“I thought it was a bad call,” said Bailey. “I thought he was the best horse in the race, but I thought he should have come down. The rules of racing state that even if you are not clear of somebody and you change paths and you interfere with their progress, which you clearly did, then you should be disqualified. I mean, if you look at the chart, even the chart says he forced his way out. I'm paraphrasing here, `repeatedly bumping with the outside horse.' And then he came back in and it was negligent. So, yeah, I thought he should have come down.”

Bailey said that the danger went beyond this one race. “Look, you want a safer product out on the track as you can possibly get for both horse and rider. And I'll tell you from experience, I went through it myself. I won't name the riders, but there were two or three in New York that the stewards let get carried away and go over the line repeatedly, and then the line gets farther and farther away and it gets more severe. And what happens is the riders take it into their own hands. If the stewards are not policing the riders and enforcing the rules, then the riders are left to police themselves. And that is not a good situation.”

Bailey also relived his exploits on Cigar, his Derby wins on Sea Hero and Grindstone, and told tales about his days in the jocks' room.

Okay, so there are going to be plenty of eyeballs rolled now that three of Bob Baffert's four Derby migrants are joining a former assistant, on the same circuit, with a total of 38 starters to his name this year—especially as it was the handling of another Baffert medication violation that reportedly caused the scuffle between this same gentleman and a fellow trainer at Clocker's Corner one morning last April. (Both were fined $500.)

The wiseguys will doubtless be finding a mischievous prompt in the name of one of these horses, Doppelganger (Into Mischief). But let's remember that Tim Yakteen learned the ropes not from one Hall of Famer, but two; and that the racing gods owe him, big time, after the harrowing loss of his breakout horse, Points Offthebench (Benchmark), in his final work before the Breeders' Cup. What might have been can be judged from that horse's posthumous Eclipse Award, while Yakteen has more recently reiterated what he can do, from modest resources, with Cal-bred Horse of the Year Mucho Unusual (Mucho Macho Man).

The horsemanship of Rodolphe Brisset, meanwhile, has already made a significant contribution to Baffert's Classic resumé, in laying the foundations for the Triple Crown campaign of Justify (Scat Daddy).

So while these four horses are hardly following Life Is Good (Into Mischief) to a big rival on the East Coast, we should respect whatever combination of principle and pragmatism has governed their departure from Baffert's barn. You (and he) can argue about the level of his culpability, in piling so many storm clouds over his community, but Baffert deserves its gratitude in at least stating that his own interests—even where coinciding with precepts as critical to the functioning of our society as fairness in the workplace and the courtroom—are transcended by those of the sport, his investors and their horses.

In claiming personal credit as the impetus for their transfer, then, Baffert definitely gets some here. After all, we've repeatedly urged that the real test of decency in this situation was faced by Baffert himself—and not the friends and patrons who found their good fortune, in having a Derby horse, haplessly turned into some kind of public examination of character or fidelity. All parties had to remember that these horses are only passing through their stewardship, and that many, many others have had a stake in breeding and raising them.

To that extent, in fact, one hopes that the grooms who have been tending these horses have been given the opportunity of sharing their loan to other trainers. But it's edifying, regardless, that their boss and his patrons have in effect acknowledged that the Derby is bigger even than Bob Baffert; and not persevered in a stance that implied things to be the other way round.

First and foremost, no doubt, that represents sound business. Certainly it feels way too much to hope that a similar breadth of perspective might now also prompt Baffert just to accept that it would be far better for everybody—perhaps even for his own sanity—to call off his lawyers, without having to cede an inch in terms of his grievances; to take his sanctions on the chin; and to reset.
As it is, he has already lost the services (and permanently, one imagines) of the G1 Dubai World Cup favorite; and must instead rely on a less theatrical but splendidly stubborn animal to draw the sting of Life Is Good.

