Florida Racing Official Ed Mackie Passes Away

Ed Mackie, a much respected and admired presence in Florida racing for 50 years, died suddenly Wednesday evening. He was 75.

Mackie was Gulfstream's director of mutuels since 2002, but before that had served in similar roles at Hialeah Park and Biscayne Dog Track. Mackie was also director of mutuels at Calder Race Course, Tropical Park and Gulfstream Park West since 2003. Before working in pari-mutuels, Mackie was a champion amateur jai alai player.

Mackie was admired by those he worked with as well as horsemen for his knowledge, his wit, and his calm under pressure.

“To say he will be greatly missed is an understatement,” said Bill Badgett, executive director of Florida Racing Operations for 1/ST Racing. “He was dedicated not only to our company, but to the entire racing industry. This is a huge loss to horse racing. Someone like Ed is valuable far beyond his knowledge, because he was an amazing colleague who was calm and could handle any situation thrown at him. I will miss talking to him every day.”

Mackie is survived by his wife, Linda, three children, and six grandchildren.

Visitation will be held on Sunday, October 23 from 3:00 PM to 4:00 PM at the Fred Hunter's University (2401 S University Dr, Davie, FL 33324) with a memorial service at 4 p.m.

Inaugural Horse Racing Women’s Summit: Women at `Tipping Point’ in the Sport

Given the current snail's pace at which the gender gap is meaningfully shrinking, it'll take more than 250 years for women to reach professional parity with men–just two-and-a-half short centuries, for those who think in blocks.

That was the daunting statistic which set the stage at the beginning of the inaugural Horse Racing Women's Summit at Santa Anita Thursday, a two-day event designed to nurture the abilities of women already involved in the sport and engender new talent to follow after the sport's current batch of female leaders.

And what was the over-arching takeaway? Greater mutual support among the sport's female participants, and the fostering of a culture of mentorship among male leaders towards their female peers.

In a panel titled “Thriving Through Challenges,” Dora Delgado, executive vice president and chief racing officer of the Breeders' Cup, described the business that she entered in 1983 as a lot of Khaki and blue blazer-clad men sitting around the boardroom table resistant to change.

“And that hasn't changed much since,” said Delgado, adding that, despite her credentials—she was anointed last year on the Sports Business Journal's prestigious “game changer” list, for example—she still feels the need to prove her qualifications “over and over and over again.”

Part of the problem is nepotism, she and others said.

The Kentucky Blueblood aristocracy, it “runs deep,” Delgado said. “If you're not born to it, it takes a bit of work to get accepted.” That cycle needs to be disrupted, she added.

“'This guy's really great—I play golf with him. He's got a son who needs a job. Where can we fit him in?'” said Delgado, rhetorically replaying what she described as familiar conversations across racetrack boardrooms.

Dora's response? “Nowhere.”

Christa Marrillia, vice president and chief marketing officer at Keeneland, detailed the female dress code for employees at the track when she first joined in 2003, which excluded open-toed shoes and pants.

While those restrictions have since lifted, changing the work-place culture for women in the sport has proven tougher, she said.

“I would sleep with my cell-phone by my pillow,” explained Marrillia, describing herself as a workaholic who never took breaks—a common refrain among the presenters, all of whom described the challenges of maintaining a healthy work-home life balance, especially those with families and children.

What changed Marrillia's attitude, she said, was witnessing her behavior rub off on her team, some of them young mothers. “I was like, 'wow, I'm creating a bad thing here.'”

She has since altered the culture for her employees at Keeneland, she said, for the better. “I do feel like we're at a tipping point,” she added, about the role of women in the game.

“I'm still really good at my job, but I'm not going to miss the birthday parties. I'm going to sleep,” she said. “I'm not going to answer an email at two in the morning.”

Dionne Benson, chief veterinary officer at 1/ST RACING, discussed the importance of male higher-ups in the sport championing their female peers.

Benson told the story of how, when on a work call, two men proceeded to disparage her, mistakenly thinking they were muted.

“Then Aidan found out about it and called all their bosses,” she said, referring to Aidan Butler, 1/ST RACING's chief operating officer.

There's also the honey-pot approach.

“What my boss finds interesting, I find fascinating,” joked Rikki Tanenbaum, 1/ST GAMING's newly minted chief commercial officer and president.

