										<content:encoded><![CDATA[<p>Every week, the <em>TDN </em>posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country.</p>
<p>Among this week's rulings, an independent arbitration panel suspended trainer Jason DaCosta for 15 days (starting on Mar. 22) and fined him $1,000 after his trainee, Poker Partner, tested positive for Gabapentin when winning at Presque Isle Downs on July 18 last year.</p>
<p>Gabapentin is a class B controlled medication under HISA that is an FDA human-approved anticonvulsant used to treat conditions like epilepsy, postherpetic neuralgia and in the treatment of partial onset seizures.</p>
<p>Trainer Carla Morgan has also been suspended for seven days and fined $1,000 after her trainee, River City Rocker, tested positive for the presence of the sedative, Xylazine, for a vet's list workout on Jan. 2 this year.</p>

										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country.</p>
<p>Among this week's rulings, trainer Daniel Franko has been suspended seven days after his trainee, Misty's Cat, tested positive for caffeine, when winning at Golden Gate Fields on Dec. 1 last year. He was also fined $1,000. Caffeine is a Class B controlled substance under HISA. The case was resolved without a hearing.</p>

<p>Here's a <a href="https://www.thoroughbreddailynews.com/weekly-stewards-and-commission-rulings-a-primer/">primer</a> on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.</p>
<p>The <em>TDN</em> will also post a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from the same week. These will include decisions from around the country.</p>
<p><strong><u>California</u></strong></p>

<p><strong>Penalty:</strong> Probation during remainder of license period, per terms and conditions</p>
<p><strong>Violation:</strong> Disorderly conduct, failure to report</p>
<p><strong>Explainer: </strong>Jockey Kent Desormeaux, having entered into a Settlement Agreement and Mutual Release with the California Horse Racing Board (CHRB) for violation of CHRB rules 1874 (Disorderly Conduct) and 1680 (Jockeys and Drivers to Report) on March 31, 2023, at Santa Anita Park, is placed on probation for the remainder of his license period, subject to the following terms and conditions of probation: He is placed on a testing agreement with the following conditions: (a) He will be tested by a CHRB investigator before entering the racetrack to exercise a horse or participate in a race. (b) On scheduled race days, he will report to the CHRB investigative office no later than 1.5 hours before the scheduled post time. (c) In the event CHRB investigators obtain a PAS reading detecting the presence of alcohol (Anything greater than 0.00) his license will be summarily suspended until a noticed hearing before a Board of Stewards is held and a ruling is issued. (d) Upon renewal of his Jockey license, a testing agreement will be part of his next license period.</p>

<p><strong>Explainer:</strong> Jockey Ricardo Ramirez who rode Irondale in the sixth race on June 10, 2023 at Santa Anita Park is suspended 4 racing days, June 18, 23, 24 and 25, 2023, for failure to maintain a straight course in the stretch causing interference resulting in the disqualification of his mount from second to third; a violation of California Horse Racing Board Rule #1699 (Riding Rules &#8211; Careless Riding &#8211; second offense in the last sixty (60) days).</p>
<p><strong><u>New York</u></strong></p>

<p><strong>Date:</strong> 06/11/2023</p>
<p><strong>Licensee:</strong> Todd Pletcher, trainer</p>
<p><strong>Penalty:</strong> Fourteen-day suspension, $2,000 fine</p>
<p><strong>Violation:</strong> Medication violation</p>
<p><strong>Explainer:</strong> Mr. Todd Pletcher, as responsible trainer under 9 NYCRR 4043.4 (a),violated Commission rules in that Mr. Todd Pletcher trained horse &#8221; Capensis &#8220;, that finished 6th in the 10th race at Saratoga racecourse on July 30th 2022, and having received a report from the New York Drug Testing and Research program that a race-day sample taken from the horse &#8221; Capensis &#8221; had the substance Phenylbutazone present at a concentration, including an assessment of the measurement uncertainty and imprecision of the quantitative threshold, in excess of 0.3 mcg/ml in plasma in violation of 9 NYCRR 4043.3 (a) (26).Trainer Mr. Todd Pletcher is hereby fined the sum of two thousand ($2,000) dollars and suspended fourteen Calandar days having appealed a stay has been granted.</p>
<p>Furthermore, &#8221; Capensis &#8221; is disqualified from any part of the purse and the Stewards order the purse redistributed as follows.</p>

