										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.</p>
<p>Among this most recent set of rulings, trainer Jorge Diaz has been suspended a total of 37 days and fined $3,500 for two separate violations.</p>
<p>Diaz was suspended for 30 days after his trainee, Melina's Dream, tested positive for an alkalinizing agent (TCO2) after finishing seventh at Parx Racing on Jan. 3. High total carbon dioxide (TCO2) levels could be an indication of bicarbonate loading&#8211;or milkshaking&#8211;which can neutralize the build-up of lactic acid in muscles, thereby helping the horse's performance.</p>
<p>Diaz was also suspended an additional seven days due to another trainee, Celtic Treasure, testing positive for Xylazine&#8211;a Class B controlled medication used as a sedative or analgesic&#8211;after running at Parx Racing on the same day. More detailed explanations of the rulings are currently unavailable on the Horseracing Integrity and Welfare Unit's (HIWU) website.</p>
<p>The new rules on intra-articular injections are still catching a noticeable number of trainers off guard.</p>
<p>Trainer Elliot Sullivan has been suspended for 30 days and fined $2,500 for giving an intra-articular injection within 14 days of a race. Two other trainers&#8211;Philip Serpe and Rohan Crichton&#8211;have each been fined $3,000 for joint injections within seven days of a timed workout.</p>
<p><strong>NEW HISA/HIWU STEWARDS RULINGS</strong><br />
The following rulings were reported on HISA's &#8220;<a href="https://portal.hisausapps.org/public-rulings">rulings</a>&#8221; portal and through the Horseracing Integrity and Welfare Unit's (HIWU) &#8220;<a href="https://www.hiwu.org/public-disclosures/pending">pending</a>&#8221; and &#8220;<a href="https://www.hiwu.org/public-disclosures/resolutions">resolved</a>&#8221; cases portals.</p>
<p><strong><u>Resolved ADMC Violations</u></strong><br />
<strong>Resolution Date: 04/01/2024</strong><br />
<strong>Licensee: Bernell Rhone, trainer</strong><br />
<strong>Penalty:</strong> Disqualification of Covered Horse's Race results, including forfeiture of all purses and other compensation, prizes, trophies, points, and rankings and repayment or surrender (as applicable); a fine of $500; imposition of 1.5 Penalty Points. Admission.<br />
<strong>Explainer:</strong> For the presence of Dexamethasone&#8211;Controlled Medication (Class C)&#8211;in a sample taken from Fury Cap, who finished third at Tampa Bay on 2/24/24. This was a possible violation of Rule 3312—Presence of Controlled Medication Substance and/or its Metabolites or Markers (Post-Race/Vets' List).</p>
<p><strong>Resolution Date: 04/01/2024</strong><br />

<strong>Penalty:</strong> 7-day period of Ineligibility for Covered Person, beginning on May 2, 2024; Disqualification of Covered Horse's Race results, including forfeiture of all purses and other compensation, prizes, trophies, points, and rankings and repayment or surrender (as applicable); a fine of $1,000; imposition of 2 Penalty Points. Admission.<br />
<strong>Explainer:</strong> For the presence of Xylazine&#8211;Controlled Medication (Class B)&#8211;in a sample taken from Celtic Treasure, who did not finish a race at Parx Racing on 1/3/24 (according to <a href="https://www.equibase.com/premium/eqbPDFChartPlus.cfm?RACE=4&amp;BorP=P&amp;TID=PRX&amp;CTRY=USA&amp;DT=01/03/2024&amp;DAY=D&amp;STYLE=EQB">Equibase</a>, Celtic Treasure was &#8220;injured in the early stages, pulled up and vanned off&#8221;). 										<content:encoded><![CDATA[<p>The Organization of Racing Investigators opened the final day of its Parx conference with another set of timely presentations.</p>
<p>Topics included the impact of bush track racing, and a variety of legal and scientific case studies, which were all geared for the investigator's toolkit.</p>
<p>With varied backgrounds in law enforcement and security, many attendees have experience growing up around horses. Investigators work for tracks and racing commissions, but they can never turn their backs on the chance to improve their techniques and plug into the ORI network fiber.</p>
<p>Kassie Creed, a Safety and Compliance Associate who works at Keeneland under Dr. Stuart Brown in equine safety, attended her second ORI meeting. She is part of the up-and-coming generation who is learning from those with decades of experience.</p>

