With Trial Looming, Chan, Former Vet for Servis, Now Wants to Change Plea

Seven weeks before the start of the final remaining high-profile trial in the federal doping conspiracy case from 2020, the New York-based veterinarian Alexander Chan, whose client list included co-defendant trainer Jason Servis, has changed his mind about having a jury decide his fate on three felony charges for alleged participation in drug adulteration, misbranding, and wire fraud conspiracies.

On Thursday, Chan asked for and was swiftly granted a Dec. 5 change-of-plea hearing in United States District Court (Southern District of New York), at which he will likely either plead guilty to or enter into a possible plea-bargained agreement instead of going to trial.

That will leave Servis alone to face the jury when his trial begins Jan. 9.

The nationwide sweep in March 2020 has already resulted in numerous prison terms, but Servis has always been the most prominent name among the indicted individuals. He amassed gaudily high win percentages during the 2010s decade prior to getting arrested on three felony drug misbranding and conspiracy to commit fraud charges.

According to a trove of wiretap evidence (plus implicating testimony from plea-bargaining defendants who are already imprisoned) Servis allegedly doped almost all the horses under his control in early 2019, including MGISW Maximum Security, who crossed the wire first in the GI Kentucky Derby, but was DQ'd for in-race interference. One of Servis' elixirs of choice was allegedly SGF-1000, the adulterated, misbranded and purportedly performance-enhancing drug (PED).

Chan is alleged to have assisted by performing injections and hiding the charges from billing and veterinary records. It is possible that he could implicate Servis at his plea change hearing.

That's what Kristian Rhein, a veterinarian formerly based at Belmont Park, did to both Servis and Chan in August 2021 when he changed his own plea to guilty on one felony count within the federal government's sprawling prosecution of an allegedly years-long conspiracy to dope racehorses.

“I, along with Jason Servis, were leaders and organizers [of others who performed allegedly criminal actions], which included my associate, Dr. Alexander Chan…” Rhein told Judge Mary Kay Vyskocil at his 2021 plea change.

Rhein got the maximum sentence of three years imprisonment for his crimes.

Vyskocil, who sentenced Rhein, is the same judge who will hear Chan's plea change on Monday.

Rhein, Chan and Servis at various times during 2019 were recorded on wiretaps discussing aspects related to Servis's alleged doping regimen. At times the two veterinarians rationalized to each other and to Servis that if the administered substances couldn't be detected via racing commission testing, then they weren't considered illegal.

Chan had filed a motion in August 2021 to suppress the use of those wiretapped calls as evidence, but the court denied his motion.

One conversation between Chan and Servis from Aug. 14, 2019, went like this, according to court documents:

Servis: Well, is it okay to use that?

Chan: Use what?

Servis: The SGF.

Chan: Yeah, like New York rules, there is nothing like against, like it's, you know, like it says unless it's not specifically written in there then it's seven days, you know. So like, it's not illegal.

According to the original indictment, “Chan and Rhein coordinated the sourcing and administration of SGF-1000, and engaged in efforts to secretly distribute and administer adulterated and misbranded PEDs and to counsel racehorse trainers and/or owners on the use of such substances, including the covert administration of such substances to avoid detection by the FDA and state regulatory authorities. They did so in furtherance of Servis and other trainers' efforts to administer adulterated and misbranded PEDs, for the purpose of secretly enhancing race performance.

“In connection with that scheme, Chan provided false billing records that did not reflect drugs Chan had injected into racehorses under Servis' control, and falsified his own prescription records as to which of Servis' racehorses received a particular prescription drug, concealing from potential investigators the true nature and means of administration of the PEDs that Chan provided and administered at Servis' direction,” the indictment stated.

Five Eastern Shippers Line Up In Field Of 11 For Del Mar’s Hollywood Derby

A trio of stakes races, headed by the 82nd edition of the Grade 1, $400,000 Hollywood Derby, will highlight a special racing card Saturday at Del Mar on the penultimate day of the sport for the 2022 Bing Crosby Season.

Also on the nine-race program will be the 32nd running of the Grade 3, $100,000 Jimmy Durante Stakes for 2-year-old fillies and the initial running of the $100,000 Stormy Liberal Stakes for older horses at five furlongs on the turf. The day's activities begin with a 12:30 p.m. first post.

The Hollywood Derby will be having its ninth presentation at Del Mar at its mile and one eighth distance on the lawn. The first local running of the feature in 2014 saw 3-year-old champion California Chrome win it handily and cement his bid to be Horse of the Year.

This time around there are 11 well-respected 3-year-olds with their eyes on the money and prestige the race offers, but there are no standouts in the lineup. Five eastern-based horses, including three out of the barn of conditioner H. Graham Motion, will try their luck in the turf test and it appears likely that one of them may go postward the favorite.