<p><strong>Explainer: </strong>Official Dr. Steven Lascher is hereby fined the sum of $8,000 for failing to follow proper lasix procedures, necessitating the scratches of horses racing in the 3rd race on May 19th 2023 at Belmont Park.</p>

<p><strong>Licensee: </strong>Rob Atras, trainer</p>
<p><strong>Penalty:</strong> Ten-day suspension, $1,000 fine</p>
<p><strong>Violation:</strong> Medication violation</p>
<p><strong>Explainer: </strong>Mr. Rob Atras as responsible trainer under 9 NYCRR 4043.4(a), violated commission rules in that Mr. Rob Atras trained horse &#8220;Market Alert&#8221; , that finished 4th in race 7 at Aqueduct Racetrack on February 20th 2023, and having received a report from the New York Drug Testing and Research Program that a race-day sample taken from the horse &#8220;Market Alert&#8221; had the substance Phenylbutazone present at a concentration, including an assessment of the measurement and imprecision of the quantitative threshold, in excess of the quantitative threshold, in excess of 0.3 mcg/ml in plasma in violation of 9 NYCRR 4043.4 (a) 26. Having waived the right to request a hearing , Mr. Rob Atras is suspended 10 Calandar days effective Sunday June 11th 2023 through June 20th 2023 inclusive, and fined the sum of one thousand ($1,000) dollars.</p>
<p>Furthermore, &#8220;Market Alert&#8221; is disqualified from any part of the purse and the Stewards order the purse redistributed as follows:</p>

In addition, every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State that is (A) owned or trained by Mr. Rob Atras, or by any individual who serves as Mr. Rob Atras agent or employee during this period of suspension; or (B) for which Mr. Rob Atras is directly or indirectly involved in training during this period of suspension, including any arrangements to care for, train, enter in a race, race, invoice, collect fees or other payments related to, manage funds, employ and / or insure workers, provide advice or other information, or otherwise handle or assist with any aspect of the training of such horses.</p>

<p><strong><u>New York</u></strong></p>

<p><strong>Penalty:</strong> $1,000 fine</p>
<p><strong>Violation:</strong> Failure to tend to business in a &#8220;proper manner&#8221;</p>
<p><strong>Explainer:</strong> Racing Official Dr. Caitlin Owen is hereby fined the sum of one thousand ($1,000) dollars for failing to tend to business in a proper manner necessitating a scratch in the 8th race at Belmont park on May 21st 2023. The <em>TDN</em> has asked for clarification on the issue and will update as needed.</p>
<p><strong><u>Kentucky</u></strong></p>
<p><strong>Track:</strong> Churchill Downs</p>
<p><strong>Date: </strong>05/18/2023</p>
<p><strong>Licensee:</strong> Irad Ortiz, Jr., jockey</p>
<p><strong>Penalty:</strong> $1,000 fine</p>
<p><strong>Violation:</strong> Wearing unapproved promotional materials</p>
<p><strong>Explainer:</strong> After waiving his right to a formal hearing before the Board of Stewards, Irad Ortiz, Jr. is hereby fined $1,000 for failure to comply with the regulation that governs advertising by wearing promotional materials in race 11 at Churchill Downs on May 6, 2023, without written approval. Upon receipt of this ruling, the licensee is required within thirty (30) days to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to a summary Suspension of license pursuant to 810 KAR 3:020 Section 15 (CC).</p>

<strong>Violation</strong>: Careless riding<br />
<strong>Explainer</strong>: Jockey Mr. Dylan Davis is hereby suspended three (3) NYRA racing days. This for careless riding during the running of the 1st race at Aqueduct racetrack on April 6th 2023 having appealed a stay has been granted.</p>