<p>&#8220;Something I've noticed as a woman, thinking about my age, things that are relevant now will hit my generation in a different way,&#8221; she said. &#8220;I'm a small-picture person and my local horse population is my chief concern. So, when I came last year to ORI I added new skills and was able to apply what I learned here to my day-to-day processes, which really helps.&#8221;</p>
<p>The group began the day by hearing a talk on unregulated horse racing in North America by the USDA's Dr. Angela Pelzel-McCluskey. The epidemiologist has found 191 'bush tracks' across 30 states, and though all of them are racing Quarter Horses, she said that it is entirely possible that Thoroughbreds could be present too.</p>
<p>&#8220;Every time I go looking for these unregulated places, I find more, and if you think they are not in your backyard, like in New England, you'd be wrong,&#8221; she said. &#8220;The spread of diseases, the use of dirty needles, is a crisis, and there is no federal law that makes this racing illegal.&#8221;</p>
<p>The Association of Racing Commissioners International's Ed Martin added during his session, &#8220;We are being lumped in with unsanctioned racing and the public sees the videos and they share them. We are going to have to deal with this. It's here. This industry needs to be talking to one another. We need to get together. We need certainty.&#8221;</p>

<p>Other presentations were offered by seasoned experts who work with Comisión de Juegos de Puerto Rico and from across the state of Pennsylvania. Their specialist's view concerning case studies went to the heart of equine health by examining everything from how pathology can be utilized in court cases, illegal horse ownership, and situational awareness when conducting interrogations.</p>
<p>The conference wrapped with Ann McGovern, the Horseracing Integrity &amp; Safety Authority's Director of Racetrack Safety. Her presentation addressed last year's catastrophic injuries at Churchill Downs by highlighting the techniques which were implemented during the assessment.</p>
<p>&#8220;The process led us to found the HISA Track Surface Advisory Committee and expand on tools like an individual horse's exercise signature and their past performances,&#8221; she said.</p>
<p>As for ORI's next conference location, Keeneland was named as the site for 2025 with Dr. Brown serving as the conference chair.</p>

										<content:encoded><![CDATA[<p>With a strong first day program which ran the gambit from the centrality of horse racing's societal license to the destructive use of xylazine to an update from the Horseracing Integrity &amp; Welfare Unit, horse racing investigators at the annual Organization of Racing Investigators were immersed in some of the most pressing issues affecting the sport.</p>
<p>Hosted by Parx Racing and sponsored by everyone from Keeneland to the Breeders' Cup, over 100 specialists who protect racetracks in America and several other countries, listened, asked questions and made connections, all in the service of equine athletes.</p>
<p>As one investigator said about why he was in attendance, &#8220;We are here to protect those who cannot protect themselves and being in a room with like-minded individuals on our 24/7 mission is how we stay ahead.&#8221;</p>
<p>Each year conference participants swap tradecraft and those conversations lead to communication which crosses jurisdictions. It is a network behind the scenes, and that is why industry afficionados and the public do not necessarily have the opportunity to see the machinery at work.</p>
<p>&#8220;What we talk about here isn't secret, but our members need to have a degree of anonymity as they liaise with various groups of law enforcement, and that is one of the reasons why we don't open this conference to just anyone,&#8221; said this year's conference chairman Jason Klouser.</p>
<p>The morning sessions included several case studies about a variety of topics including horse welfare and how investigations have yielded important results. Members of the FBI's Philadelphia Office presented how xylazine used to sedate horses can enter the drug trade on the street illegally.</p>
<p>A highlight was the University of Kentucky's Dr. Camie Heleski, who spoke about the need for all horse sports to improve their optics by directly addressing its societal license to operate.</p>
<p>In other words, developing categorical areas to focus studies like recognizing physical and emotional stress in horses, what happens to them during the other 23 hours in a day when they are not performing and how tack and equipment can be used differently to improve the overall health of the sport.</p>

