Breeders’ Cup Winner Aunt Pearl Retired; To Join Dayoutoftheoffice, Duopoly, Etoile In Fasig-Tipton November Sale

Aunt Pearl, winner of last year's Breeders' Cup Juvenile Fillies Turf, has been retired from racing and will be consigned by Elite Sales at Fasig-Tipton's Night of the Stars on Nov. 9 in Lexington, Ky. She will be part of a consignment that features three other Grade 1 winners.

At last year's Fasig-Tipton Night of the Stars, Elite led all consigners by average, median, and gross sales, with its seven-horse consignment producing total sales of more than $22 million. Since its inception in 2017, Elite Sales has led the world in selling racehorses, having sold 15 millionaires in four years.

Aunt Pearl, owned by Michael Dubb, Madaket Stables, Peter Deutsch, Michael Kisber and The Elkstone Group, went undefeated in 2020 with three gate-to-wire scores, culminating in her Breeders' Cup triumph. That race subsequently produced the winners of this year's Group 1 English 1,000 Guineas and the G1 Commonwealth Cup at Royal Ascot, cementing Aunt Pearl's global status as one of the best of her generation.

The 3-year-old daughter of Lope de Vega, became a TDN 'Rising Star' with a five-length maiden win over the Churchill Downs turf course before setting a new stakes record in winning the G2 Jessamine Stakes at Keeneland, completing the 1 1/16 miles on turf in 1:40 4/5.

Also featured in Elite's Night of the Stars draft is last year's G1 Frizette Stakes winner Dayoutoftheoffice.

Campaigned by Siena Farm and Blazing Meadows Farm, Dayoutoftheoffice will be just the second Grade 1-winning daughter of top sire Into Mischief to be sold at a breeding stock sale. After breaking her maiden in her debut at Gulfstream Park, Dayoutoftheoffice shipped to Saratoga and won the G3 Schuylerville by six lengths before defeating subsequent Eclipse champion Vequist by two lengths in the Frizette. Dayoutoftheoffice rounded out her 2-year-old season with a second-place finish in the Breeders' Cup Juvenile Fillies at Keeneland, besting fellow Grade 1 winners Simply Ravishing and Princess Noor.

Elite will also consign Etoile, a 5-year-old Grade 1 winning daughter of leading international sire Siyouni, to the Fasig-Tipton auction.

A top-rung stakes performer on both sides of the Atlantic, she captured last year's G1 E.P. Taylor at Woodbine for owners Peter M. Brant, Mrs. M. V. Magnier, and Mrs. Paul Shanahan. Prior to her Grade 1 victory in North America, Etoile captured France's G3 Prix Cleopatre at Saint-Cloud before missing by just a length in the G1 Prix de Diane. She finished ahead of eight group or listed stakes winners in that classic race, including two G1 winners. Etoile is on schedule to defend her crown in the E.P Taylor Stakes on Oct. 15.

Rounding out Elite's quartet of Grade 1 winners is last year's American Oaks conqueror Duopoly.

Owned by Klaravich Stables, Duopoly won the G1 American Oaks in impressive wire-to-wire fashion, finishing the last quarter mile in a sharp :22.63. She defeated a strong field that included two other G1 winners, one of which was 2019 Breeders' Cup Juvenile Fillies Turf winner, Sharing. Prior to her win at Santa Anita, Duopoly also captured the Winter Memories Stakes at Aqueduct in front running style.

Baffert Again Argues That NYRA Can’t Proceed With Efforts to Suspend Him

The matter of whether or not the New York Racing Association should be held in contempt and whether it can go ahead with a hearing that could lead to the suspension of Bob Baffert landed once again Friday on the desk of Judge Carol Bagley Amon.

The latest twist in the Baffert-NYRA saga began last week when Baffert's attorneys charged that NYRA should be held in contempt because of its announced plans to afford Baffert a hearing. The two sides have been at odds over the interpretation of a July 14 ruling from Amon, which blocked NYRA's plans to immediately exclude Baffert from its tracks. The Baffert team contends that Amon's ruling forbade NYRA from, at this point in time, taking any disciplinary actions against the trainer and called the proposed hearing a “sham.” NYRA has argued that it has been fully compliant with the order all along and should be permitted to go ahead with the hearing. The latest filing from NYRA read: “Plaintiff moves to hold NYRA in contempt for providing Plaintiff exactly what he argued he was entitled to in support of his motion for a preliminary injunction–notice and an opportunity to be heard.”

On Friday, Baffert's attorney Craig Robertson sent Amon a letter requesting permission for Baffert to file a Reply Memorandum that challenged NYRA's latest legal maneuver and reiterated reasons why the court should hold NYRA in contempt and issue a stay that would prevent NYRA from going forward with the hearing, now scheduled to begin Oct. 11.

The Reply Memorandum outlined the following arguments, most of which have appeared in previous court filings.

(*) NYRA should be held in contempt for violating the Injunction Order.

“The Injunction Order is clear, unambiguous, and directly prohibits NYRA from suspending Baffert,” the filing reads. “NYRA is simply inventing imagined ambiguities where they do not exist to excuse its own bad faith effort to circumvent the Injunction Order.”

(*) NYRA's new rules, procedures and charges are inconsistent with due process.

