										<content:encoded><![CDATA[<p>Both Charles Town Races and Mountaineer Park got approval Wednesday from the West Virginia Racing Commission (WVRC) to reduce live racing dates in 2024 compared to recent seasons.</p>
<p>The Horsemen's Benevolent and Protective Association (HBPA) chapters at both tracks supported the diminished schedules based on available purse funds and projected horse populations.</p>
<p>Right now the placeholders are 158 dates for Charles Town and 121 for Mountaineer.</p>
<p>But the exact number of programs will ultimately be contingent on the outcome of several overlapping federal lawsuits that have to do with the legality of the Horseracing Integrity and Safety Act (HISA).</p>
<p>In July of 2022, the states of West Virginia and Louisiana <a href="https://www.thoroughbreddailynews.com/injunction-halts-hisa-rules-but-only-in-louisiana-and-west-virginia/">won a preliminary injunction</a> that has kept the HISA rules from being implemented in those two states until their lawsuit challenging the constitutionality of HISA gets decided in full.</p>
<p>Then in September of 2023, the judge handling that case <a href="https://www.thoroughbreddailynews.com/judge-halts-anti-hisa-suit-in-louisiana-pending-outcome-of-hbpa-case-in-u-s-appeals-court">ordered it</a> to be &#8220;administratively terminated&#8221; until the United States Fifth Circuit Court of Appeals made a ruling in a separate (but related) suit in which the National HBPA is also alleging that HISA is unconstitutional.</p>
<p>Oral arguments in the HBPA vs. HISA case were <a href="https://www.thoroughbreddailynews.com/the-wait-begins-fifth-circuit-hears-hisa-constitutionality-appeal-arguments/">heard Oct. 4</a> but no Fifth Circuit decision has been issued yet.</p>
<p>WVRC executive director Joe Moore explained during the Dec. 13 meeting that if HISA were to be deemed legal nationwide and/or the court's injunction barring implementation in West Virginia got lifted, both tracks would need to recalculate how much purse money was available and how many racing dates those funds could cover.</p>
<p>That's because Charles Town and Mountaineer would be subject to HISA assessments for safety oversight and drug testing services that they currently don't pay because of the injunction that grants them an exception.</p>
<p>According to HISA's 2024 budget, West Virginia's assessment for next year is $4,448,269 (Charles Town $3,281,367; Mountaineer $1,166,902).</p>
<p>Moore said that &#8220;if HISA were to become effective in West Virginia, I suspect Charles Town and the horsemen would consider reducing their race days by a number to ensure that there were purse monies available after the [HISA] assessments were calculated for them.&#8221;</p>
<p>Charles Town's director of racing, Charlie McIntosh, concurred.</p>
<p>&#8220;If HISA were to come back into effect, we'd have to sit down and evaluate&#8221; funding options, McIntosh said.</p>

<p>No representative from Mountaineer spoke on the track's behalf during the meeting.</p>
<p>The two tracks handled their dates reduction requests differently. Charles Town asked for and received 158 dates but left the door open to come back to the commission for a further reduction request if necessary.</p>
<p>Mountaineer took the opposite approach, asking for and receiving the commission's approval for two dates contingencies so the track wouldn't have to come back a second time to request another trim if HISA gets legalized in the state.</p>
<p>So the WVRC approved 121 dates for Mountaineer, with Moore explaining that &#8220;if feasible and [if West Virginia continues to] remain exempt from HISA, their number of live race days would increase to 128.&#8221;</p>
<p>Moore said Mountaineer's season would run Apr. 28-Dec. 4 under the first contingency, with the meet extending through Dec. 11 if the second plan got utilized.</p>
<p>Charles Town's 2024 schedule, according to the track's website, will consist of four- and three-date weeks nearly year-round, with breaks Aug. 25-Sept. 11 and Dec. 15-31.</p>
<p>Charles Town's 158 dates for 2024 continues a downward trend. The track was awarded 164 dates in 2023 and 179 in 2022.</p>
<p>Unless Mountaineer ends up running the bumped-up 128 dates, its 121-date allotment also represents a decrease, from 124 dates in 2023 and 130 dates in 2022.</p>
<p>(All dates cited above are based on dates as originally assigned by the commission, and do not reflect any in-season program losses that might have occurred because of weather cancellations.)</p>
<p>Even in years when the costs of HISA assessments have not been in play, the awarding of race dates in West Virginia has been a somewhat confusing several-step process. A state statute requires Charles Town to apply for 220 programs every year, and Mountaineer is required to apply for 210 dates. But those quotas haven't been reached for quite some time.</p>
<p>What has ended up happening in recent seasons is that after the initial approvals of those mandated 220 and 210 dates every November by the WVRC, both venues have subsequently come back before the commission to ask for reductions that reflect what each track and its HBPA representatives think is a workable schedule.</p>
<p>The dates reduction votes were unanimous Dec. 13, with WVRC chairman Ken Lowe Jr. and commissioner J.B. Akers voting in the affirmative, while commissioner Tony Figaretti was listed as being absent from the meeting because of a travel conflict.</p>

