										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country.</p>
<p>Among this week's rulings, trainer Jonathan Wong has been suspended for two years and fined $25,000 for a post-race metformin positive from last June.</p>
<p>Wong <a href="https://www.thoroughbreddailynews.com/wong-suspended-two-years-and-fined-25000-says-hell-appeal/">told the <em>TDN </em></a>he has appealed the ruling which could now go before the Federal Trade Commission, head to federal court, or both. He also said that he would seek a temporary injunction against the ban.</p>
<p>Trainer Kari Craddock was issued a seven-day suspension for a post-race Methocarbamol positive. Methocarbamol is a Class C controlled medication, a first offense for which comes a possible $500 fine and loss of purse. This was Craddock's second Methocarbamol-related violation since HISA's Anti-Doping and Medication Control (ADMC) program went into effect.</p>
<p>Trainer Ismael Bahena has also been provisionally suspended after Bahena's trainee, Color Field, tested positive for methamphetamine&#8211;a banned substance under HISA and a ubiquitous drug of human abuse&#8211;when winning at Horseshoe Indianapolis on Oct. 30. HIWU has now brought 11 methamphetamine-related cases for adjudication since the ADMC program went into effect.</p>

<p><strong><u>NEW HISA/HIWU STEWARDS RULINGS</u></strong></p>
<p>The following rulings were reported on HISA's &#8220;<a href="https://portal.hisausapps.org/public-rulings">rulings</a>&#8221; portal and through the Horseracing Integrity and Welfare Unit (HIWU)'s &#8220;<a href="https://www.hiwu.org/public-disclosures/pending">pending</a>&#8221; and &#8220;<a href="https://www.hiwu.org/public-disclosures/resolutions">resolved</a>&#8221; cases portals.</p>

<p>Among the key rulings from the last seven days is the saga surrounding Tankinator, a horse at the centre of two positfives within 17 days.</p>
<p>On Oct. 21, Tankinator finished 6th at Delaware Park. Tankinator was claimed out of Webster Gayle's barn that day before running again on Nov. 7 for Bonnie Lucas at Parx Racing. Tankinator was pulled up and vanned off in that race. It's unclear whether Tankinator was euthanized.</p>
<p>In pending rulings posted on the Horseracing Integrity and Welfare Unit's (HIWU) website, the 5-year-old gelding's post-race sample after his Oct. 21 appearance tested positive for the corticosteroid Dexamethasone, a controlled drug commonly used as an anti-inflammatory.</p>
<p>Tankinator's post-race sample after his Nov. 7 run tested positive for Xylazine, a controlled drug that can be used to sedate or tranquilize horses.</p>
<p>According to a HIWU spokesperson, the notice for the first positive test was sent out after the horse ran again on Nov. 7, as the post-claim owner would not have had the option to void the claim through HISA without being aware of the first positive test. Gayle and the post-claim owner were alerted to the dexamethasone positive at the same time, the spokesperson added.</p>
<p>In a separate case, trainer Michael Lauer was handed down a two and ½ month suspension after his horse, Mowins, had tested positive for the diabetes drug, Metformin, after finishing third at Horseshoe Indianapolis on Aug. 5. He was also fined $2,600. Lauer's suspension began on Oct. 12.</p>
<p>HISA lists Metformin as a banned drug, meaning it comes with a possible two-year suspension.</p>
<p>According to the <a href="https://assets.hiwu.org/a/lauer-final-hiwu-decision.pdf">case resolution </a>posted on HIWU's website, the groom looking after Mowins had a prescription for Metformin, which he took twice daily. The day of the race, the groom, Jorge Ceballos, took the medication during lunch, before preparing Mowins for the race, &#8220;which included putting the bridle in Mowins' mouth,&#8221; according to the case resolution.</p>
<p>HIWU agreed that &#8220;Mr. Lauer was able to establish the source of Metformin by a balance of probability was unintentional contamination by Mr. Ceballos during his pre-race grooming preparations,&#8221; according to the case resolution.</p>
<p>Trainers <a href="https://assets.hiwu.org/a/summary-of-fd-j-englehart-2.pdf">Jeffrey Englehart </a>and <a href="https://assets.hiwu.org/a/summary-of-fd-a-allen-ii.pdf">A. Ferris Allen </a>were each issued seven-day suspensions and $1,000 fines for Phenylbutazone positives. Phenylbutazone is a Class C controlled medication. For both trainers, the sanctions handed down constituted their second Class C substance violations under HISA.</p>

