										<content:encoded><![CDATA[<p>To look at him and to watch him, you would never know that <strong>New Years Eve</strong> (Night Conqueror) is, well, ancient. He's holding his weight and he still manages to run around his paddock when the mood strikes him.</p>
<p>&#8220;He's doing amazingly well,&#8221; said his owner, Julie Izzo. &#8220;But he has slowed down a bit.&#8221;</p>
<p>Of course he has. He's 38.</p>

<p>As New Years Eve crept into his mid-thirties Izzo, who resides in Pennsylvania, began to do some research. Was there an older Thoroughbred out there? She has asked around, checked social media and touched base with <em>Daily Racing Form </em>photographer Barbara Livingston, who has looked high and far for an even older horse. As best as Izzo can tell, the horse she calls Axl (Izzo is a big Guns N' Roses fan) is in fact the oldest former race horse in the U.S.</p>
<p>&#8220;I found some people who claimed they had older horses, but when I asked for their Jockey Club names they disappeared or their horse wasn't a race horse,&#8221; Izzo said. &#8220;Barbara said that this has been a passion of hers for 25 years and she didn't know of an older horse. One lady said her horse was a day older. I asked what was the horse's Jockey Club name because I wanted to see if her horse and mine had ever been to the same tracks. She also disappeared on me.&#8221;</p>
<p>New Years Eve was born on March 17, 1986. His career was about as unexceptionable as it gets. He debuted on June 9, 1989 at the Nebraska racetrack Atokad Park. He ran 18 times, won two races and earned the grand total of $3,140.</p>
<p>None of which mattered to Izzo, who was looking for a pleasure horse and bought the gelding in 1993 when he was seven.</p>
<p>&#8220;He was literally my dream come true,&#8221; Izzo said. &#8220;My mother had a horse when I was born and she put me on a horse before I could walk. All I ever wanted was my own horse. I rode in stables during my childhood and teen years. But I was always riding other people's horses. My dream was to have a big bay Thoroughbred. In my brain, it had to be a big bay Thoroughbred. An ad popped up advertising him for sale and I knew, before I even saw him, that I was buying him. OTTBs (off the track thoroughbreds), they have always been my passion. I just love them. I love the fire. I love the power. I wanted a horse that was going to be fun and exciting and one where I wouldn't know what I was getting into every day. He was always that.&#8221;</p>

<p>Izzo never tried to turn New Years Eve into a show horse. She was happy to just have him around and to be able to ride him whenever she wanted.</p>
<p>&#8220;He's never been in a show,&#8221; she said. &#8220;All I ever wanted was to have a horse where I could just go out and have some fun with them. I have done some trail riding and some light dressage with him. He loves to jump. Two years ago, he took off on a dead run in the pasture and decided to jump all the wild rose bushes. He will take himself jumping. He loves to jump.&#8221;</p>
<p>That Julie Izzo owns what may be the oldest living Thoroughbred in the U.S. probably isn't a coincidence.  She also owned  a Quarter Horse mare who lived to be 40. She believes the key to a horse having a long life is to keep them out of a stall.</p>

<p>&#8220;Since I bought him, he has almost always been pasture boarded,&#8221; she said. &#8220;I do not believe in keeping horses in stalls. I think it is a horrible thing to do to them. He was always pretty much out in the pasture as much as possible.  If you put them in a box and they are standing still trying to eat that means you're affecting their digestive system and you're affecting their respiratory system because they are stuck in a dusty building. It's not good for a horse mentally to be stuck in a box all day.&#8221;</p>
<p>Then there is his diet. Izzo is careful about what she feeds her horses.</p>
<p>&#8220;He went from eating a low protein sweet feed and having free access to hay,&#8221; she said. &#8220;Now, we've converted him over to Sentinel Senior. It's easier for him to digest. Like any horse at his age, he's starting to lose teeth. In fact, we're on the fence about starting to do some major extractions. Up until two or three years ago, he ate dry pellets and had access to all the grass he could eat. Now he gets a mash because his teeth have gotten bad enough where he's not going to be able to keep eating grass. He gets a mash twice a day with alfalfa cubes, Sentinel Senior and a couple of low-carb horse cookies that I throw in there. Plus, we give him a high-quality probiotic.</p>
<p>&#8220;I did a lot of research about their diets and read all the educational materials Cornell put out and have read books by people who know what they are talking about. People ask me all the time, what do you feed him? I tell them the feed is just one part of it. Obviously, genetics play a big factor and so does keeping him out of a stall.&#8221;</p>
<p>The only problem of late has been that Axl is alone after having the Quarter Horse mare as his pasture mate for 28 years.</p>

<p>&#8220;Sometimes I think he is lonely,&#8221; Izzo said.</p>
<p>But he keeps going, year after year. And while it can't last forever, Izzo continues to marvel at how healthy and spry her horse is. He might have a few more years left in him. From a horse who is special in his own unique way, you never know.</p>

