Tyler’s Tribe Aimed For Return In Oaklawn’s Advent Stakes

Iowa-bred sensation Tyler's Tribe is expected to start in the $150,000 Advent Stakes for 2-year-old sprinters Dec. 9 at Oaklawn, Tim Martin, the gelding's co-owner/trainer, said Saturday morning.

Post positions for the 5 ½-furlong Advent, which anchors the first of 68 scheduled racing dates in 2022-2023, were drawn Saturday morning. Tyler's Tribe, among nine entrants, is scheduled to break from post 5 under regular rider Kylee Jordan. First post Dec. 9 is 12:30 p.m. (CT), with probable post time for the Advent 3:46 p.m.

Tyler's Tribe completed major preparations for a projected Advent start by working three furlongs in :37.60 under Jordan just after the second renovation break Saturday morning at Oaklawn.

“Just a little maintenance move,” Martin, a Hot Springs resident, said moments after watching the work from the first turn. “He's fit. He's been running. He ran five weeks ago, obviously. I worked him a half last week. This was six days before the race. I'll scope him. If he's clean, we'll race. If he ain't … but he looks good.”

It was the second local work for Tyler's Tribe since he suffered his first career loss in the Breeders' Cup Juvenile Turf (G1) Nov. 4 at Keeneland in his most recent start. Tyler's Tribe was eased and vanned off after bleeding in the 5 ½-furlong race.

Martin said he also considered Tyler's Tribe for the $250,000 Smarty Jones Stakes Jan. 1 at Oaklawn, but decided to pass because the anti-bleeder medication Lasix is prohibited in Kentucky Derby points events. The use of race-day Lasix is also prohibited in the Breeders' Cup. Tyler's Trible ran without Lasix for the first time in the Juvenile Turf Sprint. Horses are allowed to run on Lasix in the Advent.

“I want to take the advantage of the Lasix right now,” Martin said before Saturday's work. “That's kind of why I backed off. I breezed him last week and he scoped good – no mucus, no blood, no nothing. We'll scope him again today and if everything's good, then I'll go. It's 5 ½. He'll like that.”

Tyler's Tribe was a four-time stakes winner at Prairie Meadows – all sprints – with two of the victories coming in open company, including the Prairie Meadows Freshman Aug. 27 by 15 ½ front-running lengths. Tyler's Tribe has won his five starts by a combined 59 ¾ lengths.

From the first crop of millionaire Grade 1 winner Sharp Azteca, Tyler's Tribe has won five of six starts and earned $306,294.

The projected nine-horse Advent field from the rail out, including jockey, weight: Count de Monet, Santo Sanjur, 117 pounds; C. J.'s Storm, Nik Juarez, 117; Too Much Info, Cristian Torres, 117; How Did He Do That, Isaac Castillo, 119; Tyler's Tribe, Kylee Jordan, 124; Happy Is a Choice, David Cabrera, 117; Frosted Departure, Francisco Arrieta, 124; Alto Road, Luis Quinonez, 117; and Wild Mule, Angel Rodriguez, 119.

The Advent goes as the eighth of nine races.

Judge Sanctions Attorneys In Keeneland Radiograph Case

A Lexington judge has ordered sanctions against attorneys Mason Miller and William Rambicure, who despite dismissal of a civil claim earlier this year have continued to pursue claims against veterinarians who admitted falsification of radiograph dates at Keeneland sales, bloodhorse.com reports.

The order, which was signed by Fayette Circuit Judge Julie Muth Goodman, was entered Thursday and found on the court's online docket Friday.

Earlier this year, the Kentucky Court of Appeals upheld a lower court's dismissal of a civil claim filed by Lexington attorney Miller and Rambicure on behalf of owner/trainer Tom Swearingen against Hagyard Equine Medical Institute and a handful of its partners regarding the misdating of radiographs.

Swearingen claimed in his original case that had he known he was potentially bidding on horses whose radiographs were not presented accurately that he would not have participated in the public auctions in question.

A Fayette Circuit Court judge dismissed the 2019 case, which was based on the practice of some veterinarians of forward-dating pre-sale radiographs to make them appear to fall in the required window in relation to a horse's sale date. A handful of veterinarians from Hagyard self-reported to the Kentucky Board of Veterinary Examiners for engaging in the misdating or for being aware of others using the practice and not reporting them. Those veterinarians indicated they misdated the records in order to help manage large caseloads ahead of major public auctions.

