										<content:encoded><![CDATA[<p>Fourteen world-class jockeys from eight jurisdictions around the world will participate in the International Jockeys' Challenge to be held on the eve of the Saudi Cup meeting at King Abdulaziz Racecourse in Riyadh Friday, Feb. 23. A team of seven male riders will compete against seven of their female counterparts in the four-race series.</p>
<p>Ryan Moore will feature in the Jockeys' Challenge for the first time in its brief history. The veteran reinsman, who was recognized as the Longines World's Best Jockey in Hong Kong last December, is one of five male participants based overseas, alongside the defending champion Luis Saez from the United States, Maxime Guyon from France and Japan's Ryusei Sakai.</p>
<p>Legendary Australian jockey Damien Oliver, the last of the overseas invitees, officially retired from the saddle Dec. 16, taking a Group 3 race named in his honour at Ascot in his hometown of Perth in Western Australia. But similar to his compatriot Glen Boss in 2022, Oliver&#8211;a three-time winner of the G1 Melbourne Cup&#8211;will pause his retirement to take part in the event, which is worth US$30,000 to the winner from a total pool of US$100,000. Oliver will look to add to the 3,168 winners he rode during an illustrious 34-year career in the saddle.</p>
<p>Eight-times Saudi champion Camilo Ospina and current titleholder Adel Alfouraidi round out the line-up for the males.</p>
<p>New Zealand's Lisa Allpress made history in 2020 when becoming the first female to win a race in Saudi Arabia, and the four-time leading rider returns to Riyadh for another crack. Australasia is also set to be represented by the Sydney-based Alysha Collett. America's Katie Davis makes her debut in the event and will be joined by South Africa's Rachel Venniker, Victoria Mota from Brazil, French jockey Maryline Eon and Great Britain's Saffie Osborne, the daughter of trainer Jamie Osborne, who was part of the female team that emerged victorious at last year's Shergar Cup at Ascot.</p>
<p>&#8220;The jockeys challenge on the Friday of Saudi Cup weekend is always one of the event highlights for me,&#8221; said HRH Prince Bandar Bin Khaled Alfaisal, Chairman of the Jockey Club of Saudi Arabia. We are justifiably proud of the variety of racing showcased across the two days. To be in a position to offer a global stage to 14 of the world's best jockeys, seven men and seven women, is highly gratifying.</p>
<p>&#8220;We wish the best of luck to all the jockeys competing and hope that their feats on the racecourse serve to inspire new generations of riders both in Saudi Arabia and beyond.&#8221;</p>

Violation: According to NYRA spokesperson, Pat McKenna, &#8220;an inadvertent administrative error during the claims process on September 1 resulted in voided claims.&#8221;<br />
Explainer: Racing Official Mr. Robert MacLennan is hereby fined the sum of $2,000 for failing to tend to business in a professional manner necessitating claims to be voided.</p>

<p><strong>NEW HISA/HIWU STEWARDS RULINGS</strong></p>
<p>The following rulings were reported on HISA's <a href="https://portal.hisausapps.org/public-rulings">&#8220;rulings&#8221;</a> portal and through the Horseracing Integrity &amp; Welfare Unit's <a href="https://www.hiwu.org/public-disclosures/pending">&#8220;pending&#8221;</a> and <a href="https://www.hiwu.org/public-disclosures/resolutions">&#8220;resolved&#8221;</a> cases portals.</p>
<p>This does not include the voided claim rulings which were sent to the TDN directly. Some of these rulings are from prior weeks as they were not reported contemporaneously.</p>

										<content:encoded><![CDATA[<p>Jockey Katie Davis will be suspended from riding the first seven days of the 2024 Saratoga Race Course season after she opted not to appeal a &#8220;careless riding&#8221; penalty handed down by the stewards. The ruling follows the disqualification of her mount on the final Saturday of this summer's meet.</p>
<p>According to the ruling dated Sept. 17, the infraction occurred in Saratoga's sixth race Sept. 2, a New York-bred maiden special weight over 1 1/16 miles on the turf. Davis was aboard the 52-1 first-timer <strong>Vin Santo</strong> (Vino Rosso), who got disqualified from fifth to tenth (last) for causing interference near the sixteenth pole.</p>
