When the IEAH stable partnership closed down in 2013, it seemed like the sport had seen the last of its founder, Michael Iavarone. But after four years on the sidelines Iavarone returned as the solo owner of a small group of horses in 2017. Since, he has built his stable into a top outfit, as evidenced by the fact that he will have a starter in the GI Pegasus World Cup Invitational in O'Connor (Chi) (Boboman) and in the GI Pegasus World Cup Turf Invitational in Master Piece (Chi) (Mastercraftsman {Ire}).

What brought Iavarone back to the sport, what are his goals and what on earth is the story with the crazy outfits he wears when he shows up at the track? Those were some of the questions we had for Iavarone when he appeared on this week's TDN Writers' Room podcast presented by Keeneland. Iavarone was this week's Green Group Guest of the week.

“So when I left in 2013, obviously I ran a syndicate at the time and we were unwinding the syndicate but I always wanted to essentially come back,” Iavarone said. “I just didn't know when, but I wanted to come back, just not as a syndicate. I wanted to come back with only my own money and have a couple partners. Very much low key, more for the entertainment than a business side of it. So I had to wait for the right time. I went back into the securities industry for an extended period of time. In 2017, I talked it over with my wife and we felt the time was good for a reentry point. So that's when we dipped the toe in, per se.”

Michael Iavarone Joins the TDN Writers' Room from Thoroughbred Daily News on Vimeo.

He said he never enjoyed having the responsibilities that go hand in hand with running a big syndicate. One of his worst memories was having to tell the partners that I Want Revenge (Stephen Got Even) was being scratched the morning of the 2009 GI Kentucky Derby.

“I can tell you that having a conversation with 125 or 150 people that day was so incredibly difficult that at no moment did I get a chance to even accept or even understand myself what just happened,” he said. “It felt like the worst thing in the world for them. And it was one of the worst things in the world for me to have to tell them why we're being scratched. And from that moment forward, it kind of sucked the life out of me because nobody cared or asked me the question, why did the horse scratch? Is the horse okay? It was more of a question of what does that mean to us financially? What does it mean to my investment? What does it mean to my money? And I would say to them, I can't control that. I'm not going to put a racehorse on the racetrack that has the opportunity or even the remote possibility of breaking down. Nobody really cared about that.”

And his outfits? In his IEAH days Iavarone looked and dressed like a Wall Streeter, wearing expensive and conservative suits. Now, he shows up in outfits that look like he stole them from Elvis Presley or maybe Michael Jackson. There are the jump suits, the bling, the deep tan and the ever present sunglasses.

“When I met my wife, she was very much into fashion,” Iavarone said. “So I first tried on something that I thought was kind of outrageous and ridiculous. I was against wearing it out, but I did anyway. I got some compliments. Some people looked at me like I was crazy, but I started to grow more comfortable with it. I felt like I could express myself in an older age. When I was younger I felt like I needed to be molded. I'm comfortable in my skin and I feel like it's fun. I know some people don't like it. Some people, they love it. The good news is I don't have to answer anybody anymore. That's the best part of not being part of a syndicate. So I can kind of do it my way. I feel like the way I dress now and go to the racetrack, it's all about fun.”

In the stallion spotlight segments, the podcast featured Coolmore's Epicenter (Not This Time), who stands for a fee of $40,000. The focus was also on Always Dreaming (Bodemeister), who stands at WinStar for $5,000. His best son, Saudi Crown (Always Dreaming) was this week's Fastest Horse of the Week. He ran a 105 Beyer in his victory in the GIII Louisiana S. at Fair Grounds and is on his way to the Saudi Cup.

Elsewhere on the podcast, which is also sponsored by WinStar Farm, the Pennsylvania Horse Breeders Association,1/ST Racing, the KTA & KTOB, West Point Thoroughbreds, and XBTV.com, the team of Randy Moss, Bill Finley and Zoe Cadman looked at a trio of 3-year-olds who were impressive winners last weekend. All three agreed that GIII Lecomte S. winner Track Phantom (Quality Road) and maiden winners Hall of Fame (Gun Runner) and Maymun (Frosted) are horses to watch on the road to the GI Kentucky Derby. There were also discussions of the news that Bob Baffert and Amr Zedan had dropped their last lawsuits challenging the decision to disqualify Medina Spirit (Protonico) from the 2021 Kentucky Derby and the developments out of Saudi Arabia where The Jockey Club of Saudi Arabia announced that it is, finally, moving closer to disqualifying Maximum Security (New Year's Day) from his win in the 2020 Saudi Cup.

