Weekly Stewards and Commissions Rulings, June 6-12

Every week, the TDN publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.

Here's a primer on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.

The TDN will also post a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from the same week. These will include decisions from around the country.

California

Track: Santa Anita

Date: 06/09/2023

Licensee: Kent Desormeaux, jockey

Penalty: Probation during remainder of license period, per terms and conditions

Violation: Disorderly conduct, failure to report

Explainer: Jockey Kent Desormeaux, having entered into a Settlement Agreement and Mutual Release with the California Horse Racing Board (CHRB) for violation of CHRB rules 1874 (Disorderly Conduct) and 1680 (Jockeys and Drivers to Report) on March 31, 2023, at Santa Anita Park, is placed on probation for the remainder of his license period, subject to the following terms and conditions of probation: He is placed on a testing agreement with the following conditions: (a) He will be tested by a CHRB investigator before entering the racetrack to exercise a horse or participate in a race. (b) On scheduled race days, he will report to the CHRB investigative office no later than 1.5 hours before the scheduled post time. (c) In the event CHRB investigators obtain a PAS reading detecting the presence of alcohol (Anything greater than 0.00) his license will be summarily suspended until a noticed hearing before a Board of Stewards is held and a ruling is issued. (d) Upon renewal of his Jockey license, a testing agreement will be part of his next license period.

Penalty: Four-days suspension

Violation: Careless riding

Explainer: Jockey Ricardo Ramirez who rode Irondale in the sixth race on June 10, 2023 at Santa Anita Park is suspended 4 racing days, June 18, 23, 24 and 25, 2023, for failure to maintain a straight course in the stretch causing interference resulting in the disqualification of his mount from second to third; a violation of California Horse Racing Board Rule #1699 (Riding Rules – Careless Riding – second offense in the last sixty (60) days).

New York

Track: Belmont Park

Date: 06/11/2023

Licensee: Todd Pletcher, trainer

Penalty: Fourteen-day suspension, $2,000 fine

Violation: Medication violation

Explainer: Mr. Todd Pletcher, as responsible trainer under 9 NYCRR 4043.4 (a),violated Commission rules in that Mr. Todd Pletcher trained horse ” Capensis “, that finished 6th in the 10th race at Saratoga racecourse on July 30th 2022, and having received a report from the New York Drug Testing and Research program that a race-day sample taken from the horse ” Capensis ” had the substance Phenylbutazone present at a concentration, including an assessment of the measurement uncertainty and imprecision of the quantitative threshold, in excess of 0.3 mcg/ml in plasma in violation of 9 NYCRR 4043.3 (a) (26).Trainer Mr. Todd Pletcher is hereby fined the sum of two thousand ($2,000) dollars and suspended fourteen Calandar days having appealed a stay has been granted.

Furthermore, ” Capensis ” is disqualified from any part of the purse and the Stewards order the purse redistributed as follows.

NEW HISA/HIWU STEWARDS RULINGS

The following rulings were reported on HISA's “rulings” portal and through the Horseracing Integrity & Welfare Unit's “pending” and “resolved” cases portals.

This does not include the voided claim rulings which were sent to the TDN directly. Some of these rulings are from prior weeks as they were not reported contemporaneously.

One important note: HISA's whip use limit is restricted to six strikes during a race.

Champion Goodnight Olive Seeks To Turn The Tables On Wicked Halo In Bed O’ Roses

First Row Partners and Team Hanley's reigning Champion Female Sprinter Goodnight Olive headlines a talented field of older fillies and mares in Saturday's Grade 2, $200,000 Bed o' Roses, a seven-furlong main-track sprint, at Belmont Park.

Trained by four-time Eclipse Award-winner Chad Brown, the 5-year-old Ghostzapper mare was a perfect 4-for-4 last year, taking a pair of seven-furlong Grade 1s in the Ballerina Handicap at Saratoga Race Course and the Breeders' Cup Filly and Mare Sprint at Keeneland on her way to Championship honors.

Goodnight Olive made her seasonal debut a winning one in the seven-furlong Grade 1 Madison on April 8 at Keeneland, but endured a troubled trip last out on May 6 at Churchill Downs in the Grade 1 Derby City Distaff when she lacked racing room while boxed in along the rail by returning rival Wicked Halo. The victorious Matareya got the jump to win the seven-furlong sprint by one length with Wicked Halo completing the exacta by one length over a frustrated Goodnight Olive.

