Abdala, who has owned Thoroughbreds for 10 years after getting started in horse ownership with Standardbreds, told TDN in a Feb. 8 phone interview that he still doesn't understand why Turfway officials accepted his entry for the 0-for-9 Magnolia Wind (Central Banker) in a $30,000 maiden-claiming race Jan. 4 if the stewards later deemed the 4-year-old filly to be ineligible.

The eligibility issue arose after the Jan. 4 race when Magnolia Wind was going to be entered again, and Turfway stewards Barbara Borden, Ron Herbstreit, and Brooks Becraft III learned that Abdala had an appeal pending with the Maryland Racing Commission over Magnolia Wind's race-interference disqualification from first to second in a $30,000 maiden-claimer at Laurel Park Nov. 9.

In that Laurel race, the 12-1 Magnolia Wind led all the way in a 5 1/2-furlong grass sprint. According to the Equibase chart, she “drifted out near the sixteenth pole, dug in and prevailed.”

“She won the race,” Abdala said. “But the stewards said we were 'herding,' which I thought was ridiculous because both riders were riding to the wire, nobody checked, and we held on. I appealed it, but the hearing wasn't going to be until Feb. 6.”

In the interim, after Magnolia Wind had gone nearly two months without a start, Abdala said he told Dunham, who has been a licensed trainer for 33 years, “She's good right now, we've got to race her.”

Although Magnolia Wind trains at Fair Hill in Maryland, Abdala did not want to run her on the dirt somewhere closer to home, because that's not her best surface, he explained.

“That's why I went out to Turfway, because she needs the Tapeta or the turf,” Abdala said.

Because Magnolia Wind's record on Equibase clearly showed the she had zero lifetime wins, “I assumed that the horse was eligible as a maiden,” Abdala said.

“I told my trainer to put her in, and he put her in. He entered her [electronically via] the computer. And we never said anything to anybody [about the Maryland appeal], because I didn't know we had to. They accepted the entry. Then we drove that filly nine hours to get to Turfway.”

The long journey appeared to pay off. Magnolia Wind ran second at 5-1 odds.

“And now they come after me saying that we knew she wasn't eligible, and that we're unlawful,” Abdala said.

Abdala said that after being notified of the ineligibility, he didn't come away from a conversation with Borden, Herbstreit, and Becraft with a clear understanding of why the Turfway's racing office officials or the stewards didn't bear some responsibility for allowing the entry in the first place.

TDN emailed Borden, the chief state steward, plus Kentucky Horse Racing Commission (KHRC) executive director Jamie Eads, asking for some context behind the ruling and for clarification about why the Jan. 4 entry was approved by Turfway officials.

A different KHRC spokesperson replied with an email that outlined some of the sequence of events on “background only.” Because what was disclosed in that email could not be attributed to a specific KHRC official, the entire explanation has not been provided here. A follow-up request by TDN asking if the KHRC wanted to provide any response for the record did not yield a reply prior to deadline for this story.

The Turfway stewards' report for that date that is signed by all three stewards and posted on the Kentucky Horse Racing Commission website makes no mention of the ineligibility.

But the subsequent Feb. 2 stewards' ruling disqualified Magnolia Wind from second place and ordered her $5,331 in purse earnings redistributed.

“I'm an accountant, a CPA, and I have an accounting firm,” Abdala said. “We have a lot of horse racing people as clients. I've asked everybody, and they all told me, 'Abby, your horse was eligible.'”

Abdala said he is no longer pursuing any appeals in Maryland or Kentucky regarding his twice-DQ'd filly.

“I didn't want to cause trouble or anything, and I want the filly to be able to race,” Abdala said. “So I just dropped everything–I dropped the hearing in Maryland, and I dropped the [potential appeal] at Turfway. I just want her to run. It's detrimental to her. After I dropped everything, they said they'll accept our entry now.”

But this is not the subject of my email.

The subject is betting on horses, and I had some success in this endeavor. In fact, after my Pick Six score at Aqueduct in January of 1992, I maintained a flat-bet profit of $60,000 for 29 years. The CAWS and past-posting and the drug problem caused me to blow all of that in just three years. I played a few more years and then abruptly quit betting horses (forever!) last September. After sending about $1.5 million dollars through the windows, my net loss over 37 years amounts to $35 a week. Less than the price of a ball game at Fenway Park.