Nearly four years after Maximum Security (New Year's Day) crossed the wire first in the inaugural Saudi Cup and six months after his trainer Jason Servis was given a four-year prison sentence for doping horses under his care, the Jockey Club of Saudi Arabia (JCSA) announced Tuesday that it has concluded its own investigation into the matter and will recommend to a Stewards Committee that it should sanction Servis and disqualify Maximum Security.

The final decision will be made by the Stewards Committee, but in the press release it issued Tuesday the JCSA made a strong case that Maximum Security should be disqualified and Servis should be sanctioned. At stake is the $10 million that is paid out to the winner of the $20-million race. Should Maximum Security be disqualified, Midnight Bisou (Midnight Lute) would presumably be declared the winner.

Maximum Security did not test positive for a prohibited substance before or after the Saudi Cup, but Servis was caught on wiretapped phone calls bragging that he gave the banned substance SGF-1000 to nearly every horse in his barn. Racing officials from JCSA have maintained that it is within their power to strip Maximum Security of the win if it was proven that Servis had been illegally drugging Maximum Security in the months surrounding the race.

The statement from the JCSA read, in part: “Following the conclusion of that investigation and pursuant to the Racing Rules of the JCSA (Rules) [2] and the Horseman's Guide (Guide) [3], the JCSA has now authorised charges to be brought against Jason Servis, the former trainer of the horse Maximum Security.

“The Charges allege substantial breaches of the Rules and the Guide and relate to the administration of Prohibited Substances to Maximum Security and failures to comply with the entry requirements for the Race.

“The JCSA will contend that the Stewards Committee should sanction Jason Servis and disqualify Maximum Security.”

The statement said that the inquiry to be held by the Stewards Committee will take place “in due course.”

The inquiry will be held in private and members of the media will not be permitted to attend. The decision of the Stewards Committee will be published at the conclusion of the inquiry. Until the Stewards Committee has made its final decision, the JCSA will issue no further statements.

At deadline for this story, Jeff Bloom, who heads the syndicate that campaigned Midnight Bisou, was unavailable for comment.

Gary West, who owned Maximum Security with his wife Mary, also could not be reached for comment. However, in December, 2022, West issued a statement saying he would be supportive of a decision to disqualify Maximum Security and redistribute the purse money.

“We believe in the justice system and have patiently waited for the legal prosecution to take its course,” West said. “Now that Jason Servis has entered a guilty plea, we want to make it clear that if the Saudi Cup decides to redistribute the purse, we would support that decision. Hopefully, that action will prevent future conduct of this nature. We believe the decision to take the Saudi Cup purse from Maximum Security and redistribute it is the correct one.”

1st-GP, $70K, Msw, 2yo, 7f, 12:10 p.m.

A pair of Todd Pletcher trainees headlines the action Saturday for Gulfstream's Pegasus Preview Day led by $700,000 2-year-old BAIL US OUT (Lookin At Lucky). Picked up at OBSAPR by Repole Stable off a breeze in :10 flat, the bay is a son of a stakes-winning dam from the family of MGSW/MGISP Topicount (Private Account). Bail Us Out will break from the inside under Jose Ortiz.

Stablemate Born Noble (Constitution), himself a $725,000 KEESEP yearling for St. Elias Stable and West Point Thoroughbreds, is the first foal out of GISP Zapperkat while third dam Rokeby Rosie counts dual champion Silverbulletday (Silver Deputy) as her half-sister. Pletcher tabs the other Ortiz brother, Irad, for the ride from the far outside.

Breaking between that pair is Mo Go (Medalia d'Oro), a $400,000 KEENOV weanling for Tom Durant and Jose D'Angelo. The colt was a $625,000 RNA at OBSAPR earlier in the year.

Big City (City of Light) has the same owner and trainer as Mo Go and his own $300,000 FTKNOV price tag after RNA'ing for $445,000 also out of OBSAPR. His dam, bought for $325,000 at KEENOV with this runner in-utero, is a daughter of MGISW and $1.8m KEENOV broodmare Ask the Moon (Malibu Moon). TJCIS PPS

1st-AQU, $85K, Msw, 2yo, f, 1m, 12:20 p.m.

