										<content:encoded><![CDATA[<p>An increase in purses, totaling $500,000, have been approved for the 2024 racing season at Fingers Lakes, according to the Finger Lakes Gaming &amp; Racetrack and the Finger Lakes Horsemen's Benevolent and Protective Association Wednesday. Pending New York State Gaming Commission approval, the 63rd season is slated to kick off Monday, Apr. 29</p>
<p>Beginning with the first condition book, $5,000 claimers that are non-winners of the year or non-winners of four lifetime races will compete for $14,000, a $1,400 or 11% increase over 2023 levels. A total of 127 races took place last year in those conditions. Additionally, maiden $11,000 claimers will now run for $17,000, a $1,000 increase, while $11,000 claimers that are non-winners of the year or non-winners of four races will run for $18,100. Allowance purses will range from $26,000 for non-winners of two to $26,800 for non-winners of four. State-bred allowance races range from $24,500 for the preliminary condition to $26,000 for the third state-bred condition.</p>
<p>Purse levels for the Maiden Special Weight races, contested 88 times in 2023, will remain at $32,100. The lowest purse will be $13,500 for the Maiden $5,000 claimers.</p>
<p>&#8220;We're thrilled to be able to raise purses for our hard working and dedicated horsemen and women,&#8221; said Finger Lakes Racing Secretary Jerry Richards. 'We thank the Finger Lakes HBPA on working with us to make this possible.'</p>

										<content:encoded><![CDATA[<p>New York Thoroughbred Breeders, Inc. (NYTB) named their nominees for the Empire State's divisional champions of 2023, the organization said in a Friday morning release.</p>
<p>A panel of New York turf writers, broadcasters, handicappers, racing analysts and photographers will vote on each division and for the New York-bred Horse of the Year. The winners will be announced at the NYTB Awards Dinner sponsored by the New York Thoroughbred Breeding &amp; Development Fund on Monday, May 13 from 6-9 p.m. ET. at Sacred Saratoga on the property of GMP Farm in Schuylerville. Former jockey and NYRA TV personality Richard Migliore will again serve as host.</p>
<p>&#8220;Our organization is excited to celebrate this year's nominees. All are deserving and represent the best in New York breeding and racing. This year's awards will be a special night at an exciting new location,&#8221; said NYTB President Dr. Scott Ahlschwede, D.V.M.</p>

										<content:encoded><![CDATA[<p>On the surface, the case against trainer Jeffrey Englehart seems pretty cut and dried. He had a horse test positive for Clenbuterol, the bronchodilator that is on the Horseracing Integrity and Welfare Unit's (HIWU) list of banned substances. Trainers found using banned substances can be suspended for up to two years. But Englehart, who races at the NYRA tracks and at Finger Lakes, is adamant that he never gave the drug to the horse in question.</p>
<p>&#8220;We don't use Clenbuterol. Period,&#8221; Englehart said.</p>
<p>So is there more to this story? Dig a little deeper and you might conclude that there is. To Englehart, it's not about the fact that the horse tested positive. He doesn't dispute that finding. But when was the horse given Clenbuterol and by whom? He hopes the answers to those questions will clear his name and lead to HIWU dropping the case against him.</p>
<p>The horse that tested positive for Clenbuterol was an unnamed 2-year-old by Classic Empire out of Fast Heart. Englehart bought the horse on behalf of owner Marcello Rosa for $14,000 at the OBS auction June 15. The horse broke down while training and had to be euthanized at Finger Lakes Nov. 21.</p>
<p>Englehart's problems were just beginning.</p>
<p>HIWU performed a battery of tests on the deceased horse, including blood, urine and hair. The blood and urine tests were negative. According to Rick Arthur, former equine medical director for the California Horse Racing Board, a standard dose of Clenbuterol will typically be detectable in the blood for about three to four days after administration. For urine, the detection window would typically be between 10 to 17 days after administration.</p>
<p>But HIWU also performed a hair test, which revealed the presence of Clenbuterol. Englehart claims that hair tests can show the presence of the substance for up to a year after it was given to a horse. According to Arthur, Clenbuterol can be found in hair samples for at least six months after the drug was administered.</p>