The point of this email, however, is the aftermath of disqualifications. I can recall how angry this game made me and certainly other horse players when our horses were disqualified. We put in a lot of time and effort handicapping, and when we are right, we expect to get paid. And then we don't. This is the only sport where if your team wins you still might not get paid. That's not an attractive thing to market to newbies. “Hey, your horse may win, but you might not get paid.” This never happens in poker. But chopped pots happen all the time and it keeps the game moving.

Why do I mention “chopped pots”? Because this is the idea, I have to help horse racing stay alive. If your horse wins, but the horse is disqualified for any reason, you still get paid-but like a dead heat. You chop the pot with the horse that got moved up. Everything. WPS, all exactas and other exotics. Chop the pot. BUT ONLY FOR THE BETTORS. The connections of the DQd horse are still penalized the same way they are now. They lose the purse, and the purse gets redistributed to the connections of the horse who was moved up via DQ. But the bettors still get paid.

Maybe it's an idea already floated by others, but I hope that this idea might be helpful to the game that sustained me for 32 years. There's not a lot I can do to give back, so maybe this idea will catch on and suffice.

What is needed is to look at the Stewards box. Stewards involved should be interviewed, past decisions reviewed and what we need is industry-wide implementation to improve the process. Possibly a fourth person “in the booth” might help when a foul occurs. Evaluation of current requirements, education, improved training, age requirements, cognitive skills, etc.

Whatever blame rests 100% with the stewards in this case!

The press release was issued in advance of a panel discussion at Tuesday's Global Symposium on Racing hosted by the University of Arizona Race Track Industry Program (RTIP) in Tucson titled “Embracing Change: Are We Ready to Adopt Category 1 Rules In the US?”

The Guild also noted that it plans to “voice opposition” to proposed modifications to that standard that will be up for discussion during the Association of Racing Commissioners International Model Rules Committee meeting Dec. 7.

“While considering this decision, the Guild considered the safety of both the human and equine athletes, as well as fairness for all parties involved,” the release stated. “The Category 2 method provides Stewards with the authority to disqualify a horse if, in their opinion, it interfered with other horses, regardless of whether the interference was accidental, willful, or the result of careless riding.

“Based on experience, the Guild believes that Category 2 provides for some additional safety protections for the riders,” the release continued. “By giving the Stewards the ability to disqualify the horse which has caused the interference, regardless of where the horse finished, it will serve as a deterrent to unsafe riding.

“We, as an industry, have a responsibility to assure safety for both the horses and the jockeys. It is unreasonable to create a racing environment that is potentially going to lead to more hazardous riding styles,” the release stated.

“Additionally, with regards to the fairness of such rules, while Category 1 often protects 'the best horse,' Category 2 rules enable strong advocacy on behalf of all horses and jockeys who suffered interference,” the release stated.

“This is achieved by ensuring that the interferer is placed behind all of the horses who suffered the interference, both directly and indirectly. Using this method provides a safeguard against horses having their finishing position compromised as a result of the interference, and in turn, provides a fairer playing field to all participants, as opposed to just the 'best horse'…

“It should be noted, with the exception of Oklahoma, no other racing jurisdiction in the United States has adopted Category 1 method,” the Guild's release stated.

A pre-symposium summary of the RTIP panel discussion stated that “The conflict of equity and fairness versus heightened consistency in decisions is the heart of the conundrum that surrounds the disqualification policies between Categories 1 and 2.

“While most international racing jurisdictions have shifted away from Category 2, which requires the demotion of a horse for consequential interference if the sufferer of the interference loses a placing, North America remains reluctant to embrace this global approach which only demotes horses when the sufferer would have beaten the interferer.

“In the age of the growing global wagering market, it is imperative for our racing companies to revisit this issue as our domestic bettors have already embraced such practices at events like Ascot, and our new international customers are already accepting of Category 1 disqualification policies,” the RTIP summarized prior to its panel discussion.