Summer Wind Equine's Greatest Gift (Curlin) is the latest foal out of Lil Indy, also the dam of champion 3-year-old colt Maximum Security (New Year's Day). Summer Wind bought Lil Indy, a half-sister to MGISW Flat Out (Flatter), out of the 2019 KEENOV Sale for $1.85m. TJCIS PPS

At the conclusion of racing on Monday, Saratoga will have handled about $800 million for the meet, the third highest handle figure ever for the track. On-track attendance was at 1,055,543 after Saturday's GI Jockey Club Gold Cup Day card, setting an all-time record with two racing days to go.

Yet, by just about any measure, it was not a good meet. Saratoga came into 2023 with the wind at its back. Every year the racing seemed to get bigger, the handle would grow and more and more fans would pile into the historic racecourse. Taking out the covid year, handle had risen at Saratoga for five straight years.

Would Saratoga ever lose its momentum or would it keep growing exponentially?

It turned this year. The 12 fatalities, including two particularly gruesome ones that occurred in full view of packed grandstand and before a national TV audience, were as bad as it gets. How many racing fans were turned into ex-racing fans on those days? NYRA has always taken the safety of the horses and jockeys very seriously and will no doubt continue to put in place measures to keep both safe.

They have some control over horse safety, but none over the weather, which was a huge problem at the meet. During the 2022 meet, only 15 races came off the grass. Through Sunday of the 2023 meet, 65 races had come off the grass. There had been 189 grass races run in 2022 versus 129 this year. That always leads to the same problems. When races come off the turf there are always a number of scratches, typically creating off-the-turf races with four or five-horse fields. On Aug. 10, an off-the-turf race actually turned into a match race. This is stuff no one wants to bet on.

NYRA is ready to do what it can to address that problem. NYRA President and CEO Dave O'Rourke has said that there is serious interest in installing a synthetic track at Saratoga by the 2025 meet. It wouldn't replace either the dirt main track or the two turf courses but would give NYRA a third option when it comes to racing surfaces and the synthetic track would largely be put to use when the rains washed races off of the turf.

The weather has been a problem, but if you dig a bit further you can find some signs that Saratoga handle was affected by more than the rain. On GI Travers Day 2023, when two races came off the turf, the handle was $50,183,71. In 2022, the handle was $55,559,315 when one race came off the grass. This past Saturday, on GI Jockey Club Gold Cup Day, they bet $27,400,509 on a day not impacted by weather. The year before the handle was $32,505,600.

“I think what happened is with all the earlier rain we lost some momentum and when that happened it's hard to get it back,” O'Rourke said.

Field size fell by 2.5 percent, from 7.75 to 7.56. A more telling number was the average handle per betting interest. It was $255,773 this year and $272,599 last year, for a drop of 6.2%.

What's done is done and there's nothing to do now but turn the page and hope Saratoga 2024 is one of the safest meets in history and the weather is gorgeous from opening day to closing day. The place is still magical and popular, but everything peaks at some point. Maybe that's happened to Saratoga.

European Dominance On The Turf

This is getting a bit ridiculous. U.S. racing is used to second-flight European horses coming over and winning some of our biggest grass race, but the year European shippers are having this year shows that our grass horses are vastly inferior. Take Saturday's GIII $2 million Mint Millions at Kentucky Downs. There was only one European shipper in the field, Ancient Rome (War Front), who is trained by Charlie Hills and was ridden by Jamie Spencer. Facing the likes of GI winner Annapolis (War Front), he came into it off a win in a handicap race. Before that you had to go all the way back to 2021 for his last graded win, a victory in the GIII Prix des Chenes in France. He won that by a half-length. He won the Mint Millions by a half-length.

A week earlier, it was Bolshoi Ballet (Ire) (Galileo {Ire}). He came into the GI Sword Dancer after losing by 21 1/2 lengths in the GI King George VI and Queen Elizabeth I Stakes, where he went off at 125-1. Yet, that was good enough to win the Sword Dancer by 4 1/2 lengths. The win broke a nine-race losing streak, going back to the 2021 GI Belmont Derby where he also took advantage of a weak group of U.S. turf horses.

Then there's Aspen Grove (Ire) (Justify). She was sent off at 50-1 in the GI Irish 1,000 Guineas and finished last beaten 14 1/2 lengths. But that was good enough for her to take home first prize of $500,000 in the GI Belmont Oaks Invitational in her next outing.

Good luck to our horses in the Breeders' Cup turf races.