<p>The awarding of race dates in West Virginia is a somewhat confusing several-step process bound by a state statute that requires Charles Town to apply for 220 programs every year. The state's other Thoroughbred track, Mountaineer Park, is required to apply for 210 dates.</p>
<p>But what has ended up happening in recent seasons is that after the initial approvals of 220 and 210 dates by the West Virginia Racing Commission (WVRC), both venues have subsequently come back before the commission to ask for reductions that reflect what each track and its respective Horsemen's Benevolent and Protective Association (HBPA) think is a workable schedule based on available purse funds.</p>
<p>At the <a href="https://www.thoroughbreddailynews.com/mountaineer-to-race-six-fewer-days-in-2023/">Nov. 14 WVRC meeting</a>, Mountaineer was granted additional approval to reduce its schedule to 124 dates in 2023, a six-program cutback from the 130 that the track was awarded in 2022.</p>
<p>Also at that Nov. 14 meeting, WVRC executive director Joe Moore noted that Charles Town was approved for 179 programs in 2022.</p>
<p>But at the Dec. 20 meeting, Moore said that Charles Town ended up racing just 173 dates because of cancellations during the 2022 season just completed Dec. 17.</p>
<p>So prior to the 3-0 unanimous vote by commissioners Tuesday, Charles Town's revised 164-date request was framed by Moore as a nine-date reduction based on the actual number of programs.</p>
<p>But as per the 179-date allotment he had previously stated in November, it's a parsing of 15 cards.</p>
<p>&#8220;The request comes with the agreement [by] the racetrack and the HBPA that they will meet in July to revisit their live race schedule and their available purse monies to assess whether there is a possibility of adding any days towards the end of the calendar year,&#8221; Moore said.</p>

										<content:encoded><![CDATA[<p>The Charles Town racing community lost a long time member recently as the track's former Racing Secretary Mearl “Lonnie” Sowers passed away last week at the age of 82.</p>
<p>Sowers got his start in the racing industry rubbing horses for J.P. Simpson in the late 1950's before taking time away from the backstretch to begin a career in the racing offices of the West Virginia and Maryland circuits in the decade that followed.</p>
<p>He would then once again find himself back at the barn in 1974 when he became an assistant trainer for Bud Delp, overseeing a shed row of 50 horses until 1978.</p>
<p>Most notably in his time with Delp, Sowers called his boss to tell him he had seen something different after laying eyes on the first workout of a dark gray colt who had shipped into his barn several weeks prior. The colt, who turned out to be 1979 Kentucky Derby and Preakness winner Spectacular Bid, would go on to win 26 of 30 lifetime starts in his Hall of Fame career.</p>
<p>After leaving the backstretch for the final time in 1978, Sowers reprised his role in the Charles Town racing office, working his way up to the position of Racing Secretary in 1995 – a role he held until the track was sold. With his love of the racing industry, Sowers continued on to work as an assistant mutuel manager in the mutuels department until his retirement in 2007.</p>
<p>Sowers is survived by his wife of 61 years, Margaret “Peggy” Lynn Horsley Sowers; two children, including Charles Town's current Racing Manager Duane Sowers, eight grandchildren and fifteen great grandchildren. In addition to his parents, he was preceded in death by one brother, Thomas Sowers, Jr.</p>
<p>Funeral services will be held 1 p.m. Monday, February 7 at the Jefferson Chapel in Ranson, West Virginia with the family receiving friends from 2-4 p.m. and 6-8 p.m. Sunday at the Chapel.</p>