The bay gelding by Zoffany actually was second across the wire just a nose behind Yuesheng Zhang's Sword Zorro and just a head in front of Double L. Racing or Baffert's Hudson Ridge in a furious finish.  But the track's stewards reviewed film of the contentious stretch run where all three horses went through a series of bumps and came to the conclusion that Sword Zorro should be disqualified and placed third and the other two horses each moved up one placing.

The winning time on the 1 1/16 miles was 1:42.27.

Drayden Van Dyke rode the winner for trainer Jeff Mullins. The owners are the father and son team of Jed and Tim Cohen.

Zoffarelli returned $17.80, $6.00 and $3.80 across the board. Hudson Ridge paid $3.40 and $2.40, while Sword Zorro returned $3.60 to show.

Zoffarelli, who last raced June 30 at Bath in England, earned $90,000 for his victory moving his bankroll up to $110,325. He had won a race and was second five times in seven starts in England as a 2- and 3-year-old.

The track's Pick 6 Single Ticket Jackpot Wager proved too elusive for the 12th straight racing day meaning there will be a whopping carryover of $1,127,460 going into the return of racing Thursday. First post for the eight-race card will be 2 p.m.

The stakes win was the first of the meeting for rider Van Dyke and his first in the La Jolla Handicap. He now has 34 stakes wins at Del Mar.

The suspension begins on Sept. 7, the day after the close of the Del Mar meet in California, where Prat is the runaway leader in the jockey standings. The suspension runs through Sept. 13.

Hot Rod Charlie, ridden by Prat, made a four-wide move into the stretch of the 1 1/8-mile Haskell. overtaking Midnight Bourbon to his immediate inside nearing the furlong pole. Hot Rod Charlie then drifted in to engage Mandaloun on the rail, but did so without sufficiently clearing Midnight Bourbon, who stumbled badly after Lopez appeared to attempt to swing his mount to the outside. Midnight Bourbon managed to stay on his feet, but Lopez was unseated as Hot Rod Charlie and Mandaloun raced as a team to the wire. Hot Rod Charlie won by a nose but was disqualified and placed last, giving Mandaloun the victory in the Grade 1 race and the winner's share of the $1,005,000 purse.

Neither Midnight Bourbon nor Lopez suffered serious injury and Lopez rode the following day.

The stewards conducted a hearing with Prat July 29 and issued the ruling on Sunday morning.

“Jockey Flavien Prat failed to make a reasonable effort to keep his horse from drifting in past the eighth-mile pole, allowing his horse to cross in front of Midnight Bourbon, which resulted in Midnight Bourbon clipping heels with Hot Rod Charlie, causing Midnight Bourbon to stumble badly, unseating his rider,” the ruling states.

“Mr. Prat's actions were in violation of NJAC 13:70-11.1 (crossing and weaving), which states: 'When clear a horse may be taken to any part of the course but no horse shall cross or weave in front of other horses in such a way as to impede them or constitute or cause interference or intimidation.'”

There was no immediate word on whether Prat would appeal the suspension.

Prat's suspension comes during the Los Angeles County Fair meet at Los Alamitos.

The 40^th running of the 1 1/8-mile Federico Tesio headlined an 11-race Spring Stakes Spectacular program featuring six stakes worth $650,000 in purses. For the sixth straight year, the Tesio offered Triple Crown-nominated 3-year-olds and automatic berth in the 146^th Preakness Stakes (G1) May 15 at Pimlico.

Saturday marked the return of the Tesio to Pimlico, where it debuted in 1981 and stayed every year but two through 2015. Named for the noted Italian breeder, owner and trainer whose homebreds Nearco and Ribot dominate Thoroughbred bloodlines around the world, the Tesio was held at Laurel Park in 1987 and 1989 and each year since 2016.

Sent off the 9-5 favorite in a field of eight that included stakes winners Shackled Love, Hello Hot Rod and his former stablemate Maythehorsebwithu, The Reds ($5.80) gave both local jockey Victor Carrasco and New York-based trainer John Kimmel their first Tesio victory.

“I thought he showed tremendous courage, really,” Kimmel said by phone. “He got squeezed at the start so he ended up losing his spot. He should have been much closer. Then he had a terrible trip getting to where he was when the horse came out on him, which was a call I thought was deserved. We were just very fortunate.”