Surprise, Surprise, Still No News Out Of Saudi Arabia

Back in 2020, Maximum Security (New Year's Day) crossed the line in front in the 2020 $20 million Saudi Cup. Just a few days later, his trainer, Jason Servis, was arrested and charged with using performance-enhancing drugs on most of the horses in his barn. When that news broke, the Jockey Club of Saudi Arabia said it was withholding the purses until it could investigate the situation

It's been 29 months since Servis was indicted, he has pled guilty and in November will begin a four-year prison sentence. The case is over, but the Saudis still haven't paid out the purse. Presumably, the winner's share of $10 million will eventually go to Midnight Bisou (Midnight Lute). But no one has been paid as the Saudis, who should have all the evidence they'll ever need, do nothing and don't seem to be in any hurry to write a check. We tried to get an update on the situation this week, but the answer we got didn't really answer anything.

“Due to the extended nature of the judicial process in the USA, the JCSA has been unable to fully conduct its own investigation into the awarding of the winner's prize for The Saudi Cup 2020,” wrote the JCSA's Sarah Tregoning in response to an email sent by the TDN. “Now that the legal process in the USA has finished, the JCSA expects to swiftly conclude its own investigation and make an announcement in the coming weeks.”

I wouldn't hold your breath.

Why didn't the NYRA stewards disqualify Forte (Violence) from his win in a controversial running of the GII Jim Dandy S. Saturday at Saratoga? The wagering public bet $3,167,647 on the race and that doesn't include any of the horizontal wagers. After Forte and Irad Ortiz Jr. bulled their way off of the rail near the top of the stretch, bumped Angel of Empire (Classic Empire) and took away his path, it looked like the horse deserved to come down. But that didn't happen.

The bettors deserved an explanation. But none has been offered or, likely, ever will be.

Racing needs to do a better job with this. In the four major sports, when the umpires or referees review the replay of a play, they are required to announce their decision to the fans in the stands and those watching at home. They don't just tell you whether a player was safe or out, but why he was safe or out. The fan may or may not agree with the call, but, at least, they know why the officials ruled the way they did.

At Saratoga? Crickets.

Any time there is an inquiry or an objection, whether a horse is disqualified or not, the stewards should be required to come on in-house television and explain why they made the call that they did. It doesn't have to be that difficult or complicated. Something like, “the four horse bore in in the stretch, caused the jockey on the three horse to steady and cost that horse second-place, and that's why we disqualified the four horse and placed him third,” would suffice.

After the running of the 2019 GI Kentucky Derby, the Churchill Downs stewards disqualified Maximum Security (New Year's Day) and placed him 17th for interference. It took them an agonizing 22 minutes to reach a decision and they were not required to make their reasoning public. Worse yet, they met with the media and Kentucky Horse Racing Commission steward Barbara Borden read a brief and meaningless statement and refused to answer any questions.

The situation couldn't have been handled any more poorly, but at least they tried do better going forward. There have been instances at the Kentucky tracks when the stewards have gone on television to explain their rulings and the stewards there publish a daily report on the racing commission website which offers a brief explanation for any decisions they made during the course of a card.

The NYRA stewards could do the same thing, but they've apparently stopped trying. Starting in September of 2016, the NYRA website started posting what it called the Stewards' Corner, which offered explanations of the decisions made by the stewards during a race day.

This is what was posted for the 10th race on July 9, 2022.

“Stewards' inquiry into the stretch run. Late stretch #12 Heymackit'sjack (Irad Ortiz Jr.) drifts out under left handed crop forcing #5 Feathers Road(Jose Lezcano) to take up. After reviewing the video and speaking to the riders involved, the Stewards felt that #12 Heymackit'sjack did cost #5 Feathers Road a placing. #12 was disqualified from 2nd and placed 4th. The race was made official 4-1-5-12.”

That was the last item posted to the Stewards' Corner. Every decision since has gone unexplained. Why?

Such information is especially important in a situation like the Jim Dandy, a race in which the consensus seems to be that they made the wrong call. Here is the New York Gaming Commission rules regarding when a horse comes over and bothers another horse: “A horse crossing another may be disqualified, if in the judgment of the stewards, it interferes with, impedes or intimidates another horse, or the foul altered the finish of the race.”

Isn't that exactly what happened when it comes to Forte and Angel of Empire? Ortiz clearly came over, bumped and pushed Angel of Empire out, and could have cost him a placing. Despite the incident, Angel of Empire finished third and lost by just a half-length.