<p>&#8220;We've certainly seen Clenbuterol in hair up to six months,&#8221; said Arthur. &#8220;It could probably stay longer, we just haven't tried to look at it. We did a lot of hair testing for Clenbuterol in Quarter Horses at Los Alamitos. Trainers have contended that horses past six months have tested positive.&#8221;</p>
<p>After learning about how long after administration Clenbuterol can be found in a hair sample, Englehart started to do the math. The horse broke down exactly five months and six days after the purchase at OBS. That means, Englehart contends, that it is entirely possible that someone gave the horse the drug before he purchased it and that he could be suspended for something someone else did.</p>
<p>&#8220;(HIWU) say it's in the horse's system, so you are guilty,&#8221; said Englehart, who is still training while awaiting he results of the split sample test done on the Classic Empire colt. &#8220;It doesn't matter to them that it can stay in the system for up to a year and I only had the horse for less than six months. That's completely unfair. They are trying to upend my life.&#8221;</p>
<p>The unraced colt was sold for $4,000 at the Fasig-Tipton Kentucky October Yearling Sale Oct. 26, 2022. The consignor was Vinery Sales and the purchaser was Juan Centeno. The latter, who sells under the name of All Dreams Equine, turned around and put the horse in OBS June. It was one of five horses who successfully went through the ring, including a horse named <strong>She She's Shadow</strong> (<a href="http://www.buccherostallion.com/" class="horse-link">Bucchero</a>), who was also purchased by Englehart.</p>
<p>When asked if She She's Shadow was tested and what the results were, Alexa Ravit, the director of communications &amp; outreach for HIWU, said in an email response to the <em>TDN</em>: &#8220;HIWU cannot comment on what horses have been sampled or their subsequent test results beyond what is published on our website in accordance with the ADMC Program's public disclosure requirements.&#8221;</p>
<p>Englehart's theory is that Centeno gave the Clenbuterol to the horse in hopes that it would help the colt have a fast pre-sale workout. The horse put in a two-furlong breeze in :22.</p>
<p>&#8220;I don't know the gentleman from All Dreams Equine,&#8221; Englehart said. &#8220;I just know it had to be him because I know it wasn't me.&#8221;</p>
<p>Centeno did not respond to emails, text messages and phone calls from the <em>TDN</em> requesting a comment.</p>
<p>Englehart alleged that Clenbuterol use is &#8220;rampant&#8221; at the 2-year-old sales.</p>
<p>&#8220;This horse was probably training on (Clenbuterol) right up to day he sold,&#8221; Englehart said. &#8220;It's very well known that Clenbuterol use is rampant at sales. Every trainer knows that. I think if they did a hair test on every horse 70 to 80 percent would be positive for Clenbuterol.&#8221;</p>
<p>Under OBS's conditions of sale, no medication may be administered within 24 hours of a horse's under-tack performance. Several specific medications may not be administered on the sales grounds or present in a test sample, including Clenbuterol. OBS tests around 10-15% of the horses who are going to sell, but does not do hair-sample tests, just blood and urine. This colt was not one of those randomly tested in June, the sales company said.</p>

<p>When asked to elaborate on the sales company's rules regarding Clenbuterol, OBS President Tom Ventura said every step possible is taken to make sure that no horse in the sale has been given that particular drug.</p>
<p>&#8220;With our policy for bronchodilators, including Clenbuterol, we were ahead of the racing curve, because the sales companies have the ability within the conditions of sale to put policies in place maybe a little quicker than jumping through the regulatory hoops that are required at the racetracks,&#8221; Ventura said. &#8220;OBS, in October of 2019, prohibited bronchodilators. Period. In any animal at any level, in any type of sale.</p>
<p>&#8220;Since the very beginning of the tests, I think we had two early on who tested positive and didn't go through the ring, so two positives that we have had for Clenbuterol in four years. I know there weren't any in the last year. We test them as they're coming off the racetrack, and then the buyers have the right to test when they sign the sales ticket. We haven't had any returns for Clenbuterol from those tests.&#8221;</p>