Shackled Love, who edged Maythehorsebwithu in the March 13 Private Terms at Laurel, broke side-by-side from the two outermost posts and both were intent on the lead, going the first quarter-mile in 24.13 seconds and a half in 48.12 with Excellorator and jockey Angel Cruz tracking in third. Six furlongs went in 1:11.50 with the top two still in front, though Excellorator was closing the gap.

Neither leader was able to maintain their momentum and began to drop back as they came into the stretch, leaving Excellorator to inherit the lead. Meanwhile The Reds, shuffled back between Royal Number and Hello Hot Rod early and steadied on the far turn, got straightened out and was coming with a run when Excellorator drifted out under Cruz's left-handed urging. The Reds was forced to alter his path and had Royal Number closing on his outside.

Once on a straight path, Excellorator dug in and held off The Reds by a head after completing the distance in 1:49.98 over a fast main track. Following a lengthy stewards' inquiry and objections from both Carrasco on Cruz and Royal Number jockey Julian Pimentel on Carrasco, Excellorator was taken down and placed second behind The Reds.

“Not too disappointed really, because the horse ran a wonderful race,” Excellorator's trainer, Hugh McMahon, said. “We did our part. There's just so much we can do, but there's so many external variables that influence these kinds of outcomes.”

The remaining order of finish was unchanged. Royal Number was third, followed by Hello Hot Rod, Maythehorsebwithu, Shackled Love, Zertz and Tiz Mandate.

“He broke good. You could see going into the turn, I'm trying to get him to relax. We had a great outside post and I wanted no part of dueling for the first three-quarters,” jockey Sheldon Russell, aboard Maythehorsebwithu, said. “I'm making every effort to sort of break his stride and get him to relax. We do a lot of work trying to teach them to relax in the afternoon, but we probably had him a little too fresh today. He just ran his race early on. We'll regroup and see how he comes out.”

By Belmont Stakes (G1) winner Tonalist, The Reds broke his maiden in his fifth career start and second this year, a 1 1/8-mile maiden special weight Jan. 31 at Aqueduct. Last time out, he ran fifth in the one-mile Gotham (G3) March 6, also at the Big A.

The Reds is not Triple Crown-nominated, but can be supplemented to the 1 3/16-mile Preakness at the time of entry, May 10.

“This horse is really suited to run further. He's got that kind of temperament. He settles really well,” Kimmel said. “I'm not sure if we'll come back in three weeks but we'll see how the Derby and the participants in the Preakness shakes out and we'll go from there.”

The Herecomesthebride, a 1 1/16-mile turf stakes for 3-year-old fillies, kicked off a 14-race program with nine stakes worth more than $1.4 million, headlined by the $300,000 Fasig-Tipton Fountain of Youth (G2), a key prep for the $750,000 Curlin Florida Derby (G1) presented by Hill n' Dale Farm at Xalapa.

Con Lima ($6), who finished second in the Jan. 30 Sweetest Chant (G3) after setting the early pace, rallied from well off the early pace to finish a well-beaten second behind Spanish Loveaffair, the 8-5 favorite who drew off to finish first by 2 ¾ lengths.

However, the stewards subsequently ruled following a lengthy inquiry that Spanish Loveaffair interfered with eventual fourth-place finisher I Get It leaving the backstretch, placing the Mark Casse trainee from first to fourth.

Mail Order set the pace under Junior Alvarado, producing fractions of 23.80 and 48.10 seconds for the first half-mile with Joy of Painting and Spanish Loveaffair in close attendance. I Get it advanced quickly on the rail along the backstretch to slip inside Spanish Loveaffair but dropped back several lengths after bumping with the favorite. Spanish Loveaffair would go on to sweep to the lead with a three-wide move into the stretch to prevail by a comfortable margin. Con Lima rallied four-wide on the turn to finish second, a length ahead of Joy of Painting, who finished a nose ahead of re-rallying I Get It.

“Our plan was to go to the lead but the filly, unfortunately, didn't break that good, said Irad Ortiz Jr. “After that I just had to go to Plan B. That wasn't even our Plan B. It was Plan C, I guess. She relaxed and just sat and waited for me. I had to start working on her a little early, but she performed well and kept coming. [Spanish Loveaffair] was a  better filly today, but she's a very good filly.”