Country Grammer (Tonalist) will be carrying the same silks as poor Medina Spirit (Protonico), who has posthumous representation in this field through two of his principal crop antagonists. For if it's the “Black Gold” beneath the surface that has effectively summoned Hot Rod Charlie (Oxbow) and Midnight Bourbon (Tiznow) to the desert, then you might say they are on pretty familiar ground. True, in helping to make the GII Louisiana Derby the strongest trial last year, they left undisturbed the status of the champion bearing that name, whose remains are interred in the Fair Grounds infield, as one of only two horses to win both that race and the Run for the Roses. Because Mandaloun (Into Mischief) gave no indication, that day at least, that he would be the one to benefit when Medina Spirit was effaced from the record.

The picturesque tale of Black Gold, named for the discovery of oil in Oklahoma, is much cherished among those who took local pride in the revival last year of the New Orleans road to Churchill. How poignant, then, is the loss this very week of the only other horse to do the double, Grindstone (Unbridled), just days after acceding (from Go For Gin) as the oldest living Derby winner.
That distinction has now passed to the 28-year-old Silver Charm (Silver Buck), as it happens in the same week that he was joined at Old Friends by his old rival Swain (Nashwan). Those two sure have a few memories to mull over together, notably the gray's photo-finish success in the 1998 Dubai World Cup.

In carving his name below that of Grindstone in the Derby roll of honor, Silver Charm represented something of a baton switch between Wayne Lukas and Baffert, albeit the senior of the two came back a couple of years later with his fourth winner in Charismatic (Summer Squall)—and could yet redeem this whole mess if Secret Oath (Arrogate) can become his fifth.

Incidentally, both Charismatic and Grindstone were out of mares by Drone, who as a son of Secretariat's sibling Sir Gaylord, duly magnified the Somethingroyal distaff brand. Somethingroyal's replication (twice) in the famous family of Summer Squall made Charismatic's failure at stud a dismal disappointment, though he was typical of the old-school priorities driving the Japanese investment that has ultimately produced 22 starters on the World Cup card.

There are never any guarantees with these animals, as we know. Black Gold's one and only foal was killed by lightning. On the other hand, the Derby trail is this spring celebrating the dynasty founded by Storm Cat, himself of course out of a Secretariat mare, through one of the final foals of Giant's Causeway and at least a couple of colts by Not This Time, including Louisiana Derby favorite Epicenter.

One of my more wearily familiar complaints is that the starting points system has stripped the sprint speed out of the first Saturday in May, and Epicenter certainly looks eligible to emulate Medina Spirit and several others to have lately controlled, pretty much at their leisure, what was previously just about the most extreme test of all for a maturing Thoroughbred. As we've discussed before, Epicenter has some copper-bottomed European stayers seeding his bottom line and somebody, somehow, is going to have to press him hard and long if he is to be softened up sufficiently for Call Me Midnight (Midnight Lute) to pounce late again.

Funnily enough, Call Me Midnight himself represents a very similar blend of American dirt speed and European grass stamina, his third dam Slightly Dangerous having produced an Epsom Derby winner among several other Classic protagonists. Someday, perhaps, people will notice how often this kind of formula, once standard but now sadly neglected, still pays off when given a chance.
In the meantime let's hope that the Louisiana Derby, in tribute to the passing of Grindstone, consolidates a revival also underlined by the return to the card, in an excellent race for the GII New Orleans Classic, of last year's fourth Proxy (Tapit).

Proxy! Now there's a word that nobody should be misusing over the coming weeks, as the Baffert exiles make a belated bid to get on the Derby trail. Why shouldn't Baffert and his supporters give an opportunity to people who are on his side, people he respects and wants to do well? It will be much easier to root for these horses, this way; and they know they will never win the cynics round anyway.

If not everybody is going to love the solution, that's tough. At least the Baffert team has resolved the impasse and, if only in one regard, finally started to move things on a little. And that deserves reciprocation. So let's give Yakteen and Brisset due respect. And—quaint, crazy notion—let's restore our attention, and that of the fans, from the flaws inevitable with any and all human judgement, our own included, and back onto these beautiful horses.

“RIP Champ,” Oakhurst Equine posted on its Facebook page. “Thank you for providing us with the thrill of a lifetime. You changed our lives when you joined us and will always be missed.”