<p>HIWU's Shawn Loehr and Shaun Richards gave an update concerning their investigative operations. The pair now have four investigators on staff, along with a pair of analysts, and they will be adding more soon. Concerning states that do not have a voluntary agreement with HIWU&#8211;like New York or Oklahoma&#8211;they explained how they have come to rely on independent contractors and that their developing relationship with ORI members continues to be significant to their operations.</p>
<p>&#8220;Our mission is to catch doping, protect the horses, serve the Thoroughbred industry, and for instance, our 150 plus barn searches and tip lines continue to yield results,&#8221; Loehr said. &#8220;ORI is such a valuable resource and being able to talk with them during this conference is essential to our mission.&#8221;</p>
<p>During the evening, which shifted venues from the Parx racetrack to the casino, an awards banquet included the<em> TDN's </em>CEO/Publisher Sue Finley, who delivered the keynote over the power of integrity and the precarious position news outlets find themselves in when it comes to coverage of horse racing.</p>
<p>&#8220;Some organizations and individuals accuse us of being pro-HISA,&#8221; said Finley, speaking about the importance of independent journalism in horse racing. &#8220;The only thing we're accused of more? Is being ANTI-HISA. Sometimes, we write an article which generates complaints from some that we are pro-HISA, while others write us and say we're showing an obvious anti-HISA bias. All from the same article.&#8221;</p>
<p>The first day activities ended with the awarding of the organization's most prestigious honor which is named for longtime investigator John F. Wayne. The lifetime membership award went to Tampa Bay Downs's Deanna Nicol.</p>

										<content:encoded><![CDATA[<p>With an expected record attendance of over 120 participants, the 28th annual training and networking conference held by the Organization of Racing Investigators (ORI) is set for Sunday, Mar. 3 and will run through Wednesday, Mar. 6 at Parx Racing in Bensalem, Pennsylvania.</p>
<p>The <em>TDN's</em> CEO/Publisher Sue Finley will serve as the keynote speaker during the group's Monday evening dinner and awards ceremony, where her remarks will focus on horse racing, the media and integrity.</p>
<p>Central to ORI is the pursuit of integrity and education for its members. Interactions among investigators through networking helps to create lasting relationships between jurisdictions. This year's attendees hail from 18 states, Puerto Rico, the U.S. Virgin Islands, Canada, Ireland, England, France and South Africa.</p>
<p>The event will feature 16 presenters over the course of Monday and Tuesday, as members soak up the latest information concerning a host of pertinent topics directly related to their day-to-day work policing racetracks in their home states.</p>
<p>A broad range of case studies include unregulated horse racing, stable area access systems and equine safety stewarding, just to name a few. Representatives from various organizations like the British Horseracing Authority, the Comisión de Juegos de Puerto Rico, the Horseracing Integrity &amp; Welfare Unit and the Association of Racing Commissioners International will participate.</p>
<p>&#8220;Each year our attendance continues to grow and we would like to thank Parx for rolling out the red carpet for us and all of our sponsors for their assistance,&#8221; said ORI Chairman Jason Klouser of the Pennsylvania Horse Racing Commission. &#8220;This year's conference will have record attendance of over 120 individuals and has something for everyone. 										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.</p>
<p>Among the key rulings from the last week, trainer Bonnie Lucas was suspended seven days after a post-race Xylazine positive in a sample taken from Tankinator, who was injured and vanned off in a race at Parx Racing on Nov. 7. Xylazine is a Class B controlled medication under HISA that can be used to sedate racehorses.</p>
<p>It remains unclear whether Tankinator was euthanized as a result of his injuries sustained that day.</p>
<p>The 5-year-old gelding was having his first race for Lucas, having been claimed out of the Webster Gayle barn on Oct. 21. In a post-race sample taken Oct. 21, Tankinator tested positive for the corticosteroid Dexamethasone, a controlled medication commonly used as an anti-inflammatory.</p>
<p><strong>NEW HISA/HIWU STEWARDS RULINGS</strong></p>
<p>The following rulings were reported on HISA's &#8220;<a href="https://portal.hisausapps.org/public-rulings">rulings</a>&#8221; portal and through the Horseracing Integrity and Welfare Unit's (HIWU) &#8220;<a href="https://www.hiwu.org/public-disclosures/pending">pending</a>&#8221; and &#8220;<a href="https://www.hiwu.org/public-disclosures/resolutions">resolved</a>&#8221; cases portals.</p>
<p><strong>Resolved ADMC Violations</strong></p>
<p><strong>Date: 11/13/2023</strong><br />
<strong>Licensee: Librado Barocio, trainer</strong><br />
<strong>Penalty: A fine of $500; imposition of 1.5 Penalty Points. Admission.</strong><br />
<strong>Explainer:</strong> For the presence of Phenylbutazone—Controlled Medication (Class C)—in a sample taken from Sugar Fish. This was a possible violation of Rule 3312—Presence of Controlled Medication Substance and/or its Metabolites or Markers (Post-Race/Vets' List).</p>