<p>The Equibase chart explained that Vin Santo &#8220;swung six wide into the stretch, was bumped by a rival outside the furlong marker, came in significantly under a right-handed crop nearing the sixteenth-pole, had the rider's right hand slip off the rein while trying to correct, slammed into a foe causing several horses to have trouble, was taken up while corrected and missed the superfecta.&#8221;</p>
<p>Davis rode in 86 races at Saratoga this year, compiling a 7-5-9 record with earnings of $544,078.</p>

<p>Katie Davis rode the winner of thee $30,000 maiden claimer, Danny Gargan-trainee <strong>Bon Adieu</strong> (<a href="http://www.hillndalefarms.com/ghostzapper/" class="horse-link">Ghostzapper</a>), finishing seven lengths ahead of <strong>Mim</strong> (<a href="https://coolmore.com/farms/america/stallions/practical-joke" class="horse-link">Practical Joke</a>), ridden by her brother Dylan. <strong>Embraceable Gal</strong> (<a href="http://www.hillndalefarms.com/midnight-lute/" class="horse-link">Midnight Lute</a>) was next and was ridden by Trevor McCarthy, who is Katie Davis's husband. <strong>Sweet Liberty</strong> (Bellamy Road) was fourth and was ridden by Jackie Davis, the sister of Katie and Dylan. The all Davis superfecta paid $26.35 for a 10-cent wager.</p>
<p>Katie, Dylan and Jackie are the offspring of retired jockey Robbie Davis.</p>
<p>&#8220;I looked at the screen because Danny (Gargan) said look at the superfecta, it was all four of you,&#8221; Katie said. &#8220;I was waiting for this moment. We made history again and it was really nice to beat Dylan this time. I looked back and thought here he comes, I've got to ride harder.&#8221;</p>
<p>&#8220;I was really happy for all of us,&#8221; said Jackie Davis. &#8220;I thought it was really cool. During the race we were all trying to beat one another. Afterward, we were laughing. When my horse started getting tired, I was watching Dylan and Katie's horses go forward and I didn't know who to root for. Everybody was really excited after it was over. This was amazing.&#8221;</p>
<p>Katie Davis has had seven winners at the meet.</p>
<p>&#8220;It all comes down to having a lot of support,&#8221; she said. &#8220;I'm lucky enough that I'm doing well and I keep it going. I never thought it would be like this. It's a great surprise and I am running with it. It's very special.&#8221;</p>
<p>This is the first Saratoga meet where all four members of the family have been regular members of the jockey colony. Still another Davis, Eddie, works for Bill Mott and is the regular exercise rider of Cody's Wish (<a href="http://www.hillndalefarms.com/curlin/" class="horse-link">Curlin</a>).</p>
<p>There could be some more Davis magic Monday. In the eleventh race, Katie will ride Mugsy Fury (Big Brown) for her father, who is now a trainer.</p>

<p>The marriage coupling rule came under fire when jockeys <a href="https://www.paulickreport.com/news/people/a-stupid-stupid-rule-new-york-restrictions-on-married-jockeys-stifling-davis-business/">Trevor McCarthy and Katie Davis, married in late 2020, began riding in New York last year.</a> Mindy Coleman, general counsel for the Jockeys' Guild, spoke at the hearing to testify that the rule prevented both McCarthy and Davis “from fully and fairly engaging in their careers.”</p>
<p>Despite supporting the elimination of the married jockey coupling rule, New York Gov. Kathy Hochul vetoed a bill to eliminate it last year due to concerns that allowing legislature to rewrite racing regulations could create a dangerous precedent.</p>
<p>NYSGC executive director Robert Williams concluded the hearing by stating that the commission staff would issue a recommendation later this year.</p>

										<content:encoded><![CDATA[<p>One year ago, a decades-old state requirement in New York that mandates that same-race mounts of married jockeys be coupled in pari-mutuel wagering cost the state an estimated $4.2 million in lost betting handle.</p>
<p>That same rule also caused two well-respected, just-married riders&#8211;Katie Davis and Trevor McCarthy&#8211;to uproot their lives during the middle of a pandemic, necessitating them to move from New York to California to try and earn livings by riding where no such restrictions exist.</p>
