US Racing Website, Offshore Racebook Sued By Stronach Group Tracks

The operators of Santa Anita Park and Golden Gate Fields have filed a lawsuit against a horse racing website with alleged ties to an offshore racebook operation, charging the website with facilitating illegal online betting on California races and from California residents.

The Los Angeles Turf Club, licensed by the California Horse Racing Board to run race meetings at Santa Anita in Arcadia, and the Pacific Racing Association, which operates Golden Gate Fields in Albany, filed the suit against US Racing (www.usracing.com) and BUSR (www.busr.ag). One challenge, according to the complaint, is that both US Racing and BUSR are entities “of an unknown form…plaintiff does not know the true names” of the owners of the two websites.

Both LATC and PRA are part of the 1/ST Racing, owned by The Stronach Group.

The suit was filed Oct. 20 in the U.S. District Court for the Central District of California, Western Division.

The complaint claims that the two entities are in violation of the Interstate Horseracing Act and the Racketeer Influenced and Corrupt Organizations Act (RICO). It alleges that US Racing and BUSR “actively promote and market illegal online betting on horse races,” with US Racing directly referring individuals to the BUSR website through hyperlinks placed throughout the site. Neither entity is licensed through the California Horse Racing Board or authorized by the regulatory agency to accept wagers on California races or from California residents. Neither has statutory agreements with tracks or horsemen's groups to accept wagers on their races, and by operating offshore there are no host/signal fees or takeout mandated by California law. Wagers do not enter the pari-mutuel system.

“Defendants failure to pay the statutorily mandated takeout deductions as well as host fees and/or commissions increases Defendants net revenue thereby allowing them to offer rebates and other financial incentives to individuals…who place illegal bets through Defendants' websites in order to gain an unfair competitive advantage over Plaintiffs and over the licensed ADW providers operating in California,” the complaint states.

The Plaintiffs are seeking a permanent injunction barring defendants from accepting wagers on California races or from California residents, treble damages and attorneys fees.

A lawsuit only tells one side of the story. The Defendants in the suit will be afforded an opportunity to respond.

Gulfstream Park Suspends Five Trainers For Violating Clenbuterol Policy

Gulfstream Park has suspended five trainers for violating the Hallandale Beach, Fla., house rules concerning use of the bronchodilator clenbuterol. The track announced the suspensions after conducting out-of-competition tests, using both blood and hair samples, in 10 different barns – with five of the 10 trainers returning clean tests. A total of 12 horses from the five suspended trainers tested positive for the drug that is designed to treat airway obstruction but can have anabolic steroidal effects.

Suspended were Georgina Baxter, Rohan Crichton, Daniel Pita, Peter Walder and Gilberto Zerpa. The suspensions range from 10 to 40 days depending on the number of violations a trainer and went into effect Oct. 1. Gulfstream did not identify the length of each trainer's suspension. The trainers also have been fined $1,000 per violation, with the money going directly to support Thoroughbred aftercare initiatives.

Gulfstream Park enacted the restriction on clenbuterol as a house rule at the beginning of the 2019/2020 championship meet to further address and implement improved safety, transparency and accountability standards.

“As we have said before, individuals who do not embrace the rules and safety measures that put horse and rider safety above all else will have no place at any 1/ST racetrack,” said Aidan Butler, chief operating officer, 1/ST Racing, which owns Gulfstream Park, Santa Anita, Pimlico, Laurel Park, and Golden Gate Fields.  “At 1/ST we are committed to achieving the highest standard of horse care and safety. We expect that the stakeholders who race and train at our facilities share in that commitment.”

Horses entered by the suspended trainers will be scratched and they will not be permitted to enter any horse they train for any race at 1/ST Racing venues until the completion of the suspension.

On Oct. 1, six horses were listed as stewards scratches, including three trained by Crichton, two by Baxter, and one by Walder.

To return to racing, the horses must also submit to follow up testing and have clean blood and urine samples. The twelve affected horses will be permitted to train as a part of their daily care and exercise routines.

Because of the absence of a racing commission and deregulation imposed by former Gov. Rick Scott, many of the rules that govern Florida racing are done by the racetracks in the way of house rules. It isn't clear if suspensions resulting from violation of house rules are automatically recognized by other racing states. Gulfstream Park did not indicate whether a suspended trainer's horses (those that did not test positive) would be allowed to race under the name of another trainer during the period of suspension.

Additional barns have been tested, with results pending.

Gulfstream’s New Tapeta Track Makes It Unique Among American Racetracks

With the installation of its Tapeta racing surface nearing completion, Gulfstream Park in Hallandale Beach, Fla., will become the first pari-mutuel facility in the Americas with three distinct racing surfaces.

Workers began laying the Tapeta over the base of the track late last week. Horses will begin jogging and galloping on the Tapeta after the inner safety rail is installed. Races are expected to be carded on the all-weather surface beginning the week of Sept. 23.

The multi-million-dollar project, which also includes a new drainage system, will provide Gulfstream with three racing surfaces – a 1 1/8-mile dirt track, a 7/8-mile turf course, and a mile-and-70-yard Tapeta track.

The installation of the Tapeta track continues 1/ST Racing and Gulfstream Park's commitment to the safety of its athletes and its investment in state-of-the-art technology.

“The Tapeta surface is a truly exciting addition to Gulfstream Park,” said Aidan Butler, COO of 1/ST Racing. “The three unique surfaces plus the new drainage system will allow many options for the horsemen, provide bettors interesting wagering opportunities, and protect our turf course during inclement weather. We are very much looking forward to this new chapter in Gulfstream's history and thank everyone for all their hard work in getting it done.”

“The new Tapeta track is a significant advancement for Gulfstream Park,” Florida HBPA President Stephen Screnci said. “It creates flexibility that will benefit our horsemen in a number of ways. It will be easier to preserve the turf course. There will be more opportunities to run when races are rained off the turf, and more options in the condition book. Perhaps most important, fewer scratches in off-the-turf races generates increased handle and increased purses. This is good news for South Florida racing.”