Worse yet, on Thursday at Saratoga, Ortiz was involved in an incident very similar to what happened in the Jim Dandy and, this time, was taken down. It happened in the seventh race, a $25,000 claimer, and Ortiz was riding a horse named Eyes on Target (Exaggerator). Ortiz got his horse hemmed in on the inside, but muscled his way out in the stretch, came over a couple of paths and bothered two horses. Eyes on Target was disqualified and placed eighth. Why was Thursday's incident cause for a DQ, but the Jim Dandy incident was not?

The stewards are allowed to make mistakes and dealing with Ortiz cannot be easy. He might be the most talented jockey in the sport, but he has no problem crossing the line. Many believe he does what he does because the NYRA stewards don't hold him accountable. Which takes us back to the Jim Dandy? Do they give Ortiz more leeway than other jockeys? Are they less inclined to take a horse down in a major race like the Jim Dandy than in a $25,000 claimer on a quiet Thursday afternoon? Or did they have a good reason for not taking Forte down, one that, when explained, might have shed some light on why they ruled the way they did?

Wouldn't it be nice to know?

Judge Mary Kay Vyskocil is a Rock Star

When Jason Servis was sentenced to four years in prison Wednesday by Judge Mary Kay Vyskocil of the United States District Court for the Southern District of New York, it marked the final chapter in the long and sordid affair that began in March of 2020 when more than two dozen individuals were arrested on charges related to using performance-enhancing drugs on race horses. Getting caught was the worst thing that could have happened to these cheats. The second worst was that their cases were heard by Vyskocil.

One after another, they paraded in and out of her courtroom in lower Manhattan with their excuses and mea culpas, some of which included the defendants breaking down in tears. From the judge, they asked for some compassion and some leniency. They never got any. Not a one of them.

“You cheated, you lied and you broke the law,” Vyskocil told Servis. “You did endanger the horses in your care. Luckily, they didn't break down. You tried to gain an unfair advantage. I hope you accept that, but I don't think that you do. At the end of the day, unquestionably, you undermined the integrity of horse racing.”

It was what we had come to expect from the judge. She got it. These people were lairs and cheaters who broke the law and there was no defending what they did. And they were people who put the lives of the horses they were entrusted with in danger by using potent drugs that had the capability of doing great damage to the animal. She bristled any time one of the defendants told the court how much they loved their horses.

“You also demonstrated, Mr. Navarro, a collective, callous disregard for the well-being of the horses,” she told Jorge Navarro before sentencing him to five years in prison. “The bottom line is you likely killed or endangered the horses in your care.”

She said she would have liked to give Navarro more than five years, but that was the maximum sentence she was able to hand down. Servis also got the maximum sentence. Now, Navarro is rotting away in a federal prison and, in November, Servis will begin serving his term. They got what they deserved and that's because they came before a judge who clearly understood what had transpired and how awful these crimes were.

When Long Range Toddy (Take Charge Indy) won the eighth race at Gulfstream Park Sunday, the 7-year-old put to rest a losing streak that dated back to before the controversial 2019 GI Kentucky Derby, a race in which he earned historical footnote status by being the horse who was fouled in the only disqualification of a Derby winner for an in-race incident.

Long Range Toddy's 2 1/4-length score in a seven-furlong allowance/optional claimer July 16 was his first victory since Mar. 16, 2019, when he took a division of that year's split GII Rebel S. at Oaklawn Park, two prep races prior to his brush with infamy in the Kentucky Derby.

Despite his win drought being ended, another remarkable aspect of Long Range Toddy's career remains intact: Although he flirted with favoritism before Sunday's race went off, he closed as the 2.4-1 second choice. Amazingly, this means that despite bankrolling more than $1.2 million in earnings in a career that now spans 37 starts all up and down the class structure, the betting public has never once sent off Long Range Toddy as the favorite in the wagering.

How many other equine millionaires can claim that feat? TDN is not sure, because such esoteric stats aren't easy to verify (although we'd welcome input from readers with better memories or access to a more robust database).

For a large chunk of his career Long Range Toddy was campaigned by his breeder, Willis Horton. Owner Zenith Racing acquired him in the spring of 2022. In a trainer switch on Sunday, he started for the first time for conditioner Victor Barboza, Jr. The winning rider was Emisael Jaramillo. It was lifetime win number five Long Range Toddy.