<p>The Charles Town 6-12 carryover currently stands at $141,910 with 2 cards remaining prior to its distribution. The Charles Town 6-12 is a jackpot style Pick 6 covering the final six races on each Charles Town card and carries a low 12-percent takeout.</p>
<p>Due to the low takeout and size of the carryover, the mandatory payouts of the Charles Town 6-12 have typically resulted in a players' advantage of upwards of 13 percent paid out on top of the gross pool on the night of the distribution.</p>
<p>The first race on Charles Town's Saturday night program is scheduled for its standard 7:00 P.M EST post time, with the Pick 6 sequence beginning in Race 4 at 8:30 P.M. EST and culminating with the evening's ninth and final event.</p>

										<content:encoded><![CDATA[<p>With the Hollywood Casino at Charles Town 2021 meet quickly coming to a close, Arnaldo Bocachica has again run away with the leading jockey title. Last week he added eight wins to his already lofty total to earn the title of Jockey of the Week for Dec. 6 through Dec. 12. The honor, which is voted on by a panel of racing experts, is for jockeys who are members of the Jockeys' Guild, the organization which represents more than 1050 active, retired and permanently disabled jockeys in the United States.</p>
<p>The hard-working, personable Bocachica, known as “Boca” at the track, has led the jockey standings at Charles Town in wins and purse earnings for the last three years and is poised to make it four years in a row with 252 wins, 150 more than his closest competitor and nearly $5 million in purse earnings through Dec. 12. His winning percentage is a lofty 35 percent. The Charles Town meet closes this Saturday, Dec. 18.</p>

<p>Riding since 2006, the 33-year-old native of Puerto Rico has made Charles Town his home track riding first call for leading trainer Jeff Ronco as well as other top trainers at the track. The Ronco/Bocachica pair post a 37 percent win rate, and Bocachica won career race 2,000 on March 6, 2021 for Jeff Ronco.</p>
<p>Bocachica began the week on Wednesday by winning two races for Jeff Ronco and one for trainer Anthony Farrior. With no wins on Thursday, Bocachica won three on Friday, one for Ronco and two for Farrior. He continued his winning ways on Saturday with a win for trainer Victor Espinosa and one for Farrior.</p>
<p>Bocachica's weekly statistics included eight wins from 15 starts for 53.3 percent winners and 80 percent in-the-money finishers with total purse earnings of $127,060.</p>
<p>Other nominees for Jockey of the Week were Dylan Davis who won the Garland of Roses at Aqueduct, Mario Gutierrez who pulled the upset win in the G2 Los Alamitos Futurity, Colby J. Hernandez who won the Champions Day Classic at Fair Grounds and Luis Saez who won the G3 Mr. Prospector at Gulfstream Park.</p>

										<content:encoded><![CDATA[<p>Sam Huff and his partner Carol Holden were driving back to their West Virginia home after attending the inaugural Maryland Million races at Laurel Park in 1986 when Huff came up with the idea of having a similar day for state-breds.</p>
<p>&#8220;We're going to do that in West Virginia,&#8221; Huff said, according to a 2011 Bloodhorse.com article by Tom LaMarra.</p>
<p>Sure enough, they did.  The first West Virginia Breeders' Classic was held at Charles Town Races less than a year later, thanks to Huff's tireless advocacy for horses bred in West Virginia and fueled by a fiercely competitive personality that earlier in life made him among the most feared players in the National Football League.</p>
<p>Huff and Holden sold sponsorships for the event and found additional revenue from uncashed pari-mutuel tickets. The initial running, which included Charles Town's first-ever $100,000 race, was a success, and it's steadily grown over the years, becoming second only to Charles Town Classic day.</p>