Grindstone was the oldest living Kentucky Derby winner, a status he enjoyed for just a few days. At age 31, 1994 Kentucky Derby winner Go for Gin died Mar. 8. Silver Charm, the 1997 Derby winner, now holds that distinction. He resides at Old Friends Equine in Georgetown, Ky.

A son of Unbridled who was trained by Wayne Lukas and owned by William T. Young, Grindstone raced just twice as a 2-year-old, winning a June 1, 1995 maiden at Belmont by five lengths. After finishing second in his 3-year-old debut in an allowance race at Santa Anita, he won the GIII Louisiana Derby and then finished second in the GII Arkansas Derby.

Sent off at 5-1 in the Kentucky Derby and ridden by Jerry Bailey, he closed relentlessly in the stretch to nip Cavonnier by a nose at the wire. The photo was so close that Lukas wasn't sure that he had won the race.

“When we hit the wire we erupted,” Lukas said. “Then it hit me right between the eyes–hell, maybe we didn't win it.”

A chip was found in Grindstone's knee after the race and he never ran again. He became the first Derby winner since Bubbling Over in 1926 to be retired after winning the Derby.

“The chip was described to me as being half as big as the end of your little finger,” Young said. “The injury isn't life-threatening, but if he wasn't going to come back to his present form, I didn't want to take the chance of racing him anymore. I said that after we lost Grand Canyon that I wouldn't go through that again.”

Grindstone began his stud career at Young's Overbrook Farm in Kentucky. His most notable offspring was Birdstone, the winner of the 2003 GI Champagne S, the 2004 GI Belmont S. and the 2004 GI Travers S. He also produced Ekolu Place, who made $1,326,760 racing in Japan.

But Grindstone was not particularly successful at stud. When Young died his heirs closed the farm and dispersed the stallions. Not exactly in high demand, Grindstone was acquired by Jack Root, who owns Oakhurst Thoroughbreds, and sent to Oregon. His initial stud fee there was $2,500 and he became the first Derby winner to stand in the Pacific Northwest.

“To have Grindstone, a Kentucky Derby winner, is a dream come true,” Root said in 2014. “I just never thought it would happen to me. It's a thrill of a lifetime.”

The move to Oregon gave him a new lease on life and he was among the top three leading stallions in that state every year from 2009 through 2020.

Grindstone, pensioned since 2019, turns 29 in late January and Giacomo will be 20 in February.

“We are very, very fortunate and blessed to have two unique and special horses,” said Ben Root, operations manager for the facility founded in 1996 by his parents Dr. Jack and Margaret (“Cookie”) Root. “These stallions give us an opportunity to be ambassadors for Thoroughbred racing. We get calls a few times a month from people wanting to see them and we welcome them.”

The Derby stars have totally different personalities.

“Grindstone still thinks he is king of the world,” Root said. “He screams and yells and bangs on his stall door when a horse walks by. He loves attention. When he is led in or out of the barn, he announces his presence to the other stallions. He knows he's special, he knows he's cool.

“Giacomo is as tame and sweet as you could ever imagine. He might nip a little bit but you can get right up to him and even hold him to get a picture taken. We even have had older school children do that. Especially for non-horse people, Giacomo is an angel.”

Both have their quirks. Grindstone inexplicably removes his halter from his head almost daily. In perhaps a subtle show of dominance, Giacomo backs away if his halter is touched but willingly stands still for treats, pettings and photos. When turned loose in his paddock each morning, the son of Holy Bull performs his self-taught routine that includes pirouettes, bucks, rears and a few laps at a gallop.

Prior to pandemic restrictions, Oakhurst hosted Kentucky Derby parties for several hundred friends, family and clients and a “Breakfast with the Stallions” event where Giacomo was in a nearby pen so guests could get up close and personal.

The occasional admirers who visit the stallions include owners of their offspring for racing and non-racing activities.

“They just want to see the dad,” Root said.