In the 2019 Kentucky Derby, Long Range Toddy was a 54-1 long shot already beginning to fade on the far turn when he was forced to check sharply as part of chain-reaction crowding that the Churchill Downs stewards deemed to have been caused by first-across-the-wire Maximum Security.

After 22 agonizing minutes of examining replays, the stewards took the win away from Maximum Security, placing him behind Long Range Toddy, who ended up 17th under the wire. Country House was declared the official winner of the Derby via DQ. The connections of Maximum Security sued in federal court to get the result overturned, but the DQ stood.

As fate would have it, this past week actually turned out to be newsworthy for the only three remaining active alums of that bizarre 2019 Derby.

On July 12, Gray Magician (Graydar), who finished 19th and last in the 2019 Derby, won a $20,000 claiming sprint at Canterbury Park by 3 1/2 lengths as the 9-10 favorite. He's been claimed five times and has had six different trainers while racing at 15 different tracks globally, from Meydan to Arizona Downs. His lifetime record now stands at 5-for-41 with $921,460 in earnings for current owner Kirk Sutherland and trainer Jose Silva, Jr.

Also on Sunday, just hours before Long Range Toddy's win, the connections of Tax (Arch), who crossed the wire 15th in the 2019 Derby, announced the retirement of the 7-year-old, who most recently ran second in the Mar. 11 GIII Challenger S. at Tampa Bay Downs. Tax retires at 5-for-19 and with $1,102,190 in earnings. He was owned in partnership by R.A. Hill Stable and trainer Danny Gargan.

The sentencing for barred trainer Jason Servis, the final–and most notoriously prominent–defendant in the 2020 racehorse doping conspiracy scandal, was rescheduled by a judge's order on Thursday, from May 18 to July 26.

The May 4 court order got handed down four years to the date that the Servis-trained Maximum Security (New Year's Day) crossed the finish wire first in the GI Kentucky Derby. The colt was subsequently disqualified for in-race interference.

Unbeknownst to Servis at the time, federal investigators had already begun compiling a trove of wiretapped phone conversations between Servis and other now-convicted horsemen, veterinarians, and pharmaceutical suppliers, 31 of whom were arrested and charged in a series of coordinated law enforcement sweeps in March 2020.

Even after being implicated by other guilty-pleading conspirators, Servis had maintained his innocence and held out for a trial until Dec. 9, 2022.

As part of a negotiated plea deal with the government, he then pled guilty to a felony charge of misbranding and adulterating a chemical substance (described by prosecutors as similar to the bronchodilator clenbuterol but stronger), and to a misdemeanor, of misbranding and adulterating a purportedly performance-enhancing chemical called SGF-1000.

Prosecutors had alleged (and other convicted conspirators had admitted their roles in) Servis's administration of SGF-1000 to Maximum Security during the first half of 2019, when the colt rose from being a $16,000 maiden-claimer to a Grade I winner.

Judge Mary Kay Vyskocil of United States District Court (Southern District of New York) granted the sentencing date change at the request of Servis's attorney.

“I make this request for the following reasons,” attorney Rita Glavin wrote in a May 3 letter to the court. “First, the Apr. 27, 2023, Presentence Investigation Report contains numerous defense objections to certain factual assertions, as well as the Government's responses to the defense objections. Because of (i) the number of disagreements and (ii) the issues around those disagreements, the defense needs additional time to review documents and respond.

“Further, given the extent of the disagreements, the parties have scheduled time to meet and engage in a good faith effort to resolve as many disagreements as possible, such that if there remain disagreements, they can be streamlined and narrowed for the Court.

“Finally, I am lead counsel on another matter proceeding to trial in June 2023, which is why we seek a date later in July,” Glavin wrote.

The presentence investigation report is generally a public document that is available for anyone to access on the court's electronic docket. But the disputed one Servis's attorney referenced was not listed there as of deadline for this story.

Servis, 66, faces four years in prison when he is sentenced.

Prior to his plea deal, Servis had been scheduled to go on trial on two felony counts: Conspiracy to misbrand and adulterate performance-enhancing drugs, and conspiracy to commit mail and wire fraud. He would have faced 25 years in prison on those two counts if convicted.

[Editor's note: Gary and Mary West are clients of Werk Thoroughbred Consultants, of which Sid Fernando is president and CEO. WTC recommended the 2014 purchase of Maximum Security's dam, Lil Indy, for $80,000 at Keeneland January for the purpose of breeding her to New Year's Day, a stallion owned by the Wests at that time and the sire of Maximum Security.]

