National HBPA Issues Statement on FTC Approval of HISA Safety Rules

The Federal Trade Commission (FTC) approved the rules and accreditation standards that comprise the Horseracing Integrity and Safety Authority's (HISA) Racetrack Safety Program on Friday.

The National HBPA issued the following statement on Saturday:

“The Federal Trade Commission (FTC) on Thursday, March 3, 2022, issued an order approving without exception all the racetrack safety regulations propounded by the Horseracing Integrity & Safety Authority (HISA). The rubber-stamp order accepted without issue all of the proposed rules as well as acceptance of the Authority's responses to the comments submitted by industry participants.

The order recognized that many of the comments by industry stakeholders were useful and constructive to improve the rules. Yet, the FTC refused to disapprove any rule, nor did it direct such constructive changes be incorporated prior to approval. Instead, the FTC took the position that it would welcome future proposed rule modifications that the Authority decides to submit in response to comments received.

This FTC order makes crystal clear that this private entity of self-appointed rule-makers (i.e., The Authority) has unfettered power without governmental oversight to control the horseracing industry.

The illusion of governmental supervisory control was clearly dispelled with the FTC approving all of the Authority's proposals without exception. It also demonstrated that this private entity will make the rules without regard to the constructive comments of industry stakeholders.

The FTC's order affirms the significant concerns expressed in pending litigation that such a delegation of control is unconstitutional and that the input of those closest to the horseracing industry is no longer relevant.”

Kathleen O. Keeps it Going in Davona Dale

Winngate Stables LLC's very promising Kathleen O. (Upstart) remained undefeated and stamped herself as a leading GI Kentucky Oaks contender with another impressive victory in Saturday's GII Davona Dale S. at Gulfstream.

Backed down to 2-1 favoritism from a 9-2 morning line, the rail-drawn dark bay trailed the deep field of seven early. Up a spot into sixth following an opening quarter in :23.38, she was under a ride rounding the far turn while racing in between horses. Stuck in a little traffic approaching the quarter pole, Javier Castellano found a lane as they straightened and Kathleen O. charged home in style while securing 50 qualifying points for this year's Kentucky Oaks. Previously unbeaten 'TDN Rising Star' Classy Edition (Classic Empire), a perfect three-for-three versus fellow New York-breds, was up for second.

The narrow winner of a somewhat key seven-furlong heat at Aqueduct first up in the mud in November, Kathleen O. most recently aired by 8 1/2 lengths in the track-and-trip Cash Run S. on New Year's Day.

“She did break good today, but she just doesn't have the speed to stay up with them,” winning trainer Shug McGaughey said. “The way she finished, pretty remarkable, especially over this track. I think this is a big move for a filly coming into this race off just two starts. I mean, I hope she keeps improving. Today, she had to make her room a little bit, so I'm sure she learned quite a bit today. That would be my preference to keep her here [for the Gulfstream Park Oaks] and not have to ship her for the Ashland [at Keeneland]. I'm pleased so far. I would think that [increased distance to 1 1/16 miles] shouldn't be a problem.”

Castellano added, “I liked the way she did it today. She doesn't have the speed to be close to the horses, but I loved the way she finished. She always breaks slow out of the gate, but that's her style. Every horse is different. Turning for home, I was loaded. I was just looking for the seam and trying to split horses and that's exactly what I did.”

Pedigree Notes:

Airdrie Stud's third-crop sire Upstart is in a sweet spot with his sophomores this year. Not only does he have Kathleen O., who was ranked third in this week's TDN Kentucky Oaks Top 10 prior to her Davona Dale score, but he also has the colt Zandon in a prominent spot on the TDN Derby 12. With the Davona Dale, Kathleen O. becomes Upstart's second graded winner. She was already one of his six black-type winners, with another seven runners knocking on the door with stakes performances.

Bred by Gainesway Thoroughbreds and Bridlewood Farm and sold by Niall Brennan as a $275,000 Ocala Spring 2-year-old after working a :21 1/5 quarter, Kathleen O. is the first foal out of Quaver, who has since only visited Tapwrit, resulting in a 2-year-old colt named Tap Collector (a $65,000 OBS yearling purchased by PJ Campanella) and a yearling filly. Gainesway, Bridlewood, and the Tapwrit syndicate had bought Quaver with Kathleen O. in utero for $90,000 at the 2019 Keeneland January sale, then resold her at last year's Keeneland November sale in foal to Tapwrit for $140,000 to Lev Miller. Her dam is a half to GISW and young sire Cupid (Tapit), as well as to additional GSWs Heart Ashley (Lion Heart) and Ashley's Kitty (Tale of the Cat).

Quaver is one of six young Blame mares to produce a stakes winner to date. Blame–who entered stud the year before Upstart was born–had a repeat black-type winner of his own Saturday, with his Officiating taking Aqueduct's GIII Tom Fool S.

Mira Mission Determined Winner In Stakes Bow At Gulfstream

Mira Mission kept his perfect record on the Gulfstream Park grass when outdueling French import Mouillage through the lane for a three-quarter-length victory in his stakes debut Saturday in the $150,000 Canadian Turf Stakes (G3).

Campaigned by Mary Abeel Sullivan Revocable Trust, homebred Mira Mission won twice during last winter's Championship Meet for previous trainer Tom Bush and came into the Canadian Turf off a half-length optional claiming allowance triumph for trainer Ian Wilkes Jan. 15.

In the Canadian Turf, Mira Mission was settled in sixth under jockey Julien Leparoux as 10-1 longshot Clear Vision, winner of the one-mile Tropical Turf (G3) Jan. 8, outran 1-5 favorite Never Surprised for the early lead.

Clear Vision went a quarter-mile in :23.76 seconds and a half in :47.54 pressed to his outside by Never Surprised, exiting a runner-up finish to defending winner Colonel Liam in the Pegasus World Cup Turf (G1) Jan. 29. Noble Indy and Mouillage joined the chase midway around the turn as Mira Mission began to roll on the far outside, engaged Mouillage in midstretch and edged clear, completing 1 1/16 miles in 1:41.43 on turf rated as good.

Sent off at 8-1, he paid $18.

Mouillage, racing first time in the U.S., was a clear second, while Grade 3 winner English Bee outfinished Noble Indy for third in the race for 4-year-olds and older. They were followed by Never Surprised, Clear Vision and Sigiloso in the seven-horse field.

Leparoux said the race set up well for Mira Mission.

“Before the race, looking at the paper, I didn't know what was going to happen really,” he said. “I'm glad the favorite had some pressure early on. He didn't get an easy lead, so we could sit behind, relax, and make one run. He ran a big race. I thought he had a good chance, but the favorite looked hard to beat on paper. I'm very proud of him. He's getting better and better.”

A homebred 4-year-old gelding by Noble Mission out of the Dynaformer mare Kazamira, Mira Mission has a 5-1-2 career line from 10 starts and earnings of $261,950.

Unbeaten Flightline Back in Training

Undefeated 'TDN Rising Star' and jaw-dropping GI Runhappy Malibu S. winner Flightline (Tapit) returned to the track at Santa Anita Saturday after a strain in his hock forced him to miss a planned start in Saturday's GII San Carlos S.

“He jogged a mile which is pretty routine,” trainer John Sadler said. “We think his setback is over and he's back to training.”

Flightline, campaigned in partnership by the powerhouse line-up of Hronis Racing, Siena Farm, Summer Wind Equine, West Point Thoroughbreds and Woodford Racing, made it a perfect three-for-three with an 11 1/2-length victory while making his stakes debut in the Dec. 26 Malibu.