<strong>Licensee</strong>: Jaime Torres, apprentice jockey<br />
<strong>Penalty</strong>: Fourteen-day suspension<br />
<strong>Violation</strong>: Careless riding<br />
<strong>Explainer</strong>: For having waived your right to an appeal Jockey Mr. Jaime Torres is hereby suspended 14 NYRA racing days, April 20th, 21st ,22nd , 23rd , 27th, 28th ,29th ,30th 2023 through May 4th, 5th, 6th , 7th , 11th 12th 2023 inclusive. This for careless riding during the running of the second race at Aqueduct Racetrack on April 8th 2023.</p>
<p><strong>Kentucky</strong></p>
<p><strong>Track</strong>: Keeneland<br />
<strong>Date</strong>: 04/08/2023<br />
<strong>Licensee</strong>: Aveory Faircloth, owner-trainer<br />
<strong>Penalty</strong>: Sixty-day suspension, 30-days stayed due to good prior record<br />
<strong>Violation</strong>: Possession of contraband<br />
<strong>Explainer</strong>: After waiving his right to a formal hearing before the Board of Stewards Aveory Faircloth is hereby suspended 60 days for possession of contraband (needles, syringes and injectable medications) &#8220;by a person other than a veterinarian licensed to practice veterinary medicine&#8221; and discovered on the association grounds of Three Diamonds Training Center, a location under the jurisdiction of the Kentucky Horse Racing Commission. Due to mitigating circumstances (lack of violations in relation to length of license history), 30 days are to be served from April 11, 2023, through May 10, 2023 (inclusive). The remaining 30 days are stayed on the condition that no similar violation or Class A or Class B medication violation occurs in any racing jurisdiction within 365 days from the date of this ruling. During his suspension Mr. Faircloth is denied the privileges of all facilities under the jurisdiction of the Kentucky Horse Racing Commission. Entry of all horses owned or trained by Aveory Faircloth is denied pending transfer to persons acceptable to the stewards.</p>

<strong>Penalty</strong>: $500 fine, horse disqualified, purse forfeited<br />
<strong>Violation</strong>: Medication violation (for horse that ran at Turfway Park)<br />
<strong>Explainer</strong>: Upon receipt of notification from The University of Kentucky Equine Analytical Chemistry Laboratory, the official testing laboratory for the Kentucky Horse Racing Commission, sample number R008025 taken from Future Victory, who finished second in the first race at Turfway Park on April 1, 2023 contained methocarbamol at a level of 7.98 ng/ml in blood (Class C drug). After waiving her right to a formal hearing before the Board of Stewards, Barbara J. Riley is hereby fined $500. Future Victory is disqualified and all purse money forfeited. Pari-mutuel wagering is not affected by this ruling. Upon receipt of this ruling, the licensee is required within thirty (30) days to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to a summary suspension of license pursuant to 810 KAR 3:020 Section 15 (cc).</p>