										<content:encoded><![CDATA[<p>The Jockey Club's Report of Mares Bred (RMB) statistics reflects that through Oct. 18 of this year, 867 stallions covered 26,597 mares in North America during the breeding season, a decrease from 2022 when 925 stallions covered 27,163 mares, the organization said in a release early Friday.</p>
<p>They estimate an additional 2,500 to 3,500 mares will be reported as bred during the 2023 breeding season.</p>
<p>Kentucky traditionally leads North America in Thoroughbred breeding activity. During 2023, Kentucky's 199 reported stallions covered 16,953 mares, or 63.74% of all of the mares reported bred in North America. The number of mares bred to Kentucky stallions increased 1.58% compared with the 16,689 reported at this time last year.</p>
<p>Of the top 10 states and provinces by number of mares reported bred in 2023, in addition to Kentucky, stallions in New York, Ontario, and West Virginia covered more mares in 2023 than in 2022, as reported at this time last year.</p>

<p>The RMB also shows that there were 14 stallions with a book size of 200 or more that covered a total of 3,213 mares in North America in 2023 as reported through Oct. 18, which is 12.1% of all coverings reported. The 45 stallions with books of 150 or more covered 8,588 mares, which is 32.3% of all mares reported bred.</p>
<p>For comparison, reports submitted by Oct. 10, 2013, show that one stallion covered more than 200 mares in North America, which represented 0.6% of the total for that year. Those reports also show 19 stallions covered 150 or more with a total of 3,205 mares in the 2013 breeding season, which equates to 9.4% of all mares reported bred in 2013 as of Oct. 10.</p>

										<content:encoded><![CDATA[<p>The Jockey Club's Thoroughbred Incentive Program (T.I.P.) named the recipients of its two non-competition awards, which included the Thoroughbred of the Year Award and the T.I.P. Young Rider of the Year Award, the organization said in a release Wednesday.</p>
<p>The Thoroughbred of the Year Award recognizes a Thoroughbred that has excelled in a non-competitive career, such as equine-assisted therapy or police work, and includes a $5,000 grant to the non-profit organization associated with the horse or, if no organization is associated with the horse, to a horse-related charity chosen by The Jockey Club.</p>
<p>The 2023 Thoroughbred of the Year is Kat. Registered with The Jockey Club as Kat's Hope, Kat is a 15-year-old gelding that works as a therapy horse at Special Equestrians Therapeutic Riding Center, a nonprofit that provides a variety of equine-assisted services for individuals with physical, cognitive, behavioral, emotional, or traumatic-stress disabilities.</p>
<p>&#8220;He may have been born into the world of racing, but he was destined to be a therapy horse,&#8221; said Dana Fielding, ESMHL program manager at Special Equestrians Therapeutic Riding Center. &#8220;At Special Equestrians we harness the healing power of horses to transform lives every day, and, having Kat as part of our program, we have witnessed the profound impact he has had on the clients we serve.&#8221;</p>
<p>The young rider award, which recognizes riders 18 or younger (as of Jan. 1, 2023) who own or lease a Thoroughbred for use in 4-H, Pony Club, or other activities, has been awarded to Scarlet Boucher, Eysley Hatfield, Allie Koss, and Anna Szefc.</p>

										<content:encoded><![CDATA[<p>The Breeders' Cup is in the midst of its &#8220;40 Days of Giving&#8221; program that puts key Thoroughbred industry charities in a collective spotlight with a fundraising twist: This year's initiative involves a money-matching effort in which donors selected by each charity will match up to $1,000 raised by the general public on that charity's designated day. On the final day of the drive, the Breeders' Cup itself will match up to $20,000 in donations, with funds raised on that 40th day to be distributed evenly to all participating charities.</p>
<p>&#8220;It's the lead-up to the 40th running of the Breeders' Cup championships. So we're taking 40 days and 11 different charities, and we're trying to raise as much money as possible for all of these charities that are doing incredible work within our industry,&#8221; said Stefanie Palmieri, the vice president of events for Breeders' Cup, Ltd. &#8220;And the idea behind the match is that we can engage the public knowing that if they donate, there's a potential for their donations to be doubled.&#8221;</p>
<p>The charities that will benefit are the California Thoroughbred Horsemen's Foundation, the  Ed Brown Society, the Edwin J. Gregson Foundation, The Foundation for the Horse, the Grayson-Jockey Club Research Foundation, the National Museum of Racing and Hall of Fame, the Permanently Disabled Jockeys Fund (PDJF), the Race Track Chaplaincy of America, The Jockey Club Safety Net Foundation, the Thoroughbred Aftercare Alliance (TAA) in partnership with the California Retirement Management Account, and the Winners Foundation.</p>
<p>&#8220;We started on Sept. 21, and the last day of the match program is Oct. 30,&#8221; Palmieri said. &#8220;But <a href="https://breederscup.com/giving">all of the links to donate</a> will remain open through all of the Nov. 3-4 Breeders' Cup races so we can continue promoting and drive as many donations as possible.</p>
<p>&#8220;So far, we have hit our matches on quite a few of those days. I think people are really interested and engaged with it,&#8221; Palmieri said. &#8220;The program is really designed to support a variety of different causes within the Thoroughbred industry, and we selected the charities to represent a cross-section of focus areas.&#8221;</p>
<p>Two points stood out when TDN spoke with executives of some of the charities that the Breeders' Cup selected to participate. The first is that our sport operates differently than others in that it relies on a multitude of industry-facing organizations to keep the game going on a daily basis. The second is that most of these worthy causes generally have to compete for the same relatively small pool of Thoroughbred-supportive donors.</p>
<p>Yet those who run the charities say they welcome this opportunity to have so many good causes featured together under one fundraising umbrella, because a program like 40 Days of Giving raises not only money, but the profiles of everyone involved.</p>