										<content:encoded><![CDATA[<p>The former New York-based veterinarian Alexander Chan has filed a hand-written plea from prison asking for a reduction to his 30-month sentence that was <a href="https://www.thoroughbreddailynews.com/former-vet-chan-imprisoned-30-mos-for-role-in-doping-ring/">handed down in May</a> as punishment for his role in the wide-ranging 2020 racehorse doping conspiracy case.</p>
<p>In December 2022, Chan had cut a deal with prosecutors that involved pleading guilty to a single felony charge of drug adulteration and misbranding in exchange for two other felony counts against him being dropped.</p>
<p>Chan's filing with the court on Monday was submitted without an attorney acting on his behalf.</p>
<p>But the 10-page motion laid out a cogent case for reconsideration based on an amendment recently adopted by the United States Sentencing Commission that allows for downward revisions of sentencing levels for petitioners who have zero criminal history points on their records.</p>
<p>According to Chan's filing, the new sentencing commission guidelines allow, in certain cases, for retroactive recalculation of the &#8220;offense levels&#8221; that are used to determine prison terms, so long as the offenses didn't involve things like violent behavior, the use of weapons, sex crimes, or hate crimes.</p>
<p>Chan is arguing that a recalculated offense level in his instance would reduce his sentence to a 24-to-30 month prison term, and he is asking the court to revise his imprisonment to the lowest end of that tier because of his record of good behavior while jailed at Fort Dix, a low-security federal correctional institution in New Jersey.</p>
<p>Chan wrote in his motion that he has &#8220;pursued [computer] programming to a greater degree than any other similarly situated inmate and has been free from disciplinary actions.&#8221;</p>
<p>Chan was arrested in March 2020 as part of a series of coordinated law enforcement sweeps in the years-long federal investigation of a network of more than 30 horsemen, veterinarians, and equine pharmaceutical suppliers who ended up facing charges.</p>

<p>In the lead-up to sentencing, federal prosecutors had described Chan in court documents as &#8220;a former veterinarian for the New York Racing Association (NYRA), and a practicing veterinarian for over 15 years [who] abdicated his duty of responsibility to the horses under his care.&#8221;</p>
<p>The feds' portrayal of Chan continued: &#8220;After spending three years as a traveling veterinarian for NYRA, the defendant worked under convicted co-defendant Kristian Rhein at Empire Veterinary Group and soon after began providing and/or administering adulterated and misbranded drugs without valid prescriptions, knowing that their use violated New York's racing rules, medical ethics, and the law.&#8221;</p>
<p>Chan's own presentence report filed by his legal team had stated that, &#8220;Dr. Chan's sterling career and the beautiful young family it supported have since been destroyed because-at the direction of his boss and the owner of the veterinary practice in which he worked, Dr. Kristian Rhein-Dr. Chan participated in the distribution of misbranded substances for use on Thoroughbred racehorses.&#8221;</p>

										<content:encoded><![CDATA[<p>Every week, the <em>TDN</em> posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country.</p>
<p>Among the key rulings from the last seven days, trainer Philip Aristone has been suspended for a combined 105 days and fined a total $7,500 after two of his horses tested positive post-race for Lamotrigine, a Class A controlled medication under HISA.</p>
<p>According to the <a href="https://www.ncbi.nlm.nih.gov/books/NBK470442/#:~:text=Lamotrigine%20is%20an%20anti-seizure,%5D%5B2%5D%5B3%5D">National Institutes of Health</a>, Lamotrigine is an anti-seizure, anti-epilepsy drug that is also used off-label to treat other human health issues like acute bipolar depression, fibromyalgia, schizophrenia, and unipolar depression.</p>
<p>Los Alamitos-based trainer Reed Saldana has also been banned for two years and fined $25,000 after one of his horses tested positive post-race for the banned substance, Diisopropylamine, a vasodilator, meaning it can cause blood vessels to open or dilate. Diisopropylamine is also found in commonly used human products like hand sanitizer.</p>
<p>A Horseracing Integrity and Welfare Unit's (HIWU) arbitration body heard Saldana's case, for which he did not engage an attorney.</p>
<p>The next option for covered persons who wish to contest a HIWU arbitration decision is to appeal the result to the Federal Trade Commission (FTC).</p>
<p><strong><u>NEW HISA/HIWU STEWARDS RULINGS</u></strong></p>