<p>In limbo while awaiting the results of the split sample, Englehart has continued his own investigation. He believes the answer to his problems may lie in what is called a segmented drug test, which can provide a time line so far as when a drug was used.</p>
<p>According to the website <a href="http://www.cellmark.co.uk/">cellmark.co.uk</a>, by segmenting head hair samples into monthly one-centimeter sections, a month-by-month historic profile of drug use can be obtained. That goes for humans and horses.</p>
<p>If the segmented test shows that the Clenbuterol was administered prior to the day when Englehart bought the horse, it would seem to prove his point that someone else must have given the drug to the horse and lead, he believes, to him being exonerated.</p>
<p>Englehart has sent a hair sample off to the lab at Texas A&amp;M and asked it to do a segmented test.</p>
<p>&#8220;I'm just hoping they look at the science and I don't have to do the suspension,&#8221; he said.</p>
<p>The problem is that he doesn't know if HIWU will also do a segmented test. Will they? Have they? HIWU won't say.</p>
<p>&#8220;HIWU cannot publicly comment on the specific facts of pending cases, including whether segmented analysis was conducted on samples taken from specific horses,&#8221; Ravit said in another email.</p>

<p>That's not reassuring to Englehart, who points out that the problem extends beyond sales. Horses often change hands, whether being bought at auction, being claimed or being privately purchased, and if they test positive for Clenbuterol through hair tests it would be unfair to automatically penalize the person who had the horse at the time it tested positive.</p>
<p>&#8220;The average horseman who bought a horse or has a horse in their possession for only a short period of time, they can't be dropping the hammer on them when something can still show up in these tests after a year,&#8221; Englehart said. &#8220;You have to know when the horse was given the Clenbuterol.&#8221;</p>
<p>We posed this question to HIWU: &#8220;Could a horse be given Clenbuterol by someone prior to being transferred to a new trainer and test positive? That would mean the current trainer would be getting penalized for something someone else did. Is this a plausible scenario?&#8221;</p>
<p>Ravit's response did not answer that question.</p>
<p>&#8220;HIWU cannot comment on the specific questions regarding Englehart's pending case, including the samples collected and type of testing conducted on Fast Heart 2021, the expected timeline to receive the B Sample results, and the plausibility of his defense,&#8221; she wrote. &#8220;Additionally, HIWU cannot speculate on the adjudication of the hypothetical case you described, for the outcome would depend on the specific facts of the case.&#8221;</p>
<p>Englehart is worried that he is running short on time. Once the results of split sample are in and as long as it also shows the presence of Clenbuterol, he will be facing what could be an immediate suspension that can last as long as two years.</p>
<p>&#8220;I'm just hoping that the tests comes back and vindicates me,&#8221; he said. &#8220;I will fight this as hard as you can and take this as far as necessary. I'm ready to take it to the courts. Meanwhile, this has been a nightmare for me.&#8221;</p>

										<content:encoded><![CDATA[<p>Outlandishly high amounts of money that were bet into exotic pools at Thoroughbred and Standardbred tracks across the country during a several-hour time window Wednesday might have been the result of a feeding frenzy of opportunistic gamblers trying to take advantage of an alleged &#8220;glitch&#8221; in the FanDuel Racing account wagering system that debited only the base cost of a wager from a customer's account instead of correctly pricing multiple-combination bets at much higher amounts.</p>
<p>Although both FanDuel executives and state regulators were largely mum on the subject of the multi-million-dollar pool spikes as of Thursday afternoon, Ed DeRosa of Horse Racing Nation (HRN) was able to provide insight into the possibility that a profound technological shortcoming might have been the root cause of the massive spike in betting.</p>
<p>DeRosa got the scoop on the potential fraud by publishing screen shots from the account of a now-suspended FanDuel customer who shared betting information from Wednesday under the condition of anonymity.</p>