The afternoon was broken into two panels, the latter of which turned their gaze inwards towards matters of integrity—or what Del Mar Thoroughbred Club board member, Marie Moretti, called “intentional integrity.”

A key area of focus appeared to be the Horseracing Integrity and Safety Act (HISA), designed to provide parity in the metering out of offenses, among many other things.

“You will know what you're going to get,” said Moretti, advocating the Act's uniform rules, if not only to improve public perception of the sport. “Perception is reality in the modern world.”

Optics was a common theme. “I couldn't even get my horsey girlfriends to the track—they thought it was a cruel sport,” said Bo Derek, saying that when she took over as a California Horse Racing Board (CHRB) commissioner, the industry was in the state of flux due to problems associated with drug misuse, whip abuse and the ill-fated switch to synthetic tracks.

“I'm really encouraged. The fanbase is up, the gaming is good,” said Derek, about the current state of California's racing industry.

“I don't think it's something we can be quiet about any more,” said Shannon Kelly, executive director of the Jockey Club's Safety Net Foundation, zeroing in on the public's growing awareness towards the vast human involvement in the sport.

“What other industry has to have a charity for its workers in times of need?” Kelly said, highlighting the number of food distribution centers that feed the nation's backstretches.

All panelists advocated for financial self-sustainability to fund each aspect of the industry, from racehorse aftercare to the Permanently Disabled Jockeys Fund.

“If you're entering into the sport,” said Kelly, “you should be aware of the costs that are associated with `putting on the show.'”

The earlier panel looked outwards, each of the four speakers tasked with marketing and growing the sport to a world not forged upon racing's gristmill.

“We've all got one goal but we're all coming at it from different ways,” said Jodie Vella Gregory, director of the office of innovation at 1/ST RACING.

“Everyone in here has an idea,” she added. “We should all be taking to one another.”

Taking aim at horse racing's natural impulse to quickly bin new ideas if they fail to immediately take off, she extolled the virtues of perseverance, pointing to the evolution of the Pegasus World Cup—what originated a big-pot attraction first and foremost, but which has transformed into something of a place-holder on the social calendar.

That, and “we need to expand outside the bounds of our community,” Vella Gregory said.

Running with that theme, Lindsay Schanzer, senior producer at NBC Sports, warned of another of racing's bad habits: Leaning into its more insular, arcane traits, sometimes at the expense of new potential fans.

That's why NBC Sports has focused on the story-telling aspects of its race-day coverage, said Schanzer, pointing to its recent fond embrace of things like the jockey cam.

“We really want to put the people on the horses' backs as best we can,” said Schanzer, before making a plug. “If you ever have stories that we don't know of, please reach out to us.”

The other two panelists discussed the role of newer ventures, like FanDuel, as a means of funneling new blood towards racing.

“It's never been that way before—it's never been that easy,” said Shona Rotondo, head of marketing at My Racehorse US, about the accessibility of the racehorse ownership program, with its quick online sign-up process. “We want to sell everyone on the emotion of the game.”

Given the summit's remit, it seems only fitting the event's inaugural leadership award went to a long-time industry mainstay, Jane Goldstein.

Said Amy Zimmerman, when introducing the award, “She found an opening into the sport she loved through the publicity offices of several racetracks. She was always the first one done with her work. It wasn't that she was super quick but, you see, women weren't allowed in the press box after 12. Yes, that's also true. During racing, the press box was exclusive to men.

“After almost four decades,” Zimmerman said, “I'm still often asked the ridiculous question: `what's it like being a woman in racing?' When I was hired, I never thought about it, because Jane Goldstein was the one who hired me. Jane was the one who answered that question. The one who waged that battle to open the door. And then she held it open with class, so all of us could walk through it.”

Goldstein received a standing ovation.

Multiple Moving Parts in Monarch, AZ Simulcasting Morass

For over two years, the simulcasting signal from 1/ST-operated racetracks, along with several others around the country, has been missing in Arizona–the residual fall-out from a long-simmering dispute between the owners of Arizona Downs and the arm of The Stronach Group (TSG) tasked with distributing the company's signal.

In both California and Arizona, stakeholders argue that this simulcasting blackout has hit both the bettors and the industry–by how much appears open to debate.