<p>A day after telling the <em>TDN</em> that it was not obligated to make public the names of horses who were ineligible to race or work because they were found to have had an intra-articular injection within seven days of a timed workout, the Horseracing Integrity and Welfare Unit (HIWU) reversed course Friday and published a <a href="https://assets.hiwu.org/a/ch-provisionally-suspended-current.v3.pdf">list on its website </a>of the 19 horses that were provisionally suspended.</p>
<p>Horses that violated Horseracing Safety and Integrity Authority (HISA) Rules 3313 and 4222, which cover intra-articular injection and the timeframe in which horses can race or work after having the injections, mandates that any horses that violate the rules are ineligible race or breeze for 30 days from the date of the injection. Trainers in violation of the rules were subject to 60-day suspensions. However, HISA announced late last month that the trainers would not be penalized and that the rules would not be enforced prior to July 15. HISA Chief Executive Lisa Lazarus said at the time that the delay in implementing the rule was needed because there was confusion among trainers regarding the specifics of the rule. She added that the temporary modification of enforcement of the rules was deemed the most &#8220;fair and equitable&#8221; way to proceed &#8220;given the number of violations.&#8221;</p>
<p>But HISA/HIWU still put the horses involved on a &#8220;provisionally suspended list.&#8221; According to a HISA statement released Friday, that was done so to &#8220;protect the horse's health.&#8221;</p>
<p>The list includes 17 trainers. Two horses had not started, therefore their trainers were not listed on Equibase. Among trainers, the most prominent names on the list are Norm Casse, Michael Stidham, Todd Pletcher, Linda Rice, and Jack Sisterson. The others are Carlos Munoz, Adriel Gonzalez, Betty Ott, Pedro Nazario, Brian Cook, Adrian Farias, David Fawkes, Victor Carrasco, Jr., John Ennis, Joseph Davis and Monica McGoey.</p>
<p>The release of the names of the horses left some important questions unanswered, namely why were some of the horses permitted to race while on the suspended list? The list of horses that raced while they were supposedly suspended numbers nine and does not include horses that may have worked out while they should have been ineligible to do so. Three of the horses on the list won while &#8220;suspended.&#8221; They are Trust Me (The Big Beast), Borgobythsea (English Channel) and Let's Go Mark (American Freedom).</p>
<p>At deadline for this story, a HIWU spokesperson had just responded to an email from <em>TDN</em> asking why the horses were allowed to race while suspended and who at HISA/HIWU was responsible for this apparent lapse? In an earlier email to HIWU, <em>TDN</em> had also asked if the horses who won while on the provisionally suspended list would be disqualified.</p>
<p>Here is the reply:</p>
<p>&#8220;HIWU had not anticipated the large volume of violations related to this rule and given the newness of the ADMC program, HIWU processed and notified the cases as quickly as they could. The horsemen continued to train and race their horses prior to receiving any notification, therefore they will not receive any penalties. HISA is reviewing the rule and procedures and will make an announcement prior to July 15 on the status of the rule and related procedures subsequent to July 15. Additionally, there were numerous other potential ADMC violations that needed to be investigated and/or processed, creating a much larger than expected workload. HISA and HIWU's top priority is the safety and welfare of each horse and measures have been taken to address these operational concerns.&#8221;</p>
<p>The list published Friday was through July 3. According to HISA, it will be updated.</p>

<p><a href="https://www.thoroughbreddailynews.com/trainer-mullins-suspended-fined-for-clenbuterol-positive-in-del-mar-winner/"><em>Here's a primer</em></a><em> on how each of these jurisdictions adjudicates different offenses, what they make public (or not) and where.</em></p>
<p><em>With the Horseracing Integrity and Safety Act (HISA) having gone into effect on July 1, the TDN will also post a roundup of the relevant HISA-related rulings from the same week. </em></p>