“Just the facts, ma'am.”

The iconic line “just the facts, ma'am” is associated with the character of Sgt. Joe Friday from the 1950s cop show “Dragnet” starring actor Jack Webb in the title role of an LAPD detective. You may be too young to remember the series, but it's likely you're aware of the phrase, because it's become a part of the lexicon. That's what happens when things get repeated over and over again.

Three years ago, when the government indicted and arrested 27 individuals (it went up to 31) in what it called a wide-ranging “doping” scheme, most of us heard about the “drug” SGF-1000 for the first time. Since then, we've heard of it over and over again. This substance was specifically associated with two high-profile trainers, Jorge Navarro and Jason Servis, who'd been under investigation and were caught on tape admitting to each other that they'd used it on most of their stock.

Servis trained Maximum Security (New Year's Day), a Gary and Mary West homebred who finished first in the $20 million Saudi Cup three years ago with Coolmore as a partner. Maximum Security has yet to be declared the winner, because the following month the government issued the indictments that named the colt as the most famous recipient of SGF-1000. After this, the Saudi regulator paused purse distribution from the race, pending the outcome of its own investigation of the government's case.

In the indictment and subsequent filings, the government referred to SGF-1000 as a “customized PED,” and that label as a performance-enhancing drug has stuck. Press coverage has repeatedly referred to it as a PED and “dope.” At this stage, “dope” and “SGF-1000” are as synonymous as “dope” and Epogen, or “dope” and customized analgesics, or “dope” and “red acid,” some of the other PEDs mentioned in the indictment.

Three months ago, in early December, Servis pled guilty to two charges: a felony count of misbranding and adulterating a generic version of unprescribed clenbuterol, and a misdemeanor count of misbranding and adulterating related to SGF-1000 use. Servis admitted to judge Mary Kay Vyskocil that Maximum Security, while under his care, had been administered SGF-1000 by a veterinarian. Because SGF-1000 is the only substance that the government has said was administered to Maximum Security, its use and chemical makeup are of importance to the Saudis as they close in on a decision.

Widespread Use

It's important to understand that the government's case wasn't about “dope” per se; there are no federal laws about the doping of racehorses. Instead, the government relied on felony counts related to the misbranding and adulteration of substances used in interstate commerce under the Federal Food, Drug, and Cosmetic Act to indict and convict these individuals.

In almost all of these cases, however, the misbranded and adulterated substances were bona-fide PEDs, and the government could rightfully say that it had stopped several doping schemes. However, in the specific matter of SGF-1000, it appears the government was aware the substance wasn't a PED since at least September of 2019.

During the course of the last three years, I've read more than a thousand pages of court filings and spoken to several trainers who've admitted off the record to using SGF-1000 on some of their horses. None of them thought he was “doping” horses or doing anything illegal. Some are big names in the business, others smaller trainers.

One told me he had three horses shipped to him in Florida from a facility in New York with three bottles of SGF-1000 for his vet to administer. “Their vet prescribed it. I don't know if it helped,” this trainer said. “It was hard to tell, but the show horse people in Wellington seemed to feel it helped horses recover from work. I was told it was popular with them.”

I asked him if he'd speak on the record. “No, I'd get crucified in this environment we're in now with the Feds and drugs and HISA,” he said. “But SGF-1000 has been around for a while.”

As far back as 2014, Medivet, the company that sold SGF-1000, was openly advertising the product in print trades, radio racing shows, and online, and a rep for the company posted this on Facebook on Nov. 24, 2014: “To all my Facebook friends who are involved with horses: I want to share with you two great products that are drug free and chemical free that will maximize the health and wellness of your performance horse.” This was an overture to the dressage and eventing crowd in Wellington. One of the products he described was SGF-1000, of which he said, “USEF [US Equestrian Federation] approved for competition.” I don't know if this was true or not about USEF, but Medivet and its reps were openly hawking the substance in broad daylight, not peddling it conspiratorially under the cover of darkness.

“There was nothing nefarious about it,” said another, bigger New York-based trainer, who also spoke on the condition of anonymity and admitted that a multiple Grade l winner of his now at stud in Kentucky was once on it. “Dr. [Kristian] Rhein–he had a big practice in New York–dispensed it as something that was great for recovery and wellbeing. He was a good vet, especially on soundness. He'd trot a horse up and back and tell you right away where a problem was. I didn't think anything of it, and I think it did help my horse recover after works or races. A vet always prescribed and administered it. You know, Dr. Rhein had a lot of clients, and everyone knew everyone else was using it until they put it out on that overnight in September that no one was permitted to use it. When that came out, I got scared, and I never used it again after that. No one told us it was illegal before.”