“Baffert has already defeated NYRA in court when it sought to unilaterally and unlawfully suspend him,” the filing reads. “It now seeks to do the very same thing all over again with vague and highly subjective charges. The idea that he will receive, through the retroactive application of newly created rules and procedures, a fair adjudication from a body intent on punishing him, is laughable.”

(*) NYRA should be sanctioned.

“Finally, NYRA argues that it should be excused from the consequences of its overt attempt to circumvent the Injunction Order,” the filing reads. “However, civil contempt sanctions are necessary to 'coerce future compliance and to remedy past compliance.' NYRA is a sophisticated entity with a long history of litigation. It is painfully obvious that its failure to abide by the Injunction Order is no accident. Sanctions and fees are necessary in this case to make it clear to NYRA that the Court will not tolerate its actions.”

The Baffert team again requested that its client be reimbursed for his legal fees.

The United States District Court for the Eastern District of New York has a hearing date set for Oct. 5 on Baffert's motion to hold NYRA in contempt and to issue a stay regarding possible suspension proceedings.

Liam’s Map Pair Set To Duke It Out in Ack Ack

Stonestreet Stables' 'TDN Rising Star' Beau Liam (Liam's Map), unbeaten in three starts in the lower grades, takes a steep rise in class as he squares off with the well-traveled Rushie (Liam's Map) in Saturday's GIII Ack Ack S. at Churchill Downs. Each could book a ticket to this year's GI Breeders' Cup Dirt Mile, won in spectacular fashion by their sire at Keeneland in 2015.

The homebred turned in a freakish effort on debut, sitting off a quick pace, cruising past the front-runners under a hold and scampering home by 7 1/2 lengths en route to his 'Rising Star'. The bay was never given a breather in a loaded first-level Saratoga allowance July 17, but battled on bravely to best the talented Witsel (Nyquist) by a nose and backed that up with a six-length success in an Aug. 29 allowance at the Spa. He stretches out to Churchill's one-turn mile Saturday, the same course and distance over which his dam Belle of Perintown (Dehere) won the 2002 Pocahontas S.

Rushie ran with credit along the Triple Crown trail in 2020, finishing third in the GI Santa Anita Derby in early June and in the GII Toyota Blue Grass S. the following month before striking from just off the pace in the GII Pat Day Mile on the Kentucky Derby undercard Sept. 5. Seventh to Knicks Go (Paynter) in the Dirt Mile, he has yet to get his picture taken in four tries this term, but has run well, including placings in the Apr. 10 Oaklawn Mile and in the GII Charles Town Classic Aug. 27 over a nine-furlong trip that is beyond his best.

South Bend (Algorithms) has taken just one of his last 16 starts, but he is unbeaten in two outings around one turn beneath the Twin Spires, having graduated at first asking over six furlongs before adding the Street Sense S. at the track and distance in 2019. He returns to the dirt off unplaced efforts on the turf at Saratoga in August and last month at Kentucky Downs.

Chance It Retired To Journeyman Stud In Florida

Florida-bred Chance It, a winner of two of the three legs of the prestigious FTBOA Florida Sire Stakes in 2019 at Gulfstream Park, has been retired and will stand the 2022 breeding season at Brent and Crystal Fernung's Journeyman Stud in Ocala, Fla.

“We're excited to stand Chance It here at Journeyman next year,” said Journeyman's Brent Fernung. “He is a beloved Florida-bred racehorse that displayed tons of talent. Had he not got injured, I'm sure he would have annexed at least one Grade 1 stake before he was finished. Chance It won from six furlongs to a mile and a sixteenth and showed indications that he would have won going further. It'll be a pleasure to work with Mary and her entire team.”

Chance It was trained by Saffie Joseph Jr. for Shooting Star Thoroughbreds, a syndicate managed by Mary Lightner of Ocala, Fla.

Chance It won the $100,000 FTBOA Florida Sire Stakes Dr. Fager over six furlongs by 3 1/4 lengths on Aug. 3 of 2019 before dominating the $400,000 FTBOA Florida Sire Stakes In Reality two starts later in September, winning the 1 1/16-mile test by 7 1/4 lengths. He was also second, missing by just a head to Liam's Lucky Charm, in the $200,000 FTBOA Florida Sire Stakes Affirmed going seven furlongs on Aug. 31.

By Currency Swap out of Vagabon Diva, by Pleasantly Perfect, Chance It started his sophomore campaign with victory in the $100,000 Mucho Macho Man on Jan. 4, 2020 at Gulfstream Park, achieving a Beyer Speed Figure of 99 while defeating stakes-winner As Seen On Tv and future graded stakes-winner Sole Volante.

In four starts this year, Chance It was second twice including a runner-up performance in the Grade 3 Smile Sprint over six furlongs at Gulfstream Park on July 3 and third in the G1 Forego going seven furlongs at Saratoga on Aug. 28 while earning a 97 Beyer. He was retired after his final start in the G2 Kelso at Belmont Park on Sept. 25 when he suffered a minor injury to his left front leg.

Chance It, who was bred in the Sunshine State by Bett Usher, finished his career with four wins, four seconds and a third in 11 lifetime races while earning $583,330.

The handsome bay colt will join a stellar stallion roster at Journeyman Stud that includes Khozan, the leading sire in Florida in 2020 and 2021; St Patrick's Day, who is a full-brother to Triple Crown winner American Pharoah; and Mr. Money, a winner of four graded stakes as a 3-year-old.

Chance It's fee for the 2022 breeding season has not been announced.