Goodnight Olive has breezed back four times over Big Sandy, including a bullet five-eighths in 59.83 on Saturday. She had been under consideration for a pair of races on Belmont Stakes Day, including the 1 1/16-mile Grade 1 Ogden Phipps against fellow fillies and mares as well as being nominated to the Grade 1 Hill 'n' Dale Metropolitan Handicap against males.

“She's doing well and I'm glad we waited and gave her a little extra time,” said Brown, who won this event previously with Lewis Bay [2018] and Separationofpowers [2019]. “We'll run her seven-eighths, I think it's the right move. She's doing super. She had a nice strong work, which I really liked.”

A $170,000 purchase at the 2019 Fasig-Tipton Kentucky Fall Yearling Sale, Goodnight Olive, who sports a ledger of 9-7-1-1 for purse earnings of $1,466,200, is out of the multiple graded-stakes winning Smart Strike mare Salty Strike.

Irad Ortiz, Jr. retains the mount from the inside post aboard Goodnight Olive, who won her lone start over Big Sandy last year when taking a seven-furlong optional-claimer in frontrunning fashion.

Winchell Thoroughbreds' Kentucky homebred Wicked Halo [post 3, Jose Ortiz] boasts a record of 13-7-1-4 for purse earnings in excess of $1.1 million.

The 4-year-old Gun Runner grey, trained by Hall of Famer Steve Asmussen, won 4-of-8 starts last year, capturing the Grade 2 Prioress at Saratoga and the Grade 2 Raven Run at Keeneland en route to a closing third-place finish in the Breeders' Cup Filly and Mare Sprint.

Wicked Halo, out of the graded stakes-winning Tapit mare Just Wicked, won the six-furlong Matron over a muddy and sealed track at Oaklawn Park on March 31 in her seasonal debut ahead of her Derby City Distaff effort.

Cash is King and LC Racing's graded-stakes winner Dr B [post 4, Kendrick Carmouche] captured the Grade 3 Go for Wand over a sloppy and sealed main track on December 3 at Aqueduct Racetrack to close out her 2022 campaign.

Trained by Butch Reid, Jr., the 5-year-old Liam's Map bay enters from a runner-up effort to returning rival Caramel Swirl in the Grade 3 Vagrancy, a 6 1/2-furlong sprint for older fillies and mares on May 14 here.

Dr B, who boasts a record of 17-5-6-2 for purse earnings of $383,690, was as close as second down the backstretch but faltered back to last through the turn as Caramel Swirl advanced with ease outside rivals and drew away to a 2 1/2-length score with a resurgent Dr B following her impressive rally.

Reid, Jr. said Dr B may have needed a start after returning from a five-month layoff.

“Maybe it was just the fact that she hadn't run in a while and was getting used to her surroundings again,” Reid, Jr. said. “It was a strange race. She was laying up close and then got shuffled all the way back to last, but made a nice, wide run through the lane. Other than winning, it was a perfect comeback race for her.”

Dr B breezed back a half-mile in 48.93 Saturday over the Parx main track.

“She came out of it really well and had a nice breeze here last week. She's just where we want her,” Reid, Jr. said.

Reid, Jr. said he is confident Dr B will improve enough to match Caramel Swirl, but admitted the presence of the reigning Champion Female Sprinter is a daunting one.

“We hope so, but there's a lot more to deal with in this race,” Reid, Jr. said. “She's doing really well and this is the perfect time and distance for her to race. We'll see what happens – you have to take your chances.”

Godolphin's Kentucky homebred Caramel Swirl [post 5, Junior Alvarado] has banked $588,450 through a record of 13-5-4-2 for Hall of Fame trainer Bill Mott.

The 5-year-old Union Rags bay made the grade in the 2021 Grade 2 Raven Run at Keeneland, but raced only twice last year, taking an optional-claiming sprint here ahead of a runner-up effort to Goodnight Olive in the Ballerina.

Caramel Swirl is out of the Smart Strike mare Caramel Snap, who is a half-sister to multiple Grade 1-winning multimillionaire Frosted.

Rounding out a talented field is Charles T. Matses' graded-stakes placed Beguine [post 2, Javier Castellano] for conditioner Edward Allard.

The 4-year-old Kentucky-homebred daughter of Gun Runner won her Belmont debut last out on May 20, drawing off to a 9 3/4-length allowance score while traveling six furlongs over a sloppy and sealed main track.

Beguine, who sports a ledger of 9-2-3-1 for purse earnings of $280,303, was runner-up in both the 2022 Grade 3 Fantasy at Oaklawn and the Garland of Roses in December at the Big A. She is assigned 118 pounds, six pounds less than each of her four rivals.