<p>In the midst of that upheaval, a New York lawmaker whose district includes Saratoga Race Course crafted a small but sensible piece of legislation to eliminate the spousal rule, which had widely been criticized as being outdated and sexist. That measure sailed unanimously through both the Assembly and Senate last spring.</p>
<p>But on Oct. 25, the bill was surprisingly vetoed by New York Governor Kathy Hochul, who explained that she would instead be directing the New York State Gaming Commission (NYSGC) to review the &#8220;continued need for mandatory coupling and the circumstances under which such a requirement might be relaxed.&#8221;</p>
<p>That directive by the governor nearly three months ago was what brought together a collection of Thoroughbred industry stakeholders, regulators, and track officials for a 90-minute NYSGC  videoconference hearing Tuesday morning to debate the issue of spousal mutuel couplings and related integrity issues that might pertain to newly legalized sports betting.</p>
<p>For the record, not a single speaker advocated in favor of keeping the antiquated rule as it's written. Nor did any participant cite any alleged harms that might result from relaxing it by allowing married jockeys to ride against each other as separate betting interests&#8211;just like sibling jockeys do, or unmarried but co-habitating riders are permitted to do, in New York.</p>
<p>But there were enough ideas brought up during the discussion to provide some traction for change.</p>
<p>They included the potential for New York's current rule to be eventually superseded by a national set of uniform rules that don't even mention restrictions on married riders; allowing New York's stewards to apply the existing rule at their discretion while informing the general public about perceived conflicts when married jockeys ride against one another, or doing away with all mutuel couplings altogether while letting the bettor beware.</p>
<p>The Jan. 11 hearing also unfolded against the backdrop of legalized sports wagering having just gone live in New York three days previously, and there was plenty of talk about how the NYSGC has no restrictions on its books about taking action on sports contests that involve family members.</p>
<p>Bennett Liebman, a New York attorney who is widely considered an expert on the intersection of horse racing, gambling, and New York State government, said one potential solution involved having the NYSGC follow the example of other international jurisdictions by restricting how and when &#8220;insiders&#8221; can bet (regardless of marital status) and more strictly policing instances of &#8220;improper assistance&#8221; or perceived collusion (by anyone) in races.</p>
<p>&#8220;If we want to avoid even the perception of conflicted loyalties, we need to have stronger rules and greater enforcement,&#8221; Liebman said, noting that he &#8220;prays for&#8221; an eventual implementation of national uniform rules to replace America's longstanding state-by-state patchwork of regulation.</p>
<p>Mindy Coleman, an attorney representing The Jockeys' Guild, said her organization advocates for a more flexible version of the current rule that would allow stewards discretion in mandating spousal mutuel couplings while keeping the betting public informed whenever spouses ride against one another.</p>
<p>&#8220;The stewards would still have the ability to couple entries in the event that it was deemed necessary if there are any concerns with inappropriate actions between the two parties that are related,&#8221; Coleman said.</p>
<p>Carrie Woerner, the Assemblywoman representing New York's District 113 who filed the vetoed spousal uncoupling bill last year, called the status quo &#8220;unfair and unjust.&#8221;</p>
<p>Woerner added that, &#8220;It treats married jockeys and members of their households differently than other participants in racing, and it does so based solely on marital status. The rule pre-supposes match fixing proclivities in married persons, and assesses a penalty in advance of guilt.&#8221;</p>
<p>Like Coleman, Woerner recommended public disclosure&#8211;which was in her bill as being the responsibility of tracks. She said a notation in the program would likely suffice.</p>
<p>But Liebman pointed out that while disclosure may be necessary in theory, it doesn't work well in practice within the world of racing.</p>