<p><strong><u>California</u></strong></p>

<p><strong>Licensee:</strong> Jeff Mullins, trainer</p>
<p><strong>Penalty:</strong> Thirty-day suspension (15 days stayed), $1,500 fine</p>
<p><strong>Violation: </strong>Medication violation</p>
<p><strong>Explainer:</strong>  Owner/Trainer Jeff Mullins, who started the horse &#8220;INCH&#8221;, first place finisher, in the sixth race at Del Mar Race Track on August 25, 2022, having entered into a Settlement Agreement and Mutual Release with the California Horse Racing Board, is fined $1,500.00 and suspended for thirty days (January 9, 2023, through February 7, 2023) pursuant to California Horse Racing Board Rule #1887(a) (Trainer or Owner to Insure Condition of Horse), for violation of California Horse Racing Board rules #1843(a)(b)(d) (Medication, Drugs and Other Substances), #1843.1(a) (Prohibited Drug Substances &#8211; Clenbuterol) and assessed two (2) points in accordance with California Horse Racing Board 1843.4 (Multiple Medication Violations [MMV] Class 3). In accordance with the agreement, fifteen suspension (January 24, 2023, through February 7, 2023) are stayed, Jeff Mullins is placed on probation for one year from the date of this ruling and may not have any violation of CHRB Rules and Regulations, #1843, #1843.1, and #1887 regarding Class I, II or III drug substances. The term of suspension shall be from January 9, 2023, through January 23, 2023. If Jeff Mullins violates a condition of the probation, fifteen days of stayed suspension shall be imposed following a notice and hearing.</p>

<p><strong>Violation:</strong> Excessive use of the whip</p>
<p><strong>Explainer:</strong> Having violated the Horseracing Integrity and Safety Authority Rule #2280 (Use of Riding Crop) and pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties &#8211; Class 3), Jockey Joe Bravo, who rode Luvluv in the tenth race at Santa Anita Park on January 7, 2023, is suspended for (1) day (January 15, 2023), and fined $250.00 for one (1) strike over the limit. Furthermore, Jockey Joe Bravo is assigned three (3) violation points that will be expunged on July 8, 2023, six (6) months from the date of final adjudication pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and penalties) &#8211; third offense since August 11, 2022. Jockey Joe Bravo has accrued a total of nine (9) points.</p>

<p><strong>Date:</strong> 01/08/2023</p>
<p><strong>Licensee: </strong>Flavien Prat, jockey</p>

<p><strong>Violation:</strong> Excessive use of the whip</p>
<p><strong>Explainer:</strong> Having violated the Horseracing Integrity and Safety Authority Rule #2280 (Use of Riding Crop) and pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and Penalties &#8211; Class 3), Jockey Flavien Prat, who rode Giver Not a Taker in the seventh race at Santa Anita Park on January 7, 2023, is suspended for (1) day (January 15, 2023), and fined $250.00 for one (1) strike over the limit. Furthermore, Jockey Flavien Prat is assigned three (3) violation points that will be expunged on July 8, 2023, six (6) months from the date of final adjudication pursuant to Horseracing Integrity and Safety Authority Rule #2282 (Riding Crop Violations and penalties) &#8211; first offense.</p>

<p><strong>Date:</strong> 01/06/2023</p>
<p><strong>Licensee:</strong> Kieron Magee, trainer</p>
<p><strong>Penalty: </strong>Ten-day suspension, $1,000 fine</p>
<p><strong>Violation:</strong> Medication violation</p>
<p><strong>Explainer: </strong>Having received a report from the NYS Gaming Commission Drug Testing Laboratory of the finding of Phenylbutazone in the post-race sample taken from horse &#8220;Dat Dares Gold&#8221; (#5) which raced at Aqueduct Race track in the 3rd race and finished 2nd on November 17th 2022. Trainer of record Mr. Kieron Magee having been notified of the post-race findings and having waived his right to an appeal, is hereby fined the sum of $1,000 dollars and suspended 10 Calandar days effective Friday January 13th, 2022, through Sunday January 22nd 2022, inclusive.</p>
<p>Furthermore, the Stewards order horse &#8220;Dat Dares Gold&#8221; disqualified from any part of the purse and the purse redistributed as follows:</p>

According to NYRA spokesperson Pat McKenna, Jones was fined for failing to make the appropriate accommodations to have his horse saddled by approved personnel.</p>