<p>&#8220;When an organization like the Breeders' Cup says they're going to dedicate weeks of bringing awareness to the charities, we're obviously thrilled,&#8221; said Shannon Kelly, the executive director of The Jockey Club Safety Net Foundation. &#8220;And I always have felt the Breeders' Cup should be the moment we're promoting our industry's charities, because all eyes are on the Breeders' Cup.&#8221;</p>
<p>Since 1985, The Jockey Club Safety Net Foundation has operated as a charitable trust that provides, on a confidential basis, financial relief to needy members of the Thoroughbred industry and their families. Its assistance recipients range from jockeys, trainers, exercise riders, and grooms to office personnel and other employees of tracks, racing organizations, and breeding farms.</p>
<p>&#8220;Obviously, the Breeders' Cup has a huge platform to promote the work of charities,&#8221; Kelly continued. &#8220;They have a lot of eyes and followers. A lot of charities like us in the industry, we have small staffs and we're working quietly as best as we can. So having an arm like the Breeders' Cup's marketing arm push this is fantastic. And I think it's just a nice way to show they're dedicated. It gives us a boost, some traction to what we do.&#8221;</p>
<p>&#8220;The reality is we're all asking the same donors,&#8221; Kelly said. &#8220;We're a small industry. So I think it's good to make it a collective program, and not everyone on their own going after the same donors. I think it makes it a little bit easier from a fundraising perspective.&#8221;</p>
<p>Nancy LaSala has been the PDJF's president since its inception in 2006, and she accepted the dual role of executive director three years later. The PDJF provides financial assistance to some 60 former jockeys who have suffered catastrophic on-track accidents, most of which involve paralysis or traumatic brain injury. She said that although each specific charity focuses on its niche, they all fall into broader categories that she likened to three-legged stool that needs even support to remain standing.</p>
<p>&#8220;We need to care of our human athlete. We need to take care of our equine athlete. And we need to take care of our racing community infrastructure, which is basically the backside. If we could support those three bases, I look at them as the three prominent prongs of horse racing,&#8221; LaSala said.</p>
<p>&#8220;I don't think our donor base resides much outside of racing,&#8221; LaSala said. &#8220;It's nice to be part of a platform that includes so many industry charities. We very seldom get the chance to do that, for the greater benefit of all.&#8221;</p>

<p>Stacie Clark Rogers has been with the Thoroughbred Aftercare Alliance since its inception in 2012, and has been the organization's operations consultant since 2014. The TAA accredits, inspects, and awards grants to more than 80 approved aftercare organizations at around 180 facilities to retrain, retire, and rehome Thoroughbreds using industry-wide funding.</p>
<p>&#8220;As the official aftercare charity of the Breeders' Cup, we're always happy to be included in the event and to have the recognition for all the 80-plus organizations that we have,&#8221; Clark Rogers said. &#8220;It's the one time where we can help them raise some attention for aftercare on the national and international level. It's really inclusive that they've had so many charities be a part of this. It's great to have such a community spirit with the Breeders' Cup.</p>
<p>Palmieri said the Breeders' Cup left it up to each charity to select their own donors who are providing the matching incentives.</p>
<p>&#8220;I like the idea of choosing our match donor because it's helped me identify some people that we wanted to draw attention to,&#8221; Kelly said. &#8220;I went for people who support us throughout the year and are always looking to support more, and I think it gives them some publicity as being actively involved in supporting the industry, not just owning horses or breeding horses or whatever their business is. I think it's good promotion for them, too, to say we have some really good people and groups that want to help.</p>
<p>&#8220;We're a really unique industry, because not a lot of other big sports have in-house charities,&#8221; Kelly said. &#8220;Our charities are there for the future of the sport, to keep it moving. For us, it's personal.&#8221;</p>

