Weekly Rulings: December 19-25

Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.

Among the key rulings from the last week, trainer Bonnie Lucas was suspended seven days after a post-race Xylazine positive in a sample taken from Tankinator, who was injured and vanned off in a race at Parx Racing on Nov. 7. Xylazine is a Class B controlled medication under HISA that can be used to sedate racehorses.

It remains unclear whether Tankinator was euthanized as a result of his injuries sustained that day.

The 5-year-old gelding was having his first race for Lucas, having been claimed out of the Webster Gayle barn on Oct. 21. In a post-race sample taken Oct. 21, Tankinator tested positive for the corticosteroid Dexamethasone, a controlled medication commonly used as an anti-inflammatory.

Cottin Handed 12-Month Ban For Corticosteroid Misuse

French National Hunt trainer and former champion jump jockey David Cottin faces a 12-month suspension as both trainer and owner after failing to observe the correct withdrawal times in the use of corticosteroids on four horses in his stable.

A veterinary officer from France's National Federation of Horseracing carried out an inspection at Cottin's yard in Lamorlaye, near Chantilly, on December 3, which revealed “several violations”, according to a statement released by France Galop on Monday. Of particular concern was the evidence of intra-articular (joint) injections, as well as injections between the vertebrae on four horses. The substance used, the corticosteroid Dexamethasone, has a withdrawal period of 14 days before the treated horse is allowed to resume racing.

The four horses, identified as Matilda Du Berlais (Fr), Duke Chop (Fr), Para (Fr) and Madara (Fr), have all subsequently been disqualified from the contests in which they raced within that 14-day period.

A treble winner of the Cravache d'Or d'obstacle (French champion jump jockeys' title), Cottin retired from race-riding in 2017 at the age of 27. He made a notably successful start to his training career, and enjoyed victory at the Cheltenham Festival in 2020 with Easysland (Fr).

Cottin was one of 21 people arrested from a number of different French stables, along with one person in Spain and another in Italy, in March 2022 in connection with alleged doping offences. He was subsequently released without charge.

Cottin has 14 days in which to lodge an appeal against his suspension.

Diodoro Fined $1,000 at Oaklawn After Class 4 Positive

Robertino Diodoro, currently second in wins and fourth by earnings in the Oaklawn Park trainer standings, had a fifth-place finisher from three months ago disqualified via stewards' ruling Monday because of a Class 4 dexamethasone positive.

Although the DQ ruling itself did not impose a fine upon Diodoro, a separate stewards' ruling fined him $1,000 under the “absolute insurer” clause.

By issuing a separate fine, the Oaklawn stewards handled Diodoro's Class 4 positive similar to how they did in 2020 when Diodoro had two winners and a fifth-place horse disqualified for the prohibited use of two different Class 4 substances detected in post-race testing.
The DQ'd horse from the Mar. 7 ruling was Storm Advisory (Weigelia), who now gets demoted to sixth and last in the first race from Dec. 10, 2021. Split-sample testing confirmed the result, and Diodoro waived his right to a hearing. It was not immediately clear if any appeal would be lodged.

Dexamethasone is an anti-inflammatory listed as a Class 4/Penalty Category C prohibited substance on the Association of Racing Commissioners International's uniform classification guidelines for foreign substances.

Macias Suspended 90 Days

Conditioner Adolfo Macias has been suspended 90 days following the search of his barn at a Central Kentucky training center. The story was originally reported by the DRF based on a ruling issued by Kentucky stewards. Macias waived his right for a formal hearing on the suspension, which will begin Dec. 1 and run through Feb. 28.

The search, which was conducted July 28, turned up “injectable medications, hypodermic syringes, and needles.” The search took place about three weeks after the Macias-trained Enraged (Big Blue Kitten) won a maiden claimer at Ellis Park, after which he tested positive for dexamethasone. Enraged was disqualified and Macias was fined $500.