<p>&#8220;The user was able to wheel the entire field for only the cost of the base wager,&#8221; DeRosa reported in HRN Nov. 16. &#8220;In other words, even though an all-all-all-all dime superfecta in a seven-horse field should cost $84, the bet cost only 10 cents via FanDuel Racing.&#8221;</p>
<p>DeRosa further reported that the alleged glitch was made apparent &#8220;when five super-exotic wagering pools at four different racetracks handled a historic amount of money, but FanDuel Racing account users exploited the situation in other pools and at other tracks as well.&#8221;</p>
<p>Among the Thoroughbred tracks whose pools were inordinately large on Nov. 15 were Churchill Downs, Finger Lakes and Mahoning Valley. The Standardbred tracks Monticello Raceway and The Meadows also reported outsized handles.</p>
<p>Many of the bloated pools were first reported anecdotally on social media by horseplayers on Wednesday afternoon. Although they could only guess as to the possible causes, most folks agreed that the betting handles were far out of line with established norms.</p>
<p>By way of comparison, DeRosa reported in HRN, &#8220;Churchill Downs handled $751,000 on the [Nov. 15] race 4 Super High 5, a huge number given that the track handled $967,598 on the bet type for this year's [GI] Kentucky Derby and $118,698 on the [GI] Kentucky Oaks.&#8221;</p>
<p>Superfecta and trifecta pools also appeared to have been targeted.</p>
<p>&#8220;The two things all the wagers had in common is that they came through FanDuel Racing and involved liberal use of the 'all' button in each position of the wagers,&#8221; DeRosa reported.</p>
<p>Prior to HRN revealing the purported glitch, speculation as to the cause of the conspicuously gaudy bets included allegations of money laundering, possible mistakes by computer-robotic wagering players, and misplaced decimal points in the bet-processing code.</p>
<p>On Wednesday, FanDuel Racing put out a statement on that said the company had &#8220;identified technical issues and potential fraud related to wagering pools and took the appropriate steps to stop wagering via its platform. This issue is no longer ongoing, and wagering has resumed. The company is undertaking a full review of this matter and will be cooperating with regulatory authorities.&#8221;</p>
<p>On Thursday, TDN contacted a FanDuel spokesperson for a follow-up and also emailed commission-level regulators in New York and Kentucky to ask if they were investigating the issue. None of the queries yielded replies prior to deadline for this story.</p>
<p>Curtis Linnell, who is the executive vice president of the Thoroughbred Racing Protective Bureau (TRPB), which monitors integrity and security in the sport, told TDN in a brief phone interview Thursday that he could not discuss specifics beyond explaining that the TRPB is &#8220;actively looking at the occurrences on behalf of regulator and racetrack clients who are involved.&#8221;</p>

										<content:encoded><![CDATA[<p><strong> Canigetaloan (<a href="https://www.darbydan.com/horse/leofric/" class="horse-link">Leofric</a>)</strong> had to lay it all down, but gamely managed to fight off a familiar foe in a wild finish to break his maiden, score his first black-type victory in the Aspirant S., and tally the first stakes winner for his freshman sire (by <a href="https://lanesend.com/candyride" class="horse-link">Candy Ride</a> {Arg}) all at once.</p>
<p>Debuting in the same Aug. 11 state-bred maiden at Saratoga as <strong>Trust Fund (<a href="https://coolmore.com/farms/america/stallions/practical-joke" class="horse-link">Practical Joke</a>)</strong>, who would go on to win by 2 1/4 lengths, Canigetaloan came out on the better end of the photo for second and would have to face that foe again here. In hand early as he coasted along from fourth, he took to the rail through the turn and was cut loose to gain a slim advantage by the sixteenth pole. Canigetaloan turned the table on Trust Fund on the wire while <strong>Tall Paul (<a href="https://www.darleyamerica.com/stallions/our-stallions/frosted" class="horse-link">Frosted</a>)</strong> would lose second to the latter in a blanket finish.</p>
<p>Canigetaloan is the most recent winner to the races for his dam, who also produced the winning Avid Sucinori (Ironicus) as her first offspring. 										<content:encoded><![CDATA[<p>The two jockeys currently ranked second and third for wins this season at Finger Lakes are both facing sanctions for their roles in two separate races last week in which one rider was piloting a long shot that altered course while the other rider was aboard the beaten favorite.</p>