										<content:encoded><![CDATA[<p>SARATOGA SPRINGS, N.Y. &#8211; A panel on computer-assisted wagering (CAW) and its pros and cons, and another on trainers' reactions to the new Horseracing Integrity and Safety Authority (HISA) regulations, took center stage at the 2023 Jockey Club Round Table Conference on Matters Pertaining to Racing held in Saratoga Springs, New York on Thursday.</p>
<p>Patrick Cummings, the moderator of the panel on CAWs, is the Executive Director of the Thoroughbred Idea Foundation, a racing-industry think tank. Cummings took the panel through a brief history of parimutuel wagering and the changes the industry has seen before landing at the crux of the subject matter: CAWs.</p>
<p>&#8220;The CAWs are individuals with well-resourced staffs, developing couture models assessing vast amounts of data,&#8221; said Cummings. &#8220;They deploy finely-honed algorithms to efficiently place bets, often at the last possible second, all while receiving significant rebates for their play.&#8221;</p>
<p>The rebates, he said, while sizeable, were only one of the challenges that CAWs present to racing. The other is their ability to bet large amounts of money at the last possible second before the race, which gives them an advantage over regular players.</p>

<p>&#8220;In pari-mutuel wagering, betting late has always been beneficial,&#8221; Cummings said. &#8220;But, when all betting was done on-track, betting late came with the risk you might not get your bet down at all.</p>
<p>&#8220;That's not a concern now, especially for the CAWs, who've been given the ability to place batch bets, dumping vast amounts in the final cycle of betting. The impact of that is witnessed every day, in nearly every race and across almost every pool.&#8221;</p>
<p>That impact, he said, has led us to where we are now: CAWs have grown from 8% of total handle in 2003 to around 33% of handle today. At the same time, when adjusted for inflation, non-CAW wagering is down by nearly two-thirds over the same time period. That's a concern because the money returned to racing in the form of purses is much greater from normal bettors than from those receiving huge rebates. So while handle may be up, &#8220;the greatest source of growth has been a handful of high-frequency bettors,&#8221; who pay less back into the system.</p>
<p>&#8220;How the evolution of CAWs is managed and how we support the existing customers we still have might be key to the future of wagering on racing in today's tech-forward world&#8211;one with unfathomable processing power, machine-learning, AI and more,&#8221; Cummings said.</p>
<p>Cummings led a Q-and-A session with Joe Longo, the General Manager of Content Managing Solutions for NYRA, which owns an ownership stake in the Elite Turf Club, one of the largest computer syndicate operations; and Dr. Marshall Gramm, a horse owner and professor at Rhodes College.</p>
<p>Gramm said he had written models with partners based on statistical probabilities. He started receiving rebates in 2011, and said that doing so not only allowed him to turn a profit, but to increase his handle enormously, from $49,000 in 2010 to $25 million in 2015. He has gone on to be a major racehorse owner, with 116 horses he now owns alone or in partnerships.</p>
<p>Gramm said that some in the industry have come to believe that rebates are all negative, but that his churn had increased exponentially because of it.</p>
<p>Love it or hate it, though, CAWs are here to stay, said Gramm.</p>
<p>&#8220;There's no walking back from it,&#8221; he said. &#8220;The computers aren't going away. You can't step back in time.&#8221;</p>
<p>Neither panelist addressed the issue that Cummings talked about in his introduction and that was covered in Jerry Brown's <em>TDN</em> op/ed, <a href="https://www.thoroughbreddailynews.com/letter-to-the-editor-existential-crisis-no-hyperbole/">Existential Crisis</a>, that because in parimutuel markets, players are playing against one another, regular people are effectively paying more, and leaving the game.</p>
<p>Longo discussed how NYRA has become the only racing organization to ban CAW bettors in the win pool within two minutes to post in order to negate the late odds fluctuations which have become so frustrating to horseplayers. Longo said that while no other organization had followed that lead, he felt that others eventually would.</p>
<h2><strong><em>HISA Panel Discusses Adjustments to New Rules</em></strong></h2>
<p>Trainers Jena Antonucci and Ron Moquett served as panelists, along with Ben Mosier, Executive Director of the Horseracing Integrity and Welfare Unit (HIWU), and HISA's Lisa Lazarus on a Q-and-A panel moderated by Jim Gagliano, the President and COO of The Jockey Club, on how trainers were adjusting to the new HISA regulations.</p>
<p>Gagliano asked the two trainers how their life had changed under HISA.</p>