<strong>Explainer:</strong> For the presence of Dexamethasone—Controlled Medication (Class C)—in a sample taken from Roseinthesky, who finished second at Finger Lakes on 11/8/23. This was a possible violation of Rule 3312—Presence of Controlled Medication Substance and/or its Metabolites or Markers (Post-Race/Vets' List).</p>

										<content:encoded><![CDATA[<p>The final leg of the $1,000,000 Pennsylvania-Sired/Bred Stallion Series is set for Wednesday, Dec. 27th at Parx Racing with the Miss Behaviour S. and the Wait for It S.&#8211;both purses are $200,000.</p>
<p>Initially, four races were carded for the inaugural series in 2022, while this year saw the expansion to six. Following the conclusion of the Stallion Series, a $50,000 trainer's bonus will be split among the conditioners of the horses who accumulated the first, second and third highest number of points over the six series races.</p>
<p>The first leg kicked off on PA Day at the Races in August. <strong>Gamboling Ghost</strong> (Weigelia) took home the $100,000 Whistle Pig S. and <strong>Jody's Ruby</strong> (Talent Search) topped the $100,000 Miss Blue Tye Dye S. for fillies.</p>
<p>The series continued with the second leg on the Pennsylvania Derby Day undercard. <strong>Notice of Action</strong> (Hoppertunity) held on to take the $150,000 Prince Lucky S. and filly <strong>Aoife's Magic </strong>(Smarty Jones) romped in the $150,000 Imply S. Both winners return for the final leg of the series.</p>

										<content:encoded><![CDATA[<p>Minutes after a $40,000 claimer named Jack a Rose (<a href="https://www.darleyamerica.com/stallions/our-stallions/midshipman" class="horse-link">Midshipman</a>) broke down in an Apr. 3 race at Parx Racing, part owner Lisa Novak got a call and was told she had two choices, have the gelding euthanized or go through with an expensive and complex surgery that may or may not save his life. She didn't see it that way. There was only one choice. She would do whatever it took to save Jack a Rose's life.</p>
<p>&#8220;I have so much love for him,&#8221; Novak said. &#8220;You can't just throw a life away.&#8221;</p>
<p>Not everyone would have seen it that way.</p>
<p>It was the tenth race at Parx that day, a $40,000 claimer for the type of horses who come and go without hardly anyone noticing. Trained by Michael Stidham, Jack a Rose had won two of eight career starts and earned $87,430. He would never be a stallion, be a star or make a lot of money, but Novak didn't care. She instructed the veterinary team at Parx to send Jack a Rose to Dr. Patty Hogan's clinic, where he would undergo a surgical procedure known as arthrodesis. An arthrodesis is where surgeons artificially fuse the joints through the use of ancillary devices like plates and screws.</p>
<p>&#8220;This horse is just so sweet, kind and intelligent,&#8221; Novak said. &#8220;I had to do this for him.&#8221;</p>
<p>The injury occurred in the left hind leg.</p>
<p>&#8220;You hear the common term breakdown injury all the time, on the newscasts and TV shows,&#8221; said Hogan, who would perform the surgery on Jack a Rose. &#8220;They are very serious injuries that happen to the ankle. It's when the horses lose the integrity of the function of the ankle whether by breaking a sesamoid or suspensory. These surgeries are difficult and they are expensive. It has a lot of complications associated with it. It's a huge investment.&#8221;</p>