A pair of Hall of Fame conditioners – Claude “Shug” McGaughey III and Todd Pletcher – have runners entered that may draw the most mutuel action in Stuart Janney III's Celestial City (McGaughey) and Repole Stable, St. Elias Stable and Gainesway Stable's Wit (Pletcher). Both well-bred colts are stakes winners in the east and, naturally, have drawn top local riders — Ramon Vazquez on Celestial City and Flavien Prat on Wit.

The race will be run as the ninth and final event on the day's card.

The Jimmy Durante goes as Race 7 on the program.

Pegasus: Proxy, Simplification, Double Crown Among Early Hopefuls For $3 Million Race

Trainer Michael Stidham believes the “obvious spot” for Grade 1 Clark winner Proxy to make his next start would be Gulfstream's $3 million Pegasus World Cup Invitational (G1) Jan. 28, reports the Daily Racing Form.

“It's good timing at the end of January, and if he were to run well it's good timing to the Dubai World Cup,” Stidham told DRF of the homebred Godolphin-owned 4-year-old by Tapit.

The seventh running of the 1 1/8-mile event for 3-year-olds and up is the richest of seven graded-stakes worth $5.2 million in purses on the World Cup program that includes the $1 million Turf Invitational (G1) and $500,000 Filly & Mare Turf Invitational (G3).

Trainer Antonio Sano is also optimistic about the winter season at Gulfstream Park, and a big part of it could be Fasig-Tipton Fountain of Youth (G2) winner Simplification.

Owned by Tami Bobo and Tristan De Meric, Simplification was back on the work tab last week for the first time since finishing seventh Nov. 5 in the Breeders' Cup Mile (G1). The 3-year-old son of Not This Time, third in the Florida Derby (G1) and fourth in the Kentucky Derby (G1), is doing well, Sano said, and is being trained for a winter campaign at Gulfstream.

“He worked well, and the plan is to go [Dec. 31] in the Harlan's Holiday (G3),” said Sano, referring to the 1 1/16-mile event that has been used as a prep for the Pegasus. “He came out of the Breeders' Cup perfect. I was happy with the way he ran. We're going to see what happens in the Harlan's Holiday and after December we will think about Pegasus.”

Norman 'Lynn' Cash and Lola Cash's Double Crown, a two-time stakes winner at Gulfstream Park in the summer of 2020, could be headed for a return to South Florida for the Pegasus, as well.

Also trained by Lynn Cash, Double Crown most recently upset the one-mile Kelso (G2) at odds of 42-1 Oct. 29 during the Belmont Park at Aqueduct meet, just seven days after finishing fourth in the Maryland Million Classic at Laurel Park. The 5-year-old Bourbon Courage gelding is entered in Saturday's Cigar Mile (G1) at Aqueduct.

“If the invite comes, absolutely, we're there,” Cash said. “I would love that invite to come our way.”

Bred in Maryland, Double Crown won his career debut in a September 2019 maiden special weight for trainer Lacey Gaudet at Laurel. Following the race, he was purchased privately by Dean Reeves and sent to Kathy Ritvo at Gulfstream, where he won the 2020 Roar and Carry Back and was third in the Smile Sprint (G3) in successive starts.

On behalf of his family's Built Wright Stables, Cash claimed Double Crown for $40,000 out of a runner-up finish June 4 at Churchill Downs. He has won two of six starts since, including his 1 ¾-length triumph over favored Baby Yoda in the Kelso.

“It didn't just shock the world, it shocked me, too,” Cash said. “My wife and I weren't there. Her uncle had passed, so we were in Utah at a funeral. The funeral service finished, and we got to the car and got it pulled up, and they were a minute out from loading.

“My wife had no idea the level of race it was. After he won and she's watching the replay and hearing the announcer she was like, 'Oh my gosh, it's a Grade 2,' so she really went wild right there I the parking lot. Everybody probably thought we were crazy. We were jumping and fist pumping and everything else.”

Cash said his familiarity with Bourbon Courage, a Grade 2-winning millionaire raced from 2012-15 by Bourbon Lane Stable, led to him putting in a slip to claim Double Crown.

“The first horses that I bought back in 2011 or 2012, my bloodstock agent was Mike McMahon of Bourbon Lane Stables,” he said. “I was very familiar with Bourbon Courage. I followed him intently as I was just getting in the business as an owner. I followed his career pretty closely, and Double Crown being his offspring is pretty cool.”

Overall, Double Crown has six wins, eight seconds and a third with $548,265 in purse earnings from 24 lifetime starts.

“I describe him like this: he gives you the same 100, 102, 98 [speed figure] output every time,” Cash said. “He's a measuring stick to where if a race falls below that measuring stick he's going to win; if it falls above it, he's going to be right there.”