In September of 2019, NYRA, at the direction of the New York Gaming Commission, put a note on the bottom of its daily overnights saying the use of SGF-1000 was prohibited. Perhaps the FBI alerted the commission and NYRA that SGF-1000 use on its grounds was widespread. By this time, the FBI already had Dr. Rhein, one of the co-owners of Medivet, boasting on tape that he'd sold “assloads” of the substance, and we've subsequently learned from court filings that Medivet was making “millions” from the sale of it. All of this makes it obvious that SGF-1000 was being used by more than just Navarro and Servis.

On Aug. 3, 2021, Dr. Rhein pled guilty in federal court to a felony charge of drug misbranding and adulteration. The government has a list of Dr. Rhein's clients who purchased and used SGF-1000 and is aware that some of these trainers had horses for well-known owners, some of whom belong to elite industry organizations. From court filings, the government also is aware of the labs that made the SGF-1000 – “unregistered facilities,” according to the Department of Justice, in California and Australia. These labs shipped SGF-1000 to Medivet's facility in Kentucky for packaging. The government's case that SGF-1000 was misbranded is convincing.

Just the Facts, Ma'am

As far as SGF-1000 is concerned, however, it appears that government prosecutors, who repeatedly called it a PED in court filings and press releases, may not have been correct. In a court filing that noted an FBI application to search emails of one of the owners of Medivet, an FBI agent wrote this in part about SGF-1000: “I have further learned that the Hong Kong Lab did not detect the presence of any growth factors or growth hormones in the sample that was analyzed, but did detect the presence of sheep amino acids.”

A person with direct knowledge who is not authorized to comment on the matter told me FBI investigators don't believe SGF-1000 was a PED, unlike other substances that were named in the indictments.

According to court filings, New Jersey regulators and a confidential source working with the FBI took blood samples from Maximum Security after he was administered SGF-1000 in early June of 2019. The confidential source dispatched the samples to the Hong Kong Jockey Club lab, and the testing came back negative for PEDs. During this time frame the HKJC responded with this email note – obtained from court filings – to the confidential source: “We had analysed (sic) the content of the SGF 1000 from Medivet some years ago. It is listed to contain a combination of growth factors, peptides, proteins, and signal molecules obtained from ovine placental extract. No detectable amount of growth factors was found but collagens common to ovine or bovine origin were detected.”

SGF-1000 originated in Australia and since 2014 has been tested by a number of other reputable organizations with no relationship to Medivet, including the Racing Medication & Testing Consortium (RMTC), Australian authorities in 2015, and UC Davis Maddy Laboratory, and not once in these tests has it been positive as a PED, according to court filings. Each time, however, it tested for sheep collagen, which is widely used in the manufacture of facial creams and other human skin-care products.

Government Test

According to court filings, government agents had obtained a bottle of SGF-1000 by July of 2019 and “sent the substance to a laboratory in Hong Kong for testing to determine the precise chemical contents of that substance.”

The thinking here seemed to be that SGF-1000 didn't test in Maximum Security's blood, but it would from the actual sample straight out of the bottle.

The results of that test have never been publicly revealed. If SGF-1000 did contain PEDs, wouldn't the government have publicized it? If it didn't test positive, the government wouldn't be under any obligation to share the results, because the charges of misbranding and adulterating have nothing to do with whether a substance is a PED or not.

Tellingly, after Servis pled guilty to the misbranding charge for SGF-1000, the DOJ press release did not use the words “performance-enhancing drug” or “PED” in reference to SGF-1000 – an about-face from before; instead, the government noted that Servis was guilty of having SGF-1000 administered to horses after NY regulators said the substance was illegal to use in Sept. of 2019. The federal misdemeanor charge was essentially for a state regulatory violation.

The government had a chance to reveal the results of its 2019 test but never did.

The government had access to the “unregistered” labs that manufactured SGF-1000 and could have readily exposed the ingredients that went into the formulation of the substance, but it never did.

Based on the standing facts, SGF-1000 was a misbranded substance, but it was not a PED.

And by the way, the exact line “Just the facts, ma'am” was never uttered by Sgt. Joe Friday, either. It's an urban legend. That's what happens when something gets repeated over and over again.