<p>The couple also bred and raced horses in West Virginia and hosted a radio show, Trackside, that ran for 28 years, ending in 2016, when Huff began suffering from dementia. His condition led to a court fight later that year between Holden and Huff's daughter over his custody and care.</p>
<p>Huff died on Saturday in Winchester, Va., at the age of 87.</p>
<p>Born Robert Lee Huff on Oct. 4, 1934, in Edna Gas., W.Va., Huff was called Sam at early age and never learned why, according to a 1988 autobiography. Growing up in Coal Camp No. 9, he was from a family of coal miners but escaped that occupation when he accepted a football scholarship to West Virginia University, where he played both offensive and defensive line positions and was named an All-American before being drafted by the New York Giants in the third round of the 1956 NFL draft.</p>
<p>During his years in the National Football League, Huff was known for an aggressive defensive style that led CBS news anchor Walter Cronkite to narrate a documentary, <a href="https://youtu.be/XF_QN3e_1gw">&#8220;The Violent World of Sam Huff,&#8221;</a> that aired as part of the network's &#8220;Twentieth Century&#8221; series. As the leader of the New York Giants defense, he helped the team reach the NFL title game six times in eight years before being traded to the team then known as the Washington Redskins, where he finished out his career and worked as a commentator on the team's radio broadcasts for 38 years, retiring in 2013.</p>
<p>Huff was inducted into the Pro Football Hall of Fame in 1982.</p>

										<content:encoded><![CDATA[<p class="p1">Georgina Baxter, one of five Florida-based trainers sanctioned on Oct. 1 by Gulfstream Park for violating the track's house rules on clenbuterol, may be in jeopardy of losing her biggest career win after a horse in her care, R Adios Jersey, tested positive for the anti-inflammatory flunixin (trade name Banamine) following the $400,000, Grade 3 Charles Town Oaks in West Virginia on Aug. 27.</p>
<p class="p1">West Virginia Racing Commission steward Denver Beckner confirmed the initial finding from Industrial Laboratories in Colorado and said officials are awaiting results of a confirmatory split sample before conducting a hearing to consider possible disqualification of R Adios Jersey and sanctions that could include a fine and/or suspension of Baxter.</p>
<p class="p1">R Adios Jersey, a Florida-bred 3-year-old filly by Adios Charlie, is owned by Averill Racing LLC and ATM Racing. Her front-running, 3 1/4-length victory under Paco Lopez was her fourth victory without a defeat. R Adios Jersey earned $230,400 and paid a $12.80 mutuel for the Charles Town Oaks win.</p>

<p class="p1">Banamine is a Class 4 drug with a Category C penalty under Association of Racing Commissioners International guidelines. For flunixin, under those guidelines, if the sample tests higher than 5 ng/ml, the recommendation is for a disqualification and loss of purse in the absence of mitigating circumstances. A trainer faces a maximum fine of $1,000 for a first offense in any jurisdiction and a $1,500 fine and 15-day suspension for a second offense in a 365-day period in any jurisdiction, under the ARCI guidelines.</p>
<p class="p1">Baxter, a native of England who was a jockey and exercise rider, took over the stable of Ralph Ziadie in 2018 after the latter was denied a license renewal by the Florida Division of Pari-Mutuel Wagering because of multiple medication violations. Ralph's son, Kirk Ziadie, who won numerous South Florida training titles during his career, is serving a six-year license suspension for multiple clenbuterol violations that runs through Jan. 10, 2022.</p>
<p class="p1">According to the <a href="http://myfloridalicense.com/"><span class="s1">MyFloridaLicense.com</span></a> website, Baxter has had six complaints filed against her for Class 4 medication violations since August 2018, most recently on Nov. 5, 2020. She served a 25-day suspension earlier last year for three violations that involved impermissible levels of flunixin and phenylbutazone.</p>
<p>According to Equibase, Baxter has won 132 of 502 starts (26%) and her horses have earned $3,999,741.</p>
<p>On Friday, Baxter was one of five trainers suspended by Gulfstream Park for violating the track's house rules concerning clenbuterol. The bronchodilator was detected in 12 horses from five of the 10 stables tested out-of-competition using hair and blood samples. The other trainers sanctioned were Rohan Crichton, Daniel Pita, Peter Walder, and Gilberto Zerpa.</p>