A recent analysis by the Arizona Horseman's Benevolent & Protective Association (AZHBPA) of the projected lost revenue to California purses between 2020 and 2021 pinned the number at more than $1,1 million, and another nearly $900,000 in lost track commissions.

The estimated loss to Turf Paradise alone between the years 2021 and 2022 amounts to more than $1 million, said Vince Francia, general manager of Turf Paradise. For Arizona Downs, however, the impact has been “negligible,” say track operators.

Scott Daruty, president of TSG's Monarch Content Management, also downplays the impact of the hamstrung signal to Monarch's bottom-line, saying that the resulting lost fees is only a fraction of Monarch's total business. He also disputes the AZHBPA's projected losses to the California purse account.

Monarch's umbrella extends over several California tracks–including Santa Anita Park, Del Mar, Golden Gate Fields and Sonoma County Fair–as well as Turf Paradise, Lone Star Park, Gulfstream Park, Laurel Park, Pimlico, Rosecroft Raceway, Monmouth Park, and Meadowlands.

Against the backdrop of this ongoing dispute, there are indications that 1/ST is eyeing potential inroads into the Arizona marketplace.

Within recent months, representatives of 1/ST have visited Turf Paradise with the intention of possibly purchasing the facility, said Francia. AZHBPA executive director, Leroy Gessman, said that 1/ST recently did the same at Arizona Downs.

According to two sources familiar with the situation, 1/ST has made a thus far unsuccessful bid to purchase Arizona Downs.

Daruty declined to comment whether 1/ST has indeed made any formal bid to purchase Arizona Downs but called the Arizona marketplace “one that appears to have potential.”

 

 “At that point, you're negotiating with a terrorist, right?”

The genesis of this rather convoluted simulcasting dispute goes back years.

In summary, when Arizona Downs reopened for live racing in 2019, Monarch sent its signal to the track itself but not to the track's network of Off-Track Betting parlors (OTB), and at a higher rate than its Arizonan neighbor, Turf Paradise.

In contrast, Monarch distributed its signal to Turf Paradise and its network of some 60 OTB's.

When asked about the contracting disparities between both Arizonan tracks, Daruty said at the time that Arizona Downs had been “consistently delinquent in its payments to our racetracks.”

In an effort to resolve industry stakeholder disgruntlement, the state passed in 2019 a law requiring all simulcast providers that send their races into Arizona to offer the products uniformly among all tracks and all their OTBs.

The following January, the Arizona Racing Commission passed a motion requiring the three racetracks in the state–Turf Paradise, Arizona Downs and Rillito Park–to comply with that law.

The commission also sent a letter to Monarch to “stop sending any simulcast signals to Arizona permittees racetracks and/or their additional wagering facilities.”

To all intents and purposes and despite various legal maneuverings in the interim, that state of affairs has remained, and Monarch has not beamed its signal into Arizona since.

At the start of Santa Anita's most recent winter meet, Monarch approached the operators of Arizona Downs with an offer of all Monarch content to the entire Arizona marketplace, including to Arizona Downs' network of OTBs, said Daruty.

According to Daruty, the operators of Arizona Downs made several unilateral modifications to the contract which were unacceptable. They included reducing the fees paid to Monarch tracks below the previously contracted rate between them, and a requirement for Monarch to “pre-approve” new simulcast locations without the ability to conduct legal and regulatory due diligence, said Daruty.

“At that point, you're negotiating with a terrorist, right?” said Daruty, once again raising Arizona Downs' reported history of delinquent payments.

“We can't abandon our principles and abandon our reasoned business approach to distributing our signals,” Daruty added.

Detailing a back-and-forth process of negotiations, Tom Auther, an Arizona Downs owner and partner, said that Monarch initially offered Arizona Downs a contract with non co-mingled pools–what he described as an immediate non-starter–and then an offer charging the track overall as much as twice what Turf Paradise was paying.

Monarch subsequently declined Arizona Downs' counter-offer, which was to pay Monarch 20% more in fees than Turf Paradise, said Auther.

“Twenty percent's still a lot of money,” Auther said. “If we paid what they want us to pay, the horsemen would not approve it because there'd be no money left–only three percent left in horse purses.”