<p>Antonucci said that she was already running her business along the lines that HISA requires in terms of record-keeping, but acknowledged that that part of the business had been a learning curve for other horsemen. Moquett said that, &#8220;as a Thoroughbred trainer, there's a new set of rules to follow and we're going to adapt to those rules, but primarily, we keep the priority on the horse.&#8221;</p>
<p>Antonucci acknowledged that there were concerns and bumps in the road as the program has gotten underway, but urged people to come forward with those problems so that the solutions could be found. But the benefits, she said, were dramatic.</p>
<p>&#8220;I may be a minority in this thought,&#8221; she said, &#8220;but I find it has been the great equalizer. It isn't a secret that there is availability of different levels of pharmaceuticals on different levels. Really smart chemists, and people looking to gain an edge. So I feel the biggest benefit has been to probably the hardest hit of this industry, which is the middle and the smaller side, where it has allowed a level playing field and where that guy or gal who busts their butt 24/7 can walk into a race and not feel like they're going to watch another horse re-break at the top of the stretch. That their plied trade and their skill set will have an opportunity to shine, where that eight-percent trainer historically, where it looks like I can't train a racehorse? All of a sudden, he's winning more, or she's winning more, and it's not because we've done anything different in our practice. And you know what? What I do, I do darned well, and my horse&#8211;whether it's in the Grade I Belmont Stakes or a $12,500 maiden&#8211;is going to have the chance to march down that stretch and compete eye-to-eye with the horses next to them, and there's not a pharmaceutical in our way.&#8221;</p>
<p>The crowd gave her an ovation after the comment.</p>
<p>&#8220;There are a few parts of it that have been very challenging,&#8221; said Moquett. &#8220;You're dealing with a large group of people who are now just getting introduced to technology. I'm helping people who are sometimes my competitors try to understand and navigate the system.</p>
<p>&#8220;I wear a number of hats,&#8221; he said. &#8220;I train horses. I own horses. I'm a member of the HBPA, and I'm on the HISA Advisory Committee. I'm constantly a sounding board. People come to me and say this is unfair, and I come to [HISA]. It's new. There are going to be problems, and they're going to have to listen to horsemen. It doesn't matter how good [Lisa Lazarus] is at her job, we need the Bill Motts and the Steve Asmussens. My job is to say, `look, I understand what you're trying to do, but we need to do a better job of explaining to people what the differences are between accidental contamination, an overage of an allowed medication and someone trying to gain an edge.' I'm basically representing 4,500 people that have to go through every regulation that HISA believes is okay. So [Lazarus] and I will get together, we'll battle, and we'll come to a solution. I will say we don't always get along that great, but she has been very good about hearing me out.&#8221;</p>
<p>Lisa Lazarus said, &#8220;One of the things we heard a lot was that if the public hears that a trainer has a medication overage, they think that they're a cheater. That they don't understand the difference between true doping substances, and medications that are allowed, but just not on race day. And so, one of the things that the [AMDC] does is distinguish very clearly between allowed substances and banned substances.&#8221; Violations for each were very different, she explained. &#8220;We're there to protect the 99% of trainers who are competing cleanly, so that they get a fair race.&#8221;</p>
<h3><strong><em>Safety, and The Traceability of Thoroughbreds</em></strong></h3>
<p>Tracing what happens to a Thoroughbred when it leaves racing or breeding has long been a problem for the industry, an issue that Kristin Werner, the Senior Counsel for The Jockey Club, addressed in her report on Thoroughbred Safety.</p>
<p>&#8220;I am pleased to announce that the `Transferred as Retired from Racing' process has gone digital,&#8221; said Werner. &#8220;The permanent removal of a horse's eligibility to race is beneficial to the retiring racehorse, but the process requires thoughtfulness and transparency on the part of the seller and buyer to avoid contractual disputes or other disagreements. To that end, the previous process required a notarized signature and hard-copy form to retire a Thoroughbred from racing. With the assistance of digital signature verification, we are now able to confidently collect the required signatures through the Interactive Registration website, which will make the process easier for everyone involved.&#8221;</p>