										<content:encoded><![CDATA[<p><em>The following statement was issued by The Jockeys' Guild on Monday, following the <a href="https://www.paulickreport.com/news/the-biz/saturday-card-at-charles-town-cancelled-after-jockey-pay-dispute/">cancellation of races on Saturday, Aug. 14 at Charles Town Races in West Virginia:</a></em></p>
<p>&#8220;The decision by the jockeys at Charles Town to refuse to ride on Saturday, Aug. 14 was made with just cause and only after many discussions with management concerning timely payment for jockey's mounts. Receipt of payment in a timely fashion has been a problem on and off for several years at Charles Town and Saturday was not the first time the jockeys have considered refusing to ride over the issue.</p>

<p>&#8220;Representatives of the Jockey's Guild and members of the Charles Town jockey colony have had discussions with management and stewards several times in hopes of getting a permanent resolution. Concerns include, but are not limited to, changes to the day of the week the jockeys may get paid without notifying the jockeys and there have been instances when checks have been issued, jockeys were advised that there are insufficient funds in the account to cover the paychecks.</p>
<p>&#8220;Most jockeys live paycheck to paycheck and they felt they had no other recourse but to bring attention again to this on-going situation. The inconsistencies and issues of receiving payments consistently occurs nowhere else in the country, including at Mountaineer racetrack, which is also in West Virginia. Everyone can relate to doing a job and being paid in a timely manner. Jockeys are no exception. The jockeys at Charles Town put themselves in harm's way in each and every race and to not be paid in a timely manner is simply unacceptable.</p>
<p>&#8220;This is an issue that the management and stewards at Charles Town need to resolve immediately.&#8221;</p>
<p>Charles Town's vice president of racing operations <a href="https://www.paulickreport.com/news/the-biz/saturday-card-at-charles-town-cancelled-after-jockey-pay-dispute/">Erich Zimny told the <em>Paulick Report</em> on Saturday that the issues</a>, which resulted in the cancellation of races when jockeys refused to ride, revolved around delayed payments into the jockeys' account.</p>
<p>&#8220;We've tried damn hard to make racing, including all of the administrative functions involved, as normal as possible despite the situation we're all still in being far from normal.” Zimny said. “There was a temporary delay in money getting transferred for jockeys' checks into the normal account. The riders were told they could instead cash their checks at the casino cage and there would be no issue. Apparently, the delay was enough to choose not to ride and create a negative impact for everyone.”</p>

										<content:encoded><![CDATA[<p>With new food, beverage and entertainment options available to those making it to Hollywood Casino at Charles Town Races on Friday, Aug. 27, those unable to make it out to the track's largest racing event will still be able to enjoy the action whether at home, in the car or watching through one of Charles Town's many simulcast partners.</p>
<p>For those at home, the Charles Town Classic card will once again be broadcast live on the TVG Network, with the added bonus of TVG providing feet on the ground coverage with analyst Caton Bredar reporting from West Virginia. Bredar, who has worked behind the scenes and in front of the camera for ABC, ESPN, CBS and FOX amongst others marks the first on-site appearance by TVG since the 2012 edition of the Charles Town Classic.</p>

<p>The Horse Racing Radio Network, a winner of multiple Eclipse Awards and a Sovereign Award for its multimedia coverage of racing events will be broadcasting the Charles Town Classic for the tenth consecutive year. HRRN's on-site coverage will be anchored by Mike Penna and announcer Bobby Neuman with the show available to listeners on Sirius channel 216 and XM 201 as well as streaming through the Horse Racing Radio Network website.</p>
<p>Additionally, a familiar face – and voice – to racing fans will be seen on the track's simulcast feed with NBC's voice of the Triple Crown and Breeders' Cup, Larry Collmus handing paddock host duties for stakes races on the latter portion of the card. Collmus, who famously called American Pharoah's 2015 Triple Crown triumph and Justify's sweep of the Kentucky Derby, Preakness and Belmont Stakes just three years later, served as the track's guest announcer for the Charles Town Classic from 2012 through 2014.</p>
<p>The first race on Charles Town Classic day is slated for 5:00 P.M EST, with the $800,000 Charles Town Classic carrying a tentative post time of 10:18 P.M.</p>