Bloodhorse.com reports that Miller and Rambicure violated what is known in Kentucky as Rule 11, Goodman found, writing that their conduct was “particularly egregious” when they continued to pursue claims after Swearingen admitted in a lower court proceeding he didn't use the digital repository at auction and did not send a veterinarian to do so on his behalf.

Sanctions to be imposed are to be “equal to defendants' reasonable attorney's fees and costs from the day following the tender of discovery responses until the date of this order” but will exclude expenses incurred during an appeal, citing a lack of jurisdiction.

Good Magic’s Dubyuhnell Outlasts Arctic Arrogance In Remsen

Just one race after Stonestreet Stables homebred Julia Shining (Curlin) won the GII Demoiselle S. at Aqueduct, Stonestreet-bred Dubyuhnell (Good Magic), owned in partnership with West Paces Racing, out-dueled New York native Arctic Arrogance (Frosted) to take that venue's GII Remsen S. With the victory, he earned 10 points towards a start in the GI Kentucky Derby.

Fourth on debut behind last weekend's GII Kentucky Jockey Club winner Instant Coffee (Bolt d'Oro) at Saratoga Sept. 3, Dubyuhnell rallied to victory next out in a sloppy off-the-turf test at this oval Oct. 2.

Given a 4-1 chance to repeat here over another sloppy track, the $400,000 KEESEP buy was away in good order from the outside post in this seven-horse affair. Last-out Sleepy Hollow S. winner Arctic Arrogance went straight to the front to dictate terms and Dubyuhnell moved up alongside him, keeping the gray honest through opening splits of :24.31 and :48.13. Dubyuhnell drew even with the pacesetter as three quarters went up in 1:12.23 and the pair turned for home together, battling stride-for-stride while well clear of their competition. Dubyuhnell forged clear of Arctic Arrogance in the final strides to win by a half-length. Even-money favorite Tuskegee Airmen (Street Sense) never posed a threat, finishing 11 1/4 lengths back in third and it was another 16 1/4 lengths back to the fourth-place horse.

“This colt here I think is more of the Derby type of horse because he wants to get the distance,” said winning trainer Danny Gargan. “A mile and an eighth suits him and he came running at the end. They were going fast. He was up towards the lead and they went three-quarters in 1:12 and change and that's running today. The fillies [in the Demoiselle], I think went 1:14 and change. They went a mile in 1:37 and change and that's getting after it. I was impressed with this race.”

On a potential next start, Gargan said, “He'll go to Florida for the winter. He could show back up here for the [GIII] Withers [in February]. We'll take him down to Florida because of the weather and we wont have to miss as much training. I'd love to win the [GII] Wood Memorial, it's one of my favorite races. There's no plans for where he'll go next but we could see him here for the Withers.”

“He broke good,” said winning rider Jose Ortiz. “Initially, we thought we were going to lay a little bit farther back than that because it looked like it was going to be a lot of speed in the race. I told Dan [Gargan], 'I'm just going to break forward and see what happens going into the first turn.' Surprisingly, it was only [Jose] Lezcano there with Arctic Arrogance who I thought was one of the speed, but I was able to lay next to him every step of the way. I was very happy. On the backside, we hit the second turn and I knew it would be me or him. I won with the other horse [Artic Arrogance] first time out. I really liked him, Linda [Rice] really liked him, so I knew he was going to run big. He had a nice work coming into the race, I've watched him. I think he's a nice horse but we were better today.”

As for Arctic Arrogance, Rice said, “I am very proud of him. You never want to be second, always want to get the win, but all in all it was a huge race on his part. He's come along nicely. We'll take it one day at a time.”

Pedigree Notes:

The Demoiselle winner was sired by Curlin and the Remsen winner hails from the first crop of his champion son Good Magic. Both stallions were campaigned by Stonestreet either alone or in partnership and Good Magic was also bred by that operation. Dubyuhnell is the fourth graded winner for his freshman sire and his sixth black-type achiever.

Barbara Banke's stable went to $1 million to secure the winner's MGSW dam Wild Gams (Forest Wildcat) at the 2008 KEENOV sale. Dubyuhnell is her fourth black-type achiever, following MGSW Cazadero (Street Sense), SW Mr. Brave (Malibu Moon) and GSP Almost Famous (Unbridled's Song). The 19-year-old aborted her 2021 Bernardini foal and was barren when bred to both Justify and Constitution for 2022. She visited Stonestreet-bred and co-owned MGISW Charlatan (Speightstown), who stands alongside Curlin at Hill 'n' Dale, earlier this year.