<p>Werner also reported that the ease of traceability is increasing due to the replacement of hard-copy certificates with digital ones starting with the foal crop of 2018. This, she said, &#8220;will allow The Jockey Club to follow up with the certificate manager to try to trace a Thoroughbred that has exited the racing or breeding population with an unknown outcome. When this system is in place in 2024, an automated prompt will be triggered when a horse has not been reported dead and has no racing activity, no breeding activity, and no Thoroughbred Incentive Program number for a specified time period. The communication will explain why the prompt was triggered and will ask the manager to indicate the horse's current status.&#8221;</p>
<p>For foals born in 2017 and prior that had made a start in the past 10 years, she said, The Jockey Club would be reaching out to the last connections to try to determine their status.</p>
<p>Werner also addressed racing's safety issues.</p>
<p>&#8220;In 2022, data analysis from the 14th year of reporting to the Equine Injury Database (EID) showed a decrease in the rate of fatal injury in 2022 to 1.25 fatalities per 1,000 starts,&#8221; said Werner. &#8220;This is the lowest cumulative fatality rate since the EID was launched in 2009, and is the fourth consecutive year that the rate has decreased. While 99.88% of Thoroughbred races were completed without a fatality last year, clusters like those that occurred in April and May of 2023, unfortunately, cast a shadow over the good news and bring equine fatalities back into the headlines of national media,&#8221; she said, referring to the fatalities during the week leading up to the Kentucky Derby.</p>
<p>Werner said that the advent of the EID had allowed them to identify 35% of the risk factors which put horses at increased risk for breakdown during the running of a race. Those factors include a horse's vet list history, the race distance, and the time a horse has spent with a trainer. Long races, and longer time with a horse's trainer make that horse statistically safer.</p>
<p>The Safety Committee is also calling for the dissemination of information regarding the consistency and maintenance of track surfaces. &#8220;The Thoroughbred Safety Committee today calls for that information to be frequently measured at periodic distances and made available to the public,&#8221; said Werner. &#8220;Working with other key industry stakeholders, especially the Horseracing Integrity and Safety Authority and the Racing Surfaces Testing Laboratory, The Jockey Club recommends exploring the best methods for providing the racing surface data to the horsemen and public, including through an app, website, or other electronic feed. As with all of its recommendations, The Jockey Club will help provide resources to ensure this recommendation is met.&#8221;</p>
<h4><strong><em>Analytics in Sport</em></strong></h4>
<p>Michael Lopez, the Director of Football Data and Analytics for the National Football League, is a Saratoga resident who used to teach at Skidmore College in town, and a long-time horse racing fan. He talked about how the NFL uses data to drive decision-making, and ways in which he felt horse racing could do the same.</p>

<p>And while the sports are completely different, there were several interesting parallels.</p>
<p>Wearable technology has been an interesting new potential safety tool for horses, designed to measure things like their regular stride to detect any changes that might indicate a problem. The NFL is doing the same.</p>
<p>&#8220;Recently,&#8221; said Lopez, &#8220;all NFL players are now wearing RFID chips in their helmets, shoulder pads, and cleats, small enough so that the players don't feel them, but enough so that a signal is emitted each time they step onto the practice or game field. The burden is heavy&#8211;this data is messy and the tracking cumbersome&#8211;but the idea of a cleat specific to a running back on turf, or a helmet specific to a quarterback who likes to scramble&#8211;gives the league plenty to work on. And each practice, each club is required to wear tracking devices that give insight into a player's load, distance traveled, speed, etc., which enables sports scientists to evaluate performance, if players need to tone down, or injury recovery.&#8221;</p>
<p>Moreover, the NFL is timing the replay review process to ensure that a coach's challenge in a more prominent game is treated the same way that it would be in a less-prominent one. After the non-disqualification of Forte (<a href="https://www.hillndalefarms.com/violence" class="horse-link">Violence</a>) in the July 29 GII Jim Dandy S. prompted much discussion over whether a less well-publicized event would have merited a DQ, the topic struck home. &#8220;The horse racing corollary is obvious,&#8221; said Lopez. &#8220;When, why, and how stewards decide for or against a disqualification, because a possible DQ at Del Mar should have the identical decision-making process to one at Saratoga.&#8221;</p>
<h5><strong><em>Engagement With Racing</em></strong></h5>

<p>Lindsay Czarniak was just a baby when her father Chet took the job as the first-ever horse racing reporter for <em>USA Today</em> in 1982. Today, she is a sports broadcaster who anchored SportsCenter for six years and who works as a Fox Sports sideline reporter. She is a studio host for NBC's summer and winter Olympics. She is also an influencer with America's Best Racing and a West Point Thoroughbreds partner who was one of the co-owners of Jace's Road (<a href="https://lanesend.com/qualityroad" class="horse-link">Quality Road</a>) in this year's Kentucky Derby. &#8220;My goal was to give folks that pay attention to my content the VIP access,&#8221; said Czarniak. &#8220;I had so many people pulling for Jace's Road because they knew we were in the big race.&#8221;</p>
<p>Her advice for racing? Lean into storytelling and access; just because it feels normal to people within the industry doesn't mean that it is to fans. &#8220;There is a family aspect, a necessary aspect, a high-stakes aspect to this sport that your average sports fan would consume.&#8221;</p>
<p>She also advised racing to place itself where young people consume content, i.e., streaming platforms, digital and social media, etc., and to communicate the safety steps that have been taken.</p>
<h6><strong><em>Racing and Data</em></strong></h6>
<p>Kyle McDoniel was named the President and COO of Equibase on June 1, 2023, and comes from a sports and data background, having most recently served as vice president of U.S. Strategic Partnerships for SportRadar, a sports technology company.</p>
<p>McDoniel talked about the challenges inherent in GPS tracking of horse racing, and said that Equibase is now producing tracking at 28 tracks across the U.S. and Canada, representing over 75% of North American handle. In addition, he said the company was continuing to invest in graphical representations of past performances, including those that illustrate stride frequency and length averages, among other things.</p>