										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> publishes a roundup of key official rulings from the primary tracks within the four major racing jurisdictions of California, New York, Florida and Kentucky.</p>
<p><a href="https://www.thoroughbreddailynews.com/weekly-stewards-and-commission-rulings-a-primer/">Here's a primer </a>on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.</p>
<p>With the Horseracing Integrity and Safety Act (HISA) having gone into effect on July 1, the <em>TDN</em> will also post a roundup of the relevant HISA-related rulings from the same week.</p>
<p><u>California</u></p>
<p><strong>Track:</strong> Santa Anita</p>
<p><strong>Date:</strong> 02/03/2023</p>
<p><strong>Licensee:</strong> Eoin Harty</p>
<p><strong>Penalty: </strong>$3,000 fine</p>
<p><strong>Violation:</strong> Out-of-competition joint injection violation</p>
<p><strong>Explainer:</strong> Trainer Eoin Harty, who trains the horse El Joy, is fined $3,000.00 for violation of California Horse Racing Board rule #1866.3(c)(e) (Intra-articular Injections Restricted &#8211; treatment within 10 days of workout).</p>
<p>Harty told the <em>TDN</em> he will be appealing the ruling for various reasons, including for a career training record absent any prior medication violations (this is confirmed in the <a href="https://www.thoroughbredrulings.com/iagree.asp">Thoroughbred Rulings website</a>).</p>
<p><u>New York</u></p>
<p><strong>Track:</strong> Aqueduct</p>
<p><strong>Date:</strong> 02/02/2023</p>
<p><strong>Licensee:</strong> Suzanne Zelman, racing official/official veterinarian</p>
<p><strong>Penalty: </strong>$1,000 fine</p>
<p><strong>Violation:</strong> Lasix administration violation</p>
<p><strong>Explainer: </strong>You are hereby fined the sum of one thousand ($1,000) dollars for failing to tend to business in a proper manner necessitating the scratch of horse &#8220;Bustinupishardtodo&#8221; (# 8) from the eighth race at Aqueduct Racetrack on January 27th 2023.</p>
<p>According to New York Racing Association (NYRA) spokesperson Pat McKenna, the fine was for a failure to administer Lasix to the horse in question resulting in a mandatory scratch.</p>
<p><u>Kentucky</u></p>
<p><strong>Track:</strong> Turfway Park</p>
<p><strong>Date:</strong> 02/01/2023</p>
<p><strong>Licensee:</strong> Eric Reed, trainer</p>
<p><strong>Penalty:</strong> Five-day suspension, $1,000 fine</p>
<p><strong>Violation:</strong> Medication violation</p>
<p><strong>Explainer:</strong> Upon receipt of notification from The University of Kentucky Equine Analytical Chemistry Laboratory, the official testing laboratory for the Kentucky Horse Racing Commission, sample number R005087 taken from Golden Text, who finished first in the fourth race at Turfway Park on January 19, 2023 contained phenylbutazone at a level of 0.62 mcg/ml in blood (Class C) (2nd offense in 365 days). After waiving his right to a formal hearing before the Board of Stewards, Eric Reed is hereby suspended 5 days, February 10, 2023 through February 14, 2023 (inclusive) and fined $1,000.</p>

<p><strong>NEW HISA STEWARDS RULINGS</strong></p>
<p>The following rulings were reported on HISA's &#8220;<a href="https://portal.hisausapps.org/public-rulings">rulings</a>&#8221; portal, except for the voided claim rulings which were sent to the <em>TDN</em> directly. Some of these rulings are from prior weeks as they were not reported contemporaneously.</p>
<p>One important note: HISA's whip use limit is restricted to six strikes during a race.</p>

<p>∙              Juan Gabriel Lagunes &#8211; violation date January 31; $250 fine and one-day suspension, 9 strikes</p>
<p>Oaklawn Park</p>
<ul>
<li>Kelsi Harr &#8211; violation date January 29; $250 fine, striking mount on the flank during the fifth race on January 29, 2023.</li>
<li>Calvin Borel &#8211; violation date January 29; $250 fine and one-day suspension, 7 strikes</li>
<li>Ramsey Zimmerman &#8211; violation date January 29; $250 fine, three strikes in succession</li>
<li>Gabriel Saez &#8211; violation date February 3; $250 fine and one-day suspension, 7 strikes, on appeal and stay granted</li>
<li>Kelsi Harr &#8211; violation date February 4; $250 fine, striking mount on the flank during the second race on February 4, 2023.</li>
<li>Eduardo Gallardo &#8211; violation date February 4; $250 fine and one-day suspension, 9 strikes</li>
<li>Florent Geroux &#8211; violation date February 4; $250 fine, raising wrist above helmet when using crop</li>

<li>Yomar Ortiz &#8211; violation date February 1; $500 fine and three-day suspension, misuse of the crop</li>

<p>Santa Anita</p>

<li>Mario Gutierrez &#8211; violation date January 28; $250 fine and one-day suspension, 7 strikes</li>
</ul>
<p>Tampa Bay Downs</p>
<ul>
<li>Jose Luis Alonso &#8211; violation date February 1; $250 fine and one-day suspension, 8 strikes</li>
<li>Carlos Eduardo Rojas &#8211; violation date February 3; $250 fine and one-day suspension, 7 strikes, on appeal and stay granted</li>
<li>Carlos Eduardo Rojas &#8211; violation date February 4; 15-day suspension, &#8220;Jockey Carlos E. Rojas (P 000-026-197) has accumulated a total of 26 points for violation of HISA Rule 2280 (bl, (1). Nine of the points are under appeal and a stay has been granted, so the total points are reduced to 17 points.&#8221;</li>