When asked about Arizona Downs' reported history of defaults, Auther said that they had offered Monarch to escrow an adequate amount of money to offset the anticipated costs. “They refused it,” said Auther.

In an effort to understand the impact from the nixed signal into Arizona on California's horsemen, the Arizona HBPA contracted the firm Global Racing Solutions–founded and operated by Pat Cummings–to run the numbers.

According to GRS' calculations, California horsemen lost $1,115,000 in purse contributions between 2020 and 2021, and California track operators missed more than $877,000 in commissions during that same period.

To put that into perspective, California's purse total in 2021 was some $118 million.

TDN reached out to Thoroughbred Owners of California (TOC), who declined to comment.

As for Monarch, when they last ran the numbers, “the host fees that the Monarch tracks received out of the state of Arizona were less than one percent of the total host fees received by the Monarch tracks,” Daruty said. “It just doesn't move the needle for us.”

Daruty also said that the AZHBPA's projected California purse loss numbers were over-estimated, though added that Monarch hadn't run their own calculations.

And what of the potential impacts on the Arizona tracks? Again, there are mixed-signals.

Between 2021 and 2022, Turf Paradise lost an estimated $1,011,317 due to the missing Monarch signal, the estimated loss to the purse account was $944,915, and the estimated loss to the Regulatory Wagering Assessment (RWA)–a wagering tax used to fund the state racing department–was $61,139, according to Francia's calculations.

Auther, however, shared handle numbers with the TDN–taken, he said, from the state commission's website–comparing the year 2021 with 2018, when Turf Paradise received the Monarch signal.

According to Author's numbers, Turf Paradise lost in 2021 more than $8 million in overall handle compared to 2018. Turf Paradise operated in 2021 with 13 fewer OTBs than in 2018, however, and those OTBs were closed for 1038 days more than in 2018, according to Auther's calculations.

Auther also estimated that the annual hit to Arizona Downs' business without Monarch has been negligible. “It exists,” said Auther, about the loss. Horseplayers, however, have simply adjusted their betting patterns to other available options, he said, adding that the loss of the Monarch product to Arizona Downs was one of quality rather than numbers.

More broadly, Arizona HBPA president Bob Hutton broached what he sees as some of the more deeply felt impacts to the state's racing industry.

“With the state of racing the way it is, when we're trying to get fans to the sport, why is this good?” said Hutton, critical of Monarch's part in the negotiations. “This is costing horsemen all over the country money, and why? I don't get it.”

Turf Paradise, it should be noted, has been for sale since at least 2020.

According to Francia, 1/ST representatives recently toured the track with a potential eye to purchase the facility. “They have not made an offer but they have looked at the track,” he said.

According to Gessman, representatives from 1/ST have similarly toured Arizona Downs, adding that he was present at the visit.

According to two sources who wished to remain anonymous, 1/ST made the owners of Arizona Downs an offer for the facility which was subsequently declined.

Both Auther and Daruty refused to comment on any possible offer that 1/ST has made for Arizona Downs.

Though calling the Arizona marketplace one with potential, Daruty added that “I think all the infighting and frankly some of the regulatory dysfunction has just left it in a place that's not healthy.”

Report: Baltas Hearing Postponed Until At Least July 31

With a potential fine or suspension looming, California trainer Richard Baltas will not face a scheduled hearing with stewards at Los Alamitos Friday after Darrell Vienna, the trainer's lawyer, successfully asked for a postponement. The story was first reported by Daily Racing Form.

Vienna told DRF Monday that he has received a 30-day continuance in the case from Los Alamitos stewards. A new hearing has not been scheduled, with the earliest it can come being July 31 at Del Mar.

“I didn't receive the full complaint until seven days before the hearing,” Vienna said. “In order to prepare an adequate defense, I need time.”

It was reported last week that 23 horses trained by Baltas, who was banned from Santa Anita and other 1/ST Racing tracks with scant initial explanation in early May, were allegedly administered substances on race day in violation of California Horse Racing Board rules. Baltas was ordered to appear before the Los Alamitos stewards by the CHRB, which opened an investigation into the trainer May 8.

The postponement of Friday's hearing leaves up in the air whether or not Baltas will be allowed to stable and start horses at the Del Mar summer meet, which starts July 22.