<p>According to a stewards' ruling posted Aug. 8 on the New York State Gaming Commission (NYSGC) website, jockey John Davila, Jr., who has been riding at Finger Lakes since 1983, has been fined $500 &#8220;for riding in manner contrary to the best interest of racing&#8221; in the first race there Aug. 2.</p>

<p>&#8220;Any further similar conduct will result in an increased penalty,&#8221; the Finger Lakes stewards wrote in Davila's ruling.</p>
<p>A separate stewards' ruling, also dated Aug. 8, gave a three-day suspension to jockey Keiber Coa, a 12-year veteran, for &#8220;careless riding&#8221; in the fourth race July 31 at Finger Lakes.</p>
<p>Having waived his right to appeal, Coa will serve his days Aug. 15, 16, and 21.</p>
<p>TDN wanted to find out if Davila has appealed, and learn details about what, specifically, led to his &#8220;contrary to the best interest of racing&#8221; violation.</p>
<p>Brad Maione, the NYSGC's communications director, responded to a Wednesday email query about the rulings by writing back, &#8220;This is all that is publicly available.&#8221;</p>
<p>TDN then asked if the NYSGC could provide a stewards' report for the race dates in question, but did not receive a reply prior to deadline for this story. The website for Finger Lakes has a &#8220;Stewards' Corner&#8221; page, but the reports there have not been updated for one year, since Aug. 10, 2022.</p>
<p>Coa's &#8220;careless riding&#8221; violation July 31 occurred in a $10,000 claiming sprint over 5 1/2 furlongs in which he attained the lead from the rail under the 11-1 Forward Motion (Mission Impazible). Davila, riding the 9-5 favorite N Y Anthem (War Dancer), pressed the pacemaker from the outside until the top of the stretch.</p>
<p>At the quarter pole Coa came off the rail and edged out while appearing clear in front of Davila's mount, who was already losing touch with the leader. Coa then dropped Forward Motion back to the inside and in front of another rival, Breaking Stones (Congrats), who had to take up while Forward Motion widened to a 2 3/4-length win. The jockey on Breaking Stones claimed foul after finishing third. Davila's mount dead-heated for fourth. There was also a stewards' inquiry, but the results stood.</p>
<p>Davila incurred his &#8220;contrary to best interest&#8221; infraction two days later in a $28,500 NW2 allowance over 1 mile 70 yards. Riding the 8-1 Juggler (Lord Nelson) from post five, he sent his mount from the gate to contend with the 9-10 favorite Mo Trump (<a href="https://coolmore.com/farms/america/stallions/mo-town" class="horse-link">Mo Town</a>), who was piloted by Coa from post six.</p>
<p>The Equibase chart noted that Mo Trump was &#8220;forced six wide into the first turn by Juggler,&#8221; with announcer Tony Calo commenting in his call that the favorite was &#8220;stuck out there in no-man's land.&#8221;</p>
<p>Equibase further noted that Davila's mount &#8220;appeared to be getting out some&#8221; on the backstretch while Coa's favorite got &#8220;carried seven wide by the latter at the half mile pole.&#8221; Mo Trump finished fifth, while Juggler ran sixth and last. There was no posted stewards' inquiry.</p>

										<content:encoded><![CDATA[<p>A proposed change to claiming rules in New York would double the time that a claimed horse must refrain from racing outside the state, from 30 to 60 days.</p>
<p>In addition, in an effort to make it easier to acquire Thoroughbreds via claims, another proposed change would extend time periods for owners to be eligible to claim horses.</p>
<p>Those measures, plus several other tweaks to the &#8220;Who may make claim&#8221; rule 4038.1, were advanced by the New York State Gaming Commission (NYSGC) at Thursday's monthly meeting.</p>
<p>There was zero discussion among commissioners prior to the unanimous voice vote.</p>
<p>The proposed changes must first be published in the state register and then go through a public commentary period before the NYSGC takes a final vote on them at a future commission meeting.</p>
<p>According to a brief written by NYSGC general counsel Edmund Burns that was included in the informational packet for the Aug. 3 meeting, some horse owners and their representatives have communicated to the commission staff that the current claiming rules &#8220;need revisions.&#8221;</p>
<p>Commission staff met with personnel from the New York Racing Association (NYRA), Finger Lakes, the New York Thoroughbred Breeders (NYTB), and the New York Thoroughbred Horsemen's Association (NYTHA) in crafting the language changes, Burns wrote.</p>