<p>&#8220;Disclosure failed at the Breeders' Cup in November in the [GI] Juvenile Turf race [when] few knew the betting status of the eventual winner,&#8221; Liebman said. &#8220;We've had ample experience in New York to know that late rider, equipment, and gelding changes have never been communicated well&#8230; Getting an announcement at the track is like getting an announcement at a subway station. And in these days of mobile betting, these announcements are even less likely to reach the intended audience.&#8221;</p>
<p>As several speakers pointed out, New York's stewards already have broad powers when officiating races to investigate any alleged collusion, so why is the extra layer of the spousal rule even necessary when it diminishes the number of betting interests, and thus the revenue that goes to purses?</p>
<h2><strong><em>How Did NY Arrive Here?&#8230;</em></strong></h2>
<p>New York's spousal mutuel coupling rule was essentially a non-issue until it became a focal point of intense scrutiny in early 2021, when it affected the newly married McCarthy and Davis, who had then just moved their tacks from Maryland to New York.</p>
<p>Although the couple had ridden against each other numerous times while dating, when Davis and McCarthy began competing in common races at Aqueduct, it triggered the application of little-used rule 4025.10 (f), which states, &#8220;All horses trained or ridden by a spouse, parent, issue or member of a jockey's household shall be coupled in the betting with any horse ridden by such jockey.&#8221;</p>
<p>So on 41 occasions between Jan. 1 and Mar. 21, 2021, McCarthy and Davis's mounts in common races at Aqueduct necessitated a 1 and 1A coupling. A rough estimate of lost betting handle based on multiplying Aqueduct's winter/spring per-entrant handle of $103,000 by 41 resulted in a $4.2 million loss.</p>
<p>The rule was not only widely criticized by the general public, but it caused confusion among bettors, plus reams of bad press for Aqueduct (whose officials stated there was nothing they could do to change the law) and the NYSGC (which did not address the controversy during any open, public meetings).</p>
<p>By February 2021, Davis was claiming that Aqueduct racing office workers were pressuring trainers into not naming her on mounts so that field sizes would not be artificially reduced, an allegation that a track spokesperson denied at the time. She switched to accepting mounts in Maryland Apr. 8 while McCarthy continued to ride in New York.</p>
<p>On May 9, Davis announced on Twitter that she and McCarthy were expecting a child, and she stopped riding in races. Shortly thereafter, the couple relocated to Southern California, and McCarthy began riding on that circuit May 28. But after his record dipped to 9-for-156, he hurt an ankle and missed nearly three months while recovering from surgery.</p>
<p>The couple moved back to New York, where McCarthy resumed riding Nov. 18. Davis gave birth to a daughter Dec. 21.</p>
<h2><strong><em>'Laughable' in Other Sports&#8230;</em></strong></h2>
<p>William Gotimer, a Saratoga-based attorney who represents Davis, said at the hearing that if the NYSGC was serious about protecting bettors, why does it continue to allow in-state residents to wager on simulcasts from other states in which there are no restrictions that keep married jockeys from riding uncoupled against one another?</p>
<p>&#8220;While the commission takes great umbrage at the suggestions that this discriminatory regulation is aimed at women, there is no question that it has a disproportionate impact on women,&#8221; Gotimer said. &#8220;As such, it is my belief that it likely violates both the United States and the New York State's constitution as an example of government overreach.</p>
<p>&#8220;The commission seeks to justify the harm this regulation rains down on married riders and the racing industry by alleging this regulation protects the betting public against dishonest, married riders,&#8221; Gotimer said. &#8220;It is a little more than telling that the commission seeks to assure gamblers that it is protecting them by admitting that it is impotent to otherwise effectively police dishonesty or wrongdoing.&#8221;</p>