Julia ‘Shines’ in Demoiselle

Just like her full-sister, champion Malathaat (Curlin), Julia Shining (Curlin) not only won her debut at Keeneland Oct. 16, but did so in 'TDN Rising Star'-fashion. And she followed in her GI Breeders' Cup Distaff-winning sister's hoofprints once again Saturday, capturing the GII Demoiselle S. in the slop at Aqueduct.

Favored just like her sister, albeit at 1-2 instead of 2-5, Julia Shining was even farther back than Malathaat was in her Demoiselle, racing in second last as 37-1 shot Tribal Queen (Bolt d'Oro) clocked opening splits of :24.61 and :49.35. Pushed along by Luis Saez every step of the way while racing off the trail, the Stonestreet homebred still had plenty left to do as three quarters went in 1:14.31. Swung out six wide turning for home, the bay dug deep beneath a vigorous hand ride from Saez, sweeping past Affirmative Lady (Arrogate) and stablemate Gambling Girl (Dialed In) in the final strides to win by a neck. With the win, she earned 10 points towards a start in the GI Kentucky Oaks.

“Clearly she has tons of natural talent and is still putting it all together,” said winning trainer Todd Pletcher. “We knew from her debut that she didn't like the kickback, and you add the sloppy track into that today, so that was our biggest concern was trying to get her into the clear. Unfortunately, the only way to get her into the clear was to go pretty wide, but she's got so much natural stamina that we felt the mile and an eighth was really going to play to her strengths. The only concern I had was she has never run on an off track. The mile and an eighth [was not a concern]. That's what she really is looking for.”

The Hall of Famer continued, “She was clearly not handling things [down the backstretch] and Luis [Saez] was trying to encourage her to improve position and finally did it around the quarter pole. Once she found a rhythm down the lane, she started to close and Luis said she kind of got her head in front and then wanted to wait a little bit.”

Pletcher said Julia Shining would go to Florida, while third-place Gambling Girl would remain in New York this winter.

“The trip was good. She's still learning,” Saez said. “The track was pretty sloppy.”

Asked when the winner found her rhythm, Saez said, “At the top of the stretch, just the top of the stretch. The whole way she was not interested. She doesn't like [the kickback]. I feel like the track was a no, but when everybody started running at the top of the stretch, she just got by and stayed.”

Pedigree Notes:

Julia Shining's ultra-talented sister Malathaat opened her account with five straight wins for Pletcher. She won the Tempted S. in between her debut and the Demoiselle and captured the GI Central Bank Ashland S. en route to a GI Kentucky Oaks win. Malathaat also captured the GI Alabama S. last term and finished third in the Distaff, clinching the Eclipse award for top 3-year-old filly. She will likely take home another championship title this year after three Grade I wins, topped by a gutsy Distaff score last month, after which she was retired to Shadwell's broodmare band.

While Malathaat was sold to Sheikh Hamdan's operation for $1.05 million at KEESEP, Julia Shining was retained by Barbara Banke, just like all of her dam Dreaming of Julia's other foals. The daughter of A.P. Indy had one foal in between the two Curlin fillies, an unnamed 3-year-old colt by Medaglia d'Oro. The 12-year-old mare had a Medaglia d'Oro filly in 2021 and another Curlin filly Apr. 4 of this year. She was bred back to Into Mischief.

Also a Stonestreet homebred trained by Pletcher and ridden by John Velazquez, regular pilot of Malathaat, Dreaming of Julia captured the GI Frizette S. and GII Gulfstream Oaks. She is a daughter of dual Grade I winner Dream Rush (Wild Rush), who is also the dam of MGSW Dream Pauline (Tapit) and SW Atreides (Medaglia d'Oro).

Julia Shining is the 50th graded winner and 92nd black-type scorer for the mighty Curlin. She is also the 120th graded victor and 254th black-type winner out of a daughter of the late, great A.P. Indy. In addition to Malathaat and Julia Shining, the Curlin/A.P. Indy cross is also responsible for MGISWs Stellar Wind, Clairiere and Nest; and Grade I scorers Global Campaign, Idol and Paris Lights.