Spanish Loveaffair, who was making her first start since finishing sixth in the Breeders' Cup Juvenile Fillies Turf, ran 1 1/16 miles over a firm turf course in 1:41.30.

The punishment entailed four separate rulings, with one each disqualifying the offending horses and the fourth issuing the fine for failing to meet the Arkansas State Racing Commission's “absolute insurer” guidelines for trainers.

Two of the horses tested positive for triamcinolone acetonide, typically used to treat arthritis. Adheretome was taken down from first in a March 19 claiming race at Oaklawn Park after the substance was found in a post-race test, while Weekend Madness was disqualified from fifth after testing positive following a March 1 maiden claimer.

Moment was disqualified from first in an April 3 waver claiming race after testing positive for the relaxant methocarbamol, which can treat exercise-induced muscle soreness.

Diodoro did not immediately indicate to the TDN whether he would appeal the rulings.

Diodoro finished the 2020 Oaklawn Park meet as the track's leading trainer with 52 wins, ahead of Steve Asmussen with 49. If the disqualifications are not appealed successfully, Diodoro's win total would only decrease by one, by virtue of also having the runner-up in Moment's April 3 victory.

With the stewards ruling that first-place finisher Pirate's Punch came in and intimidated Warrior's Charge late in the race at the Oceanport, N.J., track, Cox's horse earned the second graded stakes victory of his career after being placed first.

The 1 1/16-mile Iselin, reduced to a four-horse field after scratches, was essentially a two-horse race with Pirate's Punch, ridden by Jorge Vargas, Jr., and Warrior's Charge, handled by Paco Lopez, running neck and neck around the racetrack.

Pirate's Punch took a slight advantage in mid-stretch before starting to come over inside the sixteenth pole, with Warrior's Charge battling along the rail.

With 30 yards to go, Lopez stood straight up in the irons and effectively stopped riding, finishing 1 1/2 lengths behind the Grant Forster-trained Pirate's Punch. It was another three-quarters of a length back to Bal Harbour.

Final time for the mile and a sixteenth was 1:43.37.

“He (Pirate's Punch) came in on me pretty good,” said Lopez. “I had to steady because of him. I had to completely stand up and stop riding. He came over. I think the stewards did the right thing. I had to completely stop riding my horse. I think my horse was still trying hard.

“I think if had a little room he would have come back to win because he's a fighter. You can see on the head-on how it bothered us and why I had to stop riding. That hole was there and then it closed very quickly when that horse came over on us.”

Gulliver Racing's Phil Bongiovanni, co-owner of Pirate's Punch, saw it differently.

Warrior's Charge, who started his 4-year-old campaign by winning the Grade 3 Razorback Handicap at Oaklawn Park, earned his fifth victory in 11 career starts. The son of Munnings-Battling Brook by Broken Vow is owned by Ten Strike Racing and Madaket Stables LLC.

“Paco had the horse where he needed to be, up close or on the lead,” said Cox. “Pirate's Punch took off after us and I thought we were able to battle back and get in front of him but I'm not sure he ever did, even though he hung in there with him. Maybe we were going to come back. Obviously the stewards thought we were. We were fortunate to come out on the front end of this. The horse that crossed the wire first ran a tremendous race. I honestly thought he was a horse to contend with and he obviously was.

“It's strange, because a couple of more jumps and we're probably third. It was an unfortunate way to win a race, I guess you could say. But we'll take. Now we'll see how he comes out of it.”

Cox said his ultimate goal with Warrior's Charge is the Breeders' Cup Dirt Mile at Keeneland on Nov. 7. He hopes to find one more race before then.

“He will ship back to Kentucky tomorrow and we'll see how he is,” he said. “I think we'll look at one more race (before the Breeders' Cup Mile) but we'll see how he comes out of this first.”

Warrior's Charge paid $3 to win as the 1-2 favorite, dueling with Pirate's Punch through fractions of :24.10 for the opening quarter, :47.46 for the half, 1:11.17 for three quarters of a mile and 1:36.61 for the mile. They were never separated by more than a half-length until the incident in deep stretch.