Track announcer and publicist Jason Beem, a longtime friend of the Root family, has made frequent stops to mingle with Giacomo. Another notable devotee is a man who came during his layover at the Portland International Airport.

From Bluegrass to Pacific Northwest

Grindstone and Giacomo launched their breeding careers in the heart of Kentucky's famed Bluegrass region prior to landing in their forever home. Grindstone, by Unbridled, was at owner-breeder W. T. Young's Overbrook Farm before being purchased by the Roots in 2009. Giacomo campaigned for breeders Jerry and Ann Moss until Frank Stronach became a partner for his four-year-old season. He initially was on the stallion roster at Stronach's Adena Springs before hopscotching to other states.

Grindstone was leased to Oakhurst when the Stronach conglomerate operated the now shuttered Portland Meadows with the goal of infusing enthusiasm into the area's small Thoroughbred market.

Giacomo eventually was sold to the Roots with the understanding he would remain under their care regardless of his results as a stallion.

Both have had a measure of success as sires to augment their celebrity status. A current headliner is Milords Oathkeeper, a Root family-bred son of Giacomo and the Grindstone mare Milady Rocks. The gelding brought honor to his connections in winning the Josephine County Juvenile Stakes at Grants Pass Downs in November. With two wins in five starts, he has earned a meager $14,831, but the figure is irrelevant to the family. The Root clan has long participated with more profitable racers in Washington, California, and Arizona, but Milords Oathkeeper has an intangible value. Ben Root summarizes the significance of the victory in three words.

“Oregon is home,” he said.

To punctuate the point, Root said they have declined attractive purchase offers in favor of racing him as a three-year-old in 2022.

“The emotional attachment kind of throws financial reality out the window,” Root said. “My father walks by his horses every day and says 'look what we have here.' We treat them like kings. They have beautiful stallion halters with brass name plates. Their paddock fences are black because my father designed the farm to look like Kentucky. We never take any of this for granted.”

It wasn't just the Kentucky Derby, Preakness and Belmont Stakes that were run Lasix-free. Official qualifying points races for the Derby also were run with a Lasix ban (or, in some cases, if owners and trainers chose to have the diuretic given to their horses, those horses would not qualify for points).

Grindstone was the last horse to win the Kentucky Derby without being administered Lasix four hours prior to the race. That was in 1996, when five of the 19 Derby starters raced Lasix-free. Since then, an increasing number of Derbies has been run with 100% of the starters competing on Lasix, the only recent exceptions being foreign-based runners.

The move toward Lasix-free racing of 2-year-olds in 2020 and stakes races in 2021 came about two years ago when a coalition of racetracks and industry organizations issued a statement saying they were committed to more closely aligning U.S. medication policies with international standards.  Lasix is not permitted on race day in Europe, Asia, or Australia/New Zealand and is being phased out in some Latin American countries.

There was opposition to the change, led by the Kentucky Horsemen's Benevolent and Protective Association, which sued the Kentucky Horse Racing Commission, Churchill Downs and Keeneland. The horsemen's organization claimed its members would suffer “irreparable injury” if their horses were required to race without Lasix. A judge ruled against the HBPA.

Horses will experience exercise-induced pulmonary hemorrhage, whether they are treated on race-day with Lasix or not. A scientific study from South Africa published in 2009 showed that race-day administration of the drug reduced the incidence and severity of EIPH. But 57% of the horses in that study still experienced EIPH after being treated with Lasix (compared to 79% given a saline solution as a placebo).

There were warnings from some Lasix advocates that it would be inhumane to not treat a horse with the drug, that we would start seeing more horses bleeding from the nose when they come back to be unsaddled after a race.

For the most part, the protests against the change have been much ado about nothing. Horses have bled, just as before, the majority of incidents detected through a post-race endoscopic examination. Visible bleeding from the nose has not occurred with the frequency many predicted would happen. Trainers have adjusted and racing goes on. Some have said their horses bounce back more quickly after a race without Lasix because they haven't sustained the loss of fluids that result from administration of the diuretic.