<p>With respect to the time that a claimed horse must remain in-state, Burns wrote that &#8220;current rules prohibit a claimed horse from running outside New York for a period of 30 days. The proposal would extend that general prohibition to 60 days, which would mitigate entry shortages that have been experienced at New York tracks. An exception is proposed for horses claimed at Finger Lakes Racetrack toward the end of the Finger Lakes racing season, in which case the prohibition would be limited to 30 days from the end of the Finger Lakes racing season.&#8221;</p>
<p>On the time extensions for owners to be eligible to claim, the current version of the rule states that an owner must have &#8220;nominated a starter in the previous or current race meet.&#8221;</p>
<p>The proposed rewording would change the requirement to owners who have &#8220;started a horse: (1) within the previous 120 days, including the race in which such horse started, in a race meeting of the licensed or franchised association; or (2) in the current or previous race meeting.&#8221;</p>
<p>New owners who have not previously been licensed would also get a time extension.</p>
<p>Currently, a newly licensed owner &#8220;may apply to the stewards for a certificate authorizing him or her to claim one horse during the next 30 racing days following the issuance of the certificate.&#8221; The existing version of that rule also states that the stewards &#8220;may grant an extension&#8221; to that time period &#8220;if deemed appropriate.&#8221;</p>
<p>The proposed new language would change the &#8220;if deemed appropriate&#8221; part to an extension of &#8220;30 racing days if the certificate holder had entered a claim but had lost&#8221; the shake.</p>
<p>&#8220;NYRA conducts race meetings of varying lengths and horse populations,&#8221; Burns wrote in the brief. &#8220;Consequently, the current rule, which requires an owner, in order to be eligible to claim, to have entered a starter in the previous race meeting, precludes some otherwise active owners from claiming horses.</p>
<p>&#8220;Some owners may not have participated in a previous meeting because of the meeting's short duration or because racing opportunities had been incompatible with the owner's stable of horses. The proposed rule would address these concerns by allowing claimants who have raced on a circuit within 120 days, which would increase the number of owners qualified to make claims,&#8221; Burns wrote.</p>
<p>&#8220;Additionally, due to the frequency of multiple claims on a single horse, it is possible that someone actively trying to claim may not succeed in acquiring a horse within 30 racing days, which the current rule requires,&#8221; Burns wrote.</p>
<p>&#8220;Allowing 30 additional days for holders of a certificate of eligibility would provide an owner with an opportunity to claim when the owner has not been successful within the first 30 days of a race meeting, because the owner has lost the opportunity to claim to another claimant when multiple claims had been made on the same horse. Creating an opportunity to extend claiming eligibility for unsuccessful claimants would allow these owners additional chances to claim a horse,&#8221; Burns wrote.</p>
<p>Additionally, current NYSGC regulations provide that when a horse is claimed from a particular value class, the horses is ineligible to start in the same value class for 30 days.</p>
<p>According to the brief written by Burns, &#8220;A review of recent data, however, indicates that horses generally run on a 28-day schedule and condition books generally schedule a value class every 28 days. Under current regulations, a claimant who wants to start a horse again in the same class may be effectively forced to wait 56 days from the date of the claim. The position has been advanced that such period is unnecessarily long and causes issues for owners, trainers and the racetrack, which seeks to fill competitive races.&#8221;</p>
<p>The solution, according to the proposed rewording, will be to make the regulation state that, &#8220;If a horse is claimed the horse shall not start in a claiming race for a period of 20 days from the date of the claim for less than 25 percent more than the amount for which such horse was claimed.&#8221;</p>
