Weekly Stewards and Commissions Rulings, Dec. 5-11

Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country.

Among the key rulings from the last seven days, trainer Philip Aristone has been suspended for a combined 105 days and fined a total $7,500 after two of his horses tested positive post-race for Lamotrigine, a Class A controlled medication under HISA.

According to the National Institutes of Health, Lamotrigine is an anti-seizure, anti-epilepsy drug that is also used off-label to treat other human health issues like acute bipolar depression, fibromyalgia, schizophrenia, and unipolar depression.

Los Alamitos-based trainer Reed Saldana has also been banned for two years and fined $25,000 after one of his horses tested positive post-race for the banned substance, Diisopropylamine, a vasodilator, meaning it can cause blood vessels to open or dilate. Diisopropylamine is also found in commonly used human products like hand sanitizer.

A Horseracing Integrity and Welfare Unit's (HIWU) arbitration body heard Saldana's case, for which he did not engage an attorney.

The next option for covered persons who wish to contest a HIWU arbitration decision is to appeal the result to the Federal Trade Commission (FTC).

Weekly Stewards And Commissions Rulings, Nov. 28-Dec. 4

Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.

Among the key rulings from the last seven days, the prohibition of intra-articular injections within seven days of a timed or reported workout once again stands out as a thorn in the side of trainers.

Three such cases have been resolved in the past week, resulting in $3,000 fines meted out in each case.

The Horseracing Integrity and Welfare Unit (HIWU) also handed down a seven-day suspension and $1,000 fine to trainer Norman Follett, for a post-race Lidocaine positive following a September runner at Belmont at the Big A. Lidocaine is a pain reliever used ubiquitously in human medicine.

The details of the ruling are not yet publicly available. But Equibase shows Follett to run a small New York-based stable. This year, he has made only 39 starts and had one winner.

Pursuant to California Horse Racing Board Rule #1766 (Designated Races), the term of suspension shall not prohibit participation in designated races.

Exlainer: Linda Rice as responsible trainer under 9 NYCRR 4043.4 (a), violated commission rules in that Linda Rice trained horse “Afleet Arlene” that finished 1st in the 4th race at Aqueduct Racetrack on January 21st 2023, and having received a report from the New York Drug Testing and Research Program that a race-day sample taken from the horse “Afleet Arlene” had the substance Phenylbutazone present at a concentration, including an assessment of the measurement and imprecision of the quantitative threshold, in excess of the quantitative threshold, in excess of 0.3 mcg/ml in plasma in violation of 9 NYCRR 4043.4 (a) 26. Trainer Linda Rice is hereby suspended fourteen (14) days and fined the sum of two thousand ($2,000) dollars having appealed a stay has been granted. Furthermore, the Stewards order horse “Afleet Arlene” disqualified from any part of the purse and the purse redistributed as follows:

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

With the Horseracing Integrity and Safety Act (HISA) having gone into effect on July 1, 2022, the TDN will also post a roundup of the relevant HISA-related rulings from the same week.

California