This isn't a game changer. Prohibiting Lasix will not get rid of horse racing's drug problems. But it's a step in the right direction and a further sign that the liberal medication policies of the past involving anti-inflammatories, anabolic steroids, bronchodilators and other so-called therapeutic drugs were misguided and a disservice to the sport.

That's my view from the eighth pole.

History has proven this to be easier said than done, but a young sire that manages to achieve the feat is more often than not set up for a long, bountiful stud career.

This year's Triple Crown series saw Constitution become the 10th horse to sire a North American classic winner in his first crop since 1995, when Tiz the Law won the Belmont Stakes in June. In October, Daredevil became the 11th stallion to join the club when his daughter Swiss Skydiver shocked the Preakness Stakes.

It was the first time two first-crop sires were represented by classic winners since 2017, when Always Dreaming won the Kentucky Derby for Bodemeister and Cloud Computing upset the Preakness Stakes for Maclean's Music.

Of course, there are no sure-fire indicators of future success or failure in a young stallion. There are plenty of examples of one-hit wonders whose Triple Crown race winner was their only upper-crust runner of note. Some of them just have their time in the sun earlier than others.

The market has proven, though, that a stallion that hits early will get more chances to succeed, and many of the 11 horses in the “First-Crop Club” took advantage of that trend and continued to do well.

The debate over the club member with the most successful stud career depends on the metric one wants to use.

For those counting by earnings, the winner is Street Cry, who saw champion Street Sense take the 2007 Derby. Street Cry currently sits with progeny earnings in excess of $170 million.

The late resident of Darley's Jonabell Farm became an international star at stud, siring arguably the best fillies of this century on both sides of the world: Hall of Famer Zenyatta in the Northern Hemisphere, and Australian superstar Winx in the Southern Hemisphere. He's also responsible for another top filly, Australian-born Oh Susanna, who was named South Africa's Horse of Year in 2018.

Street Cry's four progeny Breeders' Cup victories tied him with fellow Darley stallion Medaglia d'Oro for the most among the club members.

Medaglia d'Oro can also stake a claim for producing the top Northern Hemisphere filly of the century, in Rachel Alexandra, who won the 2009 Preakness as part of her sire's first crop.

Like Street Cry, Medaglia d'Oro has fashioned himself into an international sire, capable of getting a winner over any ground put before his foals. His runners have made 34 starts in Breeders' Cup races, giving him the most in the club, and his 78 graded or group stakes winners is highly likely to pass leader Street Cry's 82 before long.

Currently one of North America's most reliable high-level commercial sires, Medaglia d'Oro is also responsible for two-time champion Songbird, Canadian Horse of the Year Wonder Gadot, and Breeders' Cup winners Talismanic, Bar of Gold, and New Money Honey.

Looking at the overall body of work, Unbridled has a case for being named the most successful member of the club, as well. He became the first member of the club to post a first- crop classic winner after 1995, when Grindstone won the 1996 Derby.

Since then, Unbridled rests as the club's leader by Eclipse Award winners (four) and classic winners (three) and co-leader by classic starters. This made all the more impressive considering he did it with just 10 crops – less than five of his contemporaries.

In the years that followed Grindstone's Derby victory, Unbridled added 2000 Preakness winner Red Bullet and 2003 Belmont winner Empire Maker. He had a pair of champion 3-year-old fillies in Banshee Breeze and Smuggler, and a pair of 2-year-old Breeders' Cup winners who won their respective Eclipse Award categories in Half- bridled and Anees.

Of course, any conversation about the impact of Unbridled on the racetrack and beyond can't take place without Breeders' Cup Juvenile winner and leading sire Unbridled's Song, as well.

Unbridled is one of three sires in the club to have another classic winner after their initial success. Maria's Mon punched his ticket when Monarchos won the 2001 Derby, then Super Saver won the same race nine years later.

Distorted Humor saw Funny Cide claim the Derby and Preakness in 2003, making him the only first-crop sire since 1995 to take two legs of the Triple Crown with the same runner. In 2010, Drosselmeyer scored the upset in the Belmont Stakes to give him another classic triumph. A year later, Drosselmeyer shocked the world once again winning the Breeders' Cup Classic.