										<content:encoded><![CDATA[<p>Trainer Doug O'Neill has been suspended 60 days, fined $10,000, and put on probation for one year stemming from a medication positive by his starter Worse Read Sanchez (Square Eddie) at Golden Gate Fields May 1, <a href="http://chrb.ca.gov/stewards_rulings.aspx">according to a ruling posted </a>on the California Horse Racing Board (CHRB) website. The 3-year-old gelding finished third in Golden Gate's Silky Sullivan S., his only start at the Northern California track. Worse Read Sanchez, who is owned by Reddam Racing LLC, has since made five additional starts at Santa Anita and Del Mar, with his best finish a third Oct. 7 in an optional allowance in Arcadia.</p>
<p>The ruling is pursuant to CHRB Rule #1887 for violation of CHRB Rules #1843 (a) &amp; (d) (Medication, Drugs and Other Substances) and #1843.1 (a) (Prohibited Drug Substances). The prohibited substance was reportedly lidocaine, a Class 2 violation.</p>
<p>In addition to a 60-day suspension and $10,000 fine, O'Neill will be placed on a one-year probation, retroactive to May 1, the date of the violation, and ending May 1, 2023. His 60-day suspension is to be stayed 30 days for good cause. The actual days of suspension will begin Nov. 21 and end Dec. 20. If any of the probation is violated, the stayed 30 days will be reinstated in addition to any penalty for any addition rule violation.</p>

										<content:encoded><![CDATA[<p>Trainer Marcus Vitali, whose career has been plagued by numerous suspensions and controversies, has been suspended for one year and fined $10,000 by the Pennsylvania Racing Commission after a horse he trained named Single Lady (Shanghai Bobby) tested positive for d-methamphetamine. He was also hit with six multiple medication violation points.</p>
<p>The infraction occurred on Aug. 21, 2021 at Presque Isle Downs in a maiden special weight race won by the Vitali-trained filly. The horse is owned by Crossed Sabres Farm.</p>
<p>The story was first reported by the <em>Paulick Report</em>.</p>
<p>According to the website pubmed.ncbi, methamphetamine is banned in athletic competition because it may improve athletic performance, but there are no studies assessing its effects on performance.</p>
<p>Vitali requested a split sample, which was conducted by the UIC Analytical Forensic Testing Laboratory in Chicago, Illinois, which confirmed the d-methamphetamine positive. The suspension began Feb. 15 and is set to expire on Feb. 14, 2023.</p>
<p>According to the <em>Paulick Report</em>, Vitali has appealed the Pennsylvania suspension. He is currently racing at Turf Paradise and is scheduled to have his next starter there in Tuesday's fourth race.</p>
<p>Vitali is also awaiting word from the New York Racing Association, which has scheduled a hearing that will determine if it can suspend him from racing at the New York tracks.</p>
<p>In a separate ruling, Vitali was fined $500 after being found on Oct. 6 to be in possession of medications without a prescription. According to the racing commission ruling, Vitali was in possession of medications known as Dr. Burch's 40 Equi-Dyne and Dr. Burch's 6 Windy. Both had labels stating that they were &#8220;for veterinarian use only.&#8221;</p>
<p>This is far from the first time Vitali has found himself in trouble with regulators or track officials.</p>
<p>There are 84 docket entries under his name in The Jockey Club's online rulings database, many of them for medication violations. Between 2011 and the start of 2016, Vitali was hit with 23 medication violations in Florida alone. He was also investigated over a complaint of animal cruelty.</p>
<p>In 2016, he relinquished his license in Florida after being hit with seven drug violations over a four-month period only to resurface at Mid-Atlantic tracks. In 2019, he was suspended for one-year in Delaware after it was alleged that he interfered with a search of an employee's dorm room and ran off with a vial containing an unknown substance. In 2020 he was banned at the Maryland tracks after it was charged that he was the actual trainer of horses running under the name of Wayne Potts.</p>
<p>Still, Vitali has found places to run. He made the bulk of his starts in 2021 at Turf Paradise and Presque Isle and also had starters at Finger Lakes, Saratoga and Lone Star Park. He made 126 starts in 2021 and won 17 races.</p>
<p>It was also reported by <em>Daily Racing Form</em> Friday that trainer Juan Vazquez was given 30 days worth of suspensions by the Pennsylvania Horse Racing Commission for two levamisole positives from 2021.</p>