<p>A new clause would be inserted that further states, &#8220;For a period of 10 days thereafter, a horse is eligible to start for a claiming price equal to or greater than the price at which the horse had been claimed. On the 31st day, the horse may start in a claiming race for any price.&#8221;</p>
<p>Burns wrote that &#8220;By reducing the requisite waiting period, owners will have a greater opportunity to start a horse for the price at which the horse had been claimed, given that the owners would be able to gain access to races that had already been written in the track's condition book 28 days in advance.&#8221;</p>
<h2><strong>Rice penalty revision on target for Sept.</strong></h2>
<p>Separately, NYSGC Executive Director Robert Williams detailed the expected timeline for commissioners to revisit a possible penalty for trainer Linda Rice, who on June 8 had a New York Supreme Court Appellate Division rule that a three-year banishment imposed by the NYSGC was &#8220;entirely unwarranted.&#8221;</p>

<p>As TDN <a href="https://www.thoroughbreddailynews.com/court-rules-that-rice-suspension-is-unwarranted/">reported back in June</a>, the Gaming Commission fined Rice $50,000 and revoked her license for three years in 2021 after investigating claims that Rice received favorable treatment from the NYRA racing office and that the racing office was releasing to her the names and past performances of horses that had already been entered in races, giving her an unfair advantage. It was further alleged that Rice had paid racing officials in exchange for the information, a charge she denied. She did admit to routinely giving members of the racing department, as well as the gate crew, Christmas presents.</p>
<p>Williams said that the court ruling upheld the commission's determination that the &#8220;improper practices&#8221; rule had been violated and that the court rejected Rice's constitutional claim. But the court overturned the three-year revocation, and sent the matter back to the commission to reassess the penalty &#8220;with the constraint that any reassessed penalty cannot contain a license revocation.&#8221;</p>
<p>Williams said the case materials will be recirculated to each of the commissioners, and that both the commission's counsel and Rice's legal team have been asked to update their post-hearing briefs with respect to penalty recommendations.</p>
<p>&#8220;The matter should be set for consideration at the commission's September meeting,&#8221; Williams said.</p>
<p>Brian O'Dwyer, the NYSGC chairman, said, &#8220;I urge the commissioners that, obviously, the Rice matter is something that we need to look at. In particular, three of the commissioners are new to the matter, having been appointed after the penalty had been assessed. Obviously, we're under court mandate to reassess that penalty, and I know that we'll all take that very seriously.&#8221;</p>

										<content:encoded><![CDATA[<p>It was starting to look like time had finally caught up with the old war horse <strong>Dr Blarney</strong> (Dublin). He came into an allowance race Monday at Finger Lakes having lost six straight, understandable considering the horse is 10 and made his debut in 2015 at Monmouth Park. But the pride of the Massachusetts breeding program was back on his game, winning by a length under jockey Jackie Davis. It was the ninth straight year in which he had won at least one race.</p>
<p>&#8220;He's stayed relatively sound all these years,&#8221; trainer Karl Grusmark said. &#8220;We've had some issues with quarter cracks that pop up once in a while, but other than that he's been a very healthy horse.&#8221;</p>
<p>With there being no racing in Massachusetts, the state's breeding program is verging on extinction. In 2013, the year Dr Blarney was born, the Massachusetts foal crop consisted of 41 horses. In 2021, the latest year available through The Jockey Club Fact Book, that number was seven. In 2022, only one mare was bred in the state.</p>
<p>Dr Blarney is one of only five horses bred in Massachusetts who have raced this year.</p>
<p>But the breeding program could always depend on Dr Blarney for some needed doses of spirit-lifting good news. Bred by his owner, Joseph DiRico, he broke his maiden in his first start, a July 12, 2015 $30,000 maiden claimer at Monmouth for then trainer Thomas McCooey. He lost his next two, including a start in the Tyro S. at Monmouth, but soon found his element. McCooey shipped him to Suffolk Downs to take on fellow Mass-breds in the Norman Hall S. He won by 10 that day, the first of 15 state-bred stakes he would win from 16 tries. His only loss against Massachusetts-breds came in a grass race.</p>