Distorted Humor is the most experienced member of the club, with 19 crops of racing age through 2020, and more to come. The WinStar Farm resident's 167 stakes winners is the most of the horses in this group, and his 30 Breeders' Cup starts is second. He is also tied for the club's most classic starters, with nine.

Birdstone's admission into the club was unique, being the only sire in the group to punch his ticket with two different classic winners. In 2009, Mine That Bird skimmed the rail to upset the Kentucky Derby, then Summer Bird won the Belmont Stakes en route to securing that year's champion 3-year-old male honors.

Getting two classic winners and a champion out of a first crop seems like it ought to project to a massive stallion career, but Birdstone was never quite able to follow up on that early momentum. Noble Bird became a Grade 1 winner for his sire, and Swipe finished second in the 2015 Breeders' Cup Juvenile by just half a length, but Birdstone never had another classic starter after his first crop. Though he had a stud career that many stallions could only strive to attain, it lagged behind his breed-shaping contemporaries who entered the club around the same time.

After Birdstone and Medaglia d'Oro punched their tickets into the club, there was a seven-year gap before another stallion joined them, but that newcomer proved to be worth the wait.

With just six crops of racing age, Ashford Stud's Uncle Mo is on pace to compete for the mantle as the club's most successful member. After his first crop of juveniles set the earnings record for a freshman sire, led by champion 2-year-old male and Breeders' Cup Juvenile winner Nyquist, the same horse won the 2016 Derby.

Uncle Mo is already tied for the group's most classic starters, with nine, including three in his first Derby. His 69 stakes winners is the fourth-most among his contemporaries, and his 41 graded/group stakes winners is in the top four. With blazing speed, Uncle Mo proved himself as a sire of the highest-quality runners, and his reward was a place in the upper echelon of today's commercial sires.

A year after Uncle Mo punched his ticket, Bodemeister joined the group with Always Dreaming in the Derby, and Maclean's Music earned his place with Cloud Computing in the Preakness.

Despite entering stud as one the more lauded prospects in his class, Bodemeister never caught the same spark after Always Dreaming's high-level run in the spring of 2017. He has no Breeders' Cup starters through his first four crops of racing age. The grandson of Unbridled through sire Empire Maker was sold to stand in Turkey at the end of the 2019 breeding season, which means time is running out for him to sire another significant top-shelf U.S. runner.

Maclean's Music, a resident of Hill 'n' Dale at Xalapa, has high-level results almost in lockstep with Bodemeister, with about half the starters. The son of fellow club member Distorted Humor has been on the upswing heading into this year's Breeders' Cup, with multiple Grade 1 winner Jackie's Warrior pointing toward the Juvenile and Grade 1 winner Complexity contending for the Dirt Mile.

Much like the last two stallions to accomplish the feat in the same year, Constitution and Daredevil are on different trajectories, even though they started in the same place at WinStar Farm.

Constitution, a son of Tapit, appears destined for stardom at stud. In one of the deepest sire classes in recent memory – one including Triple Crown winner American Pharoah – Constitution has stood out as the kind of stallion that will aim to compete for a spot on the top shelf as a sire of runners and top-dollar horses. He had several buzzed-about runners on this year's Triple Crown trail, including Grade 3 winner Independence Hall and multiple Grade 1-placed Gouverneur Morris. He's also responsible for a pair of Group 1 winners in Chile.

Like Bodemeister, Daredevil was sent to Turkey after the 2019 breeding season. Because the pipeline of new foals was already at a trickle before he was exported, the son of More Than Ready's mission to carry on the momentum set by Preakness winner Swiss Skydiver and Kentucky Oaks winner Shedaresthedevil will be more of an uphill climb than his contemporary. However, that positive momentum on the racetrack earned Daredevil a ticket back stateside, following the announcement that he'll stand at Lane's End in 2021 as property of the Turkish Jockey Club. The race, it appears, is far from over.