<p>Gotimer also added that it would be &#8220;laughable&#8221; to think that after having just legalized sports betting, the NYSGC might all of a sudden step in and say it will impose similar wagering restrictions on athletes who, for example, play in contests either against or on the same team with their siblings.</p>
<p>But Joe Appelbaum, the president of the New York Thoroughbred Horsemen's Association, suggested that the NYSGC might truly have to consider those other potential conflicts in sports betting. He cited integrity instances in which teams are believed to be intentionally losing or &#8220;tanking&#8221; to get higher draft picks, or when winning teams bench star players in pre-playoff games where finishing higher in the standings doesn't matter. Should the public be allowed to bet on those events?</p>
<p>&#8220;We have to decide, is integrity the most important thing that we're talking about, and enforce that across all sports, instead of just in one sport?&#8221; Appelbaum asked. &#8220;Horse racing, in many ways, has had a much higher regulatory structure and a much higher bar to cross. Even though that might not be the popular perception, it's the actual truth.</p>
<p>&#8220;Our recommendation, in addition to having no coupled entries at all, would be to have a thorough review of all the gaming regulations involving wagering to make sure they're consistent across sports,&#8221; Appelbaum said.</p>

<p>“Tremendously excited about how his return has been received, lots of people looking for us in the mornings, and we've been very active in the mornings,” Migliore told <em>DRF</em>. “Excited to build upon the success he had last year before going to California and think that we'll be able to repeat if not expand that success this winter and beyond.”</p>
<p>McCarthy, <a href="https://www.paulickreport.com/news/the-biz/its-not-the-1800s-anymore-davis-calls-for-rule-coupling-married-riders-to-be-dropped/">who left New York partly because of a wagering rule that requires married jockeys to be coupled in the wagering,</a> went 9-for-156 in Southern California, and missed the last 11 weeks due to an ankle surgery. McCarthy now plans to ride year-round in New York, and he and his wife, jockey Katie Davis, are expecting their first child in December.</p>

<p>&#8220;The rule applies neutrally to all jockeys, without regard to gender, and is intended to enhance the wagering public's confidence in the integrity of a race,&#8221; Hochul said in a veto message Monday night. &#8220;Coupling of entries does not prevent related parties from participating in a race; rather, coupling of entries merely aggregates those related parties into a single betting interest in the race.&#8221;</p>
<p>The coupling rule was highlighted earlier this year when <a href="https://www.paulickreport.com/news/people/a-stupid-stupid-rule-new-york-restrictions-on-married-jockeys-stifling-davis-business/">jockeys Trevor McCarthy and Katie Davis told the <em>Paulick Report</em> that the outdated regulation was negatively affecting their careers in the state of New York.</a> McCarthy has since <a href="https://www.paulickreport.com/news/people/trevor-mccarthy-shifting-tack-to-southern-california/">moved his tack to Southern California</a>, and Davis hasn't ridden since May at Pimlico.</p>
<p>Gov. Hochul did add that she will direct the state gaming commission to review the &#8220;continued need for mandatory coupling and the circumstances under which such a requirement might be relaxed.&#8221;</p>

										<content:encoded><![CDATA[<p>No Guts No Glory Farm's 7-year-old mare Anna's Bandit, whose resume includes 11 stakes wins at three different tracks in two states as well as purse earnings of $806,655 over six seasons, has been retired from racing and will become a broodmare.</p>
<p>Bred and owned and trained by Maryland-based John 'Jerry' Robb and his wife, Gina, and ridden in 33 of her 39 lifetime starts by Xavier Perez, Anna's Bandit retires with a career record of 17 wins, five seconds, and eight thirds.</p>

<p>The Maryland Jockey Club will honor Anna's Bandit with a retirement ceremony between races during the 37th Jim McKay Maryland Million Day program Oct. 23 at Laurel Park.</p>
<p>“We're very excited. It's always hard, especially with a horse like Anna that's done so much, that you have to make this decision,” Gina Robb said. We couldn't be prouder of her. Now she's coming home and I'm so grateful, I really am.</p>