<p>In his closing remarks, Jockey Club Chairman Stuart Janney said that the advent of HISA had done a lot to secure racing's future.</p>
<p>&#8220;Four years ago, at this program, a great Australian breeder-owner, John Messara, speaking about the proposed federal legislation, said, `You've got everything to unleash your monster of economic rewards if you were to join the rest of the world in this harmonization in terms of the drug rules.' John was right and we are here today and it's now time to capture that future.&#8221;</p>
<p>To do so, said Janney, &#8220;I have two suggestions. First, we have to embrace the international aspect of the sport. Racing is global and thankfully, in many parts of the world, the sport is thriving.&#8221;</p>
<p>His second suggestion, he said, involved marketing. &#8220;We need to get past the concerns that we are constantly in turmoil, rocking from one crisis to the next. Another Round Table speaker from the past, David Fuscus, [who] discussed crisis management, said, `If we come together as an industry, negative perception can be turned. There is hope we can come through these dark days, but to do so, the public needs to understand what we're doing and believe we are on a path to success.'&#8221;</p>

<p>&#8220;We're delighted to honor John, not only for the accomplishments of his Harris Farms Horse Division, one of the country's leading racing stables and utmost influential owner/breeder operations, for which he has been inducted into the California Racing Hall of Fame,&#8221; says Jenine Sahadi, Foundation President. &#8220;We also acknowledge him for his many years of distinguished service to this industry as a California Horse Racing Board commissioner, board member of the Breeders' Cup, Jockey Club, and the California Thoroughbred Breeders Association.&#8221;</p>

										<content:encoded><![CDATA[<p>A <a href="https://www.thoroughbreddailynews.com/wp-content/uploads/2023/07/GGF-Berkeley-City-Council.pdf">proposed Berkeley City Council ordinance</a> has been introduced that, if passed into law, would put Golden Gate Fields' future in serious jeopardy.</p>
<p>The proposed ordinance makes it illegal to keep a horse stabled for more than 10 hours a day and requires that every horse has access to a minimum of one-half acre pasture turnout.</p>
<p>While reaffirming state and federal laws surrounding animal abuse and cruelty, the proposed ordinance also makes it a crime to conduct training and racing under a &#8220;reasonable expectation&#8221; that it could substantially injure or harm the animal.</p>
<p>&#8220;Such reasonable belief would be based upon substantial evidence, which may include, without limitation, the animal's physical condition, indicia of pain or suffering, musculoskeletal limitations, age or other relevant factors,&#8221; the ordinance states.</p>
<p>&#8220;Obviously we're concerned,&#8221; said Craig Fravel, chief executive officer at 1/ST Racing and Gaming, a company under The Stronach Group (TSG) umbrella, which owns Golden Gate Fields.</p>
<p>Fravel said that he was alerted to the ordinance on Friday. As such, TSG has not yet had a chance to conduct a legal analysis of the ordinance, or to plot a clear response, he said.</p>
<p>&#8220;I'm not going to over-react at this point, and just try to be constructive in our approach,&#8221; said Fravel. &#8220;There will be some time to engage and I think educate people on our safety record and our protocols and efforts that we go through.&#8221;</p>
<p>The proposed ordinance, introduced by Berkeley City councilmember Kate Harrison, has been referred to the Council Health and Life Enrichment Committee for hearings. The ordinance would need a recommendation from the committee before being taken up by the Berkeley City Council.</p>
<p>Harrison declined an interview, saying that she was on vacation. Harrison added, however, that she would discuss the proposed ordinance when committee discussions begin.</p>
<p>The nine-page proposed ordinance is specifically focused on horseracing and excludes other facilities within city limits where animals are housed, including animal rescue and adoption agencies.</p>
<p>It makes, however, several glaring misrepresentations and distortions of the Thoroughbred racing industry. This includes an erroneous suggestion that Thoroughbred racehorses, on average, live to only three to five years of age.</p>
<p>&#8220;Many fatalities in horseracing are euthanizations after horses suffer catastrophic injuries, cutting their lives unnaturally short,&#8221; the ordinance states. &#8220;When CBS Bay Area reported on the most recent horse death at GGF in May of this year it cited the fact that 'live into their 30s, but the average age of is [only] three to five years old.'&#8221;</p>
<p>The ordinance also states that &#8220;horse deaths continue to rise at the horse racing tracks within City limits.&#8221;</p>
<p>According to the Jockey Club <a href="https://jockeyclub.com/default.asp?section=Advocacy&amp;area=10">Equine Injury Database</a>, race-day equine fatalities are declining nationwide. Last year saw the lowest statistical equine fatality rate since 2009, when record keeping began&#8211;1.29 fatalities per 1000 starts.</p>
<p>When it comes to <a href="https://jockeyclub.com/pdfs/eid/GoldenGate.pdf">Golden Gate Fields</a>, the track's equine fatality rate has been consistently below the national average since 2017. Last year, the rate was 0.56 fatalities per 1000 starts&#8211;a number less than half the national average.</p>
<p>&#8220;I'd like to push back pretty solidly against some of the suppositions,&#8221; said Scott Chaney, executive director of the California Horse Racing Board (CHRB), who added that the CHRB is &#8220;aware and certainly concerned&#8221; about the ordinance.</p>