The Bed o' Roses is slated as Race 9 on Saturday's 10-race card. First post is 1:05 p.m. Eastern.

Seattle Slew Grants Launched by KEEP

Over $12,000 has been awarded to Kentucky equine non-profits by the Kentucky Equine Education Project (KEEP) Foundation's new Seattle Slew Grant Program. Recipients of the inaugural grants are The Ed Brown Society, Frankie's Corner Little Thoroughbred Crusade, and the Paris Bourbon County YMCA.

Available to Kentucky non-profits providing equine educational programs, events, and initiatives, the Seattle Slew Grant Program is part of the Foundation's efforts to support education and promote the importance of the equine industry to Kentucky's economy and culture.

“The KEEP Foundation is honored to support these exceptional organizations that are tirelessly working towards showcasing our industry to future equine enthusiasts,” said Katie LaMonica, KEEP Foundation Board Chair. “The KEEP Foundation congratulates the grant recipients and commends their exceptional dedication and passion for Kentucky's equine community.”

King Rasco Grey Lives Up To His Name With 250k Sale To Mullins At Goffs

It was the French sires who dominated on day two of the Goffs Arkle Sale with Willie Mullins and Harold Kirk going to €250,000 to secure a Galiway (GB) gelding [King Rasko Grey (Fr)] from Treannahow Stables.

That was followed by a Doctor Dino (Fr) gelding that was snapped up by Gordon Elliott for €185,000 from Altenbach Bloodstock and a Jeu St Eloi (Fr) gelding to Paul Nicholls and Tom Malone for €175,000. 

Galiway, the sire of dual Group 1 winner Sealiway (Fr), has made huge strides as a National Hunt sire with Mullins training two of his best jumpers, Vauban (Fr) and Gala Marceau (Fr).

The dominant force of National Hunt racing returned to the market to secure the strapping King Rasko Grey from Tony Costello, who Mullins bought Goffs Defender Bumper winner Predators Gold off.

Mullins said, “He's a gorgeous horse by a sire who has been very good to us. He was poetry in motion walking around the ring and I loved him. We've gone back to the source of success in Treannahow Stables.”

Mullins saw off the attention of Nicholls for the Wednesday top lot who was christened by the Costellos as Elvis for a very simple reason. 

“Very simply he was the king,” Tony Costello told Bernard Condren, head of sales at Goffs. “I bought him as a foal in Osarus [for €18,000] in the height of Covid. There were only a hundred people at Dublin Airport when we got there. His racing name is King Rasko Grey so Elvis was an easy decision. He's the king today.”

Of the 217 lots offered on Wednesday, 185 were sold for an aggregate of €9,514,000, representing an average of €51,427. The median stood at €45,000.

Goffs chief executive Henry Beeby said, “The Arkle Sale may have a new name this year but there was nothing new about the hunger for top class NH prospects at Goffs in June. For the last number of years this sale has enjoyed a meteoric rise as so many NH vendors have sent a larger and larger share of their best to us and we cannot thank them enough for we are nothing without their horses. 

“Over the last two days trade has matched the outdoor temperatures as both were hot, hot, hot! That trade was generated by a simply stunning group of Three-Year-Olds and it was so gratifying to hear judge after judge commend the standard of entry over the two days. Last year the sale grew by 25% so we are delighted to have consolidated those results and it is especially pleasing to see an average and median so close as that points to a sale of true consistency with the latter important figure growing by another 7%.”

He added, “The top of the market enjoyed some titanic bidding duels, none more so than for the top lot with Harold Kirk for Willie Mullins just outlasting Tom Malone for Paul Nicholls. To have the two Champions battling it out is testament to the horse in question and the sale in general, and they were just two of the many significant personalities to play an active part from start to finish.

“So the two days have clearly illustrated the appeal of NH sales at Goffs and we have been so pleased to welcome shoals of buyers from the UK, France and USA following a very proactive campaign by the Goffs Purchaser Attraction Team working in tandem with our friends at Irish Thoroughbred Marketing. They have locked horns with every Irish buyer of note including the mighty band of Point-To-Point handlers who have made such an impact in recent times.

“As we turn our focus to Part 2 of the sale tomorrow, which is bound to produce another significant group of winners, we extend our thanks to every vendor for the trust they placed in the Goffs service and wish each purchaser the best of luck, safe in the knowledge that they have bought from a sale that is truly the measure of any.”