<p>Performing an arthrodesis on a horse is not uncommon. Echo Zulu (<a href="https://www.threechimneys.com/horse/gun-runner/" class="horse-link">Gun Runner</a>) underwent the surgery after she broke down prior to the Breeders' Cup and so did Geaux Rocket Ride (<a href="https://lanesend.com/candyride" class="horse-link">Candy Ride</a> {Arg}) before he was also injured while preparing for the Breeders' Cup. Echo Zulu survived; Geaux Rocket Ride did not. For those horses, the surgery made economic sense. Both had tremendous residual value and were worth far more than the cost of the surgery. No matter what happened with his surgery, Jack a Rose would never race again and could not even be ridden. He would be a pasture pet, one with no economic value.</p>
<p>&#8220;The people who owned this horse are working-class people who bred and loved this horse,&#8221; Hogan said. &#8220;He was a modest race horse but they didn't feel like bailing on him. They wanted to fix him even if that meant he was just going to live somewhere for the rest of his life. He has no economic value whatsoever. What they did, that kind of got to us. It was really touching that they took this to the extremes they did as responsible horse owners. Euthanasia was an absolutely reasonable choice for this kind of injury.&#8221;</p>
<p>And there were no guarantees that he would survive the surgery.</p>
<p>&#8220;There are a lot of problems with this surgery,&#8221; Hogan said. &#8220;They are prone to laminitis in the other leg. They get infections because of all the metal. There's a lot of stress and a lot of tissue trauma. It's a big undertaking. Even if you have a horse that is insured many insurance companies consider the surgery an extreme measure and they won't honor the insurance policy.&#8221;</p>

<p>Hogan normally gives a horse a break of a few days between the time they are injured and when she operates. Novak could have changed her mind, something a lot of people might have done when they started to add up the numbers. The cost of the operation plus the payments for the time the horse is laid up and recovering would come out to about $25,000.</p>
<p>Novak grew up in Chicago and followed racing since she was very young. The first horse she fell in love with was Timely Writer, who had to be euthanized after breaking down in the 1982 GI Jockey Club Gold Cup. She said she was always haunted by his death and that it was never far from her mind when she had to start making decisions about Jack a Rose. Then there was the finances.</p>
<p>&#8220;I am a supervisor at a carwash here in Chicagoland,&#8221; Novak explained. &#8220;I've made $61,000 so far this year and my take home pay has been about $48,000. No, I really didn't have the money to do this. I've been through hard times financially before. I had to do it.&#8221;</p>
<p>She said she used credit cards to make the payments.</p>
<p>Jack a Rose was operated on Apr. 18 and everything went according to plan.</p>
<p>&#8220;We removed all the cartilage of his joint and put it back in perfect alignment with screws and wiring and a plate and let bone heal to bone so it becomes one single unit of bone that's very functionable,&#8221; Hogan explained. &#8220;It no longer bends but horses who have had this surgery can get around fine.&#8221;</p>

<p>Hogan said that she and her entire team rallied around the horse.</p>
<p>&#8220;This was a completely heart-warming story,&#8221; Hogan said. &#8220;We do this surgery for horses, but it's always for ones that are worth a ton of money. To do one for a horse who is a 5-year-old gelding was just amazing. Our whole crew, we were heavily invested in this horse. He's a wonderful horse. Just an amazing animal. To know how much these people cared about him was special. It was very satisfying to have been able to do a good job for them. Horse racing get bashed so much. I like to get these stories out there to educate people and show them there are plenty of people out there who really love their horses.&#8221;</p>
<p>Unable to have a second career, Jack a Rose is among the newest arrivals at Old Friends. Novak is hoping to visit him in January.</p>
<p>&#8220;I love animals,&#8221; she said. &#8220;If I could save every horse I would.&#8221;</p>