<p>&#8220;Fatalities are not on the rise at Golden Gate Fields. The opposite is true,&#8221; said Chaney. &#8220;And while it is true that racehorses generally race from three to five, that is not their average life expectancy.&#8221;</p>
<p>The ordinance argues that the City of Berkeley, a charter city, has the legal authority to &#8220;establish regulations&#8221; and the jurisdiction to &#8220;protect and promote the public health, safety and welfare by establishing safeguards for animals&#8221; as long as those regulations don't conflict with state and federal law.</p>
<p>&#8220;It is in the public interest to adopt an ordinance prohibiting inhumane or abusive treatment of animals held, owned, used, exhibited or otherwise kept for sport, entertainment or profit within the City limits,&#8221; the ordinance states.</p>
<p>Chaney is less sure of the city's ability to establish such a law. &#8220;I believe that there would be some major legal hurdles in attempting to pass such a thing,&#8221; said Chaney.</p>
<p>He added, however, that the CHRB hasn't yet conducted a thorough legal analysis of the proposed ordinance to identify what those legal obstacles might be.</p>
<p>One possible hurdle would presumably concern how Golden Gate Fields straddles two adjacent cities, Berkeley and Albany.</p>
<p>The ordinance outlines a set of tough penalties, beginning with minimum fines of $5,000 per animal, per violation, per day, or imprisonment for periods between 30 days and one year.</p>
<p>In explanation of the proposed requirement to provide racehorses access to open pastures for a good portion of the day, the ordinance argues that how colic, laminitis, and pleuropneumonia are issues worsened by excessive confinement.</p>
<p>&#8220;Confining a 1200-pound animal to a 12&#215;12 stall is akin to confining an elephant to a box car or a killer whale to a swimming pool. Equine veterinarian, Dr. Kraig Kulikowski, compared this to locking a child in a 4&#215;4 closet for 23 hours a day, abuse punishable by law,&#8221; the ordinance states.</p>
<p>In recent years, Golden Gate Fields has found itself the target of animal rights activists.</p>
<p><a href="https://www.thoroughbreddailynews.com/protestors-shut-down-racing-at-golden-gate-">In March of 2021</a>, protestors disrupted racing by running onto the track before lying in a circle with interlocking pipes.</p>
<p>The protestors belonged to animal rights organization, Direct Action Everywhere, which seeks to see <a href="https://www.directactioneverywhere.com/campaigns/shut-down-ggf">Golden Gate Fields shut down</a>.</p>

Some of the questions asked for a year-by-year comparison, while other comments cited statistics that were not correct. Courtesy of The Jockey Club's Equine Injury database, here are the figures of racing fatalities per thousand starters, year by year for the past 14 years. These statistics include fatal injuries of Thoroughbreds that occurred during a race as reported by veterinary officials and includes Thoroughbreds that succumbed to a race-related injury within 72 hours after the race day. <a href="https://jockeyclub.com/pdfs/eid_14_year_tables.pdf">For a link to the complete table, click here</a>.</p>

										<content:encoded><![CDATA[<p>Two pieces of federal legislation to incentivize investments in Thoroughbreds were reintroduced Apr. 27 by United States Reps. Andy Barr and Morgan McGarvey, both of Kentucky.</p>
<p>The Race Horse Cost Recovery Act of 2023 would make the three-year depreciation schedule permanent for racehorses, regardless of their age when put into service. Currently, Congress must reauthorize this provision in the tax law on an annual basis.</p>
<p>The Racehorse Tax Parity Act would reduce the holding period for equine assets to be considered long term capital gains, putting them on a level playing field with other similar assets.</p>
<p>Both bills would require amending the Internal Revenue Service code of 1986.</p>
<p>Barr had introduced similar versions of the Cost Recovery and Tax Parity acts on at least three previous occasions dating to 2015, but no voting action was ever taken.</p>
<p>The full text of the new versions of the bills was not available at deadline for this story.</p>
<p>According to a press release from Barr's office, the bills are endorsed by the National Thoroughbred Racing Association (NTRA), the Kentucky Thoroughbred Association, the Thoroughbred Owners and Breeders Association, Keeneland Association, the American Horse Council, and The Jockey Club.</p>
<p>&#8220;Permanently delivering these tax incentives for owners and breeders will strengthen investment in our signature equine industry,&#8221; said Barr, who serves as co-chair of the Congressional Horse Caucus.</p>
<p>&#8220;This legislation will deliver much-needed tax incentives for owners and breeders, fostering growth and investment in this critical industry and ensuring Kentucky remains the horseracing and breeding capital of the United States,&#8221; said McGarvey.</p>
