really strong move and he's a really good work horse,” Geroux said. “He continues to improve as time goes on and he showed that winning the Arkansas Derby. Even going back to his allowance win before the Arkansas Derby he showed a new level of class.”

The one-eyed Un Ojo (Laoban) was also out for a serious move Saturday morning at Churchill, working five furlongs in :59.40 for trainer Ricky Courville in splits of :11.60, :23, :35 and :47.60 before galloping out six panels in 1:12.20.

“It's amazing being here at Churchill Downs,” said Courville's son Clay. “I've been here before but nothing like this. [Un Ojo] is getting over the track really well.”

At Santa Anita Saturday morning, 'TDN Rising Star' Messier (Empire Maker) went five furlongs in :59.80 for trainer Tim Yakteen, galloping out six furlongs in 1:12 and change, per a tweet from the ownership group's Tom Ryan. The Ontario-bred works again next Friday before shipping to Kentucky.

Expected to work Sunday are the Steve Asmussen duo of GII Louisiana Derby winner Epicenter (Not This Time) and Echo Zulu (Gun Runner), each among the favorites for the Derby and Oaks, respectively.

 

 

 

Kathleen O. Leads Oaks Workers…

Winngate Stables' Kathleen O. (Upstart), undefeated winner of the GII Gulfstream Park Oaks and also among the top fancies for the GI Longines Kentucky Oaks, prepped for that engagement Saturday at Keeneland, breezing a measured half-mile in :48.80  (see below) for her Hall of Fame conditioner Shug McGaughey.

“She picked it up and galloped out strong,” said assistant trainer Anthony Hamilton. “We are in good shape. She's a happy horse–that's what you look for.”

Kathleen O. ships across to Churchill Monday or Tuesday, according to Hamilton.

Candy Raid (Candy Ride {Arg}), upset winner of the Bourbonette Oaks at Turfway Park Apr. 2, went four furlongs in :49.20 (video) with Rafael Bejarano in the irons.

“This was her last work here,” said Bejarano, who rode Candy Raid for the first time in the victory at Turfway. “She's feeling good. I got her out five-eighths in 1:02 and change.”

Candy Raid is scheduled to ship to Churchill on Thursday and have her final pre-Oaks work there.

Oaks workers at Churchill included GIII Pocahontas S. winner Hidden Connection (Connect, 5f in 1:00.60); GIII Gazelle S. victress Nostalgic (Medaglia d'Oro, 4f, :48.80); and Busher S. romper and Gazelle runner-up Venti Valentine (Firing Line, 4f, :47.40).