										<content:encoded><![CDATA[<p>Trainer Wesley Ward has been suspended 30 days and fined $500 as a result of Averly Jane (<a href="https://www.darleyamerica.com/stallions/our-stallions/midshipman" class="horse-link">Midshipman</a>) testing positive for the diabetes medication metformin after winning the Kentucky Juvenile S. at Churchill Downs on Apr. 28 last year, according to a recent <a href="https://khrc.ky.gov/Documents/22-0003%20Wesley%20A.%20Ward%20-%20Class%20B.pdf">Kentucky stewards ruling</a>.</p>
<p>Fifteen of those 30 days have been stayed, however, due to Ward's overall record and number of violations, and on condition that the trainer receives no Class A or Class B medication violations over the next year.</p>
<p>Ward will serve the other 15 days of the suspension between Jan. 26 and Feb. 9.</p>
<p>Averly Jane was also disqualified and all purse monies are forfeited, according to the stewards ruling dated Jan. 25.</p>
<p>Not an equine medication, metformin is among the most commonly prescribed human medications in the U.S. It is used in the treatment of type II diabetes, reducing glucose production in the liver and the uptake of glucose by the intestine.</p>
<p>The Association of Racing Commissioners International <a href="https://www.arci.com/wp-content/uploads/2020/01/ARCI-CLASSIFICATION-PROGRAM-v14.1.pdf">classify it</a> a Class 2B drug.</p>
<p>According to Ward's attorney, Darrell Vienna, Ward had not administered metformin to Averly Jane and that all the evidence suggests it was a case of environmental contamination.</p>
<p>As such, Vienna said that he presented the following question to the stewards.</p>
<p>&#8220;What is more plausible: That a trainer like Ward with an international reputation would have administered or caused to be administered an easily detectable substance with no impact on performance in minute quantities? Or that it resulted from contamination of feed, hay, human contact?&#8221;</p>
<p>According to Vienna, &#8220;there was not a single bit of evidence on the regulatory side other than the detection of a small amount of this substance in the horse's system.&#8221;</p>
<p>That amount, Vienna said, was in the parts per billion.</p>
<p>According to Vienna, the nature of the violation didn't warrant a suspension.</p>
<p>&#8220;I searched all the records in the United States and I found two prior cases [of metformin positives] that resulted in $1,000 fines,&#8221; Vienna said.</p>
<p>Vienna also explained that in 2019, the Kentucky legislature approved a rule change essentially modifying the trainer absolute insurer rule &#8220;by permitting trainers to introduce what they deemed substantial evidence of mitigating circumstances for which a lesser or no penalty would be appropriate.&#8221;</p>
<p>The mitigating circumstances in this case, Vienna argued, further supported the rendering of a fine only.</p>
<p>After her win in the Kentucky Juvenile S., Averly Jane had two easy victories in the Skidmore S. at Saratoga and in the Indian Summer S., at Keeneland.</p>
<p>Her last racecourse appearance was a fifth-place finish in the GII Breeders' Cup Juvenile Turf Sprint.</p>
<p>Averly Jane is owned by Hat Creek Racing, a partnership led by Keeneland's vice president of racing, Gatewood Bell, himself a former Kentucky Horse Racing commissioner.</p>
<p>Over the last 10 years and comprising 4,615 starts, Ward has been penalized for two other medication violations, according to the <a href="https://www.thoroughbredrulings.com/default.asp?RRReport=45717&amp;moveto=41&amp;recount=42&amp;From=SRCH&amp;EPID=1978&amp;L=Ward&amp;M=A.&amp;F=Wesley&amp;LAST=WARD&amp;BRD=&amp;SHOWSEARCH=YES">Thoroughbredrulings</a> website.</p>
<p>The KHRC issued Ward a $500 fine when Arcelor tested positive for methocarbamol after finishing first in the fifth race at Turfway Park on Dec. 2, 2016.</p>
<p>Prior to that, the New York State Gaming Commission served Ward a 30-day suspension and $1,000 fine after Sunset Time tested positive for clenbuterol after finishing third in the second race at Belmont Park on June 20, 2012.</p>
<p>&#8220;It happened and that's it,&#8221; <a href="https://www.paulickreport.com/news/the-biz/trainers-levine-ward-suspended-for-medication-violations-in-new-york/">said Ward</a>, at the time. &#8220;I'm responsible for whatever the stewards give me. It is what it is. There are a lot of reasons it took so long for this to get resolved. It's for a medication I used to use to keep the lungs clean and everything working good. Unfortunately, this particular filly went over the permitted level. The rules are different now, and I don't use it at all.&#8221;</p>
<p>In June of 2020, the Florida Division of PariMutuel Wagering issued Ward a written warning after Summer Sangria tested positive for omeprazole sulfide, otherwise known as the ulcer medication Gastrogard.</p>