<p>He ran in his last Mass-bred race in 2020, a year after Suffolk Downs closed down for good. Fort Erie offered some races for Massachusetts-breds and it was there that Dr Blarney won the Rise Jim S. for the fourth time. From there, he had to run exclusively against open company and he has held his own. He's won six more times, including a win against open stakes company in the 2020 Last Dance S. at Fort Erie, his second stakes win against open company. He also won the Governor's Day H. in 2018 at Delaware Park.</p>
<p>With the win this week at Finger Lakes, he upped his career record to 27-for-44 with earnings of $787,393. That doesn't include the $181,338 he's taken home in Mass-bred incentives and awards.</p>
<p>&#8220;It's like having an ATM machine in the shedrow,&#8221; said Grusmark, who took over the training of Dr Blarney from McCooey at the start of the 2017 season. &#8220;When he's right, he can compete. We won a stakes race at Delaware Park with him and we've run him at a lot of tracks. He's better against Mass-breds because of the competition, but he's a quality horse. He's a good honest horse that can win against good horses.&#8221;</p>
<p>Dr Blarney's best year earnings-wise was 2018, when he earned $188,570, but much of that was made beating up on inferior competition in state-bred races. He's made just $22,175 so far this year from three starts, but Grusmark believes there is plenty left.</p>
<p>&#8220;I think right now he's as good as he's been in a couple of years,&#8221; he said.</p>
<p>DiRico attributes Dr Blarney's longevity to how he's been handled throughout his career.</p>
<p>&#8220;Every winter we send him to a training center in South Carolina for three, three-and-a-half months,&#8221; he said. &#8220;Not racing during the winters has helped. He's also been racing in a lot of Massachusetts-bred races and in those races he really didn't have to extend himself. We've taken good care of him.&#8221;</p>
<p>So while it appears that Dr Blarney could keep going for a while, that's not the plan. With his win Monday, he passed Ask Queenie to become the leading all time Mass-bred money earner. But there's one more goal that DiRico wants to accomplish. Dr Blarney is tied with Ask Queenie and Rise Jim for most career wins ever by a Mass-bred at 27. Rise Jim is arguably the best Mass-bred ever and is a back-to-back winner of the Tom Fool S., winning the race in 1992 when it was a Grade II and again when it was a Grade III. A 28th win by Dr Blarney would mean that he had nothing else to prove.</p>
<p>&#8220;Mr. DiRico would be thrilled to see him become the leading Mass-bred winner of all time,&#8221; Grusmark said.</p>
<p>Grusmark said that Dr Blarney will likely be retired after his next win and that, win or lose, he will not race as an 11-year-old.</p>
<p>DiRico is already searching around to find a home for his gelding following his last race. He said one option is to give him Jessica Paquette, the announcer at Parx who worked at Suffolk in a number of roles before that track closed. She has offered him a home.</p>
<p>In the meantime, DiRico is making plans to say goodbye to a horse that has been so good to him.</p>
<p>&#8220;Since he's been stabled at Finger Lakes, I don't really get much of a chance to see him,&#8221; DiRico said. &#8220;I have a house at Saratoga for the summer and this year when I go up there I'm going to make sure that I go to Finger Lakes and see him and feed him carrots. When he's retired, I'll have to deal with that when the time comes. He's been very special.&#8221;</p>

										<content:encoded><![CDATA[<p>Ron Walker has been named The Jockey Club steward for Finger Lakes Racetrack and will take the place of Samantha Randazzo, who was appointed as The Jockey Club steward for The New York Racing Association tracks. Walker has been involved with horse racing since 1981 and has been an owner, breeder, trainer, and racing official. Prior to becoming steward at Finger Lakes, he was the state steward for the Oklahoma Horse Racing Commission, spent nine years as the presiding steward for the New Mexico Racing Commission and also worked as a steward at Mahoning Valley Race Course and at Calder. He is Racing Officials Accreditation Program certified.</p>
<p>&#8220;Ron's many years of experience in the racing industry make him an excellent candidate to fill the role of steward at Finger Lakes,&#8221; said Stuart S. Janney III, chairman of The Jockey Club.</p>