<p>“She means the world to us. She's like one of our children, basically. I think anybody who breeds horses can kind of relate to that, especially when it's a mom and pop kind of thing like we are,” she added. “We're a little operation. They're all there with us on the farm, and bringing her home to the farm that we built means so much to us. I'm really happy for her that she had such an incredible career, and now she's able to start over in a new chapter.”</p>
<p>In her most recent race, the daughter of Great Notion out of the No Armistice mare Onearmedbandit ran fifth in a six-furlong optional claiming allowance July 26 at Colonial Downs in New Kent, Va., behind fellow multiple stakes winner Never Enough Time.</p>
<p>“We were pretty much decided that this was going to be her last year regardless, it didn't matter if she was good, bad, or indifferent,” Gina Robb said. “She came out of that Colonial race a little tired, and we were kind of shaking our heads because we thought it was one of her easier spots.</p>
<p>“When she came back from Colonial, we just kind of didn't like the way she was going,” she added. “She doesn't have anything major where we had to stop her, but I think in all of our minds and our hearts and how much she means to us, we really didn't want to take any more chances.”</p>
<p>Perez, who reached 1,000th career wins in June at Delaware Park in Wilmington, Del., rode Anna's Bandit to 14 wins, four seconds, and seven thirds, and all but $114,540 of her purse earnings. Other jockeys to ride Anna's Bandit were Eric Camacho and Katie Davis in 2016 and 2017 and Gerald Almodovar in the May 29, 2020 Original Gold at Charles Town in Charles Town, W.Va., her last win.</p>
<p>“She deserves it,” Perez said of retirement. “She doesn't owe anything to anybody. She did her job and she made us proud. She's safe and where she belongs. I'm happy for her.”</p>
<p>In 2019, Anna's Bandit won nine of 11 starts and more than $400,000 in purses, tying for the most wins of any horse in North America. Her career stakes wins included the 2018 and 2019 Conniver, 2019 Maryland Million Distaff and 2019 Politely at Laurel Park in Laurel, Md., and 2019 Timonium Distaff.</p>
<p>In West Virginia, where she was bred, Anna's Bandit won the Down Town Allen and Sadie Hawkins in 2018; Original Gold, Sadie Hawkins, and West Virgina Cavada Breeders' Classic in 2019; and Original Gold in 2020.</p>
<p>Her Maryland Million win came just a week after Anna's Bandit won the Cavada, a feat Gina Robb felt was at the top of a laundry list of accomplishments.</p>
<p>“That one year that when she won all those stakes, it was kind of like a blur,” she said. “After she won the West Virginia-bred race and came back in seven days … I have the goosebumps thinking of it. That had to be the most incredible of all the races.”</p>

<p>Anna's Bandit also placed in 10 other stakes, including a third behind Majestic Reason and Victim of Love in the 2020 Grade 3 <a href="http://claibornefarm.com/stallions/runhappy/" class="blue-link">Runhappy</a> Barbara Fritchie, her lone graded-stakes attempt. Majestic Reason was a three-time stakes winner that was retired following the race, while Victim of Love went on to win back-to-back editions of the Grade 3 Vagrancy in 2020 and 2021 and run third in the 2020 Grade 1 Ballerina.</p>
<p>“She's amazing. She's always going to be one of the best horses I ever rode, or anybody rode,” Perez said. “They don't come around too often. You have to be lucky and be in the right place at the right time. It worked out for me.”</p>
<p>Anna's Bandit's success has been nothing short of remarkable. She showed she was special early on, debuting with a 6 ¾-length maiden special weight triumph May 6, 2016 at Laurel Park in Laurel, Md., and jumping straight into stakes company. She finished third in the Astoria at Belmont Park in Elmont, N.Y., and second in the Debutante at Churchill Downs in Louisville, Ky., the latter in July, before going to the sidelines.</p>
<p>She went 14 ½ months between races, the result of multiple operations to repair leg injuries that went undiagnosed during her formative years.</p>