										<content:encoded><![CDATA[<p>Two board members from the Organization of Racing Investigators (ORI) warmed up their vocal chords and shared a sliver of their vast expertise concerning the value of racing integrity teams during a panel at the Global Symposium on Racing, sponsored by the University of Arizona's Race Track Industry Program, this past week.</p>
<p>Don Ahrens of Sam Houston Race Park and Jason Klouser of the Pennsylvania State Horse Racing Commission explained how these special squads, working alongside agencies like the Breeders' Cup, the U.S. Trotting Association, the American Quarter Horse Association and various state racing commissions and tracks, ensure that safety and security is center stage from the test barn to the winner's circle.</p>
<p>&#8220;We have developed an approach with these integrity teams which can be tailored to any situation, racetrack or regulatory body, and it really directs all of our resources to the protection of the equine athletes and ensure a level playing field for the participants, so the wagering public can bet on a product they can trust,&#8221; said Klouser.</p>
<p>Ahrens and Klouser are part of the ORI cadre which at its core is based on training and networking. Operating behind the scenes, members wage a daily effort to strengthen racing's regulatory efforts.</p>

<p>ORI member's tradecraft will be on full display from Mar. 3-6 when the ORI meets for what will be its 28th Training Conference. This time around, the multi-day event will be held at Parx Racing in Bensalem, Pennsylvania.</p>
<p>Chaired by Klouser, the preliminary agenda includes a diverse set of speakers who will be covering some of the most important issues pertaining to investigations in racing today.</p>
<p>&#8220;Our training conference continues to grow exponentially,&#8221; said Klouser. &#8220;That speaks to the organization's reputation and the importance of our network of investigators.&#8221;</p>
<p>This year's keynote address will be given by <em>TDN's</em> CEO/Publisher Sue Finley, who will discuss the changing landscape of media coverage and how it relates to racing integrity issues.</p>
<p>&#8220;We are excited to have Sue come and speak to the group since she has such an impressive list of accomplishments and we know she is going to deliver a unique set of perspectives concerning the media,&#8221; said Klouser.</p>

										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.</p>
<p>Among the key rulings from the last seven days, the prohibition of intra-articular injections within seven days of a timed or reported workout once again stands out as a thorn in the side of trainers.</p>
<p>Three such cases have been resolved in the past week, resulting in $3,000 fines meted out in each case.</p>
<p>The Horseracing Integrity and Welfare Unit (HIWU) also handed down a seven-day suspension and $1,000 fine to trainer Norman Follett, for a post-race Lidocaine positive following a September runner at Belmont at the Big A. Lidocaine is a pain reliever used ubiquitously in human medicine.</p>
<p>The details of the ruling are not yet publicly available. But Equibase shows Follett to run a small New York-based stable. This year, he has made only 39 starts and had one winner.</p>
<p><strong>NEW HISA/HIWU STEWARDS RULINGS</strong><br />
The following rulings were reported on HISA's &#8220;<a href="https://portal.hisausapps.org/public-rulings">rulings</a>&#8221; portal and through the HIWU's &#8220;<a href="https://www.hiwu.org/public-disclosures/pending">pending</a>&#8221; and &#8220;<a href="https://www.hiwu.org/public-disclosures/resolutions">resolved</a>&#8221; cases portals.</p>
<p><em><u>Resolved ADMC Violations</u></em><br />
<strong>Date</strong>: 11/4/2023<br />
<strong>Licensee</strong>: Gustavo Amaya, trainer<br />
<strong>Penalty</strong>: A fine of $3,000; imposition of 3 Penalty Points. Admission.<br />
<strong>Explainer</strong>: A possible violation of Rule 3314—Use or Attempted Use of a Controlled Medication Substance or a Controlled Medication Method—on the horse, Sandpiper Memories. This was also a possible violation of Rule 4222—Intra-Articular Injections Within Seven (7) Days of Timed and Reported Workout.</p>