<p>Anna's Bandit was limited to four starts in 2020, due to both the coronavirus pandemic that paused live racing in Maryland for 2 ½ months from mid-March to late May, and a minor foot issue in late summer that prompted Robb to give her the rest of the year off. She began this year running fifth in the June 13 Shine Again at historic Pimlico Race Course in Baltimore, Md., and second in the July 10 Dashing Beauty at Delaware Park.</p>
<p>Plans call for Anna's Bandit to be bred in 2022, though the details have yet to be worked out.</p>
<p>“We are just trying to get over the fact that she's retired. We do have time to discuss where we're going on February 15th, because we plan on trying to get her in foal early,” Gina Robb said. “We would like to ship her and bring her home and not have her stay anywhere else. I don't know that I'm ready to let her go. I'm just getting her back.</p>
<p>“I think the first year we might keep her local, to a Maryland sire or on the East Coast, somewhere close so we can ship and go and keep her home where I don't have to worry about anything else. I'm very excited to be a part of her broodmare career, and to have her first foal on this farm is going to be one remarkable day.”</p>

										<content:encoded><![CDATA[<p>Two months after costing New York an estimated $4.2 million in lost handle revenue during the first quarter of 2021, a bill to eliminate an antiquated state requirement that same-race mounts of married jockeys be coupled in pari-mutuel wagering has passed both the Assembly and Senate.</p>
<p>The New York Senate unanimously passed Bill No. A7024 June 1 by a 63-0 margin. The Assembly had passed it 147-0 on May 5.</p>
<p>The measure, if signed into law by the governor, would take effect immediately. It now charges racetrack operators with the responsibility for &#8220;adequately&#8221; informing the public about jockey and trainer family relations that could be perceived as conflicts of interest.</p>
<p>The decades-old rule was a focal point of intense scrutiny earlier this year because it affected recently married jockeys Trevor McCarthy and Katie Davis. Together, they had moved their tack from Maryland to New York after being married in December.</p>
<p>But when they began competing in common races at Aqueduct, it triggered the application of little-used state rule 4025.10 (f), which states, &#8220;All horses trained or ridden by a spouse, parent, issue or member of a jockey's household shall be coupled in the betting with any horse ridden by such jockey.&#8221;     That meant on 41 occasions between Jan. 1 and Mar. 21, McCarthy and Davis's mounts in common races at Aqueduct necessitated a 1 and 1A coupling.</p>
<p>Although it's impossible to project the precise amount of handle that evaporates when a track loses a betting interest by forcing two independently owned and trained horses into a single mutuel coupling, a rough estimate of lost betting handle can be derived by multiplying Aqueduct's winter/spring per-entrant rounded handle of $103,000 by 41 to get the $4.2 million estimate.</p>
<p>The rule was widely criticized as being outdated and sexist, and during the first three months of 2021 it caused confusion among bettors, plus reams of bad press for Aqueduct (whose officials stated there was nothing they could do to change the law) and the New York State Gaming Commission (which did not address the controversy during any open, public meetings).</p>
<p>By February, Davis was claiming that Aqueduct racing office workers were pressuring trainers into not naming her on mounts, an allegation that a track spokesperson denied. She switched to accepting mounts in Maryland Apr. 8 while McCarthy continued to ride in New York.</p>
<p>On May 9, Davis announced on Twitter that she and McCarthy are expecting a child and she has not ridden in a race since that date. Shortly thereafter, the couple relocated to California, and McCarthy began riding at Santa Anita as of May 28.</p>
<p>The bill amends the state's racing, pari-mutuel wagering and breeding law by adding a new section that reads:</p>
<p>&#8220;Notwithstanding any law, rule or regulation to the contrary, all horses trained or ridden by a spouse, parent, issue or member of a jockey's household shall not be coupled in the betting with any horse ridden by such jockey. The racetrack operator shall take such actions as are necessary to inform the public adequately with regard to the relationship between any such jockey or trainer.&#8221;</p>
